El Decreto Ejecutivo 36535 modifica el Considerando XI del Decreto Ejecutivo 34417, que declaró de conveniencia nacional e interés público el Proyecto Eólico Los Santos. Artículo 1º—Modifícase el Considerando XI del Decreto Ejecutivo N° 34417 del catorce de marzo del año dos mil ocho, publicado en el Diario Oficial La Gaceta N° 86, del 5 de mayo de 2008, para que se lea de la siguiente forma:

“XI.—Que la realización del proyecto no implicará la eliminación de la cobertura boscosa existente, en razón de que la obra será ubicada en terrenos dedicados a actividades de potrero o con árboles dispersos, pero que si fuere necesario, se observarán las disposiciones de la Ley Forestal vigente, en lo que se refiere a las medidas de mitigación y compensación que correspondan.”

Article 1—Recital XI of Executive Decree No. 34417 of March 14, 2008, published in La Gaceta No. 86 of May 5, 2008, is amended to read as follows:

“XI.—That the execution of the project will not entail the elimination of existing forest cover, given that the work will be located on land used for pasture activities or with scattered trees; however, if it becomes necessary, the provisions of the current Forestry Law regarding the appropriate mitigation and compensation measures shall be observed.”
