Con fundamento en el artículo 50, 140 inciso 1) y 8)
de la
 Constitución Política, 4°, 11, 26 inciso b), g), 27 inciso
1), 28 incisos 2. acápites a), b), 49 de la Ley General de la Administración Pública
N° 6227 de 2 de mayo de 1978, los artículos 1° y 2° de la Ley de Conversión del
Ministerio de Industria, Energía y Minas en Ministerio de Ambiente, Energía y
Telecomunicaciones, N° 7152 de 5 de junio de 1990; la Ley Convención
Marco de Naciones Unidas sobre el Cambio Climático, N° 7414 de 13 de junio de
1994; la Ley N°
8219 del 2 de marzo del 2002, mediante la cual se aprueba el Protocolo de Kyoto
de la Convención
 Marco de las Naciones Unidas sobre el Cambio Climático, la Ley de Regulación del Uso
Racional de la Energía,
N° 7447 de 3 de noviembre de 1994; los artículos 1°, 2°, 49 a 72 de la Ley Orgánica del
Ambiente, Ley N° 7554 de 4 de octubre de 1995; la Ley de Protección al Ciudadano
del Exceso de Requisitos y Trámites Administrativos, Nº 8220 del 4 de marzo del
2002, el Decreto Ejecutivo N° 35669-MINAET, Reglamento Orgánico del Ministerio
de Ambiente, Energía y Telecomunicaciones de 4 de diciembre de 2009; artículos
1° 2°, 262, 263, 275, 276, 278, 279, 280, 281 y 344 de la Ley General de Salud,
N° 5395, del 30 de octubre de 1973, artículos 1°, y 2° de la Ley Orgánica del
Ministerio de Salud, N° 5412 del 8 de noviembre de 1973; y artículos 1°, 2°,
3°, 7°, 8°, 12, 14, 28, y 30 de la
 Ley para la Gestión Integral de Residuos, Ley N° 8839 del 24
de junio de 2010, Decreto Ejecutivo N° 36499-S-MINAET "Reglamento para la
elaboración de programas de gestión ambiental institucional en el sector
público de Costa Rica" del 17 de marzo del 2011. 

    Considerando 

I.-Que la Presidencia de la República y el
Ministerio de la
 Presidencia se encuentran comprometidos con la definición, el
desarrollo y la implementación de políticas institucionales en materia de
gestión ambiental, en cumplimiento del artículo 50 de la Constitución Política,
en procura del mayor bienestar a todos los habitantes del país, y garantizar y
preservar el derecho de las personas a un ambiente sano y ecológicamente
equilibrado, en respeto del derecho a la protección de la salud humana que se
deriva del derecho a la vida. 

II.-Que además de existir todo un marco normativo en materia de gestión
ambiental, existen distintos Acuerdos de Consejo de Gobierno y Directrices,
relacionadas con el ahorro, uso racional y eficiente de la electricidad y los
combustibles, solicitando a las instituciones públicas la elaboración y
ejecución de programas de ahorro y uso eficiente de la energía en sus
respectivas instalaciones. 

III.-Que es de interés de la Presidencia de la Repúblic y del
Ministerio de la
 Presidencia, conformar un equipo de trabajo en cumplimiento
del Decreto Ejecutivo N° 36499-S-MINAET "Reglamento para la elaboración de
programas de gestión ambiental institucional en el sector público de Costa
Rica", con el fin de facilitar la implementación de medidas ambientales que
permitan el cumplimiento de principios de la legislación ambiental aplicable,
prevención de la contaminación derivada de las actividades dela Institución y mejora
continua de la situación ambiental. 

    ACUERDAN 

text-indent:35.4pt'>Artículo 1º-Constituir la Comisión del Programa de
Gestión Ambiental Institucional "PGAI", cuyas funciones están establecidas en
el artículo 8 del Decreto Ejecutivo N° 36499-S-MINAET "Reglamento para la
elaboración de programas de gestión ambiental institucional en el sector
público de Costa Rica".

Artículo 2º-La Comisión del Programa de
Gestión Ambiental Institucional estará integrado por: 

1. El Director o Directora de Recursos Humanos o su
representante, quien la coordinará. 

2. El Director o Directora de Servicios Generales o su
representante. 

3. El Proveedor o Proveedora Institucional o su
representante. 

4. El Director o Directora de Transportes o su
representante. 

5. El encargado de Salud ocupacional de la Dirección de Recursos
Humanos.

Artículo 3º-La comisión sesionará cuando sea convocada
por quien tenga la coordinación de dicha comisión, con el fin de atender las
funciones que se establecen en el artículo 8 del Decreto Ejecutivo N°
36499-S-MINAET y las actividades afines.

Artículo 4º-Rige a partir del tres de abril del dos mil trece.

THE PRESIDENT OF THE REPUBLIC AND
THE MINISTER OF THE PRESIDENCY

Considering

I.-That the Presidency of the Republic and the Ministry of the Presidency are committed to the definition, development, and implementation of institutional policies regarding environmental management, in compliance with Article 50 of the Political Constitution, seeking the greatest well-being for all the inhabitants of the country, and guaranteeing and preserving the right of individuals to a healthy and ecologically balanced environment, in respect of the right to the protection of human health derived from the right to life.

II.-That in addition to an existing normative framework for environmental management, there are various Government Council Agreements and Directives related to the saving, rational, and efficient use of electricity and fuels, requesting public institutions to develop and execute programs for the saving and efficient use of energy in their respective facilities.

III.-That it is in the interest of the Presidency of the Republic and the Ministry of the Presidency to form a work team in compliance with Executive Decree No. 36499-S-MINAET "Regulation for the development of institutional environmental management programs in the public sector of Costa Rica", in order to facilitate the implementation of environmental measures that allow compliance with the principles of applicable environmental legislation, prevention of pollution derived from the Institution's activities, and continuous improvement of the environmental situation.

AGREE

Article 1.-To constitute the Commission of the Institutional Environmental Management Program "PGAI", whose functions are established in Article 8 of Executive Decree No. 36499-S-MINAET "Regulation for the development of institutional environmental management programs in the public sector of Costa Rica".

Article 2.-The Commission of the Institutional Environmental Management Program shall be composed of:

1. The Director of Human Resources or their representative, who shall coordinate it.
2. The Director of General Services or their representative.
3. The Institutional Procurement Officer or their representative.
4. The Director of Transportation or their representative.
5. The person in charge of Occupational Health from the Human Resources Directorate.

Article 3.-The commission shall meet when convened by whoever coordinates said commission, in order to address the functions established in Article 8 of Executive Decree No. 36499-S-MINAET and related activities.

Article 4.-It shall be effective as of April third, two thousand thirteen.
