DIRECCIÓN EJECUTIVA





R-SINAC-CONAC-30-2019.-El Consejo Nacional de Áreas de Conservación, de conformidad al Acuerdo Nº 18
de la sesión ordinaria Nº 02-2018 celebrada el día 12 de febrero del 2018 y en cumplimiento de los
Decretos Ejecutivos N° 33106-MINAE-2006 - N° 40043-MINAE-2017 y las Resoluciones SINAC-
CONAC-013-2009 y R-SINAC-CONAC-028-2011, aprueba y emite la presente:





OFICIALIZACIÓN DEL CORREDOR BIOLÓGICO





INTERURBANO GARCIMUÑOZ





Resultando:





1º-Que el artículo 22 de la Ley de Biodiversidad Nº 7788, publicada en La Gaceta Nº 101 del 27 de
mayo de 1998 establece al Sistema Nacional de Áreas de Conservación, como un Sistema de gestión y
coordinación institucional, desconcentrado y participativo, que integrará las competencias en
materia forestal, vida silvestre, áreas protegidas y protección y conservación del uso de cuencas
hidrográficas y sistemas hídricos, del Ministerio de Ambiente y Energía (MINAE), con el fin de
dictar políticas, planificar y ejecutar procesos dirigidos a lograr la sostenibilidad en el manejo
de los recursos naturales de Costa Rica.





2º-Que mediante Decreto Ejecutivo Nº 33106-MINAE, publicado en La Gaceta Nº 103 del día 30 de mayo
del 2006, se crea el Programa Nacional de Corredores Biológicos: "una Estrategia de Conservación de
la Biodiversidad; el cual contará con un Plan Estratégico de largo plazo. Se implementará a través
del Sistema Nacional de Áreas de Conservación (SINAC), el cual deberá otorgar sostenibilidad al
Programa, incluyendo las actuaciones de éste en sus planes de acción y en su estructura funcional,
administrativa y financiera".





3º-Que mediante Decreto Ejecutivo Nº 40043-MINAE, publicado La Gaceta Nº 20 del día 27 de enero del
2017, se establecen las "Regulaciones del Programa de "Corredores Biológicos", así como su objetivo
general: la promoción de la conservación y uso sostenible de la biodiversidad en Costa Rica, desde
una perspectiva de conectividad ecosistémica funcional estructural.





4º-Que mediante Decreto Ejecutivo Nº 40043-MINAE publicado La Gaceta Nº 20 del día 27 de enero del
2017, en el artículo Nº 4 se establece la definición oficial de "Corredor Biológico" y en el
artículo N° 5 se establecen las modalidades de los Corredores Biológicos, en el inciso a) de
"Corredores Biológicos Interurbanos": extensión territorial urbana que proporciona conectividad
entre paisajes, ecosistemas y hábitat modificados o naturales que interconectan microcuencas trama
verde de las ciudades (parques urbanos, áreas verdes, calles y avenidas arborizadas, línea férrea,
isletas y bosque a orilla del río, entre otros) o áreas silvestres protegidas. Estos espacios
contribuyen al mantenimiento de la biodiversidad, posibilitando la migración, dispersión de especies
de flora y fauna e incluyen las dimensiones culturales, socioeconómicas y políticas.





5º-Que mediante Resolución administrativa Nº R-SINACCONAC- 013-2009 publicada en el Diario Oficial
La Gaceta Nº 72 del 15 de abril del 2009, se establece por primera vez, los Lineamientos para la
Oficialización de Corredores Biológicos en Costa Rica; mismo que define en el artículo N° 3 inciso
2); "La iniciativa de corredor biológico y su expediente deberán ser presentados por parte del Área
de Conservación ante el CONAC; para su aprobación y oficialización".





6º-Que la Resolución administrativa Nº R-SINACCONAC-028-2011 publicada en el Diario Oficial La
Gaceta Nº 181 del 21 de setiembre del 2011, con base en el acuerdo Nº 12 de la sesión ordinaria Nº
05-2011 del 30 de mayo del 2011 del CONAC acordó Reformas a los Lineamientos para la Oficialización
de Corredores Biológicos de Costa Rica modificaciones a la resolución Nº R-SINAC-CONAC-013-2009.





Considerando:





Único.-Que de conformidad con las funciones del CONAC definidas en el artículo N°12, el inciso t)
determina "Otras funciones necesarias para cumplir con los objetivos de ésta y normas jurídicas
vigentes relacionadas con las competencias del SINAC", del Reglamento a la Ley de Biodiversidad,
Decreto Ejecutivo Nº 34433-MINAE publicado en La Gaceta Nº 68 del 08 de abril del 2008, el Consejo
Nacional de Áreas de Conservación (CONAC), mediante Acuerdo Nº 18 de la sesión ordinaria Nº 02-2018
celebrada el día 12 de febrero del 2018 conoció el expediente administrativo del Corredor Biológico
Interurbano Garcimuñoz, demostrándose su importancia en la conectividad y el cumplimiento de los
diferentes requisitos establecidos, emite la presente resolución. Por tanto,

DEL CONSEJO NACIONAL DE ÁREAS





DE CONSERVACIÓN, RESUELVE:





1º-Aprobar de Forma Unánime la Oficialización del Corredor Biológico Interurbano Garcimuñoz. El
expediente de oficialización del Corredor Biológico Interurbano Garcimuñoz puede ser consultado en
el Área de Conservación Central del SINAC, específicamente en la Oficina Subregional de Alajuela con
el enlace del CBIG, así como en la Oficina Regional del ACC en la coordinación del Programa Regional
de Corredores Biológicos, ubicada en San Miguel de Santo Domingo de Heredia, Ruta 32, diagonal a
RITEVE.





2º-Abreviaturas:





a) ACC: Área de Conservación Central.





b) CBIG: Corredor Biológico Interurbano Garcimuñoz.





c) CONAC: Consejo Nacional de Áreas de Conservación.





d) PNCB: Programa Nacional de Corredores Biológicos.





e) PRCB: Programa Regional de Corredores Biológicos.





f) MINAE: Ministerio de Ambiente y Energía.





g) SINAC: Sistema Nacional de Áreas de Conservación.





3º-Cumplimiento de requisitos:





1. Plan de Gestión (Perfil Técnico) del Corredor Biológico Interurbano Garcimuñoz.





El cual contiene la justificación técnica de la importancia para la conectividad biológica del CBIG.





2. Mapa de límites: indica el territorio del CBIG.





3. Información general sobre el Comité Local que gestiona el CBIG.





4. Acuerdos del Programa Nacional de Corredores Biológicos del SINAC, así como del Comité Técnico y
del Consejo Regional del Área de Conservación Central, con los respectivos vistos buenos al CBIG.





4º-Rige a partir de su publicación en el Diario Oficial La Gaceta.-Consejo Nacional de Áreas de

NATIONAL SYSTEM OF CONSERVATION AREAS





EXECUTIVE DIRECTORATE





R-SINAC-CONAC-30-2019.-The National Council of Conservation Areas, pursuant to Agreement No. 18
of ordinary session No. 02-2018 held on February 12, 2018, and in compliance with
Executive Decrees N° 33106-MINAE-2006 - N° 40043-MINAE-2017 and Resolutions SINAC-
CONAC-013-2009 and R-SINAC-CONAC-028-2011, approves and issues this:





OFFICIALIZATION OF THE GARCIMUÑOZ





INTERURBAN BIOLOGICAL CORRIDOR





Whereas:





1º-That Article 22 of the Biodiversity Law Nº 7788, published in La Gaceta Nº 101 of May 27,
1998, establishes the National System of Conservation Areas as a decentralized and participatory
institutional management and coordination system, which will integrate the competencies in
forestry, wildlife, protected areas, and protection and conservation of the use of watersheds
and water systems of the Ministry of Environment and Energy (MINAE), for the purpose of
issuing policies, planning, and executing processes aimed at achieving sustainability in the
management of Costa Rica's natural resources.





2º-That through Executive Decree Nº 33106-MINAE, published in La Gaceta Nº 103 on May 30,
2006, the National Program of Biological Corridors is created: "a Biodiversity Conservation
Strategy; which will have a long-term Strategic Plan. It will be implemented through
the National System of Conservation Areas (SINAC), which must provide sustainability to the
Program, including its actions in its action plans and in its functional, administrative,
and financial structure."





3º-That through Executive Decree Nº 40043-MINAE, published in La Gaceta Nº 20 on January 27,
2017, the "Regulations of the 'Biological Corridors' Program" are established, as well as its general
objective: the promotion of the conservation and sustainable use of biodiversity in Costa Rica, from
a perspective of functional and structural ecosystem connectivity.





4º-That through Executive Decree Nº 40043-MINAE, published in La Gaceta Nº 20 on January 27,
2017, in Article Nº 4, the official definition of "Biological Corridor" is established, and in
Article N° 5, the modalities of Biological Corridors are established, in subsection a) of
"Interurban Biological Corridors": an urban territorial extension that provides connectivity
between landscapes, ecosystems, and modified or natural habitats that interconnect micro-watersheds and the green
network of cities (urban parks, green areas, tree-lined streets and avenues, railway lines,
islets and riverside forests, among others) or protected wild areas. These spaces
contribute to the maintenance of biodiversity, enabling the migration and dispersal of flora
and fauna species, and include cultural, socioeconomic, and political dimensions.





5º-That through Administrative Resolution Nº R-SINACCONAC-013-2009, published in the Official Gazette
La Gaceta Nº 72 of April 15, 2009, the Guidelines for the Officialization of Biological Corridors in Costa Rica are established for the first time; which defines in Article N° 3, subsection
2); "The biological corridor initiative and its file must be submitted by the
Conservation Area to the CONAC; for its approval and officialization."





6º-That Administrative Resolution Nº R-SINACCONAC-028-2011, published in the Official Gazette La
Gaceta Nº 181 of September 21, 2011, based on agreement Nº 12 of ordinary session Nº
05-2011 of May 30, 2011, of the CONAC, agreed to Reforms to the Guidelines for the Officialization
of Biological Corridors of Costa Rica, modifications to resolution Nº R-SINAC-CONAC-013-2009.





Considering:





Sole.-That in accordance with the functions of the CONAC defined in Article N°12, subsection t)
determines "Other functions necessary to fulfill the objectives of this and current legal
norms related to the competencies of SINAC," of the Regulations to the Biodiversity Law,
Executive Decree Nº 34433-MINAE published in La Gaceta Nº 68 of April 8, 2008, the National
Council of Conservation Areas (CONAC), through Agreement Nº 18 of ordinary session Nº 02-2018
held on February 12, 2018, reviewed the administrative file of the Garcimuñoz Interurban Biological
Corridor, demonstrating its importance in connectivity and the fulfillment of the
different established requirements, issues this resolution. Therefore,

OF THE NATIONAL COUNCIL OF





CONSERVATION AREAS, RESOLVES:





1º-To Unanimously Approve the Officialization of the Garcimuñoz Interurban Biological Corridor. The
officialization file of the Garcimuñoz Interurban Biological Corridor may be consulted in
the Central Conservation Area of SINAC, specifically at the Alajuela Subregional Office through
the liaison of the CBIG, as well as at the ACC Regional Office in the coordination of the Regional
Biological Corridors Program, located in San Miguel de Santo Domingo de Heredia, Ruta 32, diagonal to
RITEVE.





2º-Abbreviations:





a) ACC: Central Conservation Area (Área de Conservación Central).





b) CBIG: Garcimuñoz Interurban Biological Corridor (Corredor Biológico Interurbano Garcimuñoz).





c) CONAC: National Council of Conservation Areas (Consejo Nacional de Áreas de Conservación).





d) PNCB: National Program of Biological Corridors (Programa Nacional de Corredores Biológicos).





e) PRCB: Regional Program of Biological Corridors (Programa Regional de Corredores Biológicos).





f) MINAE: Ministry of Environment and Energy (Ministerio de Ambiente y Energía).





g) SINAC: National System of Conservation Areas (Sistema Nacional de Áreas de Conservación).





3º-Fulfillment of requirements:





1. Management Plan (Technical Profile) of the Garcimuñoz Interurban Biological Corridor.





Which contains the technical justification of the importance for the biological connectivity of the CBIG.





2. Boundary map: indicates the territory of the CBIG.





3. General information about the Local Committee that manages the CBIG.





4. Agreements of the National Program of Biological Corridors of SINAC, as well as of the Technical Committee and
the Regional Council of the Central Conservation Area, with the respective endorsements for the CBIG.





4º-It takes effect upon its publication in the Official Gazette La Gaceta.-National Council of
Conservation Areas.
