DECRETA:





ADICIÓN DE UN PÁRRAFO AL ARTÍCULO 50 Y DE UN





TRANSITORIO AL TÍTULO XVIII, CAPÍTULO ÚNICO,





DISPOSICIONES TRANSITORIAS, DE LA





CONSTITUCIÓN POLÍTICA, PARA





RECONOCER Y GARANTIZAR





EL DERECHO HUMANO





DE ACCESO AL





AGUA





ARTÍCULO 1- Se adiciona un párrafo al final al artículo 50 de la Constitución Política. El texto es
el siguiente:





Artículo 50-

Toda persona tiene el derecho humano, básico e irrenunciable de acceso al agua potable, como bien
esencial para la vida. El agua es un bien de la nación, indispensable para proteger tal derecho
humano. Su uso, protección, sostenibilidad, conservación y explotación se regirá por lo que
establezca la ley que se creará para estos efectos y tendrá prioridad el abastecimiento de agua
potable para consumo de las personas y las poblaciones.

ARTÍCULO 2- Se adiciona un nuevo transitorio al título XVIII, Capítulo Único, Disposiciones
Transitorias, de la Constitución Política, relacionado con el artículo 50. El texto es el siguiente:





ARTÍCULO 50-XX. Se mantienen vigentes las leyes, las concesiones y los permisos de uso actuales,
otorgados conforme a derecho, así como los derechos derivados de estos, mientras no entre en
vigencia una nueva ley que regule el uso, la explotación y la conservación del agua.





Dado en la Presidencia de la República, San José, los cinco días del mes de junio del año dos mil
veinte.

WATER





ARTICLE 1- A final paragraph is added to article 50 of the Political Constitution. The text is
the following:





Article 50-

Every person has the human, basic, and inalienable right of access to potable water, as an
essential good for life. Water is a good of the nation, indispensable to protect such human
right. Its use, protection, sustainability, conservation, and exploitation shall be governed by what
is established by the law that will be created for these effects, and the supply of potable
water for consumption by persons and populations shall have priority.

ARTICLE 2- A new transitory provision is added to title XVIII, Sole Chapter, Transitory
Provisions, of the Political Constitution, related to article 50. The text is the following:





ARTICLE 50-XX. The laws, concessions, and current use permits,
granted in accordance with the law, as well as the rights derived from these, remain in force as long as a new law regulating the use, exploitation, and conservation of water does not enter into force.





Given at the Presidency of the Republic, San José, on the fifth day of the month of June of the year two thousand
twenty.
