METÁLICA A CIELO ABIERTO,

ARTICULO
ÚNICO- Se reforma el transitorio X de la Ley 8904, Reforma del Segundo Párrafo
y Adición de Varios Párrafos al Artículo 8; Adición del Artículo 8 Bis; Adición
del Inciso f) al Artículo 65, y Reforma del Inciso k) del Artículo 103 del
Código de Minería, Ley N.º 6797, de 4 de octubre de 1982, y sus Reformas, Ley
para Declarar a Costa Rica País Libre de Minería Metálica a Cielo Abierto, de 1
de diciembre de 2010. El texto es el siguiente:

Transitorio
X- A partir del 16 de agosto de 2023 y hasta el 10 de febrero de 2025, queda
habilitada la explotación y el procesamiento del oro por parte de los
trabajadores mineros debidamente asociados a las cooperativas de mineros a las
que hace referencia el artículo 8 del Código de Minería, que tengan presentadas
solicitudes de concesión para el área de reserva minera del cantón de Abangares.

Cuando
hayan presentado la solicitud correspondiente ante la Dirección de Geología y
Minas del Ministerio de Ambiente y Energía, indicando:

a) Que el material proviene únicamente del cantón de Abangares,
del área concesionada o del área solicitada en concesión, según corresponda.

b) El tipo de material a exportar, la cantidad y el peso, tanto
bruto como neto, que pertenezcan exclusivamente a las partidas arancelarias del
Sistema Arancelario Centroamericano (SAC), a saber, las partidas 710811000000,
710812000000, 710813000000, 710820000000.

c) El país, lugar de destino y medio de transporte a utilizar.

d) La estimación del valor comercial.

La
Dirección de Geología y Minas del Ministerio de Ambiente y Energía deberá
resolver todas las solicitudes de concesión pendientes para el área de reserva
minera del cantón de Abangares, antes del vencimiento del plazo establecido en
este transitorio.

ARTICLE- Transitory Provision X of Law 8904, Amendment to the Second Paragraph
and Addition of Several Paragraphs to Article 8; Addition of Article 8 Bis; Addition
of Subsection f) to Article 65, and Amendment to Subsection k) of Article 103 of the
Mining Code, Law No. 6797, of October 4, 1982, and its Amendments, Law
to Declare Costa Rica a Country Free of Open-Pit Metallic Mining, of December
1, 2010, is amended. The text is as follows:

Transitory Provision
X- As of August 16, 2023, and until February 10, 2025, the exploitation and processing of gold is enabled for mining workers duly associated with the mining cooperatives referred to in Article 8 of the Mining Code, who have submitted concession (concesión) applications for the mining reserve area of the canton of Abangares.

When
they have submitted the corresponding application to the Directorate of Geology and Mines of the Ministry of Environment and Energy, indicating:

a) That the material comes exclusively from the canton of Abangares,
from the concession area or the area for which a concession is requested, as applicable.

b) The type of material to be exported, the quantity and the weight, both
gross and net, belonging exclusively to the tariff headings of the
Central American Tariff System (SAC), namely headings 710811000000,
710812000000, 710813000000, 710820000000.

c) The country, place of destination, and means of transport to be used.

d) The estimated commercial value.

The
Directorate of Geology and Mines of the Ministry of Environment and Energy must
resolve all pending concession applications for the mining reserve area of the canton of Abangares before the expiration of the term established in this
transitory provision.

Effective as of its publication.
