                        Establece una veda total de pesca a partir del 01 de mayo hasta el 31 de
julio del 2024 desde Punta Torres conocida como Peñón hasta el Faro de la Isla Negritos, desde ahí
hasta la parte Este de Punta Cuchillos en la Península de Nicoya

AJDIP/094-2024.-Puntarenas,
a los dieciséis días del mes abril de dos mil veinticuatro.

CONSIDERANDO

1. Que por parte de la
Dirección de Ordenamiento Pesquero y Acuícola se expuso la propuesta para la veda
en el golfo de Nicoya, se acordó con representantes de pesca comercial de
pequeña escala del golfo de Nicoya y la flota semiindustrial
de sardina; así como con los miembros de la Comisión Nacional de Vedas, a
través del oficio INCOPESCA-PE-DOPA-0038-2024, recomendar las condiciones para
el establecimiento de la veda en el golfo de Nicoya, considerando el criterio
técnico brindado por el Departamento de Investigación mediante los oficios
oficio INCOPESCA-DOPA-DINV-059-2024, así como, INCOPESCA-DOPADINV-024-2023.

2. Que el Incopesca cuenta con estudios científicos que fundamentan
el establecimiento de este periodo de veda en las fechas propuestas.

3. Que mediante el acuerdo de Junta Directiva AJDIP/040-2023, de fecha 28-02-2023 se ratificó el
informe de investigación oficio DOPA-014-2023, con los resultados de la investigación sobre la
captura de fauna de acompañamiento en la pesca semiindustrial de las especies de Sardina del
complejo Ophistonema sp. en el Golfo de Nicoya, realizado por el Departamento de Investigación, el
cual es concluyente en cuanto a la confirmación que la captura incidental no objetivo, representa
menos del 3% de la captura total de sardina, ubicándose dentro del 10% del margen máximo de
tolerancia permitido conforme a lo normado mediante el punto 1.4. del Acuerdo de Junta Directiva
AJDIP/100-2021.

4. Que la dinámica
pesquera del Golfo de Nicoya presenta una nueva actividad de pesca en la
modalidad comercial turística de pequeña escala, quienes se han incorporado al
seno de la Comisión Nacional de Vedas.

5. Que en el Golfo de
Nicoya el INCOPESCA está desarrollando el proyecto de investigación denominado
"Caracterización de la pesquería de corvinas capturadas por la flota de
pequeña escala, Golfo de Nicoya, Costa Rica".

6. Que una vez discutida y
analizada la propuesta de veda para el Golfo de Nicoya 2024 por parte de los
señores directores miembros de la Junta Directiva del Instituto Costarricense
de Pesca y Acuicultura, POR TANTO;

ACUERDA

1. En base al criterio
técnico emitido por parte de la Dirección de Ordenamiento Pesquero y Acuícola,
establecer una veda total de pesca a partir del 01 de mayo hasta el 31 de julio
del 2024, ambas fechas incluidas, en el área delimitada por una línea recta
imaginaria que inicia en Punta Torres conocida como Peñón (09°53´31"
Latitud Norte, 084°43´52" Longitud Oeste) hasta el Faro de la Isla
Negritos afuera (09°49´14" Latitud Norte, 084°49´35" Longitud Oeste)
y desde ahí hasta la parte Este de Punta Cuchillos en la Península de Nicoya
(09°50´03" Latitud Norte, 084°53´42" Longitud Oeste) y de ahí aguas
adentro hasta la desembocadura del río Tempisque en el golfo de Nicoya, según
se observa en el mapa adjunto.

2. Durante los meses de
junio y julio del 2024 y con fundamento en los resultados del informe DOPA-014-2023,
se permite el ingreso a las embarcaciones semiindustriales
sardineras, para faenar únicamente en el área denominada C la cual está
delimitada por una línea imaginaria que inicia en Punta Torres conocida como
Peñón (09°53´31" Latitud Norte, 084°43´52" Longitud Oeste) al Faro de
la Isla Negritos afuera (09°49´14" Latitud Norte, 084°49´35" Longitud
Oeste) y desde ahí hasta la parte Este de Punta Cuchillos en la Península de
Nicoya (09°50´03" Latitud Norte, 084°53´42" Longitud Oeste) y de ahí
hasta el Faro de Puntarenas (9° 58´ 36.03´´ Latitud Norte 84° 51´
03.93´´Longitud Oeste), con el fin de suplir sardina para carnada a la flota
pesquera nacional y cuyos excedentes podrán ser comercializados para otros
fines según lo establecido.

3. Que toda descarga que realice la flota semiindustrial bolichera de sardina será debidamente
inspeccionada por parte de los inspectores del Incopesca, de sardina y la fauna de acompañamiento.
La franja horaria establecida para dichos fines será a partir de las 06.00 horas hasta las 20.00
horas. Excepcionalmente podrá desembarcarse fuera de este horario, bajo previa coordinación
efectuada durante el horario laboral ordinario del día de la descarga y autorización por parte de la
Jefatura del Dpto. de Fiscalización del Incopesca o quién lo represente en su ausencia.

4. El Departamento de
Investigación del Incopesca realizará muestreos
biológicos de dichas capturas para verificar las tallas legales de primera
captura y evaluar el comportamiento reproductivo de las sardinas. De lo cual
deberá presentarse informe a la Junta Directiva.

5. Que se establece una
cuota de captura incidental máxima de especies no objetivo del 10%, con
respecto a la captura total de sardina a los barcos de la flota semiindustrial bolichera de sardina.

6. Se exceptúa de esta veda la pesca de barracuda o candado (Sphyraena ensis) en las zonas B y C,
realizada por pescadores de pequeña escala utilizando cuerdas de mano y que así lo tengan autorizado
en su licencia de pesca para faenar durante los meses de mayo, junio y julio del 2024.

7. En el caso de la pesca comercial turística y deportiva de pequeña escala, se podrá realizar el
torneo que cuente con el visto bueno del INCOPESCA y durante el receso escolar del 01 al 12 de Julio
2024. La pesca se autorizará únicamente en el área denominada C la cual está delimitada por una
línea imaginaria que inicia en Punta Torres conocida como Peñón (09°53´31" Latitud Norte, 084°43´52"
Longitud Oeste) al Faro de la Isla Negritos afuera (09°49´14" Latitud Norte, 084°49´35" Longitud
Oeste) y desde ahí hasta la parte Este de Punta Cuchillos en la Península de Nicoya (09°50´03"
Latitud Norte, 084°53´42" Longitud Oeste) y de ahí hasta el Faro de Puntarenas (9° 58´ 36.03´´
Latitud Norte 84° 51´ 03.93´´Longitud Oeste). Los organizadores o responsables del evento deben
coordinar con el Jefe del Departamento de Fiscalización a fin de garantizar la presencia de
inspectores del Incopesca a fin de verificar el cumplimiento de la normativa aplicable a dicha
actividad.

7. Se exceptúa de esta veda, la actividad pesquera relacionada a la extracción de pianguas, así como
la actividad pesquera relacionada con los cultivos de organismos marinos que se desarrollan en el
Golfo de Nicoya.

Gaceta N° 93 del 24 de mayo de 2024, página N° 2, se incorporó el punto 7)
anterior. Nótese que en la publicación de la presente
norma, ya existe un punto 7)

8. Los permisos de
investigación autorizados para el proyecto "Caracterización de la
pesquería de corvinas capturadas por la flota de pequeña escala, Golfo de
Nicoya, Costa Rica" suspenderán su actividad pesquera habitual. El
departamento de investigación del Incopesca elaborará
un cronograma conteniendo los días en los cuales estos permisionarios deben
realizar la actividad pesquera durante los tres meses de veda. La totalidad de
las capturas obtenidas por los permisionarios en estos días, serán recolectadas
por el departamento de investigación del Incopesca al
momento de su desembarque a fin de obtener los datos y muestras requeridos por
el proyecto. Los gastos en que incurran los permisionarios para su actividad
pesquera durante los días autorizados en el cronograma ya mencionado, serán
sufragados por el proyecto "Caracterización de la pesquería de corvinas
capturadas por la flota de pequeña escala, golfo de Nicoya, Costa Rica"
del INCOPESCA.

9. El coordinador
responsable por parte del Incopesca del proyecto de
Investigación denominado "Caracterización de la pesquería de corvinas
capturadas por la flota de pequeña escala, golfo de Nicoya, Costa Rica",
deberá elaborar un listado de los beneficiarios con permiso de investigación de
dicho proyecto, el cual contendrá la siguiente información: Puerto base de
operación o comunidad, nombre completo y número de cédula del permisionario y
de su ayudante, número de matrícula y nombre de la embarcación autorizada en el
permiso de investigación. Previo a la entrada en vigencia de la veda, el
listado, así como el cronograma antes mencionado, deben ser entregados al
Servicio Nacional de Guardacostas con el fin de apoyar las labores de control y
vigilancia en el golfo de Nicoya durante la veda. El responsable de coordinar y
verificar la entrega de estos insumos será el Jefe del Departamento de
Investigación del Incopesca.

10. Tomando en
consideración la situación socioeconómica de las comunidades costeras, en la
zona comprendida en el punto 1 de este acuerdo, durante la presente veda se
permitirá la pesca para el consumo doméstico. Quienes opten por realizar esta
pesca, deberán cumplir con lo establecido en el acuerdo de Junta Directiva
AJDIP-511-2017.

11. La Jefatura del
departamento de fiscalización del INCOPESCA, debe realizar las coordinaciones
pertinentes entre el Incopesca, Senasa
y el Ministerio de Seguridad Pública, con el fin de garantizar los operativos
de control y vigilancia durante la época de veda.

12. Dejar sin efecto el
acuerdo AJDIP-166-2017 "Regulación para el cumplimiento del Servicio de
Trabajo Comunal por parte del pescador inscrito en Veda", durante se
encuentre vigente el periodo de veda.

13. Todas aquellas
embarcaciones cuyo puerto base de operación se encuentre ubicado dentro del
Golfo de Nicoya, pero cuya licencia de pesca les autoriza faenar en el litoral
pacífico fuera de dicho Golfo y que, por consiguiente, deben navegar para
realizar su actividad pesquera; podrán ejecutar dicha actividad de manera
normal y tramitar el combustible correspondiente. El jefe del Departamento de
Registro del INCOPESCA, debe elaborar un listado con los nombres de los
armadores y el nombre y número de matrícula de las embarcaciones que se
encuentran en la condición descrita y lo trasladará al Servicio Nacional de
Guardacostas como elemento de apoyo de las acciones de control y vigilancia
durante la época de veda, mismo que deberá presentarse y comunicarse a todas
las entidades competentes, previo a la entrada en vigencia del periodo de veda.

15. Téngase
como parte integral del presente acuerdo, el mapa que se anexa.

                        Establishes a total fishing closure from May 1 through July 31, 2024 from Punta Torres known as Peñón to the Faro de la Isla Negritos, from there to the eastern part of Punta Cuchillos on the Península de Nicoya

AJDIP/094-2024.—Puntarenas,
on the sixteenth day of April, two thousand twenty-four.

CONSIDERING

1. That the Dirección de Ordenamiento Pesquero y Acuícola presented the proposal for the closure in the Golfo de Nicoya, agreed upon with representatives of small-scale commercial fishing in the Golfo de Nicoya and the semi-industrial sardine fleet; as well as with the members of the Comisión Nacional de Vedas, through official letter INCOPESCA-PE-DOPA-0038-2024, recommending the conditions for the establishment of the closure in the Golfo de Nicoya, considering the technical opinion provided by the Departamento de Investigación through official letters INCOPESCA-DOPA-DINV-059-2024, as well as INCOPESCA-DOPADINV-024-2023.

2. That Incopesca has scientific studies that support the establishment of this closure period on the proposed dates.

3. That through Junta Directiva agreement AJDIP/040-2023, dated 02-28-2023, the research report in official letter DOPA-014-2023 was ratified, with the results of the research on bycatch (fauna de acompañamiento) capture in the semi-industrial fishing of Sardina species of the Ophistonema sp. complex in the Golfo de Nicoya, conducted by the Departamento de Investigación, which is conclusive in confirming that non-target incidental catch represents less than 3% of the total sardine catch, falling within the 10% maximum allowable tolerance margin pursuant to point 1.4 of Junta Directiva Agreement AJDIP/100-2021.

4. That the fishing dynamics of the Golfo de Nicoya include a new fishing activity in the small-scale commercial tourism modality, whose participants have joined the body of the Comisión Nacional de Vedas.

5. That in the Golfo de Nicoya, INCOPESCA is developing the research project called "Characterization of the corvina fishery caught by the small-scale fleet, Golfo de Nicoya, Costa Rica."

6. That once the proposal for the 2024 Golfo de Nicoya closure was discussed and analyzed by the board members of the Junta Directiva of the Instituto Costarricense de Pesca y Acuicultura, THEREFORE;

AGREES

1. Based on the technical opinion issued by the Dirección de Ordenamiento Pesquero y Acuícola, to establish a total fishing closure from May 1 through July 31, 2024, both dates inclusive, in the area bounded by an imaginary straight line starting at Punta Torres known as Peñón (09°53´31" North Latitude, 084°43´52" West Longitude) to the Faro de la Isla Negritos offshore (09°49´14" North Latitude, 084°49´35" West Longitude) and from there to the eastern part of Punta Cuchillos on the Península de Nicoya (09°50´03" North Latitude, 084°53´42" West Longitude) and from there inshore to the mouth of the río Tempisque in the Golfo de Nicoya, as shown on the attached map.

2. During the months of June and July 2024 and based on the results of report DOPA-014-2023, entry is permitted for semi-industrial sardine vessels to fish only in the area designated as C, which is bounded by an imaginary line starting at Punta Torres known as Peñón (09°53´31" North Latitude, 084°43´52" West Longitude) to the Faro de la Isla Negritos offshore (09°49´14" North Latitude, 084°49´35" West Longitude) and from there to the eastern part of Punta Cuchillos on the Península de Nicoya (09°50´03" North Latitude, 084°53´42" West Longitude) and from there to the Faro de Puntarenas (9° 58´ 36.03´´ North Latitude 84° 51´ 03.93´´ West Longitude), for the purpose of supplying sardine for bait to the national fishing fleet, whose surplus may be marketed for other purposes as established.

3. That all landings made by the semi-industrial sardine purse-seine fleet shall be duly inspected by Incopesca inspectors for sardine and bycatch. The time window established for such purposes shall be from 06:00 hours to 20:00 hours. Exceptionally, landing may occur outside these hours, subject to prior coordination carried out during the regular business hours of the day of landing and authorization by the head of the Dpto. de Fiscalización of Incopesca or whoever represents him in his absence.

4. The Departamento de Investigación of Incopesca shall conduct biological sampling of those catches to verify legal minimum catch sizes and evaluate the reproductive behavior of the sardines. A report on this must be submitted to the Junta Directiva.

5. That a maximum incidental catch quota for non-target species of 10% is established, in relation to the total sardine catch, for the vessels of the semi-industrial sardine purse-seine fleet.

6. Exempted from this closure is fishing for barracuda or candado (Sphyraena ensis) in zones B and C, carried out by small-scale fishers using handlines and who are so authorized in their fishing license to fish during the months of May, June, and July 2024.

7. In the case of small-scale commercial tourism and sport fishing, any tournament that has the approval of INCOPESCA and takes place during the school break from July 1 to 12, 2024 may be held. Fishing shall only be authorized in the area designated as C, which is bounded by an imaginary line starting at Punta Torres known as Peñón (09°53´31" North Latitude, 084°43´52" West Longitude) to the Faro de la Isla Negritos offshore (09°49´14" North Latitude, 084°49´35" West Longitude) and from there to the eastern part of Punta Cuchillos on the Península de Nicoya (09°50´03" North Latitude, 084°53´42" West Longitude) and from there to the Faro de Puntarenas (9° 58´ 36.03´´ North Latitude 84° 51´ 03.93´´ West Longitude). The organizers or those responsible for the event must coordinate with the head of the Departamento de Fiscalización to ensure the presence of Incopesca inspectors to verify compliance with the regulations applicable to that activity.

7. Exempted from this closure is fishing activity related to the extraction of pianguas, as well as fishing activity related to marine organism aquaculture operations carried out in the Golfo de Nicoya.

8. The research permits authorized for the project "Characterization of the corvina fishery caught by the small-scale fleet, Golfo de Nicoya, Costa Rica" shall suspend their regular fishing activity. The Departamento de Investigación of Incopesca shall prepare a schedule containing the days on which these permit holders must carry out fishing activity during the three months of the closure. All catches obtained by the permit holders on these days shall be collected by the Departamento de Investigación of Incopesca at the time of landing in order to obtain the data and samples required by the project. The expenses incurred by the permit holders for their fishing activity during the days authorized in the aforementioned schedule shall be covered by the project "Characterization of the corvina fishery caught by the small-scale fleet, Golfo de Nicoya, Costa Rica" of INCOPESCA.

9. The responsible coordinator on behalf of Incopesca for the research project called "Characterization of the corvina fishery caught by the small-scale fleet, Golfo de Nicoya, Costa Rica" shall prepare a list of the beneficiaries holding a research permit for that project, which shall contain the following information: base port of operation or community, full name and ID number of the permit holder and their assistant, registration number and name of the vessel authorized in the research permit. Prior to the entry into force of the closure, the list and the aforementioned schedule must be delivered to the Servicio Nacional de Guardacostas to support control and surveillance operations in the Golfo de Nicoya during the closure. The person responsible for coordinating and verifying the delivery of these inputs shall be the head of the Departamento de Investigación of Incopesca.

10. Taking into consideration the socioeconomic situation of the coastal communities in the area covered by point 1 of this agreement, during this closure fishing for domestic consumption shall be permitted. Those who choose to carry out this fishing must comply with the provisions of Junta Directiva agreement AJDIP-511-2017.

11. The head of the Departamento de Fiscalización of INCOPESCA must carry out the necessary coordination between Incopesca, Senasa, and the Ministerio de Seguridad Pública to ensure control and surveillance operations during the closure period.

12. To render without effect agreement AJDIP-166-2017 "Regulation for the fulfillment of Community Work Service by fishers registered in Closure," while the closure period is in effect.

13. All those vessels whose base port of operation is located within the Golfo de Nicoya but whose fishing license authorizes them to fish on the Pacific coast outside said Gulf and that, consequently, must navigate to carry out their fishing activity, may carry out said activity normally and process the corresponding fuel. The head of the Departamento de Registro of INCOPESCA must prepare a list with the names of the vessel owners and the name and registration number of the vessels that meet the described condition and shall forward it to the Servicio Nacional de Guardacostas as a support element for control and surveillance actions during the closure period, which must be submitted and communicated to all competent entities prior to the entry into force of the closure period.

15. The attached map is hereby considered an integral part of this agreement.
