SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN

CONSEJO NACIONAL DE ÁREAS DE CONSERVACIÓN

R-SINAC-CONAC-043-2024.-Consejo Nacional de Áreas de
Conservación.-Heredia a las trece horas del diez de julio del año 2024.

El Consejo Nacional de Áreas de Conservación, de
conformidad al Acuerdo N°8 de la Sesión Extraordinaria N°06- 2024 del martes 28
de mayo de 2024, y en cumplimiento del artículo 12 inciso d) del Reglamento a
la Ley de Biodiversidad N° 7788, Decreto Ejecutivo N° 34433-MINAE, aprueba y
emite el presente:

Plan General de Manejo Zona Protectora

Acuíferos de Guácimo y Pococí

Resultando:

1º-Que de conformidad con el artículo 22 de la Ley de
Biodiversidad número 7788 del 27 de mayo de 1998, se crea el Sistema Nacional
de Áreas de Conservación, con personería jurídica propia, como un sistema de
gestión y coordinación institucional, desconcentrado y participativo, que
integra las competencias en materia forestal, vida silvestre y áreas
protegidas, con el fin de dictar políticas, planificar y ejecutar procesos
dirigidos a lograr la sostenibilidad en el manejo de los recursos naturales de
Costa Rica.

2º-Que es política prioritaria de EL SINAC facilitar y
promover acciones que conlleven a la protección, conservación y manejo
sostenible de los recursos naturales y la biodiversidad presentes en las Áreas
Silvestres Protegidas, en adelante las ASP, de las Áreas de Conservación.

3º-Que es competencia del Sistema Nacional de Áreas de
Conservación a través de cada Área de Conservación, la administración y
protección de las Áreas Silvestres Protegidas a lo largo de todo el territorio
nacional.

4º-Que de conformidad con los artículos 23 y 28 de la Ley
de Biodiversidad N° 7788 y los artículos 9 y 21 de su reglamento, Decreto
Ejecutivo N° 34433-MINAE, publicado en La Gaceta N° 68 del 8 de abril de
2008, el Área de Conservación Tortuguero, en adelante denominada ACTo, es parte
de la organización del SINAC y se encarga de aplicar la legislación vigente en
materia de recursos naturales, dentro de su demarcación geográfica.

Considerando:

1º-Que la Zona Protectora Acuíferos de Guácimo y Pococí,
en adelante denominada ZPAGP, fue creado el 21 de enero de 1987 mediante
Decreto Ejecutivo Nº 17390-MAG-S, el cual fue publicado en el Diario Oficial La
Gaceta Nº 17. La ZPAGP fue creada con el fin de proteger el recurso hídrico
que contiene el sistema de acuíferos de los sectores de Guácimo y Pococí los
cuales son de gran interés para el abastecimiento de las poblaciones, mismas
que corren el riesgo de ser deteriorados por las actividades intensivas
desarrolladas por las actividades humanas.

2º-Que el Plan de Manejo de las Áreas Silvestres
Protegidas (ASP) es el instrumento orientador para una efectiva administración
y manejo de los elementos naturales y culturales presentes en dichas áreas y de
la dinámica socio ambiental ligada a estos. Además, es la herramienta técnica
por medio de la cual cada ASP establece las directrices de manejo para el uso
de los gestores, administradores y grupos de interés, por lo tanto, la primera
instancia que debe realizar la validación de la propuesta de manejo son las
autoridades del Área de Conservación, así como las instancias oficiales de
participación social establecidas en ellas, sean estas los Consejos Regionales
y Comités Locales, de conformidad con la Ley de Biodiversidad N° 7788.

3º-Los Planes de Manejo tienen como objetivo el servir
como un instrumento de planificación y operación para implementar las medidas
apropiadas de manejo y conservación de las áreas silvestres protegidas, promoviendo
la participación de la sociedad en especial de las comunidades locales a través
de diferentes procesos.

4º-Que el Consejo Nacional de Áreas de Conservación
(CONAC), aprobó el "Manual de Procedimientos para la Publicación de las
Planes de Manejo de las Áreas Silvestres Protegidas del Sistema Nacional de
Áreas de Conservación", mediante Acuerdo N° 17, tornado en Sesión
Extraordinaria N° 06-2008 del 04 de agosto del 2008.

5º-Que el CONAC en Acuerdo N° 8 de la Sesión
Extraordinaria N° 02-2011 del 02 de mayo del 2011 acordó modificar el Acuerdo
N° 17 de la Sesión Extraordinaria N° 06- 2008 del 04 de agosto del 2008, para
que la zonificación definida en el Plan General de Manejo se publique
integralmente.

6º-Que a finales del 2019 se plantea la necesidad de
elaborar el Plan General de Manejo de la Zona Protectora Acuíferos de Guácimo y
Pococí, con el apoyo técnico y financiero del Área de Conservación Tortuguero.

7º-Que a inicios del 2020 se establece el Comité de
Seguimiento por parte de la Gerencia de ASP del ACTo para el proceso de
elaboración del Plan General de Manejo de la Zona Protectora Acuíferos de
Guácimo y Pococí, y que con la facilitación de funcionarios del área de
conservación se elaboró el diagnóstico, los talleres comunales e institucionales
y la sistematización de la experiencia con la conclusión del documento final
que fue aprobado por el Comité Científico Técnico y el Consejo Regional del
ACTo.

8º-Que el 09 de octubre de 2023, se certifica mediante
oficio SINAC-ACTo-DIR-CI-003-2023 de Mauricio Alfaro Cháves de Control Interno
de ACTo, que en la Sesión Ordinaria # 6-2023 del 13 de julio del 2023 del
Comité Científico Técnico del ACTo, se tomó el Acuerdo #04; "Acuerdo N°
04: El Comité Científico Técnico del Área de Conservación Tortuguero, conoce y
aprueba la matriz estratégica y zonificación de la Zona Protectora de los
Acuíferos Guácimo y Pococí para que se incluya en el Plan General de Manejo de
dicha Área Silvestre Protegida. El borrador completo con estos dos elementos
aprobados puede ser presentado en CORACTo."

9º-Que el 19 de febrero del 2024, se certifica mediante
oficio SINAC-ACTo-DIR-044-2024 de la Directora del Área de Conservación
Tortuguero en su acta número Trece-2018 de la sesión ordinaria del Comité
Ejecutivo del CORACTo, el Acuerdo N°09 del 28 de setiembre del 2023:
"Acuerdo N° 07: El Consejo Regional del Área de Conservación Tortuguero
(CORACTo), recibe, conoce y aprueba Plan General de Manejo Zona Protectora
Acuíferos Guácimo-Pococí; según recomendación del Comité Científico Técnico,
Acuerdo N° 04 de la Sesión N° 6-2023 del 13 de julio y presentado por la
funcionaria Sara Zúñiga Calderón, Directora a. í. de Áreas Silvestres
Protegidas del Área de Conservación Tortuguero (ACTo), e instruye a la señora
Elena Vargas Ramírez, en calidad de Secretaria Ejecutiva de este Consejo
Regional, para que continúe con el trámite respectivo de acuerdo con la
normativa establecida, y que se remita al Consejo Nacional de Áreas de
Conservación (CONAC). Acuerdo aprobado en firme por unanimidad."

10.-Que el CONAC aprobó el Plan General de Manejo del Zona Protectora
Acuíferos de Guácimo y Pococí, en la Sesión Extraordinaria N° 06-2024 del
martes 28 de mayo de 2024 y mediante Acuerdo N° 8, aprueba el Plan General de
Manejo e instruye a la Dirección Ejecutiva del SINAC y a la Dirección del Acto
para que procedan con el trámite correspondiente para su publicación y
oficialización. Por tanto;

LA SECRETARIA EJECUTIVA DEL CONSEJO NACIONAL DE AREAS DE
CONSERVACION

RESUELVE:

1º-Publicar el siguiente Resumen Ejecutivo del Plan
General de Manejo la Zona Protectora Acuíferos de Guácimo y Pococí, a efectos
de su oficialización:

a) Objetivo de Creación:

Los fundamentos técnicos para la declaratoria como Zona
Protectora Acuíferos de Guácimo y Pococí e indicados en el decreto de creación
son la conservación y desarrollo del acuífero, tanto en cantidad como en
calidad del agua.

Otros elementos importantes son, según el Plan General de
Manejo (2023):

Hay que destacar que la creación de la Zona Protectora
Acuíferos de Guácimo Pococí surge a partir de una serie de consideraciones
técnicas, entre las que destacan la existencia de una zona de acuíferos de gran
interés para el abastecimiento de agua a las poblaciones aledañas de los
cantones de Pococí y Guácimo. Además de la necesidad de tomar acciones ante la
presión que estaban sufriendo producto de la contaminación provocada por las
malas prácticas agrícolas, tala acelerada de árboles, asentamiento de rellenos
sanitarios, explotación de canteras y minas, así como la sobreexplotación de
los pozos.

b) Objetivos de Gestión y Manejo

Gestionar los recursos naturales de la ZPAGP mediante el enfoque de
conectividad y manejo adaptativo respondiendo a las necesidades de protección
de los Elementos Focales de Manejo, con el liderazgo de SINAC-ACTo y la
participación de los actores locales.

La visión de la Zona Protectora Acuíferos Guácimo Pococí
es que mantiene su integridad ecológica además de ser un modelo de protección
de ecosistemas vulnerables, de provisión de bienes y servicios ambientales.

c) Zonificación de la ZPAGP

A continuación, se mencionan las zonas y su relevancia
con respecto a factores como propiedad de la tierra, marco legal y otros
factores que pueden determinar su factibilidad. Estas zonas están propuestas en
la Guía para el diseño y formulación del Plan General de Manejo de las Áreas
Silvestres Protegidas de Costa Rica (SINAC, 2014b).

Para la delimitación de la zonificación de la ZPAGP se
utilizaron los datos generados durante el taller de zonificación, donde se
trabajó sobre el mapa de la Zona Protectora basado en la generalidad del uso de
la tierra. A partir de ello, con la información generada en los tres mapas,
tomando como base los usos actuales dentro de la Zona Protectora, así como su
área de amortiguamiento y las oportunidades de uso detectadas en los talleres
anteriores, se cruzó la información y se realizó un mapa con los polígonos
sugeridos de zonas de uso, así como su posible restricción.

En cuanto a la elaboración de los polígonos de zonificación con los usos
respectivos se tomó en cuanta cinco variables, para las cuales se diseñó un
mapa respectivo realizando una intersección de variables (álgebra de variables)
en el Sistema de Información Geográfica, donde se elaboró una tabla de
atributos reclasificando en una escala de 1 a 4 cada variable y sus
características, dichas variables son: capacidad de uso del suelo, pendiente,
cobertura Forestal, vacíos de conservación y manantiales, el cruce de esas
variables dan como resultado el mapa de potencial para conservación del sitio.

2º-Plazo de ejecución:

Para el control y seguimiento de la implementación de las
líneas estratégicas del plan general de manejo para la ZPAGP 2023-2027 el
periodo es de 5 años, sin embargo, se recomienda que se realice una evaluación
de medio término a los 3 años para proponer reajustes al plan.

                        General Management Plan for the Zona Protectora Acuíferos de Guácimo y Pococí

NATIONAL SYSTEM OF CONSERVATION AREAS

NATIONAL COUNCIL OF CONSERVATION AREAS

R-SINAC-CONAC-043-2024.—National Council of Conservation Areas.—Heredia at thirteen hours on the tenth of July of the year 2024.

The National Council of Conservation Areas, in accordance with Agreement No. 8 of Extraordinary Session No. 06-2024 of Tuesday, May 28, 2024, and in compliance with Article 12, subsection d) of the Regulation to the Biodiversity Law No. 7788, Decreto Ejecutivo N° 34433-MINAE, approves and issues the following:

General Management Plan for the Zona Protectora

Acuíferos de Guácimo y Pococí

Whereas:

1º—That in accordance with Article 22 of the Biodiversity Law number 7788 of May 27, 1998, the National System of Conservation Areas was created, with its own legal personality, as a decentralized and participatory institutional management and coordination system that integrates competencies in forestry, wildlife, and protected areas, with the purpose of issuing policies, planning, and executing processes aimed at achieving sustainability in the management of Costa Rica's natural resources.

2º—That it is a priority policy of SINAC to facilitate and promote actions that lead to the protection, conservation, and sustainable management of the natural resources and biodiversity present in the Protected Wild Areas, hereinafter the ASP, of the Conservation Areas.

3º—That it is the responsibility of the National System of Conservation Areas, through each Conservation Area, to administer and protect the Protected Wild Areas throughout the entire national territory.

4º—That in accordance with Articles 23 and 28 of the Biodiversity Law No. 7788 and Articles 9 and 21 of its regulation, Decreto Ejecutivo N° 34433-MINAE, published in La Gaceta No. 68 of April 8, 2008, the Área de Conservación Tortuguero, hereinafter referred to as ACTo, is part of the SINAC organization and is responsible for applying the legislation in force regarding natural resources within its geographical demarcation.

Considering:

1º—That the Zona Protectora Acuíferos de Guácimo y Pococí, hereinafter referred to as ZPAGP, was created on January 21, 1987, by Decreto Ejecutivo Nº 17390-MAG-S, which was published in the Official Gazette La Gaceta No. 17. The ZPAGP was created for the purpose of protecting the water resource contained in the aquifer system of the Guácimo and Pococí sectors, which are of great interest for the supply of water to the populations, the same that are at risk of being deteriorated by the intensive activities carried out by human activities.

2º—That the Management Plan for Protected Wild Areas (ASP) is the guiding instrument for effective administration and management of the natural and cultural elements present in said areas and of the socio-environmental dynamics linked to them. Furthermore, it is the technical tool through which each ASP establishes the management guidelines for use by managers, administrators, and interest groups; therefore, the first instance that must carry out the validation of the management proposal are the authorities of the Conservation Area, as well as the official instances of social participation established therein, be they the Regional Councils and Local Committees, in accordance with the Biodiversity Law No. 7788.

3º—The Management Plans have the objective of serving as a planning and operational instrument to implement appropriate management and conservation measures for the protected wild areas, promoting the participation of society, especially local communities, through different processes.

4º—That the National Council of Conservation Areas (CONAC) approved the "Manual of Procedures for the Publication of Management Plans for Protected Wild Areas of the National System of Conservation Areas," by means of Agreement No. 17, adopted in Extraordinary Session No. 06-2008 of August 4, 2008.

5º—That CONAC, in Agreement No. 8 of Extraordinary Session No. 02-2011 of May 2, 2011, agreed to modify Agreement No. 17 of Extraordinary Session No. 06-2008 of August 4, 2008, so that the zoning defined in the General Management Plan is published in its entirety.

6º—That at the end of 2019, the need was raised to prepare the General Management Plan for the Zona Protectora Acuíferos de Guácimo y Pococí, with the technical and financial support of the Área de Conservación Tortuguero.

7º—That at the beginning of 2020, the Follow-up Committee was established by the ASP Management Office of the ACTo for the process of preparing the General Management Plan for the Zona Protectora Acuíferos de Guácimo y Pococí, and that with the facilitation of officials from the conservation area, the diagnosis, the community and institutional workshops, and the systematization of the experience were carried out, resulting in the conclusion of the final document that was approved by the Technical Scientific Committee and the Regional Council of the ACTo.

8º—That on October 9, 2023, it was certified by official communication SINAC-ACTo-DIR-CI-003-2023 from Mauricio Alfaro Cháves of Internal Control of ACTo, that in Ordinary Session # 6-2023 of July 13, 2023, of the Technical Scientific Committee of ACTo, Agreement #04 was adopted; "Agreement No. 04: The Technical Scientific Committee of the Área de Conservación Tortuguero, reviews and approves the strategic matrix and zoning of the Zona Protectora de los Acuíferos Guácimo y Pococí for inclusion in the General Management Plan of said Protected Wild Area. The complete draft with these two approved elements may be presented to CORACTo."

9º—That on February 19, 2024, it was certified by official communication SINAC-ACTo-DIR-044-2024 from the Director of the Área de Conservación Tortuguero, in its record number Thirteen-2018 of the ordinary session of the Executive Committee of CORACTo, Agreement No. 09 of September 28, 2023: "Agreement No. 07: The Regional Council of the Área de Conservación Tortuguero (CORACTo), receives, reviews, and approves the General Management Plan for the Zona Protectora Acuíferos Guácimo-Pococí; according to the recommendation of the Technical Scientific Committee, Agreement No. 04 of Session No. 6-2023 of July 13 and presented by the official Sara Zúñiga Calderón, Acting Director of Protected Wild Areas of the Área de Conservación Tortuguero (ACTo), and instructs Mrs. Elena Vargas Ramírez, in her capacity as Executive Secretary of this Regional Council, to continue with the respective procedure in accordance with established regulations, and to forward it to the National Council of Conservation Areas (CONAC). Agreement approved definitively by unanimous vote."

10.—That CONAC approved the General Management Plan for the Zona Protectora Acuíferos de Guácimo y Pococí, in Extraordinary Session No. 06-2024 of Tuesday, May 28, 2024, and by means of Agreement No. 8, approves the General Management Plan and instructs the Executive Directorate of SINAC and the Directorate of ACTo to proceed with the corresponding procedure for its publication and formalization. Therefore;

THE EXECUTIVE SECRETARY OF THE NATIONAL COUNCIL OF CONSERVATION AREAS

RESOLVES:

1º—To publish the following Executive Summary of the General Management Plan for the Zona Protectora Acuíferos de Guácimo y Pococí, for the purposes of its formalization:

a) Creation Objective:

The technical foundations for the designation as Zona Protectora Acuíferos de Guácimo y Pococí, as indicated in the creation decree, are the conservation and development of the aquifer, both in quantity and quality of water.

Other important elements are, according to the General Management Plan (2023):

It should be highlighted that the creation of the Zona Protectora Acuíferos de Guácimo Pococí arises from a series of technical considerations, among which the existence of an aquifer zone of great interest for the supply of water to the surrounding populations of the cantons of Pococí and Guácimo stands out. In addition to the need to take actions given the pressure they were suffering as a result of contamination caused by poor agricultural practices, accelerated tree felling, the establishment of landfills, the exploitation of quarries and mines, as well as the overexploitation of wells.

b) Management and Handling Objectives

Manage the natural resources of the ZPAGP through a connectivity and adaptive management approach, responding to the protection needs of the Focal Management Elements, with the leadership of SINAC-ACTo and the participation of local actors.

The vision of the Zona Protectora Acuíferos Guácimo Pococí is that it maintains its ecological integrity in addition to being a model for the protection of vulnerable ecosystems and the provision of environmental goods and services.

c) Zoning of the ZPAGP

Below, the zones and their relevance with respect to factors such as land ownership, legal framework, and other factors that may determine their feasibility are mentioned. These zones are proposed in the Guide for the Design and Formulation of the General Management Plan for Protected Wild Areas of Costa Rica (SINAC, 2014b).

For the delimitation of the zoning of the ZPAGP, the data generated during the zoning workshop were used, where work was carried out on the map of the Zona Protectora based on the generality of land use. From this, with the information generated in the three maps, taking as a basis the current uses within the Zona Protectora, as well as its buffer area and the use opportunities detected in previous workshops, the information was cross-referenced, and a map was created with the suggested polygons for use zones, as well as their possible restrictions.

Regarding the elaboration of the zoning polygons with the respective uses, five variables were taken into account, for which a respective map was designed by performing an intersection of variables (variable algebra) in the Geographic Information System, where an attribute table was prepared, reclassifying each variable and its characteristics on a scale of 1 to 4; these variables are: land-use capacity, slope, forest cover, conservation gaps, and springs (manantiales). The intersection of these variables results in the conservation potential map for the site.

2º—Execution Term:

For the control and monitoring of the implementation of the strategic lines of the General Management Plan for the ZPAGP 2023-2027, the period is 5 years; however, it is recommended that a mid-term evaluation be carried out at 3 years to propose readjustments to the plan.
