MINISTERIO
DE AMBIENTE Y ENERGIA. San José a las 17 horas del día ocho de noviembre del
dos mil veinticuatro.

RESULTANDO

PRIMERO:
Que mediante Decreto Ejecutivo N° 44558- MINAE del 12 de julio del 2024,
publicado en el Alcance N° 130 a La Gaceta N° 134 del 22 de julio del 2024, que
reforma el artículo 62 del Reglamento a la Ley Forestal Decreto Ejecutivo N°
25721-MINAE del 17 de octubre de 1996, se autoriza la ejecución de planes y
proyectos de pago por servicios ambientales o eco sistémicos como mecanismos de
reconocimiento a las acciones que ejecutan las comunidades rurales organizadas
que ejecutan explotación sostenible y debidamente autorizado por el Sistema
Nacional de Áreas de Conservación. Estas acciones incluyen aprovechamiento
sostenible de moluscos, crianza, monitoreo, acciones de vigilancia y
aprovechamiento sostenible.

SEGUNDO:
Que el transitorio único del citado artículo 62 dispone que el Ministerio de
Ambiente y Energía dispone de 2 meses a partir de su publicación para emitir el
Reglamento para establecer el Manual de Operación de reconocimiento de
Servicios Ambientales en Bosques de Mangle.

TERCERO:
Para implementar este mecanismo, se implementa un Acuerdo de Cooperación de
fecha 13 de setiembre del 2024, entre el Ministerio de Ambiente y Energía, El
Sistema Nacional de Áreas de Conservación, el Fondo Nacional de Financiamiento
Forestal, el Instituto Costarricense de Pesca y Acuacultura y la Fundación
Banco Ambiental, esta última que canaliza los recursos financieros para el plan
piloto, para un trabajo conjunto y colaborativo, cada uno en el campo de su
competencia.

CONSIDERANDO:

PRIMERO:
Que la comisión de trabajo instaurada por funcionarios de las entidades
señaladas, ha trabajado en elaborar el Manual de Operación de reconocimiento de
Servicios ambientales o Ecosistémicos en Bosques de
Mangle.

SEGUNDO: Que los representantes de las entidades que conforman el Acuerdo de Cooperación, le
recomiendan al señor Ministro la emisión y publicación del Manual de Operación de Reconocimiento de
pago por servicios ambientales o ecosistémicos en Bosques de Mangle.

Por tanto;

EL MINISTRO DE AMBIENTE
Y ENERGÍA

RESUELVE:

PRIMERO:
Emitir y autorizar el siguiente del Manual de Operación de Reconocimiento
Piloto para el pago por servicios ambientales o ecosistémicos
en Bosques de Mangle.

SEGUNDO: Rige a partir
de su publicación.

MANUAL
DE OPERACIÓN DEL PLAN PILOTO PARA:

PAGO DE SERVICIOS AMBIENTALES Y/O ECOSISTEMICOS EN
BOSQUES DE MANGLE

PRIMERO: Que mediante el Decreto Ejecutivo N° 44558-MINAE del 12 de julio del 2024, publicado en el
Alcance N° 130 a La Gaceta N° 134 del 22 de julio del 2024, se incorporó el artículo 62 del
Reglamento a la Ley Forestal, Decreto Ejecutivo N° 25721-MINAE del 17 de octubre de 1996, se
autoriza la ejecución de planes o proyectos de pago por servicios ambientales o ecosistémicos como
mecanismos de reconocimiento a las acciones que realicen las comunidades rurales organizadas que
ejecutan una explotación sostenible y debidamente autorizados por el Sistema Nacional de Áreas de
Conservación.

Para cumplir con este proceso el citado reglamento, establece que el mecanismo de pago por servicios
ambientales debe ser ejecutado en forma conjunta, colaborativa y coordinada entre el Ministerio de
Ambiente y Energía, el Sistema Nacional de Áreas de Conservación, el Fondo Nacional de
Financiamiento Forestal y el Instituto Costarricense de Pesca y Acuacultura, mediante el Convenio de
Cooperación denominado "CONVENIO MARCO DE COOPERACION PARA EJECUTAR UN PLAN PILOTO PARA EL PAGO DE
SERVICIOS AMBIENTALES O ECOSISTEMICOS EN BOSQUES DE MANGLE", donde se establezcan los roles de cada
parte.

SEGUNDO: Que, mediante el Convenio de Cooperación, suscrito entre el Ministerio de Ambiente y
Energía, el Sistema Nacional de Áreas de Conservación, el Fondo Nacional de Financiamiento Forestal,
el Instituto Costarricense de Pesca y Acuacultura y la Fundación Banco Ambiental, firmado de manera
digital, según lo establecido en la ley certificados, firmas digitales y documentos electrónicos
(Ley 8454) y su Reglamento (Decreto Ejecutivo No.33018-MICIT), constando en cada firma, la hora y
fecha de este, el cual se dio entre el 23 de agosto del 2024 al 13 de septiembre del 2024, se
establece un mecanismo de cooperación conjunta según las competencias correspondientes, para iniciar
el mecanismo de pago por servicios ecosistémicos en bosques de mangle. 

TERCERO: Que, el día 19 de mayo del 2023, la Fundación Banco Ambiental, ha suscrito un Convenio con
la organización The Earthshot del Reino Unido, el cual dispone de recursos financieros para iniciar
un proyecto piloto para el pago a poblaciones rurales, que realizan aprovechamiento sostenible de
moluscos y otras acciones en bosques de mangle en el Golfo de Nicoya. Que se le presentó a esta
organización el detalle del plan piloto, así como el detalle de los gastos que su ejecución conlleva
y mediante correo manifestó su conformidad con el plan propuesto.

            CUARTO: Que el transitorio único del Decreto 44558-MINAE del 12 de julio del 2024,
señala que el Ministerio de Ambiente y Energía tendrá dos meses a partir de la publicación del
decreto, para establecer el Manual de operación de reconocimiento de Servicios Ambientales o
ecosistémicos en bosques de mangle.

            QUINTO: Que la Comisión establecida en la Cláusula Octava del Convenio de Cooperación,
recomienda el borrador del Manual de Operación, necesario para el cumplimiento de los objetivos
establecidos, el cual es acogido por todos los órganos, entidades involucradas en el proceso de
establecimiento y ejecución del mecanismo.

            SEXTO: Que Costa Rica es un país reconocido por su liderazgo ambiental, sus esfuerzos de
conservación, la recuperación de la cobertura forestal de su territorio, la tutela de la
biodiversidad y más recientemente por su compromiso con la protección de los recursos marinos y
costeros. Estos últimos representan para el país una fuente importante de recursos; por lo que, su
conservación es prioritaria. 

SETIMO: Que la conservación de los recursos marinos y costeros impone la necesidad de contar con un
desarrollo político-normativo y un actuar institucional diferenciado, que garantice su adecuado
manejo y como punto de partida, se ha formulado un Plan Piloto, para el reconocimiento de pago por
servicios ambientales o ecosistémicos en los bosques de mangle por parte de las comunidades rurales
permisionarias, para la extracción de moluscos, en virtud de las acciones establecidas en el
artículo 62 del Reglamento a la ley Forestal Decreto Ejecutivo N° 25721-MINAE del 17 de octubre,
1996.

OCTAVO: Que de conformidad con el artículo 28 de la Ley General de la Administración Pública N° 6727
del 02 de mayo de 1978, es facultad del Ministro preparar y presentar al Presidente de la República
los proyectos de ley, decretos, acuerdos, resoluciones, órdenes y demás actos que deban suscribir
conjuntamente relativos a las cuestiones atribuidas a su Ministerio, por lo que tiene la facultad de
regular como será ejecutado el plan piloto señalado, con todos los elementos técnicos, legales,
administrativos y financieros.

            NOVENO: Que el Plan Piloto, establecido por el Ministerio de Ambiente y Energía, a
través de sus órganos y entidades colaboradores, determinaron que el Plan Piloto de pago por
servicios ambientales o ecosistémicos en bosques de Mangle, dispone como base algunos presupuestos
preestablecidos de inicio, entre estos están aquellos bosques de manglares que cuenten con el
respectivo Plan General de Manejo ( PGM), el Plan de Aprovechamiento de Moluscos, emitido por el
Sistema Nacional de Áreas de Conservación,  así como  las asociaciones de  poblaciones  costeras que
cuenten con los permisos de uso correspondientes, además de los permisos de comercialización por
parte del Instituto Costarricense de Pesca y Acuicultura, los cuales fueron establecidos para
iniciar la ejecución del plan piloto del reconocimiento de pago por los servicios ecosistémicos
brindados en los bosques de mangle, razón por la cual el presente manual omite el proceso inicial de
selección de las asociaciones comunitarias participantes.

DECIMO: Que en el proyecto piloto para el reconocimiento de servicios ambientales o eco sistémicos
en bosques de mangle, participan seis asociaciones de molusqueros,  las cuales representan
aproximadamente 157 personas,  y ya cuentan con el Permiso de Uso para Extracción de Moluscos por
parte del Sistema Nacional de Áreas de Conservación,  y el Permiso de  Comercialización  por parte
del Instituto Costarricense de Pesca y Acuacultura, según lo dispuesto en la Ley de Conservación de
la Vida Silvestre N° 7117,  la Ley Forestal N° 7575, Ley de Biodiversidad N° 7888, La Ley de Pesca y
Acuacultura N° 8436, así como los Decretos N° 39411-MINAE-MAG del 02 se setiembre del 1025 y
N°40023-MINAEMAG del 03 de octubre del 2016, las citadas asociaciones beneficiarias de este programa
no deben  cumplir con requisitos nuevos o adicionales. 

DECIMO PRIMERO: Que el proyecto piloto para el reconocimiento de servicios ambientales o eco
sistémicos en bosques de mangle, se ubica en los manglares ubicados en el Golfo de Nicoya, de la
Provincia Guanacaste, por lo que el presente Manual de Operaciones, solamente cobija solo a esta
población y a esta zona del país, sin tener alcances de norma general para el resto de la población.

            DECIMO SEGUNDO: Que, de conformidad con el Reglamento a la Ley de Protección al
Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo?N° 37045-MP-MEIC
del 22 de febrero de 2012 y sus reformas, se determinó que la presente propuesta no establece ni
modifica trámites, requisitos o procedimientos nuevos que?el administrado deba cumplir, situación
por la que no se procedió con el trámite de control previo.

            POR TANTO,

Se emite el siguiente
manual de operación para el reconocimiento
de servicios ambientales
y/o ecosistémicos en bosques de
mangle en su versión piloto según las siguientes clausulas:

Capítulo I.
De los Acrónimos y Definiciones

Artículo 1.- Acrónimos.

En el presente manual se emplearán los siguientes
acrónimos con su respectivo significado:

ACT: Área de Conservación
Tempisque

ASP: Área Silvestre Protegida

CCSS: Caja Costarricense
del Seguro Social.

DAJ: Dirección de Asuntos Jurídicos.  

Fodesaf: Fondo de Desarrollo de Asignaciones Familiares.

Fonafifo: Fondo Nacional de Financiamiento Forestal.

FUNBAM:
Fundación Banco Ambiental

GPS: Siglas en
inglés, relacionado al
Sistema de Posicionamiento Global.

IBAN: Siglas en
inglés (Internacional Bank
Account Number), estructura estandarizada
que identifica las cuentas
de fondos, tanto a nivel nacional como internacional.
 

INCOPESCA: Instituto Costarricense de Pesca y Acuicultura

MINAE: Ministerio de Ambiente y Energía.

Artículo 2.- Definiciones.  

Para efectos de este
manual, se considera:

Actividad: Acción relacionada
a la Protección de Bosque de manglar,
Protección de Recurso Hídrico, Protección de Biodiversidad o la combinación de
estas.

Asociación: Asociaciones de molusqueros
ubicadas en el Golfo de Nicoya, identificadas como beneficiarias
del Plan Piloto.  

Aprovechamiento: Acción de cultivo, repoblamiento y extracción racional de recursos acuáticos, que
genere o pueda generar algún provecho, beneficio, ventaja, utilidad o ganancia para la persona que
la realiza o para quien esta representa, en el tanto no afecte la salud de las poblaciones y sus
servicios ecosistémicos.

Bosque de Manglar: Humedal del sistema estuarino, normalmente crecen adyacentes a la zona
intermareal y que han desarrollado adaptaciones especiales para sobrevivir en este ambiente.

Contrato: Pacto o convenio, oral o escrito, entre partes que se obligan sobre materia o cosa
determinada, y a cuyo cumplimiento pueden ser compelidas.

EARTH SHOT PRIZE: Premio ambiental global otorgado a Costa
Rica en el año 2021, de donde provienen los recursos para el financiamiento piloto.

Gestor: Profesional Biólogo
o especializado, encargado en primer plano
de la supervisión, responsable
de la ejecución del plan piloto
con las asociaciones beneficiarias.

Gestor
Asistente: Técnico en
biología que asistirá al
Gestor en sus funciones.

Humedal: Ecosistemas con dependencia de regímenes acuáticos, naturales o artificiales, permanentes o
temporales, lénticos o lóticos, dulces, salobres o salados, incluyendo las extensiones marinas hasta
el límite posterior de fanerógamas marinas o arrecifes de coral o, en su ausencia, hasta seis metros
de profundidad en marea baja. 

Informe: Documento elaborado en digital por el Gestor, con las condiciones del recurso que
fundamenta la ejecución del proyecto PSA Manglares, en las actividades previstas en el contrato. 

Ley Forestal: Ley N°7575 "Ley Forestal" del 13
de febrero de 1996, publicada
en el Alcance N° 21 a La Gaceta N° 72 del 16 de abril del año 1996.

Moluscos: grupo
de invertebrados de cuerpo blando del Fillum
Mollusca.

Pago por Servicios Ambientales
y/o Ecosistémicos de Bosque de Mangle (PSAM): Reconocimiento financiero
por parte del Estado, a
personas dedicadas a la extracción
de moluscos inscritas en grupos organizados,
por los servicios
que éstos proveen a los ecosistemas y que inciden directamente en su protección
y mejora.

Patrimonio Natural del Estado (PNE): Bosques y terrenos forestales de las reservas nacionales, de
las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a
municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto
inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a
formar parte de su patrimonio.

Personas beneficiarias: Personas físicas miembros de las asociaciones, que poseen un permiso de uso
y carne de aprovechamiento vigente
y participan de las actividades
del Plan Piloto.

Solicitud de Ingreso
al PSAM: Formulario para solicitar el ingreso al PSAM, que
contiene las calidades de
las personas solicitantes

Capitulo
II.  De los Requisitos de ingreso

Artículo 3.- Solicitud de inicio.

Las asociaciones coordinarán con el Gestor Biólogo, la presentación del formulario de inicio en el
cual se indica y adjunta la documentación correspondiente a los requisitos establecidos en el
presente manual para la participación del Plan Piloto.

Esta solicitud deberá ser entregada en
la Oficina Regional del Área
de Conservación Tempisque
(ACT), ubicada en Nicoya,
Guanacaste. Ver Anexo 1

Artículo 4.- Sectores o Zonas de Bosque de Mangle y Asociaciones
incluidas en el Plan Piloto.

Para efectos de este proyecto se seleccionaron los sectores de acuerdo con lo establecido en los
"Planes de Manejo para el Aprovechamiento de Moluscos (almejas, mejillones, almejón y pianguas) del
Área de Conservación Tempisque, y las asociaciones ubicadas en estos sectores y que cumplen con los
requisitos establecidos en este manual:

Artículo 5.- Ámbito de aplicación.  

En virtud de que el SINAC realizó un plan general de Manejo y un Plan de Aprovechamiento, en las
áreas dentro del Golfo de Nicoya, el plan piloto para el pago por servicios ecosistémicos en bosques
de mangle ha establecido estas áreas como prioritarias. En igual sentido se ha determinado cuáles
serán las Asociaciones de Molusqueros que dentro de estas zonas participarán dado la existencia de
los permisos correspondientes.

En virtud de lo anterior este
manual omite el capítulo de
la selección de las asociaciones
beneficiarias y la determinación
de las zonas prioritarias.

Las asociaciones identificadas como beneficiarias
para implementar este plan piloto son las siguientes:

1-Puerto Pochote, Nicoya: Asociación de Molusqueros de
Puerto Pochote de Nicoya.

2-Puerto Jesús, Nicoya: Asociación de Molusqueros de
Puerto Jesús

3-Puerto Thiel y Puerto San Pablo, Nandayure: Asociación de Molusqueros Grupos Unidos de Puerto
Jesús, Puerto San Pablo y Acoyapa.

4-Corozal, Jicaral: Asociación de Pescadores de Corozal,
Jicaral de Puntarenas

5-Copal, Nicoya: Asociación Molusqueros Cerro Sombrero Copal   

6-Isla Chira, Puntarenas: Asociación de Pesca Mixta Montero de Isla Chira

Artículo 6.- Distribución de Beneficiarios. Las asociaciones seleccionarán a un grupo específico de
sus asociados para participar como beneficiarios del presente Plan Piloto.  Las asociaciones
convocarán, a sus miembros para participar en las actividades del plan piloto, verificando el
cumplimiento de los requisitos habilitantes establecidos en el presente manual. Los criterios de
selección de las personas beneficiarias serán de exclusiva responsabilidad de cada una de las
asociaciones; de acuerdo con el número de personas máximo permitida en los Permisos de Uso de cada
Asociación.  Una vez seleccionados los participantes, la asociación deberá comunicar por escrito al
Gestor Biólogo la lista de beneficiarios, quien lo remitirá oficialmente a la oficina Regional del
ACT, para la inclusión en el expediente administrativo que corresponda.

El total de personas beneficiadas
en el Plan Piloto es de 157 personas según el siguiente cuadro:

Artículo 7.- Requisitos y Obligaciones de las Asociaciones beneficiarias.

7.1. Requisitos de las Asociaciones participantes   

a.       Cada asociación deberá estar debidamente inscrita ante Registro Nacional y contar con
personería jurídica vigente durante el plazo de vigencia del Contrato.   En caso de vencimiento de
su personería, deberá procurar una nueva inscripción en los siguientes 20 días hábiles después de su
vencimiento. Los pagos a las Asociaciones quedaran sujetos al cumplimiento de este requisito.

b.      Aportar un acuerdo de Asamblea o de Junta Directiva mediante el cual se autoriza al
presidente de la Asociación para la firma del Contrato en el marco del plan piloto para el Programa
de Pago de Servicios Ambientales Marinos en Bosques de Mangle y acepta asumir los compromisos
pactados.

c.       Nota de manifestación del consentimiento, previo e informado, debidamente firmada por el
presidente de la Asociación, cuyo requisito se recomienda replicar a lo interno de cada Asociación
con todas las personas físicas participantes. Ver Anexo 2

d.     
Indicar un correo
electrónico como medio para recibir notificaciones.  

e.       Mantener vigentes los permisos otorgados de uso otorgados por el Sistema Nacional de Áreas
de Conservación y los permisos de comercialización de moluscos otorgados por el Instituto
Costarricense de Pesca y Acuacultura.

7.2. Obligaciones de las Asociaciones participantes:
 

7.2.1.
Obligaciones Técnicas:

a.      
Velar por
que los asociados cumplan las condiciones plasmadas en los
Planes de Aprovechamiento de Moluscos.

b.     
Cumplir todos los
términos de la resolución del permiso de uso
otorgado por el SINAC, las autorizaciones otorgadas por parte de INCOPESCA y mantenerlos
vigentes.

c.       No realizar actividades de tala, extracción o que dañe o alteren el bosque de manglar y sus
zonas aledañas, salvo actividades expresamente autorizadas por los permisos respectivos.

d.      Cumplir y participar en todas las actividades previstas en el contrato de pago por servicios
ambientales y/o ecosistémicos en áreas de bosques de mangle, entre ellas, acciones de vigilancia,
procesos de crianza o reproducción, involucramiento en los procesos de monitoreo de moluscos,
monitoreo ecológico del manglar y el aprovechamiento sostenible de los moluscos.

e.       Coordinar el trabajo y cumplir las recomendaciones realizadas en forma escrita o verbal por
el Gestor Biólogo.

f.       
Elaborar y cumplir con el plan de vigilancia propuesto por la misma asociación.

g.      Disponer de los mecanismos de registros de extracción diaria, semanal o mensual, según se
disponga, llevados por una persona de la asociación o contratada al efecto, que no realice
extracción de moluscos.

h.      La Asociación deberá de disponer de un Reglamento Interno de regulación de la actividad de
extracción.

7.2.2.
Obligaciones Administrativas:

a.       Mantener durante toda
la vigencia del contrato de
pago por servicios ecosistémicos en bosques de mangle una cuenta en
colones en el Banco
Nacional de Costa Rica o en otras
entidades financieras debidamente autorizadas para ello. En esta
cuenta solo serán depositados y mantenidos los recursos derivados
de este contrato.

b.      Mantener durante toda la vigencia del contrato de pago por servicios ecosistémicos en
bosques de mangle, los servicios de un contador autorizado incorporado al Colegio de Contadores
(Privado o Público), este puede ser de planta o por servicios profesionales, quien deberá mantener
la contabilidad actualizada. En caso de contratarse por servicios profesionales, deberá estar al día
con las obligaciones de la CCSS, el Ministerio de Hacienda y FODESAF.

c.      
Facilitar al MINAE, SINAC, FONAFIFO, FUNBAM y al Gestor Biólogo, su asistente
y/o cualquier otra persona autorizada. durante
la vigencia del contrato de
pago por servicios ecosistémicos y seis meses después
de su vencimiento, el acceso

a la información contable de la Asociación, libros contables, conciliaciones bancarias, estados de
cuenta bancarios del periodo correspondiente y estados financieros mensuales 

d.      Enviar al SINAC el listado de los asociados participantes de las actividades de
aprovechamiento de moluscos. Este listado deberá ser presentado una vez al mes durante la vigencia
del contrato de pago por servicios ecosistémicos en bosques de mangle, debidamente firmados por el
presidente de la asociación.  Este informe debe indicar la información de los nuevos ingresos y
salidas de las personas participantes, en el entendido que no se podrán sobrepasar en el número de
personas autorizadas por los permisos de SINAC e INCOPESCA de la determinación inicial, pero sí
podrán ser sustituidos siempre y cuando estos cumplan con los requisitos correspondientes.

e.       Mantener un mecanismo de Registro en la Asociación, con la fotografía, copia de la cédula,
domicilio, número de la cuenta bancaria para realizar los depósitos que correspondan.   De igual
forma deberá elaborar un carné de identificación, para que lo porten durante su presencia en los
manglares, con los detalles como nombre, número de cédula, nombre de la Asociación, nombre del
proyecto, entre otros.

7.2.3.
Obligaciones financieras:

a.      
Mantenerse al día durante toda la vigencia del contrato de pago por servicios
ambientales en bosques de mangle, el pago de las
obligaciones con la CCSS, FODESAF y el impuesto de las personas jurídicas
cuando corresponda.

b.     
Mantenerse al día con las obligaciones tributarias.

c.      
Administrar los recursos
derivados del contrato de pago por servicios ambientales
en bosques de mangle, como un buen padre de familia.

d.      Realizar los desembolsos que correspondan y acordados, a los asociados que han participado
en las actividades relacionadas, debiendo guardar los comprobantes bancarios. Esta obligación deberá
realizarse a más tardar 15 días hábiles desde la recepción de los recursos, salvo situaciones
debidamente justificadas. Este pago deberá ser únicamente por transferencia bancaria y no podrá
realizarse en efectivo.

e.       Gestionar y administrar los recursos destinados a cumplir con las obligaciones comunes,
como, por ejemplo: la delimitación del área asignada, mediante rótulos, boyas, banderines o
cualquier otro mecanismo, propuesto y aprobada por el gestor biólogo o el mantenimiento de los
servicios del contador o del supervisor.

7.2.4.
Otras obligaciones:

a.       Recopilar y analizar las pruebas aportadas por sus asociados, de forma directa o por el
Gestor Biólogo o su asistente, y realizar formal denuncia, por los hechos irregulares o ilegales,
que se lleguen a su conocimiento. Esta denuncia incluye la extracción de moluscos o daños al manglar
y a la biodiversidad, realizados por personas ajenas a la asociación; y deberá ser interpuesta en el
Sistema Integrado de Trámite y Atención de Denuncias Ambientales (SITADA), con copia al contacto
designado por el MINAESINAC e indicado en el contrato, así a más tardar dentro de los 8 días
naturales, posteriores al conocimiento de los hechos, cuando corresponda. 

A criterio del SINAC deberá la Asociación presentar la denuncia penal interpuesta al Ministerio
Público y/o al Tribunal Ambiental Administrativo, según corresponda. La copia de estas denuncias
deberá ser remitida a la Oficina Regional del SINAC, al INCOPESCA   y FONAFIFO, a más tardar 15 días
naturales después de haber sido interpuesta.

b.      Durante la vigencia de este contrato y seis meses después de concluido el contrato de pago
por servicios ecosistémicos en bosques de mangle, deberá elaborar y remitir un informe de
cumplimiento de obligaciones, técnicos, administrativos, financieras y otras, al menos cada tres
meses, o cuando SINAC, MINAE, FONAFIFO e

INCOPESCA,
así la soliciten. Esta obligación debe ser cumplida
a más tardar 15 días hábiles después
de su solicitud.  

Artículo 8.- Valoración de Aspectos Legales.  

Previo a la firma del contrato, el FONAFIFO verificará el cumplimiento de los requisitos previstos
en este Manual.  En el caso de no cumplir con los requisitos indicados, se realizará una prevención
a la Asociación dando un plazo de 15 días hábiles para aclarar o subsanar lo que corresponda.

El SINAC remitirá a FONAFIFO, un comunicado oficial, certificando los Sectores y a la vez las
comunidades que cuentan con los Planes Generales de Manejo de los Manglares y el Plan de
Aprovechamiento.

Cumplidos
los requisitos, se procederá a elaborar
el contrato de pago por servicios ambientales
en bosques de mangle.

Artículo 9.- Aspectos Técnicos.

El cumplimiento de los aspectos técnicos relacionados con las Actividades sujetas a reconocimiento
del presente plan piloto será evaluado por el Gestor biólogo, quien emitirá un reporte asegurando el
cumplimiento de los Protocolos definidos por el SINAC e INCOPESCA, a saber: 

1.Crianza de moluscos. (Anexo x)  

2.  Monitoreos:(Anexo X)

2.1 
Monitoreo ecológico de ecosistemas de manglar.  

2.2 
Monitoreo de moluscos. Guía para la elaboración básica de manglar)

3.  Acciones de Vigilancia.  

4.  Aprovechamiento Sostenible.

Capítulo
III.  De la Ejecución del Contrato

Artículo.10.- Del Contrato. Para formalizar el ingreso
al Programa Piloto de Pago por Servicios Ambientales
y/o Ecosistémicos en Bosques de Mangle, se suscribirá
un contrato entre la Asociación
y el Ministerio de Ambiente
y Energía, donde se establecerán los derechos y obligaciones de las partes.

El plazo del contrato será de un año a partir de su firma y podrá ser prorrogado por un periodo
igual en el tanto existan los recursos económicos suficientes para ello y se hayan cumplido las
obligaciones. Ver Anexo 3

 Artículo 11.- Del Incumplimiento del contrato y del presente Manual.

Las
partes se comprometen a dar pleno cumplimiento a las obligaciones de hacer y no
hacer establecidas en el contrato suscrito y en el presente
Manual. La falta de cumplimiento
faculta a la parte cumpliente
a tomar acciones y a declarar unilateralmente el incumplimiento con responsabilidad;
teniendo como
excepción a lo anterior aquellas
situaciones o circunstancias
de fuerza mayor.  

Artículo 12.- Del
no cumplimiento de las obligaciones.
 

El incumplimiento de las obligaciones
por parte de las Asociaciones
será abordado de la siguiente manera:  

1)      Cuando no se cumplan las condiciones respecto al permiso de uso y/o los permisos de
extracción, evidenciado a través de un reporte del Gestor Biólogo o mediante los procesos de
supervisión ejecutados por el SINAC o INCOPESCA, se elaborará un informe detallado sobre el
incumplimiento detectado. 

2)      Cuando no se cumplan con las otras condiciones previstas en el contrato o en el presente
Manual de Operación del Plan Piloto, evidenciadas ya sea mediante un reporte del Gestor Biólogo o a
través de los procesos de supervisión del SINAC, INCOPESCA o FONAFIFO, se elaborará un informe
detallado que documente el incumplimiento detectado.

3)      El INCOPESCA y el SINAC, a través de la Oficina Regional correspondiente, serán los
responsables de realizar la valoración pertinente cuando concurran las situaciones previstas en el
inciso 1) de este artículo, pudiendo en tales casos determinar las acciones correctivas hasta la
suspensión o revocación del respectivo permiso de uso y/o extracción, en cuyo caso se deberá aplicar
el procedimiento ordinario previsto en los artículos 308 y siguientes de la Ley General de la
Administración Pública, garantizando los principios de Debido Proceso y Legítima Defensa, entre
otros. 

4)      El FONAFIFO, en conjunto con el SINAC, serán los responsables de realizar la valoración de
los hechos cuando concurran los supuestos mencionados en el inciso 2) de este artículo, pudiendo en
tales casos determinar las acciones correctivas hasta la rescisión del contrato de Pago por
Servicios Ambientales y/o Ecosistémicos de bosque de Manglar, en cuyo caso, se deberá aplicar el
procedimiento ordinario previsto en los artículos 308 y siguientes de la Ley General de la
Administración Pública, garantizando los principios de Debido Proceso y Legítima Defensa, entre
otros.

5)      Ante faltas menores o leves al contrato de Pago por Servicios Ambientales y/o Ecosistémicos
de Bosque de Manglar, se realizará el análisis correspondiente y se establecerá un plazo razonable
para su cumplimiento. No obstante, en caso de mantenerse el incumplimiento prevenido, se procederá
según lo dispuesto en los incisos 1) y 2) del presente artículo. 

6)      Ante faltas mayores o graves de cualquiera de los supuestos contemplados en los incisos 1) y
2) del presente artículo, se realizará el análisis correspondiente y se procederá a suspender los
pagos faltantes mediante una resolución razonada. 

7)     
En todos los
casos, si se tratare de incumplimientos focalizados y ejecutados por uno o varios
miembros de una Asociación contemplada en el Plan Piloto, se le comunicará a esta con el fin de
que proceda a la exclusión
de tales personas de la lista de beneficiarios,
en apego a los procesos internos
que al efecto sean establecidos en el Reglamento que establezca la Asociación.
 

8)      Cuando así se determine, ya sea debido a la revocatoria de los permisos otorgados por el
SINAC y/o INCOPESCA, o por la rescisión del contrato de Pago por Servicios Ambientales y/o
Ecosistémicos de bosque de Manglar en virtud de un incumplimiento a las obligaciones previstas en él
o a las contempladas en el presente Manual, la Asociación deberá realizar la devolución parcial o
total de los recursos girados, para lo cual, se podrán pactar arreglos de pago o deducciones
futuras.

Capítulo IV:
Del Seguimiento y Control

Artículo 13.- De
la Competencia.

En virtud de las leyes y reglamentos vigentes, el Convenio Marco de las Naciones Unidas para la
Protección de la Biodiversidad, el Convenio Interinstitucional y de acuerdo con un marco lógico,
este plan piloto de pago por servicios ambientales y/o ecosistémicos en bosques de mangle, serán
ejecutado según la competencia y experiencia de cada órgano público involucrado.

Los procesos de control, supervisión, seguimiento, serán ejecutados por el SINAC con apoyo del
INCOPESCA. Por su parte el trámite de ejecución, suscripción de contrato y seguimiento de
obligaciones administrativas corresponderán a FONAFIFO y con el apoyo financiero para este proyecto
de FUNBAM.

Artículo 14.- Del Expediente Administrativo.

Para cada Asociación será llevado un expediente administrativo único, el cual mantendrá un formato
digital, aunque existan documentos físicos, que serán soportados y custodiados por cada entidad
competente. Este expediente de formato digital estará en línea para todas las entidades involucradas
y se deberá mantener totalmente actualizado por todos los actores públicos y privados.

Existe un deber de coordinación y colaboración de los órganos involucrados en la ejecución del plan
piloto, cualquier situación de conflicto, discrepancias u otras que se presenten deberá ser resuelta
por éstas bajo los principios de colaboración y buena fe, en caso de que subsista la situación será
resuelta en forma definitiva por el MINAE, en cabeza de su jerarca el Ministro de Ambiente y
Energía.

Artículo 15.- Del
Gestor Biólogo

Para garantizar una implementación fluida y transparente de las acciones establecidas en los
contratos y en cada uno de los protocolos correspondientes a las actividades sujetas al
reconocimiento de Pago por Servicios Ambientales y/o Ecosistémicos de bosque de Manglar, se
establecerá una estructura de seguimiento y supervisión, cuyo funcionamiento será asumido con los
recursos del programa, la cual estará integrada por al menos dos profesionales; a saber: un Gestor
Biólogo y un Asistente Biólogo, contratados y pagados por FUNBAM quienes serán el vínculo entre las
asociaciones  beneficiarias,  las autoridades encargadas y los responsables de los bosques de mangle
y la biodiversidad que en ellos se encuentran y su conservación; dando garantía al Estado de la
correcta ejecución de las actividades para la extracción y aprovechamiento sostenible de moluscos en
los sitios priorizados y la restauración del Manglar.  

Sin desmeritar la labor de
control y supervisión que la Ley le concede al
Sistema Nacional de Áreas de Conservación,
el Gestor Biólogo será el
principal responsable frente
al SINAC e INCOPESCA de la correcta implementación de las actividades,
así como de la coordinación interinstitucional
entre las instituciones y las asociaciones;
realizando el monitoreo de
las actividades y documentando
sus resultados, para tomar las acciones correctivas que correspondan. Dicho Gestor contará
con un Asistente Biólogo quien brindará
apoyo al cumplimiento de sus labores.

Artículo 16.- De
la Comisión de Coordinación.

El seguimiento, evaluación y mejora continua del programa de Pago por Servicios Ambientales y/o
Ecosistémicos de bosque de Manglar y cualquier otro ecosistema marino costero que a posteriori se
integre a dicho mecanismo de reconocimiento,  se llevará a cabo por medio de la Comisión técnica
interinstitucional integrada inicialmente  por los órganos y entes competentes citados en el
"CONVENIO MARCO DE COOPERACION PARA EJECUTAR UN PLAN PILOTO PARA EL PAGO DE SERVICIOS AMBIENTALES O
ECOSISTEMICOS EN BOSQUES DE MANGLE"; lo anterior, sin perjuicio de que se incorporen representantes
de otras instancias en caso de que se incluyan otros ecosistemas marino costeros.

Artículo 17.- De los Informes.   

A-   
Informe del
Gestor Biólogo

El Gestor Biólogo elaborará cuatro informes; Tres informes técnicos trimestrales de avance respecto
al cumplimiento de las actividades sujetas a pago, con observaciones y recomendaciones específicas y
generales según corresponda (Ver Anexo 4). El cuarto y último informe incluirá los resultados
finales de los monitoreos y su análisis respectivo. 

Dichos informes deberán detallar las actividades llevadas a cabo por las Asociaciones y sus
miembros, frecuencia de visitas, datos recolectados por los grupos, resultados destacados, puntos de
mejora, y cualquier otro que las Asociaciones consideren. 

B-    Informe de la Asociación

El contenido de los Informe de las Asociaciones participantes será:

-Las listas de los beneficiarios que incluya nombre completo, cédula y fecha de vencimiento del
carné. 

-Informe de los estados financieros contables mensuales y las copias de las transferencias a los
miembros de la Asociación y la aclaración correspondiente en caso de no haber podido realizar el
pago a algún miembro.  

C-    Informes de SINAC e INCOPESCA relativos a los incumplimientos

Los funcionarios del SINAC e INCOPESCA, elaborarán un informe cuando se percaten o sean informados
de situaciones de incumplimiento a los permisos de uso y/o extracción o

cualquiera de las actividades sujetas
al pago del presente Plan Piloto. Los funcionarios elaborarán un informe
detallado sobre los supuestos incumplimientos.

Artículo 18.- De
las Visitas de Control.  

Los órganos públicos participantes en el Plan Piloto para el Pago por Servicios Ambientales y/o
Ecosistémicos de bosque de Manglar deberán ejercer sus acciones de control para supervisar el
cumplimiento de las obligaciones asumidas por las Asociaciones y coadyuvar al éxito del proyecto. En
la medida de lo posible, estas acciones serán previamente coordinadas a efecto de lograr realizar
visitas conjuntas y maximizar los recursos disponibles. 

Capítulo V. De las Actividades Sujetas a Pago por Servicios Ambientales
y/o Ecosistémicos de Mangle

            Artículo 19. Actividades por Desarrollar.

Las actividades que se deberán de realizar para recibir el PSAM, son:

1.       
Crianza de moluscos.

2.       
Monitoreo:

2.1 
Monitoreo ecológico de ecosistemas de manglar.

2.2 
Monitoreo de moluscos.

3.       
Acciones de Vigilancia.

4.       
Aprovechamiento Sostenible.

Las Asociaciones deberán desarrollar las anteriores actividades como un conjunto.  Cada actividad
estará dirigida por el Biólogo Gestor y su Asistente, de acuerdo con el Plan de Trabajo; sin
embargo, es responsabilidad de las organizaciones la ejecución de las actividades y tareas que
permitirán completar cada una de las actividades. 

Artículo 20.-
Crianza de Moluscos.

Las Asociaciones deberán garantizar la creación de viveros en el medio que permitan la reproducción,
el desove y generación de semilla para mantener las generaciones en el tiempo. La ubicación de los
viveros y su correspondiente creación se guiará bajo la supervisión del Gestor Biólogo y la
metodología aprobada por el INCOPESCA. (Ver Anexo 5).

La actividad de crianza de moluscos funcionará como sitio de vivero y monitoreo para la
reproducción, incluyendo: colección - separación- reubicación- registro de tallas, zonas de
extracción, destino (comercialización, vivero o consumo propio), crecimiento y sobrevivencia- y
monitoreo).

Artículo 21.- Actividades de Monitoreo.

Las actividades de monitoreo se basarán en las guías para la evaluación rápida de poblaciones de
piangua del SINAC (2014) y la guía "Generación de la línea base para la elaboración de planes de
manejo de moluscos bivalvos en humedales de manglar y playas lodo arenosas" del SINAC (2018). Los
procedimientos y contenidos se fundamentan en el Decreto Ejecutivo N° 39411-MINAE-MAG, así como el
Protocolo Oficializados PRONAMEC para el  monitoreo de manglares. (Ver Anexo 6) 

Artículo 22.-
Actividad de Vigilancia.

Las Asociaciones deben desarrollar un plan de vigilancia y asumir dichas tareas, como, por ejemplo,
recorridos periódicos por las zonas, para documentar delitos, generar la alerta oportuna y en la
medida de lo posible, la anticipación a la extracción ilegal. Así como informar a las autoridades,
facilitar documentación de anomalías, realizar el reporte en SITADA o al 1192, así como la
Asistencia a Capacitaciones sobre vigilancia.

Artículo 23.- Actividad de Aprovechamiento Sostenible.

Las Asociaciones generarán a través de sus miembros participantes un uso racional de los recursos
autorizados para el aprovechamiento de los moluscos indicados. Estas acciones deberán tener el menor
impacto posible al ecosistema y mantenerse dentro de los límites de extracción permitidos para
asegurar el aprovechamiento en condiciones de sostenibilidad.

Capítulo VI.
De la Emisión y Entrega del Pago por Servicios Ambientales y/o Ecosistémicos de bosque de Manglar

Artículo 24.- Del
Pago.  

Como contraprestación por los servicios brindados por las Asociaciones beneficiarias del Programa de
Pago de Servicios Ambientales y/o Ecosistémicos de bosque de Manglar, el Estado reconocerá un monto
de 2.698,85USD (dos mil seiscientos noventa y ocho dólares con ochenta y cinco centavos, moneda de
curso legal de los Estados Unidos de América) anuales por persona participante en este programa.

Este monto será pagado a la Asociación mediante cuatro desembolsos, respecto del monto señalado en
el párrafo anterior. El primer desembolso del 25% se realizará a partir de la firma del contrato y
cuando se reporte el cumplimento de los requisitos formales establecidos. El segundo desembolso,
correspondiente a un 25%, se realizará transcurridos 3 meses posteriores a la firma del contrato; un
tercer desembolso, correspondiente al 25%, transcurridos 6 meses desde la firma del contrato y el
restante 25%, se realizará transcurridos 9 meses posteriores a la firma del contrato. Cada pago se
realizará previa verificación de cumplimiento de las obligaciones establecidas en el contrato y en
el presente Manual. 

Artículo 25.- Trámite del Primer Desembolso.

Posterior a la firma del contrato, FONAFIFO procederá con la gestión del
primer desembolso a las Asociaciones
participantes, disponiendo de
hasta 10 días naturales
para emitir la respectiva orden de pago; para lo cual, deberá:  

-          Verificar la acreditación de la cuenta bancaria en colones de la Asociación y que ésta
haya cumplido con la presentación del listado de beneficiarios, el plan de vigilancia, el código de
ética, el nombramiento del supervisor interno, los mecanismos para el conteo y reportes, y la
contratación de un contador.

-          Verificar la existencia del reporte de cumplimiento
de los requisitos formales y corroborar el monto a pagar.  

-          Realizar la consulta de morosidad de pago en la CCSS, FODESAF.

Si la información estuviere correcta y completa, FONAFIFO procederá a generar la orden de pago
respectiva, debiendo trasladarla a FUNBAM, la cual dispondrá de hasta 10 días naturales para
realizar el depósito correspondiente. No obstante, si tras la verificación de la información se
detectare inconsistencias, se notificará a la Asociación beneficiaria, otorgándole un plazo de hasta
10 días hábiles para su corrección. De no corregirse la inconsistencia en el tiempo señalado, se
notificará a la Asociación y se anulará la solicitud de pago.

Artículo 26.- Trámite de Pagos Subsiguientes.

De previo a cada uno de los pagos subsiguientes, las Asociaciones remitirán al SINAC la lista de
personas beneficiarias y el documento suscrito por el Gestor Biólogo acerca del cumplimiento de las
actividades objeto de reconocimiento; para lo cual, las Asociaciones deberán enviar dicho listado al
menos 10 días hábiles con antelación a la fecha de pago programada.

Una vez valorada la información por parte del SINAC (punto focal de humedales), este emitirá su
aprobación y solicitará al FONAFIFO continuar con el trámite de pago.

FONAFIFO realizará la verificación contemplada en el artículo anterior en un plazo de hasta 10 días
naturales y emitirá la respectiva orden de pago, debiendo trasladarla a FUNBAM, la cual dispondrá de
hasta 10 días naturales para realizar el depósito correspondiente. En caso de detectarse
inconsistencias en la información verificada, se procederá a notificar a la Asociación para que
subsane lo pertinente, otorgándole para tal efecto un plazo de hasta 10 días hábiles. De no
corregirse la inconsistencia señalada en el tiempo otorgado, se procederá a notificar a la
Asociación y se anulará la solicitud de pago

Artículo 27.-
De la Caducidad de los Pagos.   

Si en un plazo máximo de 6 meses posteriores al momento en que sean exigibles cada uno de los pagos
del contrato de Pago por Servicios Ambientales y/o Ecosistémicos de Mangle, no se realizare el cobro
respectivo, estos caducarán y no serán desembolsados por el FONAFIFO, sin que ello le genere
responsabilidad alguna de su parte. Se exceptúan de esta disposición aquellos casos en que exista
una justificación razonable del motivo que ha atrasado el respectivo desembolso y ello se encuentre
debidamente documentado en el expediente administrativo. La caducidad de los pagos no afectará la
vigencia del contrato.

Artículo 28.- Gastos Administrativos de las Asociaciones beneficiarias.

La asociación beneficiaria, deberá retener el porcentaje de 6,16% del total anual, previsto en el
artículo 24 del presente Manual, el cual utilizará para el cumplimiento de sus obligaciones comunes.

De igual forma la Junta Directiva con activa participación de las personas beneficiarias podrán
acordar mediante reuniones formales, que serán documentadas y firmadas por los participantes, otros
montos a retener, para hacer frente a gastos comunes, como las delimitaciones, rótulos, vigilancia,
transporte, mecanismos de control y reporte u otras obligaciones de los permisos de uso o del
contrato de pago por servicios ambientales.  

Los montos restantes
serán distribuidos entre los beneficiarios, para lo cual deberán realizarse
los desembolsos a más tardar 15 días
hábiles posteriores al depósito realizado en favor de la Asociación; sin
que ello se traduzca en una relación
laboral entre la Asociación
y sus asociados.   

Para todos los efectos la Asociación será la responsable de los recursos entregados
en virtud del contrato de pago por servicios
ambientales o ecosistémicos
en bosques de mangle.

Artículo 29.- De
las fechas de inicio.

Que existe el compromiso con el Gobierno del Reino Unido, de iniciar el proyecto a más tardar el
primero de diciembre del 2024.

Artículo 30.-. De la vigencia
del Manual.

Este
Manual solo será aplicable a la ejecución del Plan Piloto de pago por servicios
ambientales o ecosistémico en bosques de mangle, por lo que solo rige para las
asociaciones y órganos o entidades en él involucradas.

TRANSITORIO
ÚNICO.   

En caso de que alguna de las Asociaciones contempladas en el artículo 5 del presente Manual no
cumplan con los requisitos establecidos, se podrá considerar a otras Asociaciones, previa
verificación de cumplimiento de los requerimientos técnicos y legales.

ANEXO 2
CONSENTIMIENTO PREVIO INFORMADO DE LA ASOCIACIÓN

El abajo firmante (denominado el Usuario) autorizo de manera libre, inequívoca, específica e
informada al Fondo Nacional de Financiamiento Forestal, cédula jurídica 3-007-204724 en adelante
denominado FONAFIFO para que cree, almacene y consulte mis datos personales, sensibles o no, que me
identifican y me hacen identificable ante las diferentes instituciones, buros de créditos, bases de
datos e información pertinente, reconociendo:  a) Que existe una base de datos denominada BASE DE
DATOS FONAFIFO (SICGI-SISUS) SISTEMA DE CONTROL DE GESTION INSTITUCIONAL DE LOS SISTEMAS SUSTANTIVOS
que el FONAFIFO posee para el almacenamiento y tratamiento de datos personales, en virtud de los
servicios públicos presta a sus usuarios.  b) Que la recolección de estos datos personales es con la
finalidad de toma de decisiones en sus funciones y para el seguimiento de los tramites que los
programas del FONAFIFO conlleva, como lo son las solicitudes de ingreso, contratos, seguimientos y
controles de estos. c) Que los datos personales podrán ser usados por el FONAFIFO para efectos del
trámite y aprobación de los servicios, así como la prospección y ofrecimiento de otros productos y
servicios, vía cualquier medio de comunicación.  d) Que los destinatarios de los datos personales,
así como las personas que podrán consultar los mismos serán los profesionales que trabajan
directamente dentro de la estructura del FONAFIFO o por prestadores de servicios externos, todos los
cuales serán obligados a cumplir con las políticas de confidencialidad y protección de datos propias
del FONAFIFO e) Que las respuestas a las preguntas que se formulen al usuario durante el proceso de
recolección de los datos tienen carácter facultativo.  f) Que el tratamiento que el FONAFIFO dará a
los datos personales solicitados será su análisis, para determinar el cumplimiento de requisitos del
usuario para ser parte del Programa de Pago de Servicios Ambientales con fines exclusivamente
internos.  g) Que el usuario tiene derecho de suministrar o no los datos que solicita el FONAFIFO,
por lo que el usuario no está obligado en ningún caso a suministrar información personal, sin
embargo, la consecuencia única de no facilitarnos los datos solicitados en los formularios de
Solicitud de Ingreso, será la imposibilidad del Responsable de realizar las actividad descrita
anteriormente, esto por ser la información solicitada la estrictamente necesaria y no excesiva,
atendiendo de manera estricta al principio de calidad de los datos de la regulación en la materia. 
h) Que en virtud de la Ley N°8968, al usuario le asisten una serie de derechos en relación con la
información personal que brinde al FONAFIFO como lo es el derecho de solicitar la rectificación,
actualización o eliminación de la información brindada, siendo que la información brindada siempre
será propiedad del usuario. i) Que el responsable de la base de datos será el jefe de la Unidad de
Tecnología de Información y Comunicación (Informática) del FONAFIFO, quien se ubica en las oficinas
principales del FONAFIFO. j) El FONAFIFO, con ocasión de y para la efectiva prestación de los
servicios solicitados u ofrecidos, podrá recopilar, comprar, verificar y consultar los datos
personales del usuario, existentes en otras bases de datos suministradas por terceras personas.  k)
El FONAFIFO podrá ceder, transferir e intercambiar los datos personales que obtenga y mantenga en su
base de datos a lo interno y con terceras personas, ubicadas fuera del ámbito interno, que prestan o
prestarán servicios al FONAFIFO, tales como, pero no limitada a: colaboradores, asesores,
acreedores, corresponsales, autoridades regulatorias y de supervisión, autoridades gubernamentales;
centrales de riesgo, agencias de cobro y la Unidad de Inteligencia Financiera del Instituto
Costarricense sobre Drogas; en el entendido que dicha información igualmente no será vendida ni de
cualquier otra manera comercializada, lo anterior con ocasión de y para la efectiva prestación de
los servicios solicitados u ofrecidos por el FONAFIFO.  Autorizo expresamente al FONAFIFO a acceder
o consultar y recopilar los datos de las distintas consultas a sitios web del estado como la Caja
Costarricense del Seguro Social y el Registro Nacional.  En especial mas no limitado a:  i) ii) iii)
Los registros del Tribunal Supremo de Elecciones (en caso de ser nacional), para lo cual se utiliza
la información que dicho ente tiene a disposición del público. 

El servicio Web llamado INTERDATA (si es extranjero), el cual es proporcionado por RACSA mediante un
canal de comunicación seguro entre sus sistemas y los del FONAFIFO; Por medio de la base de datos
del Registro Nacional e instituciones públicas. el Sistema Oficial de Consulta y Validación de la
Identidad de Extranjeros Residentes en Costa Rica de la Dirección General de Migración y Extranjería
y/o el sistema de Verificación de Identidad (VID) del Tribunal Supremo de Elecciones, según
corresponda, con el fin de validar los documentos de identificación que he aportado, y a los cuales
tendrá acceso el FONAFIFO por la lectura de mis datos de identificación y/o lectura de mis huellas
digitales, por lo cual autorizo y relevo al FONAFIFO de cualquier responsabilidad por el uso de
dichos sistemas de identificación.  Por medio de la firma del presente documento otorgo mi
consentimiento informado al FONAFIFO para que mantenga mis datos en su Base de Datos de conformidad
con lo que en el presente me ha sido informado.

CONTRATO DE PAGO POR SERVICIOS AMBIENTALES O
ECOSISTEMICOS EN

BOSQUES DE
MANGLE

CONTRATO NUMERO XX-01-70-XXX-2024

Nosotros, Franz Tattenbach Capra, mayor, casado una
vez, economista, portador de la cédula de identidad número uno- seiscientos
veintidós- trescientos veinticinco, vecino de Escazú, en su carácter de
Ministro de Ambiente y Energía, según Acuerdo número cero cero uno- P del ocho
de mayo de dos mil veintidós, publicado en el Diario Oficial La Gaceta número ochenta
y cinco, Alcance número noventa y uno del diez de mayo del dos mil veintidós,
quien mediante resolución N° R- cuatrocientos uno - dos mil veinticuatro- MINAE
de las diez horas cuarenta minutos del día catorce de octubre del dos mil
veinticuatro, publicada en la Gaceta Número ciento noventa y cinco, del día
dieciocho de octubre del dos mil veinticuatro, ha delegado la firma de los
contratos tramitados por el Fondo Nacional de Financiamiento

Forestal para el Pago de Servicios Ambientales en cualquiera de sus actividades en el señor GILMAR
NAVARRETE CHACÓN, mayor, casado una vez, Ingeniero Forestal, portador de la cédula de identidad
número  uno-ochocientos noventa y seis-ciento cincuenta y cinco, vecino San José, Curridabat, quien
actúa en su condición de Director Ejecutivo del Fondo Nacional de Financiamiento Forestal, cédula
jurídica tres-cero cero siete-dos cero cuatro siete dos cuatro, en adelante denominado "FONAFIFO",
debidamente facultado para este acto  por la Junta Directiva de Fonafifo mediante acuerdo segundo de
la  Sesión extraordinaria número 03-2024, del día 25 de setiembre de 2024, en adelante denominado
"FONAFIFO" y (Nombre completo), mayor, (estado civil), (Profesión u oficio), cédula de identidad
número xxx, vecino de (indicar Provincia, Distrito, Cantón y otras señas), quien comparece en su
condición de xxx con facultades de Apoderado Generalísimo sin límite de suma de la LA ASOCIACION
___________________denominada XXX, cédula jurídica tres-ciento xxxxxx, domiciliada en xxx, según
consta en el Sistema Automatizado de Personas Jurídicas del Registro Nacional, en adelante
denominada "LA BENEFICIARIA" con fundamento en la

Ley número siete mil quinientos setenta y cinco
"Ley Forestal",  el
artículo  62 del  Reglamento Decreto Ejecutivo Número
veinticinco mil setecientos veintiuno-MINAE y sus reformas y el Manual de
Operación del Plan Piloto para Pago de Servicios ambientales y/o Ecosistémicos
en Bosques de Mangle, publicado en el Alcance número _______ de la Gaceta
N°_______________ del año dos mil veinte y su reformas, convenimos en celebrar
el presente contrato, que se regirá en especial por las siguientes cláusulas:

CLÁUSULA PRIMERA: De los Permisos
de SINAC e INCOPESCA

Asimismo, el Instituto Costarricense de Pesca y Acuacultura (INCOPESCA),
autorizó la comercialización de un total de ______________ de miembros de la
BENEFICIARIA, para la comercialización de las especies de _______________
extraídas en el área del permiso otorgado por el SINAC, listado que comprende
el anexo número uno de este contrato.

CLÁUSULA SEGUNDA: Del Objeto del Contrato 
                                                                      El objeto de este contrato es
regular la relación entre la BENFICIARIA y EL MINAE en el cual este segundo reconoce los servicios
ambientales generados por la BENEFICIARIA, a través del cumplimiento de sus obligaciones. En este
acto LA BENEFICIARIA cede al FONAFIFO y al MINAE, los servicios ambientales o ecosistémicos
generados en el cumplimiento de este contrato.

Estos
servicios ambientales se entregarán en tractos anuales y futuros,
contabilizados a partir de la vigencia del presente
contrato, siempre y cuando así lo informe el Profesional Biólogo, al confirmar
que las condiciones del bosque de mangle y las obligaciones acordadas se están
cumpliendo. En virtud de la cesión de servicios ambientales
realizada en este contrato, MINAE y Fonafifo son libres de disponer de la forma
que considere oportuno de los servicios ambientales adquiridos y cedidos,
pudiendo venderlos a terceros tanto a nivel nacional como internacional, sin
que para ello deba comunicar tal acción a LA BENEFICIARIA, quien no podrá
reclamar monto alguno al MINAE y/o al Fonafifo por esta disposición de los
servicios adquiridos. De acuerdo a lo anterior, LA BENEFICIARIA no podrá
bajo ningún concepto, vender o disponer a cualquier título los servicios
ambientales que genera el bosque durante el plazo de
vigencia de este contrato.

  

CLÁUSULA TERCERA: Del plazo

El
plazo del presente contrato es de un año a partir de su firma, de conformidad
con el Manual de Operación del Plan Piloto para Pago de Servicios Ambientales
y/o Ecosistémicos en Bosques de Mangle, pudiendo ser prorrogado por un periodo
igual en el tanto existan los recursos económicos suficientes para ello y se
hayan cumplido las obligaciones.

  

CLÁUSULA CUARTA: Del área de
impacto del proyecto

El
área en la que se desarrollará el proyecto de será de _____ hectáreas y se
identifica en el levantamiento realizado por el Sistema Nacional de Áreas de
Conservación, el cual forma parte de este contrato,
conformando el anexo dos.

  

CLÁUSULA QUINTA: Del precio y forma
de pago  

Fonafifo, como contraprestación por la cesión establecida en este contrato, pagará por los servicios
ambientales adquiridos, una suma anual de 2.698,85USD (dos mil seiscientos noventa y ocho dólares
con ochenta y cinco centavos, moneda de curso legal de los Estados Unidos de América) por cada
hectárea de bosque de mangle comprometida en la actividad de protección. Según lo dispuesto en el
Manual de Operación del Plan Piloto para Pago de Servicios ambientales y/o Ecosistémicos en Bosques
de Mangle, Fonafifo autorizará, y remitirá la orden de desembolso a la Fundación Banco Ambiental
para que esta emita los desembolsos. Este monto será pagado a la Asociación mediante tres tractos,
respecto del monto señalado en el párrafo anterior. El primer desembolso del 25% se realizará a
partir de la firma del contrato y cuando se reporte el cumplimento de los requisitos formales
establecidos. El segundo desembolso, correspondiente a un 25%, se realizará transcurridos 3 meses
posteriores a la firma del contrato; un tercer desembolso, correspondiente al 25%, transcurridos 6
meses desde la firma del contrato y el restante 25%, se realizará transcurridos 9 meses posteriores
a la firma del contrato. Cada pago se realizará previa verificación de cumplimiento de las
obligaciones establecidas en el presente contrato y en el Manual de Operación del Plan Piloto para
Pago de Servicios ambientales y/o Ecosistémicos en Bosques de Mangle, así de los permisos de uso y
comercialización establecidos en la cláusula primera de este contrato.

  

CLÁUSULA SEXTA: De las obligaciones
de LA BENEFICIARIA  

LA BENEFICIARIA se obliga a: A) Cumplir en forma total con las obligaciones establecidas por el
SINAC en el Plan de Aprovechamiento de Moluscos otorgado mediante resolución No._________________ de
fecha_______________________________ y velar por que sus asociados cumplan con las condiciones
plasmadas en el respectivo plan B) Cumplir a cabalidad con las obligaciones establecidas por el
INCOPESCA en el Plan de Extracción emitido mediante resolución No._________________ de
fecha_______________________________ y velar por el cumplimiento de estas por parte de sus
asociados. C) Mantener vigentes las autorizaciones emitidas por el SINAC y el INCOPESCA. D) No
realizar actividades de tala, extracción cualquier otra que dañe o alteren el bosque de manglar y
sus zonas aledañas, salvo las actividades expresamente autorizadas en los permisos respectivos. E)
Realizar las acciones necesarias para proteger el bosque de mangle objeto del permiso de uso, así
como evitar cualquier daño provocado por terceras personas; estas acciones de protección como mínimo
serán: deslinde y delimitación del área de bosque de mangle asignada mediante rótulos, boyas,
banderines o cualquier otro mecanismo, propuesto y aprobado por el gestor biólogo. Así como
supervisión y vigilancia periódica del área sometida, según un plan de vigilancia que deberá ser
propuesto, elaborado y cumplido por LA BENEFICIARIA. F) Coordinar el trabajo con el Gestor Biólogo,
así como acatar e implementar las recomendaciones técnicamente justificadas que hayan sido de
emitidas de manera verbal o escrita tanto por el Gestor Biólogo, como por el personal del MINAE,
SINAC, INCOPESCA o Fonafifo. G) Cumplir y participar en todas las actividades previstas en este
contrato, entre ellas, acciones de vigilancia, procesos de crianza o reproducción, involucramiento
en los procesos de monitoreo de moluscos, monitoreo ecológico del manglar y el aprovechamiento
sostenible de los moluscos. H) Disponer de los mecanismos de registros de extracción diaria, semanal
o mensual, según se disponga, llevados por una persona de la asociación o contratada al efecto, que
no realice extracción de moluscos. I) Disponer de un Reglamento Interno de regulación de la
actividad de extracción. J) Establecimiento y mantenimiento de rótulos según lo dispuesto en el
Manual de Manual de Operación del Plan Piloto para Pago de Servicios ambientales y/o Ecosistémicos
en Bosques de Mangle. K) Cumplir con las acciones de conservación como la extracción solo de los
moluscos del tamaño autorizado, según las herramientas establecidas y aquellas de menor tamaño al
parámetro establecidas, deberán ser remitidas a las áreas de crianza, las cuales serán guiadas y
establecidas por el Gestor Biólogo encargado. L) Denunciar y constituir pruebas (fotos u otros) a
aquellas personas ajenas a la asociación que realicen extracción de moluscos y daños o, alteraciones
al bosque de mangle y la biodiversidad que en ellas se encuentran. Esta denuncia deberá ser
interpuesta en las oficinas del MINAE- SINAC a más tardar dentro de los 8 días naturales posteriores
al conocimiento de los hechos, cuando corresponda. Asimismo, la Asociación presentar la denuncia
penal al Ministerio Público, y la denuncia administrativa ante el SINAC, Tribunal Ambiental
Administrativo, según corresponda. La copia de estas denuncias deberá ser remitida a la Oficina
Regional del SINAC a más tardar 30 días naturales después de haber sido interpuestas. M)Ceder al
MINAE y al Fonafifo los Servicios Ambientales o Ecosistémicos por un periodo igual a la vigencia
objeto de este contrato. N) Cumplir con las obligaciones establecidas en la Ley N° 7575 "Ley
Forestal", el Decreto Ejecutivo N° 25721 "Reglamento a la Ley Forestal" y sus modificaciones, este
contrato y el Manual de Operación del Plan Piloto para Pago de Servicios ambientales y/o
Ecosistémicos en Bosques de Mangle.

O) Cumplir con las obligaciones administrativas y financieras establecidas en el Manual de Operación
del Plan Piloto para Pago de Servicios ambientales y/o Ecosistémicos en Bosques de Mangle pero
especialmente las siguientes: Mantener durante toda la vigencia del contrato de pago por servicios
ecosistémicos en bosques de mangle, los servicios de un contador autorizado incorporado al Colegio
de Contadores (Privado o Público), este puede ser de planta o por servicios profesionales, quien
deberá mantener la contabilidad actualizada. En caso de contratarse por servicios profesionales,
deberá estar al día con las obligaciones de la CCSS, el Ministerio de Hacienda y FODESAF; Facilitar
al MINAE, SINAC, FONAFIFO, FUNBAM y al Gestor Biólogo, su asistente y/o cualquier otra persona
autorizada. durante la vigencia del contrato de pago por servicios ecosistémicos y seis meses
después de su vencimiento, el acceso a la información contable de la Asociación, libros contables,
conciliaciones bancarias, estados de cuenta bancarios del periodo correspondiente y estados
financieros mensuales; entregar recursos y pagos a las personas asociadas por las acciones de
conservación y extracción;  presentar un informe contable mensual y detalle de acciones realizadas
en el área objeto de los permisos otorgados por SINAC. P) Mantener durante toda la vigencia del
contrato una cuenta en colones en el Banco Nacional de Costa Rica o en otras entidades financieras
debidamente autorizadas para ello; en cuya cuenta solo serán depositados y mantenidos los recursos
derivados de este contrato. Q) Estar al día con las obligaciones de la CCSS, FODESAF y el Ministerio
de Hacienda. R) Durante la vigencia de este contrato y seis meses después de concluido el contrato
de pago por servicios ecosistémicos en bosques de mangle, LA BENEFICIARIA deberá elaborar y remitir
un informe de cumplimiento de obligaciones, técnicos, administrativos, financieras y otras, al menos
cada tres meses, o cuando SINAC, MINAE, FONAFIFO e INCOPESCA, así la soliciten. Esta obligación debe
ser cumplida a más tardar 15 días hábiles después de su solicitud.  

 

 

 

 

 

CLÁUSULA
SÉTIMA: De los derechos de las partes LA BENEFICIARIA tiene derecho a:

a.       Distribuir los recursos derivados de este contrato según los términos aprobados por la
Asamblea de Asociados, debidamente firmada.

b.      Recibir los pagos estipulados por la cesión de los
servicios ambientales en el tiempo acordado, siempre y cuando se encuentre al
día en el pago de las obligaciones con la Caja Costarricense de Seguro Social,
Fodesaf y el Ministerio de Hacienda. Asimismo, deberá estar al día con las
obligaciones contraídas con MINAE, Fonafifo y SINAC derivadas en este contrato.

c.       Establecer un porcentaje de
gastos administrativos de la Beneficiaria, el cual no podrá ser superior a
6.16%.

d.      A ser notificado de previo a cualquier visita al área del proyecto.

e.       En caso de un presunto
incumplimiento, tendrá derecho al debido proceso en sede administrativa.

  

MINAE -Fonafifo- SINAC tiene derecho a:

f.       
Exigir el cumplimiento de las
obligaciones contraídas en el presente contrato por LA BENEFICIARIA.

g.      Monitorear y supervisar el área donde se ubique el
bosque de mangle objeto de este contrato.

h.      Supervisar las cuentas y la forma de inversión de los
recursos pagados en virtud de este contrato.

i.       
Que la Beneficiaria le otorgue los
informes técnicos, financieros y administrativos que considere oportuno.

j.       
Suspender los pagos pendientes en
caso de presuntos o comprobados incumplimientos contractuales, o por un aviso del Gestor Biólogo.

 

CLÁUSULA OCTAVA: De la falta

En
la ejecución del contrato podrán darse dos tipos de
faltas: Leves y graves. Las leves serán resueltas por el SINAC en coordinación
con el Profesional Biólogo; las graves serán resueltas por el SINAC, quien
determinará la gravedad de la falta que acarrea el incumplimiento contractual
tomando en cuenta el impacto al bosque de mangle o la biodiversidad que en él
se encuentra, y los criterios técnicos.

 

CLÁUSULA NOVENA: Del incumplimiento

El incumplimiento de los términos y obligaciones del presente contrato generará el derecho a la
parte cumpliente de reclamar el cumplimiento forzoso, o dar por terminado el contrato sin
responsabilidad para sí, pudiendo generar ambas situaciones el pago de los daños y perjuicios
consistentes en la devolución de los recursos económicos y sus intereses cuando corresponda.  Sin
perjuicio de lo anterior, el representante regional de MINAE, SINAC, INCOPESCA o  Fonafifo, cuando
detecte alguna situación anómala o algún presunto incumplimiento, procederá a comunicarse con LA
BENEFICIARIA y el Gestor Biólogo, con el fin de aclarar los hechos y llegar a un acuerdo, a efecto
de continuar con el contrato, acatando las disposiciones técnicas y administrativas que se giren al
respecto.

Si se evidenciara la existencia de presuntas faltas graves que acarreen un incumplimiento
contractual, Fonafifo establecerá un procedimiento administrativo ordinario según lo dispone la Ley
General de la Administración Pública, a fin de establecer la verdad real y declarar el
incumplimiento. Fonafifo, suspenderá los desembolsos pendientes de pago, hasta tanto se emita el
acto final en el cual se declare o no el incumplimiento. 

Sin
perjuicio de lo establecido en esta cláusula, en el trascurso del procedimiento
administrativo por presunto incumplimiento LA BENEFICIARIA podrá proponer al
MINAE un plan reparador, el cual será valorado por Fonafifo y de aceptarse se
realizarán los ajustes respectivos a este contrato.

 

CLÁUSULA DÉCIMA: De la devolución
de recursos, pago de intereses y otros

En
caso de incumplimiento comprobado, cuando corresponda la devolución de
recursos, estos serán realizados por LA BENEFICIARIA reconociendo al MINAE-
Fonafifo el pago de intereses corrientes a partir de la verificación del
incumplimiento, los cuales corresponderán a la tasa básica más tres puntos y
como interés moratorio una tasa del uno por ciento mensual. En los casos en que
LA BENEFICIARIA deba realizar devoluciones no derivadas de incumplimiento
contractual, el monto será devuelto al Fonafifo sin intereses corrientes, pero
si se cobrarán intereses moratorios en un porcentaje del uno por ciento mensual
a partir de la mora. En ambos casos, MINAE- Fonafifo y LA BENEFICIARIA podrán
acordar arreglos de pago cuyas condiciones deberán ser adecuadas y convenientes
al Fonafifo.

En caso de un incumplimiento el MINAE Fonafifo podrá reconocer en la
liquidación respectiva las acciones ejecutadas en que haya habido cumplimiento
del contrato.

 

CLÁUSULA DÉCIMA PRIMERA: De la no
ejecución de los pagos.

Si
en un plazo máximo de 6 meses posteriores al momento en que sean exigibles cada
uno de los pagos del contrato de Pago por Servicios Ambientales y/o
Ecosistémicos de Mangle, no se realizare el cobro respectivo, estos caducarán y
no serán desembolsados por el Fonafifo, sin que ello le genere responsabilidad
alguna de su parte. Se exceptúan de esta disposición aquellos casos en que
exista una justificación razonable del motivo que ha
atrasado el respectivo desembolso y ello se encuentre debidamente documentado
en el expediente administrativo. La caducidad de los pagos no afectará la
vigencia del contrato.

 

CLAUSULA DECIMA SEGUNDA: De las
comunicaciones oficiales y del domicilio

Es deber de las partes informar cualquier cambio en estos domicilios y medios para recibir
notificaciones. En caso de que estos cambios se den, bastará una comunicación formal por escrito y
no requiere la modificación del contrato; no obstante, en caso de que se varíe el domicilio o el
medio de notificaciones y no se informe a la contraparte, ésta realizará válidamente cualquier

CLÁUSULA DÉCIMA TERCERA: Criterios
de interpretación  

Las
partes establecen que el presente contrato será interpretado bajo los
principios de buena fe y colaboración mutua, en todo
caso, esta interpretación tendrá como finalidad que se pueda realizar el
cumplimiento del objeto contractual pactado.

Para todos los casos el presente contrato se regirá por la legislación costarricense en general y en
específico por La Ley Forestal N° 7575, Decreto Ejecutivo N° 25721-MINAE de 17 de octubre de 1996 y
sus reformas, el Manual de Operación del Plan Piloto para Pago de Servicios ambientales y/o
Ecosistémicos en Bosques de Mangle, publicado en el Diario Oficial La Gaceta N° xxx Alcance xxx del
xxx de xxx del 2024, así como otras disposiciones emitidas por el Poder Ejecutivo. La jurisdicción
aplicable será los Tribunales de Justicia de Costa Rica.

ANEXO 5
METODOLOGÍA DE CRIANZA DE MOLUSCOS

1.     
Construcción, manejo y mantenimiento de viveros

  

Los viveros consistirán en áreas 300 m2, separados en doce
parcelas de 25m2 cada una, con una capacidad máxima
de 2500 individuos. Al separarlo
en 12 parcelas los organismos reubicados podrán ser sembrados de forma escalonada durante
un año, y así se podrá tener ciclos
de siembra y cosechas anuales.

Mediante el monitoreo se evaluará la efectividad de las actividades de reubicación y crianza
realizadas por los molusqueros. Estos consisten en el registro de información continua de la
actividad de extracción, las especies extraídas, su talla, zonas de extracción, destino
(comercialización o vivero), crecimiento y sobrevivencia.

1.1. Diseño de viveros:

Según la especie que se extraiga se deben seleccionar sitios para los viveros con características
similares a los lugares de pesca natural. La delimitación de los viveros debe ajustarse según los
requerimientos de las especies que se desean reubicar, es decir, si habitan en barro o bancos de
arena, cercanos a la zona de pleamar o bajamar, y que sea congruente con las zonas de reproducción
delimitadas en los Planes de Aprovechamiento y el Plan General de Manejo al cual están ligadas las
autorizaciones de los molusqueros beneficiados.

a. Materiales para construcción del vivero:

1.     
Delimitar un área
de 15x20 m (300 m2), la cual se debe de dividir en cuadrantes de 5 m x 5 m (25 m2),
teniendo un total de 12 parcelas
(Figura 3). Figura 3.

2.     
Marcar la ubicación de las parcelas
con cinta flagging, y registrar las coordenadas con el GPS, esta información
deberá ser manejada por el SINAC e Incopesca.

3.     
Se utilizará una siembra de 100
individuos por metro cuadrado, en total 2500 individuos/parcela de 25 m2.
 

4.     
Los organismos se deben agrupar por
especies y tres rangos de tallas:  

a.      
Rango 1 menores o iguales a 10mm hasta los 25mm,  

b.     
Rango 2 de 25mm hasta los 35mm

c.      
Rango 3 de los 35mm hasta los 47mm

5.     
Siguiendo estos rangos de tallas,
colocar los individuos en las bolsas de malla. Las bolsas de malla deberán ser
de 90 cm x 60 cm, elaboradas con abertura similar a la red sardinera, y
contener un cordón para el cierre de la bolsa (Figura
4).

Las bolsas deberán ser amarradas a
las raíces o ancladas en las parcelas, esto para evitar que se muevan debido a
la marea, e incluso como seguridad contra robo.
Procurar colocar las bolsas durante marea creciente o
marea alta, para evitar la depredación por otros organismos.

7.      Dentro de las bolsas se pueden colocar botellas, retazos de malla, o algún otro material
para ofrecer un sustrato a la semilla para fijarse, y para simular las condiciones que las raíces
del manglar ofrecen durante condiciones normales. Si se utilizan botellas plásticas, se recomienda
recortar las botellas de forma transversal.

Cada parcela en
el vivero representa un mes de extracción, con una
capacidad máxima de 2500 moluscos por parcela. Es decir, una vez se llegue a
recolectar los 2500 individuos de esa parcela, no se podrán reubicar más
organismos durante ese mes para no superar la
capacidad máxima del vivero.

2.  Extracción, recolección de moluscos
y Reubicación

2.1. 
Extracción

Al ser este un proyecto piloto, el proceso de extracción, selección
y reubicación de moluscos se realizará de dos maneras para determinar el método
con mejor control y mayor efectividad:

a.       Se reubicarán 1250 individuos recolectados por medio de giras organizadas entre los
molusqueros y las autoridades, individuos menores a la talla legal de primera captura (TLPC). Se
recolectarán de sitios identificados por los molusqueros, conocidos por ellos como bancos de
individuos juveniles donde no se observa un adecuado crecimiento de los mismos.

b.     
Se reubicarán otros 1250 individuos
recolectados durante las faenas de extracción de los
molusqueros autorizados por el Incopesca. Es decir, que del recurso que extraen
regularmente, aquel que cumple con TLCP podrá ser comercializado, según la
normativa vigente y de acuerdo a las disposiciones de su autorización de
extracción. Y los organismos que no alcance la TLPC se podrán reubicar en los
viveros autorizados.

2.2. 
Selección y reubicación de los moluscos

La selección de
los moluscos se deberá hacer con ayuda de un
pianguimetro o algún dispositivo de medición que facilite la separación de
moluscos con la TLPC, de aquellos menores a la TLPC.  

Los molusqueros
deberán hacer un muestreo de los organismos que serán destinados a los viveros,
este consistirá en el registro de información de la colecta realizada, y la
medición de al menos 30 individuos por especie a colocar en cada una de las
bolsas de malla. Para ello, deberán:

a.      
Medir la longitud total de los 30
organismos, para determinar la talla promedio de siembra en cada bolsa.

b.     
Identificar con un
sistema de numeración cada bolsa (ejemplo: V1P1B1), para poder llevar un
control del crecimiento y una trazabilidad de los organismos recolectados y
reubicados en el vivero.  

c.      
Completar un
registro de aportaciones de los organismos extraídos, con la información
indicada en el Formulario para Registro de Reubicación de Moluscos suministrado
por el Incopesca.  

Si durante la colecta no se alcanza a recolectar al menos 30
organismos, se deberá medir todo el producto destinado para su reubicación.

Para la
reubicación de los moluscos, únicamente se podrán utilizar aquellos viveros
autorizados por SINAC e INCOPESCA para este proyecto.  

3.  Monitoreo del crecimiento, cuido y
cosecha

3.1. 
Monitoreo del crecimiento y ajuste de densidad por bolsa

Durante el cuido
en vivero, se deberá llevar un control de crecimiento
de los organismos con muestreos mensuales. El muestreo consiste en:

a.      
Cada mes deberá registrar la
longitud total de al menos 30 individuos de cada bolsa, para determinar el
crecimiento promedio de cada bolsa en cada parcela.

b.     
Contabilizar el total de organismos
por bolsa, para llevar un control de la supervivencia
de los individuos dentro de las bolsas.

c.      
Realizar un proceso de
mantenimiento: Limpieza de las bolsas y los organismos en caso de observar
crustáceos u otros organismos adheridos, revisar y mantener el buen estado de
las bolsas, el sistema de etiquetado de cada una, el sistema de amarre o
anclaje, y el marcaje de las parcelas.

d.     
Cada 8 meses, se deberá realizar un
desdoble, es decir, se deberá de ajustar las densidades de los organismos
dentro de cada bolsa, de acuerdo a su talla, y el tiempo transcurrido en las
bolsas (Cuadro 1). Es decir, que una vez los organismos tengan tallas entre
25mm y 35mm, no podrán haber más de 500 individuos por bolsa, y cuando tengan
tallas de entre 35 mm y 47mm deberán colocarse no más de 200 individuos por
bolsa.

e.      
Para llevar registro del monitoreo deberán de completar el formulario de
Monitoreo de Crecimiento.

3.2. 
Cosecha  

Una vez que los organismos superen la TLPC, podrán ser comercializados de la forma tradicional. Si
después de 22 meses de haberse reubicado en los viveros, los organismos no alcanzan la TLPC, estos
podrán ser consumidos por los miembros del grupo asociado al proyecto, más no podrán ser utilizados
para su comercialización, ni devueltos al ecosistema.

  

4.  Control, datos de muestreo e
informes

4.1. 
Control de información y supervisión

  

4.1.1.  Entrega de datos de muestreo

Es
responsabilidad de los molusqueros entregar al Incopesca de forma mensual
información de cantidad y venta del producto extraído, dispuesto así en el
acuerdo de junta directiva como condición para que puedan mantener la
autorización de extracción, y para que la autoridad lleve registros
estadísticos de extracción y comercialización.  

Las
organizaciones que participen dentro de los proyectos de monitoreo y engorde
deberán adjuntar a la información entregada al Incopesca: los formularios para
Registro de Reubicación de Moluscos, y los formularios para Monitoreo de
Crecimiento descritos anteriormente.

  

4.1.2.  Supervisión

Toda la actividad estará supervisada por el gestor biólogo del proyecto,
procurando el buen manejo y funcionamiento de los viveros de moluscos, según la
normativa vigente, el plan de aprovechamiento ligado a las autorizaciones, y a
las disposiciones indicadas por el SINAC e

Incopesca para manejo de los viveros descritas en este documento.  

  

4.2. 
Métodos de control:

  

a.      
Coordinación: La coordinación del proyecto piloto deberá hacerse de forma conjunta entre
el SINAC y el INCOPESCA

b.     
Reportes: Los reportes se
realizarán mediante el informe mensual que deberá presentar el regente al
SINAC-INCOPESCA, y con la entrega de los formularios "Registro de

Reubicación de Moluscos", y "Monitoreo de
Crecimiento"  

  

5.  Actividades e Indicadores de
Efectividad

  

5.1. Descripción de la actividad:  

En el cuadro 2, se detallan las principales actividades que los
molusqueros deben realizar para el cumplimiento del
presente proyecto piloto, para un periodo de 12 meses.

23 horas mensuales por persona y se requieren 5 personas al mes es igual a 115 horas de pago mensual
por 22 meses.

4.2. Indicadores de Efectividad

No hay
indicadores de efectividad base, ni se pueden definir
valores o márgenes de tolerancia hasta no tener la primera toma de información
del presente proyecto piloto. Sin embargo, los indicadores que se obtendrán con
el monitoreo descrito anteriormente serán los siguientes:

Indicador de crecimiento:
Mediciones del largo total mensuales hasta llegar a la talla TLPC (Cuadro 3).

ANEXO 6
METODOLOGÍA DE MONITOREO

1- Monitoreo Moluscos:

La extracción de los moluscos de cada parcela se realizará con los molusqueros quienes conocen en
detalle la zona y son experimentados.   Los molusqueros participantes en el muestreo serán
instruidos previamente. Se desarrollará un proceso participativo presencial con grupos de los
molusqueros SINAC e INCOPESCA, para dar la inducción, capacitar, marcaje de parcelas, toma de datos
y posterior análisis, y socialización. 

Para esta Actividad se requiere de dos tipos de Monitoreo:

a- Datos biológicos b- Evaluación del estado de la población
de moluscos por sectores, anual.

 

a- Monitoreo de Datos
Biológicos Moluscos.

Para generar información sobre la biología de los moluscos comerciales del manglar se tomarán datos
para los indicadores que generarán registros que al momento son un vacío de información científica.
Monitoreo de los diferentes indicadores información para generación de conocimiento de las especies.

Se tomarán 2 transectos
y 6 parcelas de 5m x 5m, cada
transecto costa de 3 parcelas.
Se establecerán subgrupos
de trabajo, para la toma de
datos de los diferentes indicadores.

Los moluscos de cada parcela o cuadrante se colocarán en bolsas
diferentes y etiquetadas
con el número o código asignado a los transectos y parcelas. Asimismo, se colocará en cada bolsa
una etiqueta con la información adicional requerida.  

De cada unidad muestral se extraerán todos los moluscos encontrados sin importar el tamaño de estos.
Terminada la jornada de extracción, se procederá con el traslado de los moluscos hasta un lugar
adecuado para mediciones. 

Cada individuo se pesará y se medirá en su largo y ancho, se anotan los datos de cada uno en el
formato aportado por el SINAC-INCOPESCA.  El análisis de los datos de las colectas corresponderá al
Regente procesar la información, sistematizarla en un informe y presentarlo a los grupos de
molusqueros y a las Instituciones. 3 salidas por mes formando equipos, 4 equipos por cada grupo.

INDICADORES:

Para el monitoreo de Datos Biológicos de moluscos, los indicadores
son los siguientes:

i.

b- Evaluación del estado de la población de moluscos por sectores

Se parte de la línea base del Plan de Aprovechamiento
del 2022 de Moluscos del ACT y se requiere
para conocer las proporciones
de las poblaciones

La evaluación del recurso
se realizará de conformidad
con la guía para la evaluación
rápida de poblaciones de piangua del SINAC (2014) y la guía
"Generación de la línea
base para la elaboración de planes de manejo de moluscos bivalvos en humedales
de manglar y playas lodo arenosas" del SINAC (2018). Los procedimientos
y contenidos se fundamentan
en el Decreto Ejecutivo N° 39411-MINAE-MAG.

El muestreo y medición de parámetros morfométricos de pianguas, almejas y mejillones se realizará
mediante visitas de campo; se establecerán entre 9 y 15 parcelas por sector en transectos con 3
parcelas cada uno, dependiendo de las condiciones del manglar, playa y substrato. 

En total se muestrean transectos
y sus parcelas de 5m X 5m para
piangua y mejillón navaja, y 1 m X 1 m para almejas almejones y choras.  

Los moluscos de cada parcela o cuadrante se colocarán en bolsas
diferentes y etiquetadas
con el número o código asignado a los transectos y parcelas. Asimismo, se colocará en cada bolsa
una etiqueta con la información adicional requerida.  

De cada unidad muestral se extraerán todos los moluscos encontrados sin importar el tamaño de estos.
Terminada la jornada de extracción, se procederá con el traslado de los moluscos hasta un lugar
adecuado para mediciones. 

Cada individuo
se pesará y se medirá en su largo y ancho, se anotan los datos
de cada uno en el formato aportado
por el SINAC-INCOPESCA.

El análisis de los datos de las colectas corresponderá al Regente procesar la información,
sistematizarla en un informe y presentarlo a los grupos de molusqueros y a las Instituciones.

INDICADOR:

El Indicador utilizado para este
objetivo será:

i.  Estado de la Población, (el peso
total de los organismos por unidad de área
o volumen), De cada parcela en todos
los sectores de todos los individuos
colectados. 2-Monitoreo Ecológico Manglares.

El SINAC cuenta con un Protocolo Ecológico para el Monitoreo de Manglares (SINACUNA, 2020). Para los
manglares se cuenta con veintitrés indicadores que servirán para evaluar el estado de este elemento
focal de manejo. Sin embargo, para este Proyecto Piloto se propone aplicar los Indicadores que se
enlistan abajo.

Considerando como una condición ideal la ubicación de entre 8 y 10 parcelas permanentes por cada 100
hectáreas de Manglar, se propone para efectos de este proyecto, la delimitación de dos transectos
lineales en dirección perpendicular a los gradientes fisicoquímicos, sobre los cuales se ubicarán
convenientemente distribuidas parcelas de 10 x 10 m y cada transecto con tres parcelas de 10m x 10m.
Tanto el transecto como las parcelas serán georeferenciadas.

De cada parcela se hará el registro de información según los indicadores seleccionados y cuya
descripción metodológica se encuentra en el documento "Protocolo Ecológico para el Monitoreo de
Manglares":

INDICADORES DE MONITOREO ECOLOGICO
DE ECOSISTEMAS DE MANGLAR

1.     
Indicador 5. Estimación de Área Basal (Ver detalle metodológico en SINAC-UNA, 2020).

i.              
Especies presentes. Cada individuo será identificado por una placa
de aluminio previamente numerado (codificada).

ii.           
Medición del diámetro a la altura del pecho de todas las especies mayores a 2,5 cm.

especies de gasterópodos de los géneros Littoraria, Cerithidea y Thaisella encontrados en ellos,
tanto en el suelo como en raíces y troncos (Ashton et al. 2003; Irma & Sofyatuddin, 2012). La
identificación en campo se puede realizar con la guía de Cruz & Jiménez (1994), en caso de que las

                        Pilot Recognition Operating Manual for the payment for environmental
or ecosystem services in Mangrove Forests

OF ENVIRONMENT AND ENERGY. San José at 5 p.m. on the eighth of November,
two thousand twenty-four.

WHEREAS

FIRST:
That by Executive Decree No. 44558-MINAE of July 12, 2024,
published in Supplement No. 130 to La Gaceta No. 134 of July 22, 2024, which
amends Article 62 of the Regulations to the Forest Law, Executive Decree No.
25721-MINAE of October 17, 1996, the execution of plans and
projects for payment for environmental or ecosystem services is authorized as mechanisms
for recognition of the actions carried out by organized rural communities
that carry out sustainable exploitation duly authorized by the National
System of Conservation Areas. These actions include sustainable
harvesting of mollusks, rearing, monitoring, surveillance actions, and
sustainable harvesting.

SECOND:
That the sole transitory provision of said Article 62 provides that the Ministry of
Environment and Energy has 2 months from its publication to issue the
Regulation to establish the Operating Manual for the recognition of
Environmental Services in Mangrove Forests.

THIRD:
To implement this mechanism, a Cooperation Agreement dated
September 13, 2024, is implemented between the Ministry of Environment and Energy, The
National System of Conservation Areas, the National Forest Financing
Fund, the Costa Rican Institute of Fisheries and Aquaculture, and the Environmental Bank
Foundation, the latter channeling financial resources for the pilot
plan, for joint and collaborative work, each in its field of
competence.

CONSIDERING:

FIRST:
That the working commission established by officials of the entities
indicated, has worked on preparing the Operating Manual for the recognition of
Environmental or Ecosystem Services in Mangrove
Forests.

SECOND: That the representatives of the entities that make up the Cooperation Agreement,
recommend to the Minister the issuance and publication of the Operating Manual for the Recognition of
payment for environmental or ecosystem services in Mangrove Forests.

Therefore;

THE MINISTER OF ENVIRONMENT
AND ENERGY

RESOLVES:

FIRST:
To issue and authorize the following Pilot Recognition Operating Manual
for the payment for environmental or ecosystem services
in Mangrove Forests.

SECOND: It shall take effect upon
its publication.

MANUAL OF THE PILOT PLAN FOR:

PAYMENT FOR ENVIRONMENTAL AND/OR ECOSYSTEM SERVICES IN
MANGROVE FORESTS

FIRST: That by Executive Decree No. 44558-MINAE of July 12, 2024, published in
Supplement No. 130 to La Gaceta No. 134 of July 22, 2024, Article 62 was incorporated into the
Regulations to the Forest Law, Executive Decree No. 25721-MINAE of October 17, 1996, authorizing
the execution of plans or projects for payment for environmental or ecosystem services as
mechanisms for recognition of the actions carried out by organized rural communities that
carry out sustainable exploitation duly authorized by the National System of
Conservation Areas.

To comply with this process, the cited regulation establishes that the payment for environmental
services mechanism must be executed jointly, collaboratively, and in coordination among the Ministry of
Environment and Energy, the National System of Conservation Areas, the National Forest
Financing Fund, and the Costa Rican Institute of Fisheries and Aquaculture, through the Cooperation
Agreement called "FRAMEWORK COOPERATION AGREEMENT TO EXECUTE A PILOT PLAN FOR THE PAYMENT OF
ENVIRONMENTAL OR ECOSYSTEM SERVICES IN MANGROVE FORESTS," where the roles of each
party are established.

SECOND: That, through the Cooperation Agreement, subscribed between the Ministry of Environment and
Energy, the National System of Conservation Areas, the National Forest Financing Fund,
the Costa Rican Institute of Fisheries and Aquaculture, and the Environmental Bank Foundation, digitally signed,
pursuant to the provisions of the law on certificates, digital signatures, and electronic documents
(Law 8454) and its Regulations (Executive Decree No. 33018-MICIT), with the time and
date stated in each signature, which took place between August 23, 2024, and September 13, 2024, a
mechanism for joint cooperation is established according to the corresponding competences, to initiate
the payment mechanism for ecosystem services in mangrove forests.

THIRD: That, on May 19, 2023, the Environmental Bank Foundation entered into an Agreement with
the organization The Earthshot of the United Kingdom, which provides financial resources to initiate
a pilot project for payment to rural populations that carry out sustainable harvesting of
mollusks and other actions in mangrove forests in the Gulf of Nicoya. The details of the pilot plan, as well as the breakdown of expenses that its execution entails, were presented to this
organization, and it expressed its conformity with the proposed plan by email.

            FOURTH: That the sole transitory provision of Decree 44558-MINAE of July 12, 2024,
indicates that the Ministry of Environment and Energy shall have two months from the publication of the
decree to establish the Operating Manual for the recognition of Environmental or
ecosystem services in mangrove forests.

            FIFTH: That the Commission established in Clause Eight of the Cooperation Agreement,
recommends the draft Operating Manual, necessary for the fulfillment of the established
objectives, which is accepted by all the bodies, entities involved in the process of
establishment and execution of the mechanism.

            SIXTH: That Costa Rica is a country recognized for its environmental leadership, its conservation
efforts, the recovery of its national forest cover (cobertura forestal), the protection of its
biodiversity, and more recently for its commitment to the protection of marine and coastal
resources. The latter represent an important source of resources for the country; therefore, their
conservation is a priority.

SEVENTH: That the conservation of marine and coastal resources imposes the need for a
differentiated political-normative development and institutional action, which guarantees their adequate
management and as a starting point, a Pilot Plan has been formulated for the recognition of payment for
environmental or ecosystem services in mangrove forests by the rural communities that are
permit holders for the extraction of mollusks, by virtue of the actions established in
Article 62 of the Regulations to the Forest Law, Executive Decree No. 25721-MINAE of October 17,
1996.

EIGHTH: That in accordance with Article 28 of the General Law of Public Administration No. 6727
of May 2, 1978, it is the authority of the Minister to prepare and present to the President of the Republic
the draft laws, decrees, agreements, resolutions, orders, and other acts that must be signed
jointly relating to the matters attributed to their Ministry, therefore having the authority to
regulate how the indicated pilot plan will be executed, with all the technical, legal,
administrative, and financial elements.

            NINTH: That the Pilot Plan, established by the Ministry of Environment and Energy, through
its collaborating bodies and entities, determined that the Pilot Plan for payment for
environmental or ecosystem services in Mangrove Forests, has as a basis some pre-established
starting assumptions, among these are those mangrove forests that have the
respective General Management Plan (Plan General de Manejo, PGM), the Mollusk Harvesting Plan (Plan de Aprovechamiento de Moluscos), issued by the
National System of Conservation Areas, as well as the associations of coastal populations that
have the corresponding use permits, in addition to the commercialization permits from the
Costa Rican Institute of Fisheries and Aquaculture, which were established to
initiate the execution of the pilot plan for the recognition of payment for the ecosystem services
provided in mangrove forests, which is why this manual omits the initial selection process
for participating community associations.

TENTH: That six mollusk-gatherer associations participate in the pilot project for the recognition of environmental or ecosystem services in mangrove forests, representing approximately 157 people, and they already have the Use Permit for Mollusk Extraction from the National System of Conservation Areas, and the Commercialization Permit from the Costa Rican Institute of Fisheries and Aquaculture, according to the provisions of the Wildlife Conservation Law No. 7117, the Forest Law No. 7575, the Biodiversity Law No. 7888, the Fisheries and Aquaculture Law No. 8436, as well as Decrees No. 39411-MINAE-MAG of September 2, 2015 and No. 40023-MINAEMAG of October 3, 2016; the cited associations that are beneficiaries of this program do not have to meet new or additional requirements.

ELEVENTH: That the pilot project for the recognition of environmental or ecosystem services in mangrove forests is located in the mangroves situated in the Gulf of Nicoya, Guanacaste Province, therefore this Operating Manual only covers this population and this area of the country, without having the scope of a general norm for the rest of the population.

            TWELFTH: That, in accordance with the Regulations to the Law for the Protection of the Citizen from Excess Administrative Requirements and Procedures, Executive Decree No. 37045-MP-MEIC of February 22, 2012, and its amendments, it was determined that this proposal does not establish or modify new procedures, requirements, or processes that the administered party must comply with, a situation for which the prior control procedure was not carried out.

            THEREFORE,

The following operating manual for the recognition of environmental and/or ecosystem services in mangrove forests in its pilot version is issued according to the following clauses:

TITLE I

OF THE PAYMENT FOR ENVIRONMENTAL AND/OR ECOSYSTEM SERVICES IN MANGROVE FORESTS

Chapter I.
Of Acronyms and Definitions

Article 1.- Acronyms.

In this manual, the following acronyms with their respective meaning shall be used:

ACT: Tempisque Conservation Area

ASP: Protected Wild Area

CCSS: Costa Rican Social Security Fund.

DAJ: Legal Affairs Directorate.

Fodesaf: Family Allowances Development Fund.

Fonafifo: National Forest Financing Fund.

FUNBAM: Environmental Bank Foundation

GPS: English acronym related to the Global Positioning System.

IBAN: English acronym (International Bank Account Number), a standardized structure that identifies fund accounts, both nationally and internationally.

INCOPESCA: Costa Rican Institute of Fisheries and Aquaculture

MINAE: Ministry of Environment and Energy.

PAM: Mollusk Harvesting Plan

PGM: General Management Plan

PNE: State Natural Heritage

PSAM: Payment for Environmental and/or Ecosystem Services of Mangrove.

SIG: Geographic Information System.

SINAC: National System of Conservation Areas.

Article 2.- Definitions.

For the purposes of this manual, the following is considered:

Activity: Action related to the Protection of Mangrove Forest, Protection of Water Resources, Protection of Biodiversity, or a combination thereof.

Association: Mollusk-gatherer associations located in the Gulf of Nicoya, identified as beneficiaries of the Pilot Plan.

Harvesting (Aprovechamiento): The action of cultivation, repopulation, and rational extraction of aquatic resources, which generates or may generate some benefit, advantage, utility, or profit for the person who performs it or for whom they represent, as long as it does not affect the health of the populations and their ecosystem services.

Mangrove Forest: Wetland of the estuarine system, normally growing adjacent to the intertidal zone and which have developed special adaptations to survive in this environment.

Contract: Pact or agreement, oral or written, between parties who obligate themselves on a specific matter or thing, and to whose fulfillment they can be compelled.

EARTH SHOT PRIZE: Global environmental prize awarded to Costa Rica in the year 2021, from which the resources for the pilot financing come.

Manager (Gestor): Professional Biologist or specialist, primarily responsible for supervision, responsible for the execution of the pilot plan with the beneficiary associations.

Assistant Manager (Gestor Asistente): Technician in biology who will assist the Manager in their functions.

Wetland: Ecosystems dependent on aquatic regimes, natural or artificial, permanent or temporary, lentic or lotic, fresh, brackish, or saline, including marine extensions up to the posterior limit of marine phanerogams or coral reefs or, in their absence, up to six meters deep at low tide.

Report: Document prepared digitally by the Manager, with the conditions of the resource that substantiates the execution of the PSA Mangroves project, in the activities foreseen in the contract.

Forest Law: Law No. 7575 "Forest Law" of February 13, 1996, published in Supplement No. 21 to La Gaceta No. 72 of April 16, 1996.

Mollusks: group of soft-bodied invertebrates of the Phylum Mollusca.

Payment for Environmental and/or Ecosystem Services of Mangrove Forest (PSAM): Financial recognition by the State to persons dedicated to the extraction of mollusks registered in organized groups, for the services they provide to the ecosystems and that directly impact their protection and improvement.

State Natural Heritage (Patrimonio Natural del Estado, PNE): Forests and forest lands of national reserves, areas declared inalienable, farms registered in its name, and those belonging to municipalities, autonomous institutions, and other Public Administration bodies, except for properties that guarantee credit operations with the National Banking System and become part of its patrimony.

Beneficiary persons: Natural persons who are members of the associations, have a valid use permit and harvesting card, and participate in the activities of the Pilot Plan.

Application for Admission to the PSAM: Form to request admission to the PSAM, which contains the qualifications of the applicant persons.

Chapter II. Of the Admission Requirements

Article 3.- Application for initiation.

The associations will coordinate with the Biologist Manager the submission of the initiation form in which the documentation corresponding to the requirements established in this manual for participation in the Pilot Plan is indicated and attached.

This application must be delivered at the Regional Office of the Tempisque Conservation Area (ACT), located in Nicoya, Guanacaste. See Annex 1

Article 4.- Sectors or Zones of Mangrove Forest and Associations included in the Pilot Plan.

For the purposes of this project, the sectors were selected in accordance with the provisions of the "Management Plans for the Harvesting of Mollusks (clams, mussels, large clam, and pianguas) of the Tempisque Conservation Area, and the associations located in these sectors and that meet the requirements established in this manual:

Article 5.- Scope of application.

By virtue of the fact that SINAC carried out a general Management Plan and a Harvesting Plan, in the areas within the Gulf of Nicoya, the pilot plan for the payment for ecosystem services in mangrove forests has established these areas as a priority. In the same sense, it has been determined which Mollusk-gatherer Associations within these zones will participate given the existence of the corresponding permits.

By virtue of the above, this manual omits the chapter on the selection of the beneficiary associations and the determination of the priority zones.

The associations identified as beneficiaries for implementing this pilot plan are the following:

1-Puerto Pochote, Nicoya: Asociación de Molusqueros de Puerto Pochote de Nicoya.

2-Puerto Jesús, Nicoya: Asociación de Molusqueros de Puerto Jesús

3-Puerto Thiel and Puerto San Pablo, Nandayure: Asociación de Molusqueros Grupos Unidos de Puerto Jesús, Puerto San Pablo y Acoyapa.

4-Corozal, Jicaral: Asociación de Pescadores de Corozal, Jicaral de Puntarenas

5-Copal, Nicoya: Asociación Molusqueros Cerro Sombrero Copal

6-Isla Chira, Puntarenas: Asociación de Pesca Mixta Montero de Isla Chira

Article 6.- Distribution of Beneficiaries. The associations will select a specific group of their associates to participate as beneficiaries of this Pilot Plan. The associations will convene their members to participate in the activities of the pilot plan, verifying compliance with the qualifying requirements established in this manual. The selection criteria for the beneficiary persons shall be the sole responsibility of each one of the associations; according to the maximum number of persons allowed in the Use Permits of each Association. Once the participants have been selected, the association must communicate the list of beneficiaries in writing to the Biologist Manager, who will officially forward it to the Regional Office of the ACT, for inclusion in the corresponding administrative file.

The total number of persons benefited in the Pilot Plan is 157 persons according to the following chart:

Article 7.- Requirements and Obligations of the Beneficiary Associations.

7.1. Requirements of the Participating Associations

a.       Each association must be duly registered before the National Registry and have a valid legal entity for the duration of the Contract. In the event of expiration of its legal entity, it must obtain a new registration within the following 20 business days after its expiration. Payments to the Associations shall be subject to compliance with this requirement.

b.      Provide an Assembly or Board of Directors agreement authorizing the president of the Association to sign the Contract within the framework of the pilot plan for the Program for Payment of Marine Environmental Services in Mangrove Forests and agreeing to assume the agreed commitments.

c.       Note of expression of prior and informed consent, duly signed by the president of the Association, a requirement that is recommended to be replicated internally within each Association with all participating natural persons. See Annex 2

d.      Indicate an email address as a means to receive notifications.

e.       Keep current the use permits granted by the National System of Conservation Areas and the mollusk commercialization permits granted by the Costa Rican Institute of Fisheries and Aquaculture.

7.2. Obligations of the Participating Associations:

7.2.1. Technical Obligations:

a.       Ensure that the associates comply with the conditions set forth in the Mollusk Harvesting Plans (Planes de Aprovechamiento de Moluscos).

b.      Comply with all the terms of the use permit resolution granted by SINAC, the authorizations granted by INCOPESCA, and keep them current.

c.       Not carry out activities of logging, extraction, or activities that damage or alter the mangrove forest and its surrounding areas, except for activities expressly authorized by the respective permits.

d.      Comply with and participate in all activities foreseen in the contract for payment for environmental and/or ecosystem services in mangrove forest areas, among them, surveillance actions, rearing or reproduction processes, involvement in mollusk monitoring processes, ecological monitoring of the mangrove, and the sustainable harvesting of mollusks.

e.       Coordinate the work and comply with the recommendations made in writing or verbally by the Biologist Manager.

f.        Prepare and comply with the surveillance plan proposed by the association itself.

g.      Have available the mechanisms for daily, weekly, or monthly extraction records, as established, kept by a person from the association or hired for this purpose, who does not extract mollusks.

h.      The Association must have an Internal Regulation governing the extraction activity.

7.2.2. Administrative Obligations:

a.       Maintain, throughout the entire validity of the contract for payment for ecosystem services in mangrove forests, an account in colones at the Banco Nacional de Costa Rica or at other financial entities duly authorized for this purpose. In this account, only the resources derived from this contract shall be deposited and held.

b.      Maintain, throughout the entire validity of the contract for payment for ecosystem services in mangrove forests, the services of an authorized accountant incorporated into the Colegio de Contadores (Private or Public); this may be in-house staff or contracted for professional services, who must keep the accounting updated. If contracted for professional services, they must be up to date with the obligations with the CCSS, the Ministry of Finance, and FODESAF.

c.       Facilitate MINAE, SINAC, FONAFIFO, FUNBAM, and the Biologist Manager, their assistant, and/or any other authorized person, during the validity of the contract for payment for ecosystem services and six months after its expiration, access

to the accounting information of the Association, accounting books, bank reconciliations, bank statements for the corresponding period, and monthly financial statements.

d.      Send SINAC the list of participating associates in the mollusk harvesting activities. This list must be submitted once a month during the validity of the contract for payment for ecosystem services in mangrove forests, duly signed by the president of the association. This report must indicate the information on new entries and departures of participating persons, on the understanding that the number of persons authorized by the SINAC and INCOPESCA permits from the initial determination cannot be exceeded, but they may be substituted as long as they meet the corresponding requirements.

e.       Maintain a Registration mechanism in the Association, with the photograph, copy of the ID card, address, and number of the bank account to make the corresponding deposits. Likewise, it must prepare an identification card for them to carry during their presence in the mangroves, with details such as name, ID number, name of the Association, project name, among others.

7.2.3. Financial Obligations:

a.       Keep current, throughout the entire validity of the contract for payment for environmental services in mangrove forests, the payment of the obligations with the CCSS, FODESAF, and the legal entities tax when applicable.

b.      Keep current with tax obligations.

c.       Administer the resources derived from the contract for payment for environmental services in mangrove forests as a prudent steward.

d.      Make the corresponding and agreed disbursements to the associates who have participated in the related activities, and must keep the bank receipts. This obligation must be fulfilled no later than 15 business days from the receipt of the resources, except for duly justified situations. This payment must be made only by bank transfer and may not be made in cash.

e.       Manage and administer the resources intended to comply with common obligations, such as, for example: the delimitation of the assigned area, by means of signs, buoys, pennants, or any other mechanism, proposed and approved by the biologist manager, or the maintenance of the services of the accountant or the supervisor.

7.2.4. Other Obligations:

a.       Collect and analyze the evidence provided by their associates, directly or by the Biologist Manager or their assistant, and file a formal complaint for the irregular or illegal acts that come to their knowledge. This complaint includes the extraction of mollusks or damage to the mangrove and biodiversity, carried out by persons outside the association; and must be filed in the Integrated System for Processing and Addressing Environmental Complaints (SITADA), with a copy to the contact designated by MINAESINAC and indicated in the contract, no later than within 8 calendar days after becoming aware of the facts, when applicable.

At SINAC's discretion, the Association must file the criminal complaint lodged with the Public Prosecutor's Office and/or the Administrative Environmental Tribunal, as applicable. A copy of these complaints must be sent to the SINAC Regional Office, INCOPESCA, and FONAFIFO, no later than 15 calendar days after having been filed.

b.      During the validity of this contract and six months after the conclusion of the contract for payment for ecosystem services in mangrove forests, it must prepare and submit a report on compliance with technical, administrative, financial, and other obligations, at least every three months, or when SINAC, MINAE, FONAFIFO, and

INCOPESCA so request. This obligation must be fulfilled no later than 15 business days after their request.

Article 8.- Assessment of Legal Aspects.

Prior to signing the contract, FONAFIFO will verify compliance with the requirements set forth in this Manual. In case of non-compliance with the indicated requirements, a notice shall be issued to the Association giving a period of 15 business days to clarify or rectify what is required.

SINAC will send FONAFIFO an official communication certifying the Sectors and, simultaneously, the communities that have the General Management Plans for the Mangroves and the Harvesting Plan.

Once the requirements are met, the contract for payment for environmental services in mangrove forests shall be drafted.

Article 9.- Technical Aspects.

Compliance with the technical aspects related to the Activities subject to recognition in this pilot plan shall be evaluated by the Biologist manager, who will issue a report ensuring compliance with the Protocols defined by SINAC and INCOPESCA, namely:

1. Rearing of mollusks. (Annex x)

2.  Monitoring:(Annex X)

2.1 Ecological monitoring of mangrove ecosystems.

2.2 Mollusk monitoring. Guide for Basic Mangrove Assessment)

3.  Surveillance Actions.

4.  Sustainable Harvesting.

Chapter III. Of the Execution of the Contract

Article 10.- Of the Contract. To formalize admission to the Pilot Program for Payment for Environmental and/or Ecosystem Services in Mangrove Forests, a contract shall be signed between the Association and the Ministry of Environment and Energy, establishing the rights and obligations of the parties.

The term of the contract shall be one year from its signing and may be extended for an equal period as long as sufficient economic resources exist for it and the obligations have been fulfilled. See Annex 3

 Article 11.- Of Non-compliance with the contract and this Manual.

The parties undertake to fully comply with the obligations to do and not to do established in the signed contract and in this Manual. Failure to comply empowers the complying party to take actions and to unilaterally declare non-compliance with liability; with the exception of those situations or circumstances of force majeure.

Article 12.- Of the non-compliance with obligations.

Non-compliance with the obligations by the Associations shall be addressed as follows:

1)      When the conditions regarding the use permit and/or extraction permits are not met, evidenced through a report from the Biologist Manager or through the supervision processes carried out by SINAC or INCOPESCA, a detailed report on the detected non-compliance shall be prepared.

2) When the other conditions provided for in the contract or in this Pilot Plan Operations Manual are not met, evidenced either through a report from the Biologist Manager (Gestor Biólogo) or through the supervision processes of SINAC, INCOPESCA, or FONAFIFO, a detailed report documenting the detected non-compliance shall be prepared.

3) INCOPESCA and SINAC, through the corresponding Regional Office, shall be responsible for carrying out the pertinent assessment when the situations provided for in subsection 1) of this article occur, and may in such cases determine corrective actions up to the suspension or revocation of the respective use and/or extraction permit, in which case the ordinary procedure provided for in articles 308 and following of the General Public Administration Law (Ley General de la Administración Pública) shall be applied, guaranteeing the principles of Due Process (Debido Proceso) and Legitimate Defense (Legítima Defensa), among others.

4) FONAFIFO, jointly with SINAC, shall be responsible for carrying out the assessment of the facts when the scenarios mentioned in subsection 2) of this article occur, and may in such cases determine corrective actions up to the termination (rescisión) of the Payment for Environmental and/or Ecosystem Services of Mangrove Forest (Pago por Servicios Ambientales y/o Ecosistémicos de bosque de Manglar) contract, in which case the ordinary procedure provided for in articles 308 and following of the General Public Administration Law shall be applied, guaranteeing the principles of Due Process and Legitimate Defense, among others.

5) In the event of minor or slight breaches of the Payment for Environmental and/or Ecosystem Services of Mangrove Forest contract, the corresponding analysis shall be carried out and a reasonable period shall be established for its fulfillment. However, if the warned non-compliance persists, action shall be taken as provided in subsections 1) and 2) of this article.

6) In the event of major or serious breaches of any of the scenarios contemplated in subsections 1) and 2) of this article, the corresponding analysis shall be carried out and the remaining payments shall be suspended by means of a reasoned resolution.

7) In all cases, if the non-compliance is focused and carried out by one or several members of an Association contemplated in the Pilot Plan, said Association shall be notified so that it may proceed with the exclusion of such persons from the list of beneficiaries, in accordance with the internal processes established for this purpose in the Bylaws established by the Association.

8) When so determined, whether due to the revocation of the permits granted by SINAC and/or INCOPESCA, or due to the termination of the Payment for Environmental and/or Ecosystem Services of Mangrove Forest contract by virtue of a breach of the obligations provided for therein or those contemplated in this Manual, the Association shall make a partial or total refund of the funds disbursed, for which payment arrangements or future deductions may be agreed upon.

Chapter IV:
Monitoring and Control

Article 13.- Competence.

By virtue of the laws and regulations in force, the United Nations Framework Convention for the Protection of Biodiversity, the Inter-institutional Agreement, and in accordance with a logical framework, this pilot plan for payment for environmental and/or ecosystem services in mangrove forests shall be executed according to the competence and experience of each public body involved.

The control, supervision, and monitoring processes shall be executed by SINAC with the support of INCOPESCA. For its part, the execution process, contract signing, and monitoring of administrative obligations shall correspond to FONAFIFO, with financial support for this project from FUNBAM.

Article 14.- Administrative Case File.

For each Association, a single administrative case file shall be kept, which shall maintain a digital format, even if physical documents exist, which shall be supported and safeguarded by each competent entity. This digital format case file shall be online for all involved entities and must be kept fully updated by all public and private actors.

There is a duty of coordination and collaboration among the bodies involved in the execution of the pilot plan; any conflict situation, discrepancies, or others that arise must be resolved by them under the principles of collaboration and good faith. If the situation persists, it shall be definitively resolved by MINAE, headed by its chief, the Minister of Environment and Energy.

Article 15.- The Biologist Manager

To guarantee a fluid and transparent implementation of the actions established in the contracts and in each of the protocols corresponding to the activities subject to the recognition of Payment for Environmental and/or Ecosystem Services of Mangrove Forest, a monitoring and supervision structure shall be established, whose operation will be covered by the program's resources, which will be composed of at least two professionals; namely: a Biologist Manager and a Biologist Assistant, hired and paid by FUNBAM, who will be the link between the beneficiary associations, the responsible authorities, and those responsible for the mangrove forests and the biodiversity found therein and their conservation; guaranteeing the State the correct execution of the activities for the extraction and sustainable use (aprovechamiento sostenible) of mollusks in the prioritized sites and the restoration of the Mangrove.

Without detracting from the control and supervision work that the Law grants to the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación), the Biologist Manager shall be the primary responsible party before SINAC and INCOPESCA for the correct implementation of the activities, as well as for the inter-institutional coordination between the institutions and the associations; carrying out the monitoring of activities and documenting their results, in order to take the corresponding corrective actions. Said Manager shall have a Biologist Assistant who will provide support in the fulfillment of their duties.

Article 16.- The Coordination Commission.

The monitoring, evaluation, and continuous improvement of the Payment for Environmental and/or Ecosystem Services of Mangrove Forest program and any other coastal marine ecosystem that is subsequently integrated into said recognition mechanism shall be carried out through the inter-institutional technical Commission initially composed of the competent bodies and entities cited in the "FRAMEWORK COOPERATION AGREEMENT TO EXECUTE A PILOT PLAN FOR THE PAYMENT OF ENVIRONMENTAL OR ECOSYSTEM SERVICES IN MANGROVE FORESTS"; the foregoing, without prejudice to the incorporation of representatives from other instances in the event that other coastal marine ecosystems are included.

Article 17.- Reports.

A- Report of the Biologist Manager

The Biologist Manager shall prepare four reports; three quarterly technical progress reports regarding the fulfillment of the activities subject to payment, with specific and general observations and recommendations as applicable (See Anexo 4). The fourth and final report shall include the final results of the monitoring and their respective analysis.

Said reports must detail the activities carried out by the Associations and their members, frequency of visits, data collected by the groups, outstanding results, points for improvement, and any other that the Associations consider.

B- Report of the Association

The content of the Reports of the participating Associations shall be:

- The lists of beneficiaries including full name, identification number, and expiration date of the ID card.

- Report of the monthly accounting financial statements and copies of the transfers to the members of the Association, and the corresponding clarification in the event that payment could not be made to any member.

C- Reports of SINAC and INCOPESCA regarding non-compliance

Officials of SINAC and INCOPESCA shall prepare a report when they become aware of or are informed of situations of non-compliance with the use and/or extraction permits or

any of the activities subject to payment under this Pilot Plan. The officials shall prepare a detailed report on the alleged non-compliance.

Article 18.- Control Visits.

The public bodies participating in the Pilot Plan for the Payment for Environmental and/or Ecosystem Services of Mangrove Forest must exercise their control actions to supervise the fulfillment of the obligations assumed by the Associations and contribute to the success of the project. To the extent possible, these actions will be previously coordinated in order to conduct joint visits and maximize available resources.

Chapter V. Activities Subject to Payment for Environmental and/or Ecosystem Services of Mangrove

Article 19. Activities to be Carried Out.

The activities that must be carried out to receive the PSAM are:

1. Mollusk farming (Crianza de moluscos).

2. Monitoring:

2.1 Ecological monitoring of mangrove ecosystems.

2.2 Monitoring of mollusks.

3. Surveillance Actions.

4. Sustainable Use.

The Associations must carry out the above activities as a whole. Each activity shall be directed by the Biologist Manager and their Assistant, according to the Work Plan; however, the execution of the activities and tasks that will allow each of the activities to be completed is the responsibility of the organizations.

Article 20.- Mollusk Farming.

The Associations must guarantee the creation of nurseries in the environment that allow reproduction, spawning, and generation of seed to maintain the generations over time. The location of the nurseries and their corresponding creation will be guided under the supervision of the Biologist Manager and the methodology approved by INCOPESCA. (See Anexo 5).

The mollusk farming activity shall function as a nursery and monitoring site for reproduction, including: collection - separation - relocation - recording of sizes, extraction zones, destination (commercialization, nursery, or own consumption), growth and survival - and monitoring).

Article 21.- Monitoring Activities.

The monitoring activities shall be based on the guides for the rapid assessment of piangua populations from SINAC (2014) and the guide "Generation of the baseline for the elaboration of management plans for bivalve mollusks in mangrove wetlands and sandy mud beaches" from SINAC (2018). The procedures and contents are based on the Decreto Ejecutivo N° 39411-MINAE-MAG, as well as the Officialized PRONAMEC Protocol for mangrove monitoring. (See Anexo 6)

Article 22.- Surveillance Activity.

The Associations must develop a surveillance plan and assume said tasks, such as, for example, periodic patrols of the zones, to document crimes, generate timely alerts, and, to the extent possible, anticipate illegal extraction. As well as informing the authorities, facilitating documentation of anomalies, making the report in SITADA or to 1192, and Attending Training on surveillance.

Article 23.- Sustainable Use Activity.

The Associations shall generate, through their participating members, a rational use of the authorized resources for the use of the indicated mollusks. These actions must have the least possible impact on the ecosystem and remain within the permitted extraction limits to ensure use under conditions of sustainability.

Chapter VI.
Issuance and Delivery of Payment for Environmental and/or Ecosystem Services of Mangrove Forest

Article 24.- Payment.

As compensation for the services provided by the beneficiary Associations of the Payment for Environmental and/or Ecosystem Services of Mangrove Forest Program, the State shall recognize an amount of 2,698.85 USD (two thousand six hundred ninety-eight dollars and eighty-five cents, legal tender of the United States of America) annually per person participating in this program.

This amount shall be paid to the Association in four disbursements, with respect to the amount indicated in the preceding paragraph. The first disbursement of 25% shall be made upon the signing of the contract and when compliance with the established formal requirements is reported. The second disbursement, corresponding to 25%, shall be made 3 months after the signing of the contract; a third disbursement, corresponding to 25%, after 6 months from the signing of the contract; and the remaining 25% shall be made after 9 months following the signing of the contract. Each payment shall be made upon prior verification of compliance with the obligations established in the contract and in this Manual.

Article 25.- Processing of the First Disbursement.

After the signing of the contract, FONAFIFO shall proceed with the management of the first disbursement to the participating Associations, having up to 10 calendar days to issue the respective payment order; for which, it must:

- Verify the accreditation of the Association's bank account in colones and that it has complied with the presentation of the beneficiary list, the surveillance plan, the code of ethics, the appointment of the internal supervisor, the mechanisms for counting and reporting, and the hiring of an accountant.

- Verify the existence of the compliance report for the formal requirements and corroborate the amount to be paid.

- Carry out the consultation of payment delinquency with the CCSS, FODESAF.

If the information is correct and complete, FONAFIFO shall proceed to generate the respective payment order, which must be transferred to FUNBAM, which shall have up to 10 calendar days to make the corresponding deposit. However, if inconsistencies are detected after verifying the information, the beneficiary Association shall be notified, granting it a period of up to 10 business days for correction. If the inconsistency is not corrected within the specified time, the Association shall be notified and the payment request shall be annulled.

Article 26.- Processing of Subsequent Payments.

Prior to each subsequent payment, the Associations shall submit to SINAC the list of beneficiary persons and the document signed by the Biologist Manager regarding the fulfillment of the activities subject to recognition; for which, the Associations must send said list at least 10 business days in advance of the scheduled payment date.

Once the information has been assessed by SINAC (wetlands focal point), it shall issue its approval and request FONAFIFO to continue with the payment process.

FONAFIFO shall carry out the verification contemplated in the previous article within a period of up to 10 calendar days and shall issue the respective payment order, which must be transferred to FUNBAM, which shall have up to 10 calendar days to make the corresponding deposit. If inconsistencies are detected in the verified information, the Association shall be notified to rectify the pertinent matter, granting for this purpose a period of up to 10 business days. If the indicated inconsistency is not corrected within the time granted, the Association shall be notified and the payment request shall be annulled.

Article 27.- Expiration of Payments.

If, within a maximum period of 6 months after the moment each of the payments of the Payment for Environmental and/or Ecosystem Services of Mangrove contract become due, the respective collection is not made, these shall expire and shall not be disbursed by FONAFIFO, without this generating any liability on its part. Excepted from this provision are those cases where there is a reasonable justification for the reason that has delayed the respective disbursement, and this is duly documented in the administrative case file. The expiration of the payments shall not affect the validity of the contract.

Article 28.- Administrative Expenses of the Beneficiary Associations.

The beneficiary association must retain the percentage of 6.16% of the annual total, provided for in article 24 of this Manual, which it shall use for the fulfillment of its common obligations.

Likewise, the Board of Directors, with the active participation of the beneficiary persons, may agree, through formal meetings which will be documented and signed by the participants, on other amounts to be retained, to cover common expenses, such as boundary marking, signage, surveillance, transportation, control and reporting mechanisms, or other obligations of the use permits or the payment for environmental services contract.

The remaining amounts shall be distributed among the beneficiaries, for which disbursements must be made no later than 15 business days after the deposit made in favor of the Association; without this translating into an employment relationship between the Association and its members.

For all purposes, the Association shall be responsible for the resources delivered by virtue of the payment for environmental or ecosystem services in mangrove forests contract.

Article 29.- Start Dates.

There is a commitment with the Government of the United Kingdom to start the project no later than December first, two thousand twenty-four.

Article 30.- Validity of the Manual.

This Manual shall only be applicable to the execution of the Pilot Plan for payment for environmental or ecosystem services in mangrove forests, and therefore only governs for the associations and bodies or entities involved therein.

SINGLE TRANSITORY PROVISION.

In the event that any of the Associations contemplated in article 5 of this Manual do not meet the established requirements, other Associations may be considered, upon prior verification of compliance with the technical and legal requirements.

PRIOR INFORMED CONSENT OF THE ASSOCIATION

SECOND CLAUSE: The Object of the Contract
The object of this contract is to regulate the relationship between THE BENEFICIARY and MINAE, under which the latter recognizes the environmental services generated by THE BENEFICIARY, through the fulfillment of their obligations. In this act, THE BENEFICIARY assigns to FONAFIFO and MINAE the environmental or ecosystem services generated in the fulfillment of this contract.

These environmental services will be delivered in annual and future installments, counted from the effective date of this contract, provided that the Professional Biologist so reports, upon confirming that the conditions of the mangrove forest and the agreed obligations are being met. By virtue of the transfer of environmental services made in this contract, MINAE and Fonafifo are free to dispose of the acquired and transferred environmental services in any manner they deem appropriate, and may sell them to third parties both nationally and internationally, without having to notify THE BENEFICIARY of such action, who may not claim any amount from MINAE and/or Fonafifo for this disposition of the acquired services. In accordance with the foregoing, THE BENEFICIARY may not, under any circumstances, sell or dispose of, by any title, the environmental services generated by the forest during the term of this contract.

  

CLAUSE THREE: Term

The term of this contract is one year from its signing, in accordance with the Operation Manual of the Pilot Plan for Payment of Environmental and/or Ecosystem Services in Mangrove Forests, and may be extended for an equal period provided sufficient economic resources exist for such purpose and the obligations have been fulfilled.

  

CLAUSE FOUR: Project impact area

The area in which the project will be developed shall be _____ hectares and is identified in the survey conducted by the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación), which forms part of this contract, constituting Annex Two.

  

CLAUSE FIVE: Price and form of payment

Fonafifo, as consideration for the transfer established in this contract, shall pay for the acquired environmental services an annual sum of 2,698.85 USD (two thousand six hundred ninety-eight dollars and eighty-five cents, legal tender of the United States of America) per hectare of mangrove forest committed to the protection activity. As provided in the Operation Manual of the Pilot Plan for Payment of Environmental and/or Ecosystem Services in Mangrove Forests, Fonafifo shall authorize and send the disbursement order to the Fundación Banco Ambiental for it to issue the disbursements. This amount shall be paid to the Association in three installments, with respect to the amount stated in the preceding paragraph. The first disbursement of 25% shall be made upon the signing of the contract and when compliance with the established formal requirements is reported. The second disbursement, corresponding to 25%, shall be made 3 months after the signing of the contract; a third disbursement, corresponding to 25%, shall be made 6 months after the signing of the contract, and the remaining 25% shall be made 9 months after the signing of the contract. Each payment shall be made upon prior verification of compliance with the obligations established in this contract and in the Operation Manual of the Pilot Plan for Payment of Environmental and/or Ecosystem Services in Mangrove Forests, as well as the use and commercialization permits established in clause one of this contract.

  

CLAUSE SIX: Obligations of THE BENEFICIARY

THE BENEFICIARY is obligated to: A) Fully comply with the obligations established by SINAC in the Mollusk Use Plan (Plan de Aprovechamiento de Moluscos) granted through resolution No._________________ dated_______________________________ and ensure that its associates comply with the conditions set forth in the respective plan B) Fully comply with the obligations established by INCOPESCA in the Extraction Plan (Plan de Extracción) issued through resolution No._________________ dated_______________________________ and ensure compliance with these by its associates. C) Keep the authorizations issued by SINAC and INCOPESCA current. D) Not carry out logging, extraction, or any other activities that damage or alter the mangrove forest and its surrounding areas, except for activities expressly authorized in the respective permits. E) Take the necessary actions to protect the mangrove forest subject to the use permit, as well as prevent any damage caused by third parties; these protection actions shall at a minimum be: demarcation and delimitation of the assigned mangrove forest area by means of signs, buoys, flags, or any other mechanism proposed and approved by the biologist manager. As well as periodic supervision and surveillance of the subject area, according to a surveillance plan that must be proposed, prepared, and fulfilled by THE BENEFICIARY. F) Coordinate work with the Biologist Manager, as well as abide by and implement the technically justified recommendations that have been issued verbally or in writing by the Biologist Manager, as well as by personnel from MINAE, SINAC, INCOPESCA, or Fonafifo. G) Comply with and participate in all activities provided for in this contract, including surveillance actions, breeding or reproduction processes, involvement in mollusk monitoring processes, ecological monitoring of the mangrove, and the sustainable use of mollusks. H) Have mechanisms for recording daily, weekly, or monthly extraction, as provided, kept by a person from the association or hired for that purpose, who does not extract mollusks. I) Have an Internal Regulation governing the extraction activity. J) Establishment and maintenance of signs as provided in the Operation Manual of the Pilot Plan for Payment of Environmental and/or Ecosystem Services in Mangrove Forests. K) Comply with conservation actions such as extracting only mollusks of the authorized size, according to the established tools, and those smaller than the established parameter must be sent to the breeding areas, which will be guided and established by the Biologist Manager in charge. L) Report and gather evidence (photos or others) against persons outside the association who extract mollusks and cause damage or alterations to the mangrove forest and the biodiversity found therein. This report must be filed at the MINAE-SINAC offices no later than 8 calendar days after becoming aware of the facts, where applicable. Likewise, the Association must file a criminal complaint with the Public Ministry (Ministerio Público), and an administrative complaint before SINAC and the Environmental Administrative Tribunal (Tribunal Ambiental Administrativo), as appropriate. A copy of these complaints must be sent to the SINAC Regional Office no later than 30 calendar days after having been filed. M) Transfer to MINAE and Fonafifo the Environmental or Ecosystem Services for a period equal to the term of this contract. N) Comply with the obligations established in Law No. 7575 "Ley Forestal", Executive Decree No. 25721 "Reglamento a la Ley Forestal" and its amendments, this contract, and the Operation Manual of the Pilot Plan for Payment of Environmental and/or Ecosystem Services in Mangrove Forests.

O) Comply with the administrative and financial obligations established in the Operation Manual of the Pilot Plan for Payment of Environmental and/or Ecosystem Services in Mangrove Forests, especially the following: Maintain, throughout the term of the payment for ecosystem services in mangrove forests contract, the services of an authorized accountant registered with the Colegio de Contadores (Private or Public), who may be in-house or contracted for professional services, and who must keep the accounting up to date. If contracted for professional services, they must be up to date with obligations to the CCSS, the Ministerio de Hacienda, and FODESAF; Facilitate to MINAE, SINAC, FONAFIFO, FUNBAM, and the Biologist Manager, their assistant, and/or any other authorized person, during the term of the payment for ecosystem services contract and six months after its expiration, access to the Association's accounting information, accounting books, bank reconciliations, bank account statements for the corresponding period, and monthly financial statements; deliver resources and payments to the associated persons for the conservation and extraction actions; submit a monthly accounting report and detail of actions taken in the area subject to the permits granted by SINAC. P) Maintain, throughout the term of the contract, an account in colones at the Banco Nacional de Costa Rica or at other duly authorized financial entities for such purpose; into which account only the resources derived from this contract shall be deposited and maintained. Q) Be up to date with obligations to the CCSS, FODESAF, and the Ministerio de Hacienda. R) During the term of this contract and six months after the conclusion of the payment for ecosystem services in mangrove forests contract, THE BENEFICIARY must prepare and submit a report on compliance with obligations, technical, administrative, financial, and others, at least every three months, or when SINAC, MINAE, FONAFIFO, and INCOPESCA so request. This obligation must be fulfilled no later than 15 business days after the request.

 

 

 

 

 

CLAUSE SEVEN: Rights of the parties THE BENEFICIARY has the right to:

a. Distribute the resources derived from this contract according to the terms approved by the Associates' Assembly, duly signed.

b. Receive the payments stipulated for the transfer of the environmental services within the agreed time, provided it is up to date with the payment of obligations to the Costa Rican Social Security Fund (Caja Costarricense de Seguro Social), Fodesaf, and the Ministerio de Hacienda. Likewise, it must be up to date with the obligations contracted with MINAE, Fonafifo, and SINAC derived from this contract.

c. Establish a percentage for administrative expenses of the Beneficiary, which may not exceed 6.16%.

d. Be notified prior to any visit to the project area.

e. In the event of an alleged breach, have the right to due process in administrative proceedings.

  

MINAE -Fonafifo- SINAC has the right to:

f. Demand compliance with the obligations contracted in this contract by THE BENEFICIARY.

g. Monitor and supervise the area where the mangrove forest subject to this contract is located.

h. Supervise the accounts and the manner of investment of the resources paid by virtue of this contract.

i. Require the Beneficiary to provide the technical, financial, and administrative reports it deems appropriate.

j. Suspend pending payments in the event of alleged or proven contractual breaches, or upon notice from the Biologist Manager.

 

CLAUSE EIGHT: Faults

In the execution of the contract, two types of faults may occur: Minor and serious. Minor faults shall be resolved by SINAC in coordination with the Professional Biologist; serious faults shall be resolved by SINAC, who shall determine the seriousness of the fault entailing the contractual breach, taking into account the impact on the mangrove forest or the biodiversity found therein, and technical criteria.

 

CLAUSE NINE: Breach of contract

The breach of the terms and obligations of this contract shall generate the right for the complying party to demand forced compliance, or to terminate the contract without liability for itself, and both situations may result in the payment of damages consisting of the return of economic resources and their interest where applicable. Without prejudice to the foregoing, the regional representative of MINAE, SINAC, INCOPESCA, or Fonafifo, upon detecting any anomalous situation or any alleged breach, shall proceed to contact THE BENEFICIARY and the Biologist Manager, in order to clarify the facts and reach an agreement, for the purpose of continuing with the contract, abiding by the technical and administrative provisions issued in this regard.

If the existence of alleged serious faults entailing a contractual breach is evidenced, Fonafifo shall establish an ordinary administrative procedure as provided by the General Public Administration Law (Ley General de la Administración Pública), in order to establish the real truth and declare the breach. Fonafifo shall suspend pending disbursements until the final act declaring or not declaring the breach is issued.

Without prejudice to the provisions of this clause, during the course of the administrative procedure for alleged breach, THE BENEFICIARY may propose a remedial plan to MINAE, which shall be evaluated by Fonafifo and, if accepted, the respective adjustments to this contract shall be made.

 

CLAUSE TEN: Return of resources, payment of interest, and others

In the event of a proven breach, when the return of resources is applicable, these shall be made by THE BENEFICIARY, recognizing to MINAE-Fonafifo the payment of ordinary interest from the verification of the breach, which shall correspond to the basic rate plus three points, and as default interest a rate of one percent monthly. In cases where THE BENEFICIARY must make returns not derived from a contractual breach, the amount shall be returned to Fonafifo without ordinary interest, but default interest shall be charged at a rate of one percent monthly from the date of default. In both cases, MINAE-Fonafifo and THE BENEFICIARY may agree to payment arrangements whose conditions must be adequate and convenient for Fonafifo.

In the event of a breach, MINAE Fonafifo may recognize, in the respective settlement, the actions executed in which there has been compliance with the contract.

 

CLAUSE ELEVEN: Non-execution of payments.

If, within a maximum period of 6 months after the moment each of the payments of the Payment for Environmental and/or Ecosystem Services for Mangroves contract becomes due, the respective collection is not made, these shall expire and shall not be disbursed by Fonafifo, without this generating any liability on its part. Excepted from this provision are those cases where there is a reasonable justification for the reason that has delayed the respective disbursement, and this is duly documented in the administrative file. The expiration of payments shall not affect the validity of the contract.

 

CLAUSE TWELVE: Official communications and contractual domicile

It is the duty of the parties to inform of any change in these domiciles and means for receiving notifications. Should these changes occur, a formal written communication shall suffice and modification of the contract is not required; however, should the domicile or means of notification be changed and the counterparty not be informed, the latter shall validly make any communication or proceeding via the means of notification originally established.

 

CLAUSE THIRTEEN: Interpretation criteria

The parties establish that this contract shall be interpreted under the principles of good faith and mutual collaboration; in any case, this interpretation shall have the purpose of enabling the fulfillment of the agreed contractual purpose.

  

CLAUSE FOURTEEN: Annexes to this contract

The reports submitted by the professional biologist for the execution of this contract shall form an integral part of this contract.

  

 

 

CLAUSE FIFTEEN: Applicable Law

In all cases, this contract shall be governed by Costa Rican legislation in general and specifically by Ley Forestal No. 7575, Executive Decree No. 25721-MINAE of October 17, 1996, and its amendments, the Operation Manual of the Pilot Plan for Payment of Environmental and/or Ecosystem Services in Mangrove Forests, published in the Official Gazette La Gaceta No. xxx Alcance xxx of xxx, xxx, 2024, as well as other provisions issued by the Executive Branch. The applicable jurisdiction shall be the Courts of Justice of Costa Rica.

CLAUSE SIXTEEN: Effective date

This contract is effective as of its signing.

ANNEX 5
MOLLUSK BREEDING METHODOLOGY

1. Construction, management, and maintenance of nurseries

  

The nurseries shall consist of 300 m2 areas, divided into twelve parcels of 25 m2 each, with a maximum capacity of 2500 individuals. By dividing it into 12 parcels, the relocated organisms can be planted in a staggered manner over one year, thus allowing for annual planting and harvest cycles.

Monitoring will evaluate the effectiveness of the relocation and breeding activities carried out by the mollusk gatherers. This consists of the continuous recording of information on the extraction activity, the species extracted, their size, extraction zones, destination (commercialization or nursery), growth, and survival.

1.1. Nursery design:

According to the species being extracted, nursery sites with characteristics similar to natural fishing grounds must be selected. The delimitation of the nurseries must be adjusted according to the requirements of the species to be relocated, that is, whether they inhabit mud or sandbanks, whether they are close to the high-tide or low-tide zone, and it must be consistent with the reproduction zones delimited in the Use Plans (Planes de Aprovechamiento) and the General Management Plan (Plan General de Manejo) to which the authorizations of the beneficiary mollusk gatherers are linked.

a. Materials for nursery construction:

? Mesh bags of 90x60cm, with an opening similar to sardine netting

? Plastic bottles, mesh scraps, or some material serving as substrate

b. Construction:

1. Delimit an area of 15x20 m (300 m2), which must be divided into quadrants of 5 m x 5 m (25 m2), resulting in a total of 12 parcels (Figure 3). Figure 3.

2. Mark the location of the parcels with flagging tape, and record the coordinates with the GPS; this information must be managed by SINAC and Incopesca.

3. A planting density of 100 individuals per square meter shall be used, totaling 2500 individuals/parcel of 25 m2.
 
4. The organisms must be grouped by species and three size ranges:

a. Range 1 less than or equal to 10mm up to 25mm,
b. Range 2 from 25mm up to 35mm
c. Range 3 from 35mm up to 47mm

5. Following these size ranges, place the individuals in the mesh bags. The mesh bags must be 90 cm x 60 cm, made with an opening similar to sardine netting, and have a cord for closing the bag (Figure 4).

6. The bags must be tied to the roots or anchored in the parcels, to prevent them from moving due to the tide, and even as security against theft. Try to place the bags during the rising tide or high tide to avoid predation by other organisms.

7. Inside the bags, bottles, mesh scraps, or some other material can be placed to offer a substrate for the seed to attach to, and to simulate the conditions that mangrove roots offer under normal conditions. If plastic bottles are used, it is recommended to cut the bottles transversely.

Each parcel in the nursery represents one month of extraction, with a maximum capacity of 2500 mollusks per parcel. That is, once the 2500 individuals for that parcel have been collected, no more organisms may be relocated during that month so as not to exceed the maximum nursery capacity.

2. Extraction, collection of mollusks, and Relocation

2.1. Extraction

As this is a pilot project, the process of extraction, selection, and relocation of mollusks will be carried out in two ways to determine the method with better control and greater effectiveness:

a. 1250 individuals collected through organized trips between the mollusk gatherers and the authorities will be relocated, specifically individuals below the legal size at first capture (talla legal de primera captura, TLPC). They will be collected from sites identified by the mollusk gatherers, known to them as banks of juvenile individuals where adequate growth is not observed.

b. Another 1250 individuals collected during the extraction tasks of the mollusk gatherers authorized by Incopesca will be relocated. That is, from the resource they regularly extract, those meeting the TLCP may be commercialized, according to current regulations and the provisions of their extraction authorization. And organisms that do not reach the TLPC may be relocated in the authorized nurseries.

2.2. Selection and relocation of mollusks

The selection of mollusks must be done with the help of a pianguimetro or some measuring device that facilitates the separation of mollusks with the TLPC from those below the TLPC.

The mollusk gatherers must take a sample of the organisms destined for the nurseries; this shall consist of recording information on the collection carried out, and measuring at least 30 individuals per species to be placed in each of the mesh bags. To do this, they must:

a. Measure the total length of the 30 organisms to determine the average planting size in each bag.

b. Identify each bag with a numbering system (example: V1P1B1) to monitor growth and maintain traceability of the organisms collected and relocated in the nursery.

c. Complete a record of contributions from the extracted organisms, with the information indicated in the Form for Mollusk Relocation Registry (Formulario para Registro de Reubicación de Moluscos) provided by Incopesca.

If during collection, at least 30 organisms are not collected, all the product destined for relocation must be measured.

For the relocation of mollusks, only those nurseries authorized by SINAC and INCOPESCA for this project may be used.

3. Growth monitoring, care, and harvest

3.1. Growth monitoring and density adjustment per bag

During care in the nursery, growth control of the organisms must be kept through monthly samplings. The sampling consists of:

a. Each month, the total length of at least 30 individuals from each bag must be recorded to determine the average growth of each bag in each parcel.

b. Count the total organisms per bag to monitor the survival of individuals within the bags.

c. Carry out a maintenance process: Cleaning the bags and organisms if crustaceans or other adherent organisms are observed, checking and maintaining the good condition of the bags, the labeling system for each, the tying or anchoring system, and the marking of the parcels.

d. Every 8 months, a thinning process must be carried out, meaning the densities of organisms within each bag must be adjusted according to their size and the time spent in the bags (Table 1). That is, once the organisms have sizes between 25mm and 35mm, there may not be more than 500 individuals per bag, and when they have sizes between 35mm and 47mm, no more than 200 individuals per bag should be placed.

e. To keep a record of monitoring, the Growth Monitoring form must be completed.

3.2. Harvest

Once the organisms exceed the TLPC, they may be commercialized in the traditional manner. If, after 22 months of being relocated in the nurseries, the organisms do not reach the TLPC, they may be consumed by the members of the group associated with the project, but may not be used for commercialization, nor returned to the ecosystem.

  

4. Control, sampling data, and reports

4.1. Information control and supervision

  

4.1.1. Delivery of sampling data

It is the responsibility of the mollusk gatherers to deliver to Incopesca, on a monthly basis, information on the quantity and sale of the extracted product, as stipulated in the board of directors' agreement as a condition for maintaining the extraction authorization, and for the authority to keep statistical records of extraction and commercialization.

The organizations participating in the monitoring and fattening projects must attach to the information delivered to Incopesca: the forms for Mollusk Relocation Registry, and the Growth Monitoring forms described previously.

  

4.1.2. Supervision

All activity shall be supervised by the project's biologist manager, ensuring the proper management and functioning of the mollusk nurseries, according to current regulations, the use plan linked to the authorizations, and the provisions indicated by SINAC and

Incopesca for the management of the nurseries described in this document.

  

4.2. Control methods:

  

a. Coordination: The coordination of the pilot project must be carried out jointly between SINAC and INCOPESCA

b. Reports: Reports shall be made through the monthly report that the regent must present to SINAC-INCOPESCA, and with the delivery of the "Registro de

Mollusk Relocation", and "Growth Monitoring"

5.  Activities and Effectiveness Indicators

5.1. Activity description:

Table 2 details the main activities that the shellfish gatherers (molusqueros) must carry out for the fulfillment of this pilot project, for a 12-month period.

23 hours per month per person and 5 people are required per month, equaling 115 payable hours per month for 22 months.

4.2. Effectiveness Indicators

There are no baseline effectiveness indicators, nor can values or tolerance margins be defined until the first data collection from this pilot project is obtained. However, the indicators that will be obtained through the monitoring described above will be the following:

MONITORING METHODOLOGY

1- Mollusk Monitoring:

The extraction of mollusks from each plot will be carried out with the shellfish gatherers (molusqueros), who know the area in detail and are experienced. The shellfish gatherers (molusqueros) participating in the sampling will be instructed beforehand. A participatory, in-person process will be developed with groups of the shellfish gatherers (molusqueros), SINAC, and INCOPESCA, to provide induction, training, plot marking, data collection and subsequent analysis, and dissemination.

Two types of monitoring are required for this activity:

a- Biological data b- Annual assessment of the state of the mollusk population by sector.

a- Monitoring of Mollusk Biological Data.

To generate information on the biology of commercial mangrove mollusks, data will be collected for indicators that will generate records, which currently represent a gap in scientific information. Monitoring of different indicators provides information for the generation of knowledge about the species.

2 transects and 6 plots of 5m x 5m will be established; each transect consists of 3 plots. Work subgroups will be established for data collection of the different indicators.

The mollusks from each plot or quadrant will be placed in different bags, labeled with the number or code assigned to the transects and plots. Likewise, a label with the additional required information will be placed in each bag.

All mollusks found will be extracted from each sample unit, regardless of their size. Once the extraction day is finished, the mollusks will be transported to a suitable location for measurements.

Each individual will be weighed and its length and width measured; the data for each one will be recorded in the format provided by SINAC-INCOPESCA. The data analysis of the collections will be the responsibility of the Regent, who will process the information, systematize it into a report, and present it to the groups of shellfish gatherers (molusqueros) and the Institutions. 3 outings per month forming teams, 4 teams per group.

INDICATORS:

For the monitoring of Mollusk Biological Data, the indicators are the following:

i.                          The abundance of mollusk species (the number of individuals per unit area or volume).

ii.                        The diversity of mollusk species (the variety and richness of species present in the ecosystem).

iii.                      The distribution of mollusk species (the way they are arranged in space according to environmental conditions and available resources).

iv.                        The productivity of mollusk species (the amount of biomass they produce per unit of time).

v.                          The health status of mollusk species (the presence or absence of diseases, parasites, contaminants, or stress).

vi.                        The utilization (aprovechamiento) of mollusk species (the use given to them as a food, economic, or cultural resource).

vii.                      The impact of human activities on mollusk species (the alteration or loss of their habitat, overexploitation, the introduction of invasive species, or contamination).

viii.                    The biomass of mollusk species (the total weight of organisms per unit area or volume).

b- Assessment of the state of the mollusk population by sector

It starts from the baseline of the 2022 ACT Mollusk Harvesting Plan (Plan de Aprovechamiento) and is required to understand the proportions of the populations.

The resource assessment will be carried out in accordance with the SINAC guide for the rapid assessment of piangua populations (2014) and the SINAC guide "Generation of the baseline for the elaboration of management plans for bivalve mollusks in mangrove wetlands and sandy-mud flats" (2018). The procedures and contents are based on Decreto Ejecutivo N° 39411-MINAE-MAG.

The sampling and measurement of morphometric parameters of pianguas, clams, and mussels will be carried out through field visits; between 9 and 15 plots per sector will be established in transects with 3 plots each, depending on the conditions of the mangrove, beach, and substrate.

In total, transects and their plots of 5m X 5m for piangua and razor mussel, and 1 m X 1 m for clams, large clams, and choras are sampled.

INDICATOR:

The Indicator used for this objective will be:

i.  Population Status (the total weight of organisms per unit area or volume), from each plot in all sectors, of all individuals collected. 2- Mangrove Ecological Monitoring.

SINAC has an Ecological Protocol for Mangrove Monitoring (SINACUNA, 2020). For mangroves, there are twenty-three indicators that will serve to evaluate the state of this focal management element. However, for this Pilot Project, it is proposed to apply the Indicators listed below.

Considering the location of between 8 and 10 permanent plots per 100 hectares of Mangrove as an ideal condition, for the purposes of this project, the delimitation of two linear transects in a direction perpendicular to the physicochemical gradients is proposed, upon which 10 x 10 m plots will be conveniently distributed, with three 10m x 10m plots per transect. Both the transect and the plots will be georeferenced.

Information will be recorded from each plot according to the selected indicators, whose methodological description is found in the document "Ecological Protocol for Mangrove Monitoring":

MANGROVE ECOSYSTEM ECOLOGICAL MONITORING INDICATORS

1.       Indicator 5. Estimation of Basal Area (See methodological detail in SINAC-UNA, 2020).

i.                  Species present. Each individual will be identified by a pre-numbered aluminum tag (coded).

ii.               Measurement of the diameter at breast height of all species greater than 2.5 cm.

2.       Indicator 6. Density of Core Species (See methodological detail in SINAC-UNA, 2020).

i.                  All individuals with DBH equal to or greater than 2.5 cm in each plot must be counted, considering the total number of individuals and per species, and divided by the total sampled area.

ii.               The number of dead individuals and/or branches present within each plot must be noted.

3.       Indicator 7. Estimation of the Complexity Index (See methodological detail in SINACUNA, 2020).

i.                  Estimate, with a clinometer, the total height of the tree from the base of the ground to the highest part of the crown.

4.       Indicator 8. Estimation of the Importance Value (See methodological detail in SINAC-

UNA, 2020).

5.       Indicator 11. Presence of Core Flora (See methodological detail in SINAC-UNA, 2020).

i.                  Also called obligate halophytes, they are found in the intertidal zone due to their dependence on saline influences. The core flora will be identified at the time the structural measurements of each plot are taken.

6.       Indicator 12. Presence of Marginal and Facultative Marginal Flora (See methodological detail in SINAC-UNA, 2020).

i.                  Identify the largest possible number of species in the field; in case they cannot be recognized, take photographs or samples to be evaluated in the laboratory. 7. Indicator 13. Gastropod Richness (See methodological detail in SINAC-UNA, 2020).

i. In the permanent plots, place four 1 m² quadrants for each 100 m² vegetation plot as indicated in Figure 7. Record the diversity and abundance of all gastropod species of the genera *Littoraria*, *Cerithidea*, and *Thaisella* found in them, both on the ground and on roots and trunks (Ashton et al. 2003; Irma & Sofyatuddin, 2012). Field identification can be done using the guide by Cruz & Jiménez (1994); in case the species cannot be recognized on site, samples must be taken to be evaluated in the laboratory using said guide.

8. Indicator 14. Crab Burrow Richness (See methodological detail in SINACUNA, 2020).

i. In the permanent plots, place four 1 m² quadrants for each 100 m² vegetation plot. Record the number of burrows present in each quadrant.

9.       Indicator 15. Bird Presence (See methodological detail in SINAC-UNA, 2020).

10.  Indicator 16. Mammal Presence (See methodological detail in SINAC-UNA, 2020). 11. Indicator 17. Solid Waste Frequency (See methodological detail in SINAC-UNA, 2020).

12. Indicator 18. Hydrocarbon Presence (See methodological detail in SINAC-UNA, 2020).

i. Take one sediment sample with a diameter of approximately 4.50 cm and a length of 14.50 cm (core sampler), for each of the plots. Then, the subsamples are frozen and subsequently sent to the UNA Chemistry Laboratory.

13. Indicator 21. Interstitial Water (See methodological detail in SINAC-UNA, 2020).

i.                         Place interstitial water sampling stations in each monitoring plot.

ii.                       Before extracting the water sample, the physicochemical parameters (pH, salinity, temperature, dissolved oxygen, redox potential) must be taken and recorded, by introducing the multiparameter meter's electrodes into the tube (coordinate beforehand with the ASP-ACT Directorate for the loan of the multiparameter meter).

14.  Indicator 23. Carbon Sequestration (See methodological detail in SINAC-UNA, 2020).

15.  Additional Indicators: Organic matter and heavy metals.

i. Take two separate sediment samples with a diameter of approximately 4.50 cm and a length of 14.50 cm (core sampler), for each of the plots. Then, the subsamples are frozen and subsequently sent to the UNA Chemistry Laboratory.
