MINISTRO DE CULTURA Y JUVENTUD

En
uso de las facultades que les confieren los artículos 140, incisos 3), 18) y
20) y 146 de la Constitución Política de la República de Costa Rica, y con
fundamento en los artículos 23, inciso m), 25 párrafo 1), 27 párrafo 1), 28,
incisos I y 2, acápite b) de la Ley General de la Administración Pública, Nº.
6227 de 2 de mayo de 1978, artículo 36 de la Ley sobre Patrimonio Nacional
Arqueológico, Nº. 6703 del 28 de diciembre de 1981, artículos 1 y 2 del Decreto
Ejecutivo Nº 29.908 del 5 de setiembre de 2001 y su reforma Decreto Ejecutivo
Nº. 35841 del 18 de noviembre de 2009 que declara e incorpora al Patrimonio
Histórico Arquitectónico de Costa Rica, el inmueble conocido Monumento Nacional
Agua Caliente, del partido de Cartago, y,

Considerando:

l.
Que el Ministerio de Cultura y Juventud es la institución rectora de las
políticas nacionales en materia cultural y le corresponde fomentar y preservar
la pluralidad y la diversidad cultural, facilitar la participación de todos los
sectores sociales en los procesos de desarrollo cultural y artístico sin
distingos de género, grupo étnico o ubicación geográfica; mediante la apertura
de espacios y oportunidades que propicien la revitalización de las tradiciones
y manifestaciones culturales, el disfrute de los bienes y servicios culturales,
así como la creación y apreciación artística en sus diversas manifestaciones.

II.
Que la cultura es un factor de cohesión social y reserva de recursos simbólicos
y materiales que, por lo tanto, tiene un papel medular en la vida política,
económica y social de las poblaciones y es un elemento central en el bienestar
humano.

III.
Que el artículo 36 de la Ley sobre Patrimonio Nacional Arqueológico, Nº. 6703 del
28 de diciembre de 1981, declara de interés público la investigación,
protección, conservación, restauración y recuperación del patrimonio
arqueológico de Costa Rica.

IV.
Que el Decreto Ejecutivo Nº 29.908 del 5 de setiembre de 2001 declara e
incorpora al Patrimonio Histórico- Arquitectónico de Costa Rica. bajo la
categoría de Monumento, el inmueble conocido Sitio de Agua Caliente, ubicado en
el distrito quinto, del cantón primero de la provincia de Cartago.

V.
Que el Proyecto Monumento Nacional Agua Caliente de Cartago, encuentra su línea
de acción en los siguientes ejes estratégicos de la política: participación
efectiva y disfrute de los derechos culturales en la diversidad, dinamización
económica de la cultura, protección y gestión del patrimonio cultural, material e
inmaterial y Fortalecimiento institucional para la promoción y protección de
los Derechos Culturales.

VI.
Que el Monumento Nacional Agua Caliente es considerado el asentamiento
precolombino de mayor importancia dentro del Valle de El Guarco
y de los principales dentro de la denominada Región Arqueológica Central y fue
declarado Monumento Nacional por Decreto Ejecutivo Nº 29.908.

VII.
Que el Museo Nacional de Costa Rica es propietario del inmueble conocido como
Monumento Nacional Agua Caliente, ubicado en el distrito quinto, del cantón
primero de la provincia de Cartago, matrículas de folios reales 216894-000,
216895-000, 216896-000.

VIII.
Que el sitio arqueológico Monumento Nacional Agua Caliente, se conoce desde el
siglo XIX, pero comienza a investigarse científicamente a partir del año 1981
por parte del Museo Nacional de Costa Rica, siendo que, producto de estas
investigaciones, se determina que esta fue la aldea de mayor importancia
política y ceremonial de la región, perviviendo hasta tiempos de las primeras
incursiones españolas al valle de El Guarco.

IX.
Que el programa "Parque Arqueológico Agua Caliente de Cartago" es
coincidente con lo establecido en el Plan Nacional de Desarrollo e Inversión
Pública 2023-2026 Rogelio Fernández Güell, donde en el apartado del Sector
Cultura se indica que se trabajará en generar un acercamiento de las
instituciones culturales, a la población de todo el país, especialmente a las
regiones periféricas, procurando vincular iniciativas de museos, bibliotecas,
movimientos teatrales, música, patrimonio, cine, entre otras expresiones
culturales, a la idiosincrasia de las regiones, aprovechando sus condiciones
culturales locales únicas.

X.
Que el Parque arqueológico se conceptualiza como un foco de desarrollo basado
en la puesta en valor de patrimonio cultural arqueológico como medio para la
investigación científica de las poblaciones antiguas, la reactivación
socioeconómica de la población local, la atención y capacitación a la población
con altos niveles de pobreza, que fortalecerá las capacidades blandas, el
desarrollo de liderazgo e innovación social, la generación de valor a partir
del trabajo creativo y la gestión responsable con el patrimonio arqueológico,
el medio ambiente y el entorno social, adicionalmente a otras posibilidades de
desarrollo, participación y expresión de la población.

XI.
Que esta labor transciende al Ministerio de Cultura y Juventud e involucra
tanto a las instituciones gubernamentales como a la Municipalidad de Cartago,
las organizaciones no gubernamentales y, en general, a la sociedad civil.

XII.
Que de conformidad con el artículo 12 bis del Reglamento a la Ley de Protección
al Ciudadano del Exceso de Requisitos y Trámites Administrativos (Decreto
Ejecutivo Nº 3 7045-MPMEIC del 22 de febrero de 2012), cuando la institución
proponente determine que la regulación no establece ni modifica trámites,
requisitos o procedimientos, que el administrado deba cumplir ante la
Administración Central, no deberá realizar este control previo y así deberá
indicarlo en la parte considerativa de la regulación propuesta.

XIII.
Que, al utilizar como referencia el cuestionario establecido en la Sección I
Formulario de Evaluación Costo- Beneficio Denominada Control Previo de Mejora
Regulatoria del MEIC, se verifica que la presente norma no establece ni
modifica trámites, requisitos o procedimientos, que el administrado deba
cumplir ante el Ministerio de Cultura y Juventud, por lo que no se realiza el
control previo.

Por tanto,

DECRETAN:

CREACIÓN
DEL "PARQUE ARQUEOLÓGICO

AGUA
CALIENT E DE CARTAGO"

CAPÍTULO
l.

DISPOSICIONES
GENERALES

Artículo 1 ° - Creación. Créase el Parque Arqueológico
Agua Caliente de Cartago, corno un Programa del Museo Nacional de Costa Rica
desarrollado de manera conjunta con la Municipalidad de Cartago, con la
finalidad de ser un espacio para el desarrollo del Cantón de Cartago y zonas
aledañas basado en una gestión integral del patrimonio arqueológico y natural
con participación ciudadana.

Artículo 2°-
Objetivos. El Parque Arqueológico Agua
Caliente de Cartago tendrá los siguientes objetivos:

Objetivo
general: Desarrollar un Parque
arqueológico en el Monumento Agua Caliente que garantice la protección, conservación,
investigación y educación del patrimonio cultural y natural para el beneficio
de la ciudadanía.

Objetivos
estratégicos:

a.
Desarrollar acciones y estrategias multidisciplinarias e interinstitucionales
que permitan la conservación de los recursos patrimoniales del monumento.

b. Promover
la investigación permanente en el sitio patrimonial, para el reconocimiento de
las características socioculturales, económicas, políticas, ceremoniales y arqueológicas
de las antiguas poblaciones del valle de El Guarco.

c.
Desarrollar actividades formativas e investigativas que permitan la comprensión
y val oración de las riquezas arqueológicas e históricas del monumento.

d.
Desarrollar actividades que permitan la integración de la comunidad local, para
uso responsable y el máximo aprovechamiento del sitio, de tal forma que se
estimule el sentido de pertenencia, el
arraigo identitario y la protección de las riquezas patrimoniales.

e. Establecer
un diseño paisajístico que integre elementos florísticos nativos de la región para
el beneficio ecológico y el rescate de especies botánicas de la región.

f. Promover
la dinamización de la economía y el desarrollo en el cantón y el distrito, al convertirse
en un sitio patrimonial de alta visitación.

Artículo 3°-
Financiamiento. El Parque
Arqueológico Agua Caliente de Ca1tago, se podrá financiar mediante las
siguientes fuentes:

a. Recursos
provenientes del Presupuesto Ordinario y Extraordinario de la República de cada
año fiscal asignados al Museo Nacional de Costa Rica.

b. Recursos
de cualquier otra fuente, pública o privada, nacional o internacional, incluyendo
donaciones, con sustento en el marco jurídico vigente y siguiendo las normas
presupuestarias vigentes.

CAPÍTULO II.

INSTANCIAS
RESPONSABLES DE GESTIONAR

EL PATRIMONIO
CULTURAL ARQUEOLÓGICO

Artículo 4.-
De la Comisión Institucional. Créase la
Comisión Institucional que le dará seguimiento al programa "Parque
Arqueológico Agua Caliente de Cartago", integrada por:

a. La
dirección general del Museo Nacional de Costa Rica o su representante, quien presidirá
la comisión.

b. El Alcalde
de la Municipalidad de Cartago o su representante.

c. La
dirección de la Dirección de Patrimonio Cultural del Ministerio de Cultura y
Juventud o su representante, quién fungirá como enlace para atender las
asesorías y acompañamiento que dicta la Ley No. 7555, Ley de Patrimonio
Histórico y Arquitectónico de Costa Rica y su Reglamento, Decreto Ejecutivo No.
32749-C.

d. La Jefatura
del Departamento de Antropología e Historia del Museo Nacional de Costa Rica
quien ejercerá la secretaría técnica.

Artículo 5º -
Funciones de la Presidencia. Serán
funciones de la Presidencia de la Comisión Institucional las siguientes:

a) Presidir,
con todas las facultades necesarias para ello, las reuniones de la Comisión Institucional.
las que podrá suspender en cualquier momento por causa _justificada.

b) Convocar a
sesiones extraordinarias.

c)
Confeccionar el orden del día, teniendo en cuenta en su caso, las peticiones de
los demás miembros. Los miembros
deberán presentar sus solicitudes con al menos tres días de anticipación a la
realización de la sesión. En su defecto, delegar esta función en la Secretaría.

d) Ejercer el
voto de calidad.

e) Velar por
la adecuada y eficaz ejecución de los acuerdos de la Comisión Institucional.

t) Comunicar
a los interesados las resoluciones de la Comisión Institucional.

Artículo 6.- Funciones de la Secretaría de la Comisión Institucional. Serán funciones de la
Secretaría de la Comisión las siguientes:

a) Convocar a
los miembros de la Comisión Institucional a las sesiones ordinarias.

b) Levantar
las actas de las sesiones de la Comisión Institucional y velar por su debida
firma y conservación.

c) Apoyar al Presidente
en el seguimiento de los acuerdos de la Comisión Institucional.

Artículo 7.-
De las funciones de la Comisión Institucional. Serán funciones de la Comisión Institucional:

a) Dar
seguimiento al Plan de Gestión del Parque Arqueológico Agua Caliente.

b) Apoyar al
Museo Nacional de Costa Rica en la gestión del Parque Arqueológico Agua Caliente.

c) Velar por
que los fondos destinados para el desarrollo del Parque Arqueológico Agua Caliente
de Cartago, provenientes del Presupuesto Ordinario y Extraordinario de la República,
así como de otras fuentes de financiamiento, se asignen y ejecuten de acuerdo con
el destino para el cual se trasladan.

Artículo 8.- Sesiones de la Comisión Institucional. La Comisión Institucional sesionará
ordinariamente cada seis meses y extraordinariamente cuando el caso lo amerite, a solicitud de la
Presidencia. Para esto deberá convocarse vía correo electrónico con una antelación mínima de
veinticuatro horas.

Artículo 9.- Quórum en las sesiones de la Comisión Institucional. Para que pueda sesionar la
Comisión Institucional, se necesitará la presencia de una mayoría absoluta de sus miembros. Si no
hubiere quórum a la hora convocada, podrá sesionar después de media hora. y para ello será
suficiente la asistencia de la tercera parte de sus miembros.

Artículo 10.- Sustitución de los miembros de la
Comisión Institucional. En caso de
que alguno de los representantes de la Comisión Institucional faltare a dos
sesiones seguidas, sin justificación; el Presidente de la Comisión
Institucional deberá comunicarlo a la institución que representa el ausente,
para que su jerarca proceda a su sustitución. Las debidas justificaciones
deberán presentarse ante la Presidencia de la Comisión Institucional con veinticuatro
horas de antelación a la sesión y de forma escrita.

Artículo 11.- Acuerdos de la Comisión Institucional. Los acuerdos de la Comisión Institucional serán
adoptados por mayoría absoluta de sus miembros presentes en la sesión.

No podrá ser
objeto de acuerdo ningún asunto que no figure en el orden del día, salvo que estén
presentes los dos tercios de los miembros de la Comisión Institucional y sea
declarada la urgencia del asunto por el voto favorable de todos ellos.

Artículo 12.-
Del Grupo Asesor. La Comisión
Institucional solicitará criterio al Grupo de Asesor en la toma de decisiones
de aspectos técnicos específicos cuando lo considere pertinente. El grupo
estará integrado por los jefes de los Departamentos del Museo Nacional de Costa
Rica de Administración y Finanzas, la Unidad de Asesoría Jurídica, Protección
del Patrimonio Cultural, Proyección Museológica, Programa Museos Regionales, un
representante de la dirección de la Dirección de Patrimonio Cultural del
Ministerio de Cultura y Juventud y/u otros representantes de instituciones que,
a juicio del Ministerio de Cultura y Juventud, sean fundamentales para el
desarrollo del Parque.

Artículo 13.-
Del Plan de Gestión. El Plan de
Gestión consiste en un documento rector que orienta las acciones e inversiones
necesarias para la investigación, conservación y manejo sostenible del
patrimonio cultural y natural del monumento arqueológico Agua Caliente. De acuerdo
con los objetivos el Plan de Gestión del Parque Arqueológico Agua Caliente de Cartago
será presentado por el Museo Nacional de Costa Rica a la Comisión Institucional
en un plazo de seis meses una vez de publicado este decreto.

Artículo 14.-
Vigencia. Rige a partir de su
publicación.

THE
PRESIDENT OF THE REPUBLIC,

AND THE
MINISTER OF CULTURE AND YOUTH

In
use of the powers conferred upon them by articles 140, subsections 3), 18) and
20) and 146 of the Political Constitution of the Republic of Costa Rica, and based
on articles 23, subsection m), 25 paragraph 1), 27 paragraph 1), 28,
subsections I and 2, subparagraph b) of the General Law of Public Administration, No.
6227 of May 2, 1978, article 36 of the Law on National Archaeological Heritage, No. 6703 of December 28, 1981, articles 1 and 2 of Executive Decree No. 29.908 of September 5, 2001 and its amendment Executive Decree
No. 35841 of November 18, 2009 which declares and incorporates into the Architectural Historical Heritage of Costa Rica, the property known as Agua Caliente National Monument, of the Cartago district, and,

Considering:

I.
That the Ministry of Culture and Youth is the governing institution for national
cultural policies and is responsible for promoting and preserving cultural plurality and diversity, facilitating the participation of all social sectors in cultural and artistic development processes without distinctions of gender, ethnic group or geographic location; by opening spaces and opportunities that foster the revitalization of traditions and cultural expressions, the enjoyment of cultural goods and services, as well as artistic creation and appreciation in its various manifestations.

II.
That culture is a factor of social cohesion and a reserve of symbolic and material resources that, therefore, plays a central role in the political, economic and social life of populations and is a core element in human well-being.

III.
That article 36 of the Law on National Archaeological Heritage, No. 6703 of
December 28, 1981, declares the research, protection, conservation, restoration and recovery of the archaeological heritage of Costa Rica to be of public interest.

IV.
That Executive Decree No. 29.908 of September 5, 2001 declares and incorporates into the Historical-Architectural Heritage of Costa Rica, under the category of Monument, the property known as Agua Caliente Site, located in
the fifth district, of the first canton of the province of Cartago.

V.
That the Agua Caliente de Cartago National Monument Project finds its line of action in the following strategic policy axes: effective participation and enjoyment of cultural rights in diversity, economic revitalization of culture, protection and management of cultural heritage, tangible and intangible, and Institutional strengthening for the promotion and protection of Cultural Rights.

VI.
That the Agua Caliente National Monument is considered the most important pre-Columbian settlement within the El Guarco Valley and one of the main ones within the so-called Central Archaeological Region and was declared a National Monument by Executive Decree No. 29.908.

VII.
That the National Museum of Costa Rica is the owner of the property known as
Agua Caliente National Monument, located in the fifth district, of the first canton of the province of Cartago, registered under real folio numbers 216894-000,
216895-000, 216896-000.

VIII.
That the Agua Caliente National Monument archaeological site has been known since the
19th century, but began to be scientifically researched starting in 1981
by the National Museum of Costa Rica, with the result that, from this
research, it is determined that this was the village of greatest political and ceremonial importance in the region, surviving until the time of the first Spanish incursions into the El Guarco valley.

IX.
That the "Parque Arqueológico Agua Caliente de Cartago" program is
consistent with the provisions of the Rogelio Fernández Güell National Development and Public Investment Plan 2023-2026, where in the Culture Sector section it is indicated that work will be done to bring cultural institutions closer to the population of the entire country, especially in peripheral regions, seeking to link initiatives of museums, libraries, theater movements, music, heritage, cinema, among other cultural expressions, to the idiosyncrasy of the regions, taking advantage of their unique local cultural conditions.

X.
That the archaeological park is conceptualized as a development hub based on the enhancement of archaeological cultural heritage as a means for the scientific research of ancient populations, the socioeconomic reactivation of the local population, the support and training of the population with high levels of poverty, which will strengthen soft skills, the development of leadership and social innovation, the generation of value from creative work and responsible management with archaeological heritage, the environment and the social surroundings, in addition to other possibilities for development, participation and expression of the population.

XI.
That this work transcends the Ministry of Culture and Youth and involves
both governmental institutions and the Municipality of Cartago,
non-governmental organizations and, in general, civil society.

XII.
That in accordance with article 12 bis of the Regulation to the Law for the Protection of Citizens from Excessive Requirements and Administrative Procedures (Decreto Ejecutivo Nº 37045-MP-MEIC of February 22, 2012), when the proposing institution determines that the regulation does not establish or modify procedures, requirements or processes that the administered party must comply with before the Central Administration, it shall not carry out this prior control and shall so indicate in the considerative part of the proposed regulation.

XIII.
That, using as a reference the questionnaire established in Section I, Cost-Benefit Evaluation Form Called Prior Control of Regulatory Improvement of the MEIC, it is verified that this norm does not establish or modify procedures, requirements or processes that the administered party must comply with before the Ministry of Culture and Youth; therefore, the prior control is not carried out.

Therefore,

THEY DECREE:

CREATION
OF THE "AGUA CALIENTE DE CARTAGO
ARCHAEOLOGICAL PARK"

CHAPTER
I.

GENERAL
PROVISIONS

Article 1 - Creation. The Agua Caliente de Cartago Archaeological Park is created as a Program of the National Museum of Costa Rica developed jointly with the Municipality of Cartago, with the purpose of being a space for the development of the Canton of Cartago and surrounding areas based on an integrated management of the archaeological and natural heritage with citizen participation.

Article 2 -
Objectives. The Agua Caliente de Cartago Archaeological Park shall have the following objectives:

General objective: To develop an archaeological park at the Agua Caliente Monument that guarantees the protection, conservation, research and education of cultural and natural heritage for the benefit of the citizenry.

Strategic objectives:

a.
To develop multidisciplinary and inter-institutional actions and strategies that allow for the conservation of the heritage resources of the monument.

b. To promote permanent research at the heritage site, for the recognition of the sociocultural, economic, political, ceremonial and archaeological characteristics of the ancient populations of the El Guarco valley.

c.
To develop training and research activities that allow for the understanding and appreciation of the archaeological and historical riches of the monument.

d.
To develop activities that allow for the integration of the local community, for responsible use and the maximum utilization of the site, in such a way as to stimulate the sense of belonging, identity rootedness and the protection of heritage riches.

e. To establish a landscape design that integrates native floristic elements of the region for ecological benefit and the rescue of botanical species of the region.

f. To promote the revitalization of the economy and development in the canton and the district, by becoming a heritage site with high visitation.

Article 3 -
Financing. The Agua Caliente de Cartago Archaeological Park may be financed through the following sources:

a. Resources from the Ordinary and Extraordinary Budget of the Republic for each fiscal year allocated to the National Museum of Costa Rica.

b. Resources from any other source, public or private, national or international, including donations, with support in the current legal framework and following current budget norms.

CHAPTER II.

INSTANCES RESPONSIBLE FOR MANAGING
THE ARCHAEOLOGICAL CULTURAL HERITAGE

Article 4.-
The Institutional Commission. The Institutional Commission that will follow up on the "Parque Arqueológico Agua Caliente de Cartago" program is created, composed of:

a. The general director of the National Museum of Costa Rica or their representative, who will preside over the commission.

b. The Mayor of the Municipality of Cartago or their representative.

c. The director of the Cultural Heritage Directorate of the Ministry of Culture and Youth or their representative, who will act as liaison for attending to the advice and accompaniment dictated by Law No. 7555, Historical and Architectural Heritage Law of Costa Rica and its Regulation, Decreto Ejecutivo No. 32749-C.

d. The Head of the Department of Anthropology and History of the National Museum of Costa Rica who will exercise the technical secretariat.

Article 5 -
Functions of the Presidency. The functions of the Presidency of the Institutional Commission shall be the following:

a) To preside, with all necessary powers for this, over the meetings of the Institutional Commission, which it may suspend at any time for justified cause.

b) To convene extraordinary sessions.

c) To prepare the agenda, taking into account, where applicable, the requests of the other members. Members must submit their requests at least three days in advance of the session. Otherwise, to delegate this function to the Secretariat.

d) To exercise the casting vote.

e) To ensure the adequate and effective execution of the agreements of the Institutional Commission.

f) To communicate the resolutions of the Institutional Commission to the interested parties.

Article 6.- Functions of the Secretariat of the Institutional Commission. The functions of the Secretariat of the Commission shall be the following:

a) To convene the members of the Institutional Commission to ordinary sessions.

b) To draft the minutes of the sessions of the Institutional Commission and ensure their proper signature and safekeeping.

c) To support the President in the follow-up of the agreements of the Institutional Commission.

Article 7.-
Functions of the Institutional Commission. The functions of the Institutional Commission shall be:

a) To follow up on the Management Plan of the Agua Caliente Archaeological Park.

b) To support the National Museum of Costa Rica in the management of the Agua Caliente Archaeological Park.

c) To ensure that the funds allocated for the development of the Agua Caliente de Cartago Archaeological Park, coming from the Ordinary and Extraordinary Budget of the Republic, as well as from other sources of financing, are allocated and executed in accordance with the purpose for which they are transferred.

Article 8.- Sessions of the Institutional Commission. The Institutional Commission shall meet ordinarily every six months and extraordinarily when the case warrants it, at the request of the Presidency. For this, it must be convened via email with a minimum of twenty-four hours' notice.

Article 9.- Quorum for the sessions of the Institutional Commission. For the Institutional Commission to meet, the presence of an absolute majority of its members shall be required. If there is no quorum at the convened time, it may meet after half an hour, and for this, the attendance of one-third of its members shall be sufficient.

Article 10.- Replacement of the members of the Institutional Commission. In the event that any of the representatives of the Institutional Commission misses two consecutive sessions, without justification, the President of the Institutional Commission shall communicate this to the institution represented by the absent member, so that its head may proceed with their replacement. Proper justifications must be submitted to the Presidency of the Institutional Commission twenty-four hours in advance of the session and in writing.

Article 11.- Agreements of the Institutional Commission. The agreements of the Institutional Commission shall be adopted by an absolute majority of its members present at the session.

No matter that does not appear on the agenda may be the subject of an agreement, unless two-thirds of the members of the Institutional Commission are present and the urgency of the matter is declared by the favorable vote of all of them.

Article 12.-
The Advisory Group. The Institutional Commission shall request the opinion of the Advisory Group in making decisions on specific technical aspects when it deems it pertinent. The group shall be composed of the heads of the Departments of the National Museum of Costa Rica for Administration and Finance, the Legal Advisory Unit, Protection of Cultural Heritage, Museological Outreach, the Regional Museums Program, a representative of the directorate of the Cultural Heritage Directorate of the Ministry of Culture and Youth and/or other representatives of institutions that, in the judgment of the Ministry of Culture and Youth, are fundamental for the development of the Park.

Article 13.-
The Management Plan. The Management Plan consists of a guiding document that directs the actions and investments necessary for the research, conservation and sustainable management of the cultural and natural heritage of the Agua Caliente archaeological monument. In accordance with the objectives, the Management Plan for the Agua Caliente de Cartago Archaeological Park shall be presented by the National Museum of Costa Rica to the Institutional Commission within a period of six months once this decree is published.

Article 14.-
Effective Date. It shall take effect from its publication.
