Con
fundamento en lo dispuesto en los artículos 11, 140, inciso 18) y 146 de la
Constitución Política, en los artículos 25 inciso 1), 27 inciso 1) y 28 inciso 2)
acápite b) de la Ley General de Administración Pública Nº 6227 del 02 de mayo
de 1978, en el artículo 32 de la Ley de Asociaciones Nº 218 del 8 de agosto de
1939 y los artículos 27 y siguientes del Reglamento a la Ley de Asociaciones Nº
29496-J, publicado en La Gaceta Nº 96 del 21 de mayo del 2001.

CONSIDERANDO

I.- Que el
artículo 3 2 de la Ley de Asociaciones Nº218 del 8 de agosto de 193 9 y sus reformas,
confiere al Poder Ejecutivo la potestad de declarar de utilidad pública a las asociaciones
simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente
útiles para los intereses del Estado, y que por ello contribuyan a solventar una
necesidad social.

II.-Que La Asociación
Administradora del Acueducto y Alcantarillado Rural de Bananito Norte y Sur de
Limón, cédula jurídica número tres- cero cero dos-quinientos cincuenta y ocho
mil ochocientos veinticuatro, se inscribió en el Registro de Asociaciones del
Registro Público el cinco de diciembre del dos mil ocho, al tomo quinientos
setenta y cinco, asiento cincuenta y un mil seiscientos noventa y uno.

III-Que el
artículo 32 de la Ley de Asociaciones establece: "Las Asociaciones que
sean declaradas de utilidad pública gozarán de beneficios y franquicias que el
Poder Ejecutivo otorga de acuerdo con la ley. Deberán presentar a la Asesoría
Jurídica del Ministerio de Justicia y Paz un informe anual de su gestión,
referido al aprovechamiento a favor de la comunidad del beneficio que les fue
otorgado sin necesidad de requerimiento expreso. El plazo para la presentación
del informe anual es durante los meses de enero, febrero y hasta el último día
hábil del mes de marzo inclusive. " Asimismo, el ordinal 33 bis del Reglamento
a la Ley de Asociaciones, agrega: "La declaratoria de utilidad
pública será revocable en cualquier momento, no obstante, en caso de la no
presentación o presentación incompleta del informe de labores, se prevendrá a
la asociación, una única vez, por el plazo de diez días hábiles. Asimismo, la derogatoria
de la utilidad pública se realizará mediante resolución razonada resultante del
procedimiento de derogatoria del beneficio de utilidad pública el cual, se
regirá por lo establecido en la Ley General de Administración Pública (.) ".
Finalmente, el numeral 33 ter del Reglamento a la Ley de Asociaciones, indica:
"En caso de que alguna asociación renuncie a la declaratoria de utilidad
pública, deberá presentar la documentación correspondiente ante la Asesoría
Jurídica del Ministerio de Justicia y Paz quien, sin más trámite, procederá a
realizar la derogatoria. "

IV.-Que la
Asociación Administradora del Acueducto y Alcantarillado Rural de Bananito Norte
y Sur de Limón, cédula jurídica número tres- cero cero dos-quinientos cincuenta

Asociación Administradora del Acueducto y Alcantarillado Rural de Bananito Norte
y Sur de Limón, cédula jurídica número tres- cero cero dos-quinientos cincuenta
y ocho mil ochocientos veinticuatro, fue declarada de utilidad pública por el
Ministerio de Justicia y Paz mediante Decreto Ejecutivo N°41749-MPJ del ocho de
marzo del dos mil diecinueve, publicado en el Diario Oficial La Gaceta Nº l 15 del
veinte de junio del dos mil diecinueve.

V.-Que la
Asociación Administradora del Acueducto y Alcantarillado Rural de Bananito Norte
y Sur de Limón, incumplió con la presentación de informes anuales de labores correspondiente
a los años 2022 y 2023 y por medio de su representante legal, el señor Eric de
la Trinidad Salguero Espinoza, cédula de identidad número siete-cero ciento
cuatro-cero cero veintidós, a través del memorial de fecha seis de julio de dos
mil veintitrés, expresamente renuncio a la declaratoria de utilidad pública,
otorgada por el Ministerio de Justicia y Paz, para acogerse a la Ley Nº 8776,
Exoneración a las Asociaciones Administradoras de Sistemas de Acueductos y
Alcantarillados Comunales (ASADAS).

Por tanto,

DECRETAN

DEROGAR LA
DECLARATORIA DE UTILIDAD PÚBLICA DE LA ASOCIACIÓN

ADMINISTRADORA
DEL ACUEDUCTO Y ALCANTARILLADO RURAL DE

BANANITO
NORTE Y SUR DE LIMÓN

Artículo 1.- Dejar sin efecto el Decreto Ejecutivo Nº41749-MPJ
del ocho de marzo del dos mil diecinueve, mediante el cual se declaró de
utilidad pública para los intereses del Estado a Asociación Administradora Del
Acueducto Y Alcantarillado Rural De Bananito Norte Y Sur De Limón cédula
jurídica número tres- cero cero dos-quinientos cincuenta y ocho mil ochocientos
veinticuatro

Artículo 2.- Una vez publicado este decreto, deberá comunicarse
al Registro de Asociaciones del Registro Nacional para su respectiva anotación.

Artículo 3.- La administración notificará el presente acto al
Ministerio de Hacienda, la Dirección General de Tributación y el Registro
Nacional de la Propiedad, a efecto de que proceda conforme su competencia.

Artículo 4.- Rige a partir de su publicación.

THE PRESIDENT
OF THE REPUBLIC

OF JUSTICE AND PEACE

Based
on the provisions of Articles 11, 140, subsection 18) and 146 of the
Political Constitution, Articles 25 subsection 1), 27 subsection 1) and 28 subsection 2)
item b) of the General Law of Public Administration Nº 6227 of May 2,
1978, Article 32 of the Law of Associations Nº 218 of August 8,
1939 and Articles 27 and following of the Regulation to the Law of Associations Nº
29496-J, published in La Gaceta Nº 96 of May 21, 2001.

CONSIDERING

I.— That Article 3 2 of the Law of Associations Nº 218 of August 8, 193 9 and its amendments,
grants the Executive Branch the power to declare of public utility (utilidad pública) simple, federated, or confederated associations whose development and activities are particularly
useful for the interests of the State, and that thereby contribute to solving a
social need.

II.—That the Administrative Association of the Rural Aqueduct and Sewer System of Bananito Norte and Sur of
Limón (Asociación
Administradora del Acueducto y Alcantarillado Rural de Bananito Norte y Sur de
Limón), legal ID number three-zero zero two-five hundred fifty-eight
thousand eight hundred twenty-four, was registered in the Registry of Associations of the
Public Registry on December five, two thousand eight, in volume five hundred
seventy-five, entry fifty-one thousand six hundred ninety-one.

III—That Article 32 of the Law of Associations establishes: "Associations that
are declared of public utility (utilidad pública) shall enjoy benefits and franchises that the
Executive Branch grants in accordance with the law. They must submit to the Legal
Advisory Office of the Ministry of Justice and Peace an annual report of their management,
referring to the use for the benefit of the community of the benefit that was granted
to them without the need for an express request. The deadline for the submission
of the annual report is during the months of January, February, and up to the last
business day of the month of March, inclusive." Likewise, subsection 33 bis of the Regulation
to the Law of Associations adds: "The declaration of public utility (utilidad pública)
shall be revocable at any time; however, in the event of non-submission or incomplete
submission of the work report, the association shall be warned, one single time, within
a period of ten business days. Likewise, the repeal of
the public utility (utilidad pública) shall be carried out by reasoned resolution resulting from the
procedure for the repeal of the benefit of public utility (utilidad pública), which shall
be governed by the provisions of the General Law of Public Administration (.)."
Finally, numeral 33 ter of the Regulation to the Law of Associations indicates:
"In the event that an association renounces the declaration of public utility (utilidad pública),
it must submit the corresponding documentation to the Legal
Advisory Office of the Ministry of Justice and Peace which, without further procedure, shall proceed to
carry out the repeal."

IV.—That the Administrative Association of the Rural Aqueduct and Sewer System of Bananito Norte
and Sur of Limón, legal ID number three-zero zero two-five hundred fifty
and

Administrative Association of the Rural Aqueduct and Sewer System of Bananito Norte
and Sur of Limón, legal ID number three-zero zero two-five hundred fifty
and eight thousand eight hundred twenty-four, was declared of public utility (utilidad pública) by the
Ministry of Justice and Peace through Executive Decree N°41749-MPJ of March eight,
two thousand nineteen, published in the Official Gazette La Gaceta Nº 115 of June
twenty, two thousand nineteen.

V.—That the Administrative Association of the Rural Aqueduct and Sewer System of Bananito Norte
and Sur of Limón, failed to comply with the submission of the annual work reports corresponding
to the years 2022 and 2023, and through its legal representative, Mr. Eric de
la Trinidad Salguero Espinoza, identity card number seven-zero one hundred
four-zero zero twenty-two, by means of the brief dated July six, two thousand
twenty-three, expressly renounced the declaration of public utility (utilidad pública),
granted by the Ministry of Justice and Peace, in order to avail itself of Law Nº 8776,
Exoneration for Administrative Associations of Community Water and Sewer Systems (ASADAS).

Therefore,

THEY DECREE

REPEAL THE
DECLARATION OF PUBLIC UTILITY OF THE ASSOCIATION

ADMINISTRATIVE
MANAGER OF THE RURAL AQUEDUCT AND SEWER SYSTEM OF

BANANITO
NORTE AND SUR OF LIMÓN

Article 1.— Render without effect Executive Decree Nº41749-MPJ
of March eight, two thousand nineteen, by which the Administrative Association of the Rural Aqueduct
and Sewer System of Bananito Norte and Sur of Limón, legal
ID number three-zero zero two-five hundred fifty-eight thousand eight hundred
twenty-four, was declared of public utility (utilidad pública) for the interests of the State.

Article 2.— Once this decree is published, it must be communicated
to the Registry of Associations of the National Registry for its respective annotation.

Article 3.— The administration shall notify this act to the
Ministry of Finance (Ministerio de Hacienda), the General Directorate of Taxation (Dirección General de Tributación), and the National
Property Registry (Registro Nacional de la Propiedad), so that they may proceed according to their competence.

Article 4.— It shall take effect from its publication.
