En uso de las facultades
que les confiere el artículo 140 incisos 3 y 18 de la Constitución Política;
artículo 28 párrafo 2) inciso b) de la Ley Nº 6227 Ley General de la
Administración Pública del 02 de mayo de 1978; Ley Nº 7064 Ley de Fomento a la
Producción Agropecuaria FODEA y Orgánica del MAG del 29 de abril de 1987;
artículos 27, 28, 29, 30, 67, 78, 79, 80 y 83 de la Ley Nº 7664 Ley de
Protección Fitosanitaria del 8 de abril de 1997 y de conformidad con lo
dispuesto en el artículo 1 7 inciso ch) de la Ley Nº 7221 Ley Orgánica del
Colegio de Ingenieros Agrónomos del 06 de abril de 1991.

CONSIDERANDO:

1. Que el artículo 46 de la
Constitución Política establece el derecho constitucional de los consumidores-y
usuarios a la protección de su salud, ambiente, seguridad e intereses económicos,
así como a recibir información adecuada y veraz, a la libertad de elección y a
un trato equitativo.

2. Que el artículo 50 de la
Constitución Política consagra el derecho de todas las personas a un ambiente
sano y ecológicamente equilibrado, siendo el deber del Estado garantizar,
defender y preservar ese derecho.

3. Que el artículo 27 de la
ley de Protección Fitosanitaria No. 7664 del 08 de abril de 1997, establece que
las personas físicas y jurídicas que importen, registren almacenen, distribuyan,
reempaquen o mezclen sustancias químicas biológicas o afines con propósitos
comerciales, deberán contar con los servicios de un profesional en ciencias agrícolas,
incorporado al Colegio de Ingenieros Agrónomos.

4. Que el artículo 28 de la
Ley de Protección Fitosanitaria No. 7664 del 08 de abril de 1997, establece la
responsabilidad de que las sustancias químicas, biológicas o afines estén
debidamente registrados, etiquetados y se ajusten a todas las disposiciones de
esta ley y sus reglamentos. Igual responsabilidad le compete al regente en lo
relativo a los equipos de aplicación para uso agrícola.

5. Que las recomendaciones
del regente serán vinculantes para la persona fisica o jurídica a la cual
presta sus servicios, así establecido en el artículo 28 de la Ley de Protección
Fitosanitaria.

6. Que el artículo 29 de la
Ley de Protección Fitosanitaria, establece que todas aquellas sustancias
químicas, biológicas o afines para uso agrícola que se clasifiquen en las categorías
de mayor toxicidad y las declaradas de uso restringido, deberán venderse únicamente
mediante receta expedida por un profesional en Ciencias Agrícolas, incorporado
al Colegio de Ingenieros Agrónomos el cual hará constar en la prescripción las
especificaciones e indicaciones técnicas, agronómicas y los métodos que deberán
aplicarse.

7. Que el artículo 30 de la
Ley de Protección Fitosanitaria, faculta al Ministerio de Agricultura y
Ganadería a restringir o prohibir la importación, el tránsito, el redestino, la
fabricación, la formulación, el reenvase, el reempaque, el almacenamiento, la
venta, la mezcla y la utilización de sustancias químicas, biológicas o afines y
equipos de aplicación para uso agrícola, cuando se justifique por razones
técnicas y se considere que emplearlas es perjudicial para la agricultura, la
salud o el ambiente.

8. Que la digitalización de
documentos en la administración pública transforma archivos físicos en
versiones electrónicas para agilizar procesos, mejorar la seguridad, reducir costos
y aumentar la transparencia, permitiendo un acceso más rápido y fácil a la información
por parte de funcionarios y ciudadanos trayendo beneficios como eficiencia y
agilidad mediante el aceleramiento de la gestión para la búsqueda y la
localización de documentos, eliminando la lentitud de los procesos manuales y
reduciendo errores. La Reducción de costos liberando espacio físico y disminuyendo
los gastos en papel e insumos y el almacenamiento físico. También mejora de la
seguridad y protección de los documentos toda vez que la digitalización permite
respaldar, encriptar y controlar mediante accesos restringidos, protegiendo la
información sensible. Mejora en la transparencia y acceso público con la
facilitación y el acceso a la información, promoviendo una mayor apertura y
control ciudadano sobre los procesos administrativos y por último mejora la colaboración
interinstitucional facilitando el intercambio ágil de documentos entre distintas
dependencias, fomentando la coordinación entre las instituciones
gubernamentales.

9. Que aunado a lo indicado en el acápite anterior se hace necesario digitalizar las recetas de
productos restringidos y crear los libros de actas de productos restringidos, con el fin de tener un
proceso ágil de manejo de datos asociados a estos productos y trazabilidad de toda aquella necesidad
de información ante entes fiscalizadores, control de ventas, atención de situaciones particulares y
demás requerimientos de alguna información específica, lo que actualmente se ve limitado al  levarse
de forma física, por lo que es indispensable adicionar una definición, infracciones y reformar el
artículo 17 del Decreto Ejecutivo No 26503-MAG, denominado Reglamento de Regencias Agropecuarias del
Colegio de Ingenieros Agrónomos de Costa Rica, publicado en la Gaceta 242 del 16 de diciembre de
1997.

10. Que la Ley de la
Promoción de la Competencia y Defensa Efectiva del Consumidor, Ley 7472 del 20
de diciembre de 1994. en su artículo 3 establece que: "los trámites y los requisitos
de control y regulación de las actividades económicas no deben impedir, entorpecer
ni distorsionar las transacciones en el mercado interno e internacional. La Administración
Pública debe revisar, analizar y eliminar, cuando corresponda esos trámites
para proteger el ejercicio de la libertad de empresa de garantizar la defensa
de la productividad ... ".

11. Que de conformidad con
lo establecido en el artículo 12 bis del Decreto Ejecutivo Nº 37045 del 22 de
febrero de 2012 y su reforma "Reglamento a la Ley de Protección al Ciudadano
del Exceso de Trámites y Requisitos Administrativos", esta regulación cumple
con los principios de mejora regulatoria, de acuerdo con el informe Nº DMRDAR- INF-269-2025
emitido por la Dirección de Mejora Regulatoria y Reglamentación Técnica del
Ministerio de Economía, Industria y Comercio.

Por tanto,

DECRETO EJECUTIVO Nº 26503-MAG

"REGLAMENTO DE
REGENCIAS AGROPECUARIAS DEL COLEGIO DE

INGENIEROS AGRONOMOS DE
COSTA RICA"

Artículo 1.- Adiciónese el inciso j) del artículo 2 del Decreto Ejecutivo Nº
26503-MAG, denominado Reglamento de Regencias Agropecuarias del Colegio de
Ingenieros Agrónomos de Costa Rica, publicado en la Gaceta 242 del 16 de
diciembre de 1997, y por consiguiente córrase el alfabeto, para que se lea de
la siguiente manera:

"j) Libro de
inventario de productos restringidos: registro aprobado por el Ministerio de Agricultura
y Ganadería, en el que se hará constar todo movimiento del producto restringido
que se manipuló, importó, formuló, reempacó y vendió. El registro debe indicar
la fecha de su formulación o entrada al país, el nombre de las personas físicas
o jurídicas a quienes se les vendió el producto, la cantidad, presentación,
fecha de operación, número de receta, número de factura, nombre del profesional
y número de colegiado de quien emitió la receta, uso recomendado del producto y
saldo de inventarios. "

Artículo 2.- Adiciónese un artículo 3 al Decreto Ejecutivo Nº 26503-MAG, denominado Reglamento
de Regencias Agropecuarias del Colegio de Ingenieros Agrónomos de Costa Rica,
publicado en la Gaceta 242 del 16 de diciembre de 1997, para que se lea de la
siguiente manera:

"Artículo 3 °-En todas
las categorías regencia/es el regente deberá acatar las disposiciones específicas
emitidas por el Servicio Fitosanitario del Estado, sobre la restricción de
venta y uso de agroquímicos en todo el país. ".

Artículo 3.- Adiciónese un articulo 43 al Decreto Ejecutivo Nº 26503-MAG, denominado Reglamento
de Regencias Agropecuarias del Colegio de Ingenieros Agrónomos de Costa Rica,
publicado en la Gaceta 242 del 16 de diciembre de 1997, y por consiguiente
córrase la numeración, para que se lea de la siguiente manera:

"Artículo 43°- Toda
infracción a las disposiciones del presente reglamento que afecten el uso y
manejo de sustancias químicas, biológicas o afines y equipos para aplicarlas en
la agricultura dará lugar a la aplicación de las sanciones establecidas en este
reglamento, así como las medidas especiales señaladas en los artículos 67, 78,
79, 80 y 83 de la Ley Nº 7664 del 08 de abril de 1997 "Ley de Protección
Fitosanitaria "y sus reformas."

Artículo 4.- Adiciónese un transitorio segundo al Decreto Ejecutivo Nº 26503-MAG, denominado
Reglamento de Regencias Agropecuarias del Colegio de Ingenieros Agrónomos de
Costa Rica, publicado en la Gaceta 242 del 16 de diciembre de 1997, en cuanto
al transitorio único existente, léase correctamente como Transitorio Uno y por
consiguiente el transitorio nuevo se lea de la siguiente manera:

"TRANSITORIO SEGUNDO:
Se establece un plazo de seis meses para que las regencias aprobadas por la
Junta Directiva del Colegio agoten los formularios físicos correspondientes a
la receta profesional para la venta de plaguicidas, que se clasifican en la
categoría de mayor toxicidad y aquellos que se declaren de uso restringido.
Transcurrido este plazo el regente deberá utilizar únicamente la receta profesional
digital, que se realizará mediante la plataforma web del Sen1icio Fitosanitario
del Estado del Ministerio de Agricultura y Ganadería. "

Artículo 5.- Adiciónese el ANEXO A al Decreto Ejecutivo Nº 26503-MAG, denominado Reglamento
de Regencias Agropecuarias del Colegio de Ingenieros Agrónomos de Costa Rica,
publicado en la Gaceta 242 del 16 de diciembre de 1997, para que se lea de la
siguiente manera:

Artículo 6.- Refórmese el inciso ñ) del artículo 2 del Decreto Ejecutivo Nº
26503-MAG,denominado Reglamento de Regencias Agropecuarias del Colegio de
Ingenieros Agrónomos de Costa Rica, publicado en la Gaceta 242 del 16 de
diciembre de 1997, para que se lea de la siguiente manera:

"ñ) Receta Profesional: documento expedido . de forma digital por un profesional incorporado al
Colegio de Ingenieros Agrónomos mediante el cual recomienda la utilización de un plaguicida o un
método de combate y cultivo, para uso en agricultura y su forma de aplicación que corresponda. Dicha
receta profesional, será elaborada y emitida digitalmente, por medio de la plataforma electrónica
que posee el Servicio Fitosanitario del Estado del Ministerio de Agricultura y Ganadería en su sitio
web. "

Artículo 7.- Refórmese el artículo 17 del Decreto Ejecutivo Nº 26503-MAG, denominado Reglamento
de Regencias Agropecuarias del Colegio de Ingenieros Agrónomos de Costa Rica,
publicado en la Gaceta 242 del 16 de diciembre de 1997, para que se lea de la
siguiente manera:

"Artículo 17º- Los
plaguicidas biológicos, sintéticos formulados, ingrediente activo grado técnico,
coadyuvantes y sustancias afines que se clasifiquen en la categoría de mayor toxicidad
y aquellos otros que se declaren de uso restringido, solo podrán ser comercializados
y utilizados bajo receta profesional, emitida por un miembro del Colegio que se
encuentre a derecho en sus obligaciones con el mismo.

La receta profesional será
emitida mediante formulario digital que estará disponible en la plataforma del
Sen1icio Fitosanitario del Estado del Ministerio de Agricultura y Ganadería.

En caso de que esta
plataforma estuviera fuera de servicio, el profesional deberá emitir la receta
utilizando el formulario indicado en el Anexo A de este reglamento.

Toda receta emitida en
formulario físico debe ser ingresada a la plataforma digital del Servicio
Fitosanitario del Estado del Ministerio de Agricultura y Ganadería, una vez que
la plataforma esté nuevamente en servicio en un plazo de 24 horas.

Artículo 8.- Rige a partir de su publicación

                        Reform of the Agricultural Stewardship Regulations of the College of Agronomists
                        of Costa Rica

THE PRESIDENT OF THE
REPUBLIC and

THE MINISTER OF AGRICULTURE
AND LIVESTOCK

In exercise of the powers
conferred by Article 140, subsections 3 and 18 of the Political Constitution;
Article 28, paragraph 2), subsection b) of Law No. 6227, General Law of the
Public Administration of May 2, 1978; Law No. 7064, Law for the Promotion of
Agricultural Production FODEA and Organic Law of the MAG of April 29, 1987;
Articles 27, 28, 29, 30, 67, 78, 79, 80 and 83 of Law No. 7664, Phytosanitary
Protection Law of April 8, 1997, and in accordance with the provisions of
Article 17, subsection ch) of Law No. 7221, Organic Law of the College of
Agronomists of April 6, 1991.

CONSIDERING:

1. That Article 46 of the
Political Constitution establishes the constitutional right of consumers and
users to the protection of their health, environment, safety, and economic
interests, as well as to receive adequate and truthful information, freedom of
choice, and equitable treatment.

2. That Article 50 of the
Political Constitution enshrines the right of all persons to a healthy and
ecologically balanced environment, it being the duty of the State to guarantee,
defend, and preserve that right.

3. That Article 27 of the
Phytosanitary Protection Law No. 7664 of April 8, 1997, establishes that
natural and legal persons who import, register, store, distribute, repackage,
or mix chemical, biological, or related substances for commercial purposes must
have the services of a professional in agricultural sciences, incorporated into
the College of Agronomists.

4. That Article 28 of the
Phytosanitary Protection Law No. 7664 of April 8, 1997, establishes the
responsibility for chemical, biological, or related substances to be duly
registered, labeled, and compliant with all provisions of this law and its
regulations. The same responsibility falls upon the agricultural steward (regente) regarding
application equipment for agricultural use.

5. That the recommendations
of the agricultural steward (regente) shall be binding on the natural or legal
person to whom they provide their services, as established in Article 28 of the
Phytosanitary Protection Law.

6. That Article 29 of the
Phytosanitary Protection Law establishes that all those chemical, biological, or
related substances for agricultural use that are classified in the categories
of highest toxicity and those declared for restricted use, shall be sold only
by means of a prescription issued by a professional in Agricultural Sciences,
incorporated into the College of Agronomists, who shall state in the
prescription the technical and agronomic specifications and indications and the
methods to be applied.

7. That Article 30 of the
Phytosanitary Protection Law authorizes the Ministry of Agriculture and
Livestock to restrict or prohibit the import, transit, re-consignment,
manufacture, formulation, re-containerization, repackaging, storage, sale,
mixing, and use of chemical, biological, or related substances and application
equipment for agricultural use, when justified for technical reasons and it is
considered that their use is harmful to agriculture, health, or the
environment.

8. That the digitization of
documents in the public administration transforms physical files into
electronic versions to streamline processes, improve security, reduce costs,
and increase transparency, allowing faster and easier access to information by
officials and citizens, bringing benefits such as efficiency and agility by
accelerating the management of document search and retrieval, eliminating the
slowness of manual processes and reducing errors. Cost reduction by freeing up
physical space and decreasing expenses on paper, supplies, and physical
storage. It also improves document security and protection, since digitization
allows for backing up, encrypting, and controlling information through
restricted access, protecting sensitive information. Improvement in
transparency and public access by facilitating access to information, promoting
greater openness and citizen oversight of administrative processes, and finally
improving inter-institutional collaboration by facilitating the agile exchange
of documents between different departments, fostering coordination among
government institutions.

9. That in addition to what
is indicated in the preceding paragraph, it is necessary to digitize the prescriptions
for restricted products and create the record books (libros de actas) for restricted
products, in order to have an agile process for managing data associated with
these products and traceability for all information needs before oversight
entities, sales control, attention to particular situations, and other
requirements for specific information, which is currently limited by being kept
in physical form; therefore, it is essential to add a definition, infractions, and
reform Article 17 of Executive Decree No. 26503-MAG, called the Agricultural
Stewardship Regulations of the College of Agronomists of Costa Rica, published
in Gazette 242 of December 16, 1997.

10. That the Law for the
Promotion of Competition and Effective Defense of the Consumer, Law 7472 of
December 20, 1994, in its Article 3 establishes that: "the procedures and
requirements for control and regulation of economic activities must not impede,
hinder, or distort transactions in the domestic and international market. The
Public Administration must review, analyze, and eliminate, when appropriate,
those procedures to protect the exercise of freedom of enterprise and guarantee
the defense of productivity ... ".

11. That in accordance with
the provisions of Article 12 bis of Executive Decree No. 37045 of February 22,
2012, and its reform, "Regulation to the Law for the Protection of Citizens
from Excess Procedures and Administrative Requirements," this regulation
complies with the principles of regulatory improvement, in accordance with
report No. DMRDAR-INF-269-2025 issued by the Directorate of Regulatory
Improvement and Technical Regulation of the Ministry of Economy, Industry, and
Commerce.

Therefore,

THEY DECREE:

ADDITION OF SUBSECTION J) OF
ARTICLE 2; ARTICLE 3; ARTICLE 43;

TRANSITORY SECOND AND
ANNEX A) AND REFORM OF SUBSECTION Ñ) OF

ARTICLE 2; ARTICLE 17 OF
EXECUTIVE DECREE NO. 26503-MAG

"AGRICULTURAL
STEWARDSHIP REGULATIONS OF THE COLLEGE OF

AGRONOMISTS OF COSTA
RICA"

Article 1.- Subsection j) is added to Article 2 of Executive Decree No.
26503-MAG, called the Agricultural Stewardship Regulations of the College of
Agronomists of Costa Rica, published in Gazette 242 of December 16,
1997, and consequently, the alphabet is shifted, so that it reads as follows:

"j) Inventory book for restricted products (Libro de inventario de productos restringidos): registry approved by the Ministry of Agriculture and Livestock, in which every movement of the restricted product that was handled, imported, formulated, repackaged, and sold shall be recorded. The registry must indicate the date of its formulation or entry into the country, the name of the natural or legal persons to whom the product was sold, the quantity, presentation, date of operation, prescription number, invoice number, name of the professional and membership number of the person who issued the prescription, recommended use of the product, and inventory balance. "

Article 2.- An Article 3 is added to Executive Decree No. 26503-MAG, called the Agricultural Stewardship Regulations of the College of Agronomists of Costa Rica, published in Gazette 242 of December 16, 1997, so that it reads as follows:

"Article 3.- In all stewardship categories (categorías de regencia), the agricultural steward (regente) must comply with the specific provisions issued by the State Phytosanitary Service (Servicio Fitosanitario del Estado), regarding the restriction of sale and use of agrochemicals throughout the country."

Article 3.- An Article 43 is added to Executive Decree No. 26503-MAG, called the Agricultural Stewardship Regulations of the College of Agronomists of Costa Rica, published in Gazette 242 of December 16, 1997, and consequently, the numbering is shifted, so that it reads as follows:

"Article 43.- Any infraction of the provisions of this regulation that affects the use and handling of chemical, biological, or related substances and equipment to apply them in agriculture shall give rise to the application of the sanctions established in this regulation, as well as the special measures indicated in Articles 67, 78, 79, 80, and 83 of Law No. 7664 of April 8, 1997, "Phytosanitary Protection Law," and its reforms."

Article 4.- A second transitory provision (transitorio segundo) is added to Executive Decree No. 26503-MAG, called the Agricultural Stewardship Regulations of the College of Agronomists of Costa Rica, published in Gazette 242 of December 16, 1997; regarding the existing single transitory provision, it shall be correctly read as Transitory One, and consequently, the new transitory provision shall read as follows:

"SECOND TRANSITORY PROVISION: A period of six months is established for the agricultural stewardships (regencias) approved by the Board of Directors of the College to exhaust the physical forms corresponding to the professional prescription for the sale of pesticides, which are classified in the category of highest toxicity and those declared for restricted use. After this period, the agricultural steward (regente) must use only the digital professional prescription, which shall be executed through the web platform of the State Phytosanitary Service of the Ministry of Agriculture and Livestock."

Article 5.- ANNEX A is added to Executive Decree No. 26503-MAG, called the Agricultural Stewardship Regulations of the College of Agronomists of Costa Rica, published in Gazette 242 of December 16, 1997, so that it reads as follows:

Article 6.- Subsection ñ) is reformed in Article 2 of Executive Decree No. 26503-MAG, called the Agricultural Stewardship Regulations of the College of Agronomists of Costa Rica, published in Gazette 242 of December 16, 1997, so that it reads as follows:

"ñ) Professional Prescription (Receta Profesional): document issued digitally by a professional incorporated into the College of Agronomists, whereby they recommend the use of a pesticide or a method of control and cultivation, for use in agriculture and its corresponding form of application. Said professional prescription shall be prepared and issued digitally, through the electronic platform that the State Phytosanitary Service of the Ministry of Agriculture and Livestock has on its website."

Article 7.- Article 17 of Executive Decree No. 26503-MAG, called the Agricultural Stewardship Regulations of the College of Agronomists of Costa Rica, published in Gazette 242 of December 16, 1997, is reformed so that it reads as follows:

"Article 17.- Biological pesticides, formulated synthetics, technical-grade active ingredient, adjuvants, and related substances that are classified in the category of highest toxicity and those others declared for restricted use, may only be marketed and used under a professional prescription (receta profesional), issued by a member of the College who is current in their obligations to the same.

The professional prescription shall be issued using a digital form that will be available on the platform of the State Phytosanitary Service of the Ministry of Agriculture and Livestock.

In the event that this platform is out of service, the professional must issue the prescription using the form indicated in Annex A of this regulation.

Every prescription issued on a physical form must be entered into the digital platform of the State Phytosanitary Service of the Ministry of Agriculture and Livestock, once the platform is back in service, within a period of 24 hours."

Article 8.- It shall enter into force upon its publication.
