LA ASAMBLEA LEGISLATIVA
DE LA REPÚBLICA DE COSTA RICA,

DECRETA:

APROBACIÓN DE LA
ADHESIÓN AL PROTOCOLO DE 1996, RELATIVO AL CONVENIO

SOBRE LA PREVENCIÓN DE
LA CONTAMINACIÓN DEL MAR POR VERTIMIENTO DE

DESECHOS Y OTRAS
MATERIAS, DE 1972

ARTÍCULO 1-
Se aprueba la adhesión del Gobierno de la República de Costa Rica al Protocolo
de 1996, relativo al Convenio sobre la Prevención de la Contaminación del Mar
por Vertimiento de Desechos y otras Materias, de 1972, modificado por sus
enmiendas, y que en su versión consolidada oficial consta de lo siguiente:

 RELATIVAS AL PROTOCOLO Y SUS ENMIENDAS

Protocolo
  de 1996 relativo al Convenio sobre la prevención de la contaminación del mar
  por vertimiento de desechos y otras materias, 1972.

Enmiendas de 2006 al Protocolo
  de 1996 relativo al Convenio sobre la prevención de la
  contaminación del mar por vertimiento de desechos y otras materias, 1972,
  enmienda para incluir en el Anexo 1 del Protocolo de Londres el secuestro de
  CO2 en las formaciones geológicas del subfondo
  marino (Resolución LP.1(1).

Enmiendas de 2009 al
  Protocolo de 1996 relativo al Convenio sobre la prevención de la
  contaminación del mar por vertimiento de desechos y otras materias, 1972,
  enmienda al artículo 6 del Protocolo de Londres (Resolución LP.3(4).

Enmiendas
  de 2009 al Protocolo de 1996 relativo al Convenio sobre la prevención de la
  contaminación del mar por vertimiento de desechos y otras materias, 1972,
  enmienda al artículo 6 del Protocolo de Londres (Resolución LP.3(4).

Enmiendas
  de 2013 al Protocolo de 1996 relativo al Convenio sobre la prevención de la contaminación
  del mar por vertimiento de desechos
  y otras materias, 1972, para
  regular la colocación de materias a f ines de fertilización de los océanos
  y otras actividades de geoingeniería marina (Resolución LP.4(8).

Enmiendas
  de 2022 al Protocolo de 1996 relativo al Convenio sobre la prevención de la
  contaminación del mar por vertimiento de desechos y otras materias, 1972,
  para retirar los fangos cloacales de los anexos 1 y 2, relativos a la lista y
  la evaluación de los desechos u otras materias cuyo vertimiento podrá
  considerarse (Resolución LP.6(17).

El SUSCRITO, JOSÉ LUIS OBANDO CASTRO, LICENCIADO EN DERECHO, EN MI CALIDAD DE
COORDINADOR DEL PROCESO NORMATIVO DE LA ACTIVIDAD MARÍTIMA Y DE ASESOR LEGAL DE
LA DIVISIÓN MARÍTIMO PORTUARIA DEL MINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTES,
HAGO CONSTAR QUE: Las
siguientes treinta y ocho (38) páginas corresponden a la versión
consolidada del Protocolo de 1996 relativo al Convenio sobre la
Prevención de la Contaminación del Mar por Vertimiento de Desechos y otras
Materias, 1972, compuesta por las siguientes copias auténticas
certificadas por la Organización Marítima Internacional: 1) Protocolo de
1996 relativo al Convenio sobre la Prevención de la Contaminación del Mar
por Vertimiento de Desechos y otras Materias, 1972; 2) Resolución LP.1 (1).
Sobre la enmienda para incluir en el Anexo I del Protocolo de 1996
relativo al Convenio sobre la Prevención de la Contaminación del Mar por
Vertimiento de Desechos y otras materias, 1972; 3) Resolución LP.3(4). Sobre
la Enmienda al artículo 6 del Protocolo de Londres; 4) Resolución LP.4(8) Sobre
la Enmienda al Protocolo de Londres para Regular la Colocación de
Materias a Fines de Fertilización de los Océanos y otras Actividades de
Geoingeniería Marina; 5) Resolución LP.6(17). Enmiendas a los Anexos 1 y
2 del Protocolo de Londres para retirar los Fangos Cloacales de la lista y la
Evaluación de los Desechos u otras Materias cuyo vertimiento podrá
considerarse; las cuales tuve a la vista y se encuentran bajo custodia
en esta División. Se extiende para efectos de aprobación por parte de la
Asamblea Legislativa de la adhesión del Gobierno de Costa Rica al Convenio
citado; dado en San José, Costa Rica, a las nueve horas del veintiocho
de enero del año dos mil veinticinco. *************************

ARTÍCULO 2- La República de
Costa Rica hace reserva a los artículos 21 y 22 del Protocolo de 1996, relativo
al Convenio sobre la Prevención de la Contaminación del Mar por Vertimiento de Desechos
y otras Materias, de 1972, sus anexos y enmiendas; en el sentido de que las
enmiendas aprobadas conforme al procedimiento ahí descrito tendrán vigencia en
el país cuando se consideren protocolos de menor rango derivados del Convenio
en los términos que establece nuestra Constitución Política. En el caso de
enmiendas sustanciales, tendrán vigencia una vez que hayan sido aprobados de
conformidad con los procedimientos establecidos en la Constitución Política de la
República de Costa Rica.

DECREES:

APPROVAL OF THE
ACCESSION TO THE 1996 PROTOCOL TO THE CONVENTION

ON THE PREVENTION OF
MARINE POLLUTION BY DUMPING OF

WASTES AND OTHER
MATTER, 1972

ARTICLE 1-
The accession of the Government of the Republic of Costa Rica to the Protocol
of 1996 to the Convention on the Prevention of Marine Pollution
by Dumping of Wastes and Other Matter, 1972, as amended by its
amendments, is approved, and which in its official consolidated version consists of the following:

 RELATING TO THE PROTOCOL AND ITS AMENDMENTS

1996 Protocol
  to the Convention on the prevention of marine pollution
  by dumping of wastes and other matter, 1972.

2006 Amendments to the 1996 Protocol
  to the Convention on the prevention of
  marine pollution by dumping of wastes and other matter, 1972,
  amendment to include CO2 sequestration in sub-seabed geological formations
  in Annex 1 of the London Protocol (Resolution LP.1(1)).

2009 Amendments to the
  1996 Protocol to the Convention on the prevention of the
  marine pollution by dumping of wastes and other matter, 1972,
  amendment to article 6 of the London Protocol (Resolution LP.3(4)).

2009 Amendments
  to the 1996 Protocol to the Convention on the prevention of the
  marine pollution by dumping of wastes and other matter, 1972,
  amendment to article 6 of the London Protocol (Resolution LP.3(4)).

2013 Amendments
  to the 1996 Protocol to the Convention on the prevention of marine pollution
  by dumping of wastes
  and other matter, 1972, to
  regulate the placement of matter for ocean fertilization purposes
  and other marine geoengineering activities (Resolution LP.4(8)).

2022 Amendments
  to the 1996 Protocol to the Convention on the prevention of the
  marine pollution by dumping of wastes and other matter, 1972,
  to remove sewage sludge from annexes 1 and 2, relating to the list
  and the assessment of wastes or other matter that may be considered for dumping
  (Resolution LP.6(17)).

On the amendment to include in Annex I of the 1996 Protocol
to the Convention on the Prevention of Marine Pollution by
Dumping of Wastes and other matter, 1972; 3) Resolution LP.3(4). On
the Amendment to article 6 of the London Protocol; 4) Resolution LP.4(8) On
the Amendment to the London Protocol to Regulate the Placement of
Matter for Ocean Fertilization Purposes and other Marine
Geoengineering Activities; 5) Resolution LP.6(17). Amendments to Annexes 1 and
2 of the London Protocol to remove Sewage Sludge from the list and the
Assessment of Wastes or other Matter that may be considered for dumping;
which I have had in view and are in the custody
of this Division. Issued for the purposes of approval by the
Legislative Assembly of the accession of the Government of Costa Rica to the cited
Convention; given in San José, Costa Rica, at nine o'clock in the morning on the twenty-eighth
of January of the year two thousand twenty-five. *************************

ARTICLE 2- The Republic of
Costa Rica enters a reservation to articles 21 and 22 of the 1996 Protocol to
the Convention on the Prevention of Marine Pollution by Dumping of Wastes
and Other Matter, 1972, its annexes and amendments; in the sense that
amendments approved in accordance with the procedure described therein shall take effect in
the country when they are considered protocols of lesser rank derived from the Convention
in the terms established by our Political Constitution. In the case of
substantial amendments, they shall take effect once they have been approved in
accordance with the procedures established in the Political Constitution of the
Republic of Costa Rica.

Effective as of its publication.

Given
at the Presidency of the Republic, San José, on the tenth day of the month of February
of the year two thousand twenty-six.
