                        Establece una veda total para la pesca comercial y deportiva, en el Golfo de
Nicoya

INSTITUTO COSTARRICENSE DE PESCA Y
ACUICULTURA

AJDIP/101-2026.-Acuerdo de Junta Directiva
INCOPESCA.

Considerando:

1º-Que
mediante oficio DDI-012-02-2019, se emitió criterio técnico para proponer la
veda, el Documento Técnico n.º 24, en el que se analiza el comportamiento
temporal de las corvinas reina, aguada, picuda, y de las especies marinas de
alto interés comercial en el golfo de Nicoya, propone que la veda se mantenga de
mayo a julio de 2026.

2º-Que el INCOPESCA tiene los estudios
científicos que fundamentan el establecimiento del periodo de veda de mayo a
julio de 2026 en el Golfo de Nicoya.

3º-Que mediante el acuerdo de Junta
Directiva n.º AJDIP/040-2023, del 28-02-2023 se ratificó el informe de
investigación oficio DOPA-014-2023, con los resultados de la investigación
sobre la captura de fauna de acompañamiento en la pesca semiindustrial de las
especies de Sardina del complejo Ophistonema sp. en el Golfo de Nicoya, realizado
por el Departamento de Investigación, el cual es concluyente en cuanto a la
confirmación que la captura incidental no objetivo, representa menos del 3% de
la captura total de sardina, ubicándose dentro del 10% del margen máximo de
tolerancia permitido conforme a lo normado mediante el punto 1.4. del acuerdo
de Junta Directiva N.º AJDIP/100-2021.

4º-Que en el Golfo de Nicoya INCOPESCA se
está desarrollando proyectos de investigación que su información contribuye a
conservación y uso sostenible del ecosistema.

5º-Que una vez discutida y analizada la
propuesta de veda para el Golfo de Nicoya por parte de los señores miembros de
la Junta Directiva del Instituto Costarricense de Pesca y Acuicultura, Por
tanto,

ACUERDA:

1.-Establecer una veda total para la pesca
comercial y deportiva, en el Golfo de Nicoya, desde el 01 de mayo del 2026
hasta el 31 de julio de 2026.

2.-La
zona vedada corresponde el área delimitada por una línea recta imaginaria que
inicia en Punta Torres conocida como Peñón (09°53´31" Latitud Norte, 084°43´52"
Longitud Oeste) hasta el Faro de la Isla Negritos afuera (09°49´14" Latitud
Norte, 084°49´35" Longitud Oeste) y desde ahí hasta la parte Este de Punta
Cuchillos en la Península de Nicoya (09°50´03" Latitud Norte, 084°53´42"
Longitud Oeste) y de ahí aguas adentro hasta llegar a una línea recta
imaginaria entre Puerto Níspero (10°12'7'' Latitud Norte, 85°13'9'' Longitud
Oeste) y Puerto Moreno (10°12'4'' Latitud Norte, 85°14'75" Longitud Oeste) en
la desembocadura del Río Tempisque.

3.-Durante
el período comprendido entre el 01 de junio al 31 de julio de 2026, y con
fundamento en los resultados del informe DOPA-014-2023, se permite el ingreso a
las embarcaciones semiindustriales sardineras, para
realizar faenas de pesca únicamente en la zona delimitada por una línea
imaginaria que inicia en Punta Torres conocida como Peñón (09°53´31" Latitud
Norte, 084°43´52" Longitud Oeste) al Faro de la Isla Negritos afuera (09°49´14"
Latitud Norte, 084°49´35" Longitud Oeste) y desde ahí hasta la parte Este de
Punta Cuchillos en la Península de Nicoya (09°50´03" Latitud Norte, 084°53´42"
Longitud Oeste) y de ahí hasta el Faro de Puntarenas (9° 58´36.03´´ Latitud
Norte 84° 51 03.93´´Longitud Oeste), con el fin de suplir sardina para carnada
a la flota pesquera nacional y cuyos excedentes podrán ser comercializados para
otros fines.

Los armadores o los capitanes de las
embarcaciones están obligados a solicitar la inspección de desembarque según el
procedimiento establecido.

Todo viaje de pesca realizado por la flota
semiindustrial, al realizar el desembarque debe ser inspeccionado por un
funcionario del departamento de fiscalización del INCOPESCA y dejar consignada
la descarga en el respectivo formulario de inspecciones.

En concordancia con el acuerdo de Junta
Directiva n.º AJDIP/049-2020 de 02 de abril de 2020, la captura incidental en
la pesca de sardina no puede ser superior al 10% de la captura total de la
embarcación.

4.-El Departamento de Investigación del
INCOPESCA realizará muestreos biológicos para evaluar el comportamiento
reproductivo de las sardinas y corvinas, y cualquier otra investigación que
contribuya a los análisis biológicos pesqueros.

5.-Las personas con permisos de
investigación y licencias de pesca turística vigentes, cuya zona de actividad
pesquera corresponda a la zona vedada, podrán acogerse a la ayuda económica
aportada por el IMAS durante el período de veda.

6.-Se exceptúa de la veda, la extracción
de moluscos que se desarrolla en el Golfo de Nicoya, a las personas físicas y
jurídicas con autorización vigente del INCOPESCA.

7.-La Jefatura del Departamento de
Fiscalización del INCOPESCA coordinará con instituciones públicas: SENASA,
MINAE, Ministerio de Seguridad Pública y el Servicio Nacional de Guardacostas
para garantizar los operativos de control y vigilancia durante los períodos de
veda en el Golfo de Nicoya.

8.-Las embarcaciones cuyo puerto base de
operación se encuentre ubicado dentro del área vedada del Golfo de Nicoya, pero
cuya licencia de pesca les autoriza faenar fuera del área vedada y, por
consiguiente, deben navegar para trasladarse fuera del área a realizar su
actividad pesquera; podrán ejecutarla y tramitar el combustible a precio
preferencial. Para lo cual, deberán llenar el formulario diseñado para esos
efectos el cual fue trasladado con antelación, antes del 30 de marzo de cada
año.

9.-Publíquese por una vez en el Diario
Oficial La Gaceta.

                        Establishes a total closed season for commercial and sport fishing in the Gulf of
Nicoya

COSTA RICAN INSTITUTE OF FISHERIES AND
AQUACULTURE

AJDIP/101-2026.—Board of Directors Agreement
INCOPESCA.

Considering:

1º—That
by official memorandum DDI-012-02-2019, a technical opinion was issued to propose the
closed season, Technical Document No. 24, in which the temporal behavior
of the weakfish (corvina) species reina (reina), aguada (aguada), picuda (picuda), and of marine species of
high commercial interest in the Gulf of Nicoya is analyzed, proposes that the closed season be maintained from
May to July 2026.

2º—That INCOPESCA has the scientific
studies that support the establishment of the closed season period from May to
July 2026 in the Gulf of Nicoya.

3º—That by Board of Directors
Agreement No. AJDIP/040-2023, of 02-28-2023, the research report official memorandum DOPA-014-2023 was ratified, with the results of the research
on the bycatch (fauna de acompañamiento) capture in the semi-industrial fishing of
Sardine (Sardina) species of the Ophistonema sp. complex in the Gulf of Nicoya, carried out
by the Research Department, which is conclusive in confirming
that the non-target incidental catch represents less than 3% of
the total sardine catch, falling within the 10% maximum tolerance
margin allowed in accordance with point 1.4. of the Board of Directors
Agreement No. AJDIP/100-2021.

4º—That in the Gulf of Nicoya INCOPESCA is
developing research projects whose information contributes to
conservation and sustainable use of the ecosystem.

5º—That once the closed season proposal for the Gulf of Nicoya was discussed and analyzed by the members of
the Board of Directors of the Costa Rican Institute of Fisheries and Aquaculture, Therefore,

IT IS AGREED:

1.—To establish a total closed season for commercial
and sport fishing, in the Gulf of Nicoya, from May 1, 2026
until July 31, 2026.

2.—The
closed zone corresponds to the area delimited by an imaginary straight line that
begins at Punta Torres known as Peñón (09°53´31" North Latitude, 084°43´52"
West Longitude) to the Lighthouse of Isla Negritos outer (09°49´14" North
Latitude, 084°49´35" West Longitude) and from there to the East part of Punta
Cuchillos on the Nicoya Peninsula (09°50´03" North Latitude, 084°53´42"
West Longitude) and from there offshore until reaching an imaginary straight
line between Puerto Níspero (10°12'7'' North Latitude, 85°13'9'' West
Longitude) and Puerto Moreno (10°12'4'' North Latitude, 85°14'75" West Longitude) at
the mouth of the Tempisque River.

3.—During
the period between June 1 and July 31, 2026, and based
on the results of report DOPA-014-2023, entry is permitted for
semi-industrial sardine vessels, to
carry out fishing operations solely in the zone delimited by an imaginary
line that begins at Punta Torres known as Peñón (09°53´31" North Latitude, 084°43´52" West Longitude) to the Lighthouse of Isla Negritos outer (09°49´14"
North Latitude, 084°49´35" West Longitude) and from there to the East part of
Punta Cuchillos on the Nicoya Peninsula (09°50´03" North Latitude, 084°53´42"
West Longitude) and from there to the Puntarenas Lighthouse (9° 58´36.03´´ North
Latitude 84° 51 03.93´´ West Longitude), in order to supply sardine for bait
to the national fishing fleet and whose surpluses may be commercialized for
other purposes.

The vessel owners (armadores) or the captains of the
vessels are required to request the landing inspection according to the
established procedure.

Every fishing trip carried out by the semi-industrial
fleet, upon landing, must be inspected by an
official of the enforcement department (departamento de fiscalización) of INCOPESCA and the landing must be recorded
in the respective inspection form.

In accordance with Board of Directors
Agreement No. AJDIP/049-2020 of April 2, 2020, the incidental catch in
sardine fishing may not exceed 10% of the vessel's total catch.

4.—The Research Department of
INCOPESCA shall carry out biological sampling to evaluate the reproductive
behavior of sardines and weakfish (corvinas), and any other research that
contributes to fishery biological analyses.

5.—Persons with current research
permits and sport fishing licenses (licencias de pesca turística), whose fishing activity zone
corresponds to the closed zone, may avail themselves of the economic aid
provided by IMAS during the closed season period.

6.—Excluded from the closed season is the extraction
of mollusks (moluscos) that takes place in the Gulf of Nicoya, for natural persons and
legal entities with current authorization from INCOPESCA.

7.—The Head of the Enforcement Department (Departamento de Fiscalización) of INCOPESCA shall coordinate with public institutions: SENASA,
MINAE, Ministry of Public Security and the National Coast Guard Service (Servicio Nacional de Guardacostas)
to guarantee control and surveillance operations during the closed season
periods in the Gulf of Nicoya.

8.—Vessels whose home port (puerto base) of
operation is located within the closed area of the Gulf of Nicoya, but
whose fishing license (licencia de pesca) authorizes them to operate outside the closed area and, therefore,
must sail to move outside the area to carry out their fishing
activity; may carry it out and process fuel at the preferential
price. For which, they must fill out the form designed for those
purposes which was forwarded in advance, before March 30 of each
year.

9.—Publish once in the Official Gazette La Gaceta.
