                        Se prohíbe la utilización de dispositivos agregadores de peces (FADs o
plantados) como auxiliares para la realización de acti­vidades de pesca, sobre ellos en aguas
jurisdiccionales de Costa Rica

INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA

AJDIP/090-2026, Acuerdo de Junta Directiva INCOPESCA

Considerando

1. Que mediante resolución N° 2025039367 dictada por la
Sala Constitucional de la Corte Suprema de Justicia, dentro del expediente N°
25-021856-0007-CO, inter­puesto por Donald Mc Guinness Sarkis
contra el Institu­to Costarricense de Pesca y Acuicultura (INCOPESCA), el
Ministerio de Obras Públicas y Transportes, a través de la División Marítima
Portuaria, y el Servicio Nacional de Guardacostas, se analizó la utilización de
dispositivos agregadores de peces conocidos como FADs o "planta­dos", utilizados como auxiliares
para la actividad pesquera.

2. Que la Sala Constitucional analizó la práctica
consistente en la instalación y utilización de dispositivos agregadores
de peces (FADs o plantados) anclados al fondo marino,
utilizados como auxiliares para la agregación de especies y la consecuente
realización de actividades pesqueras.

3. Que de conformidad con lo dispuesto en la Ley de Pesca
y Acuicultura N° 8436, el Instituto Costarricense de Pesca y Acuicultura es la
autoridad ejecutora encargada de la administración, regulación y control de la
actividad pesquera en las aguas marinas jurisdiccionales del país.

4. Que en sesión de Junta Directiva la Lic. Daniela
Madrigal Solórzano, funcionaria de la Asesoría Jurídica del INCOPESCA, expone
los alcances de la resolución emitida por la Sala Constitucional y recomienda
la adopción de las medidas necesarias para garantizar el debido cumplimiento de
lo ordenado por el Tribunal Constitucional.

5. Que en acatamiento a lo
dispuesto por la Sala Constitucional en la resolución antes citada, corresponde
a este Instituto adoptar las medidas regulatorias necesarias en el ámbito de
sus competencias para garantizar el cumplimiento de lo ordenado por dicho
Tribunal.

6. Que dichas acciones
deberán ejecutarse en coordinación con el Servicio Nacional de Guardacostas
y la División Marítima Portuaria del Ministerio
de Obras Públicas y Transportes, en lo relativo al control y vigilancia
de las actividades que se desarrollan
en el medio marino.

7. Que una vez escuchado lo expuesto, luego de deliberar, la Junta
Directiva del Instituto Costarricense de Pesca y Acuicultura, Por tanto;

ACUERDA

1. En acatamiento de lo dispuesto por la Sala Constitucio­nal mediante
resolución N° 2025039367, se prohíbe la utilización de dispositivos agregadores de peces (FADs o
plantados) como auxiliares para la realización de acti­vidades de pesca, sobre
ellos en aguas jurisdiccionales de Costa Rica.

2. Prohibir la instalación de dispositivos agregadores
de peces (FADs o plantados) en el medio marino.

3. Prohibir la promoción o publicidad de actividades de pesca que se
realicen o se pretendan realizar sobre dispositivos agregadores
de peces (FADs o plantados).

4. No autorizar torneos de pesca deportiva, turística o comercial en los
cuales se pretenda realizar actividades de pesca sobre dispositivos agregadores de peces (FADs o
plantados).

5. Instruir a las dependencias institucionales correspondientes para que,
en coordinación con el Servicio Nacional de Guardacostas y la División Marítima
Portuaria del MOPT, adopten las acciones necesarias para la fiscalización y
control de lo dispuesto en el presente acuerdo.

6. Acuerdo firme.

7. Publíquese por una vez en
el Diario Oficial La Gaceta.

                        The use of fish aggregating devices (FADs or plantados) as auxiliaries for carrying out fishing activities over them in Costa Rican jurisdictional waters is prohibited.

COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE

AJDIP/090-2026, Agreement of the Board of Directors of INCOPESCA

Considering

1. That through resolution No. 2025039367 issued by the Constitutional Chamber of the Supreme Court of Justice, within case file No. 25-021856-0007-CO, filed by Donald Mc Guinness Sarkis against the Costa Rican Institute of Fisheries and Aquaculture (INCOPESCA), the Ministry of Public Works and Transport, through the Maritime Port Division, and the National Coast Guard Service, the use of fish aggregating devices known as FADs or "plantados," used as auxiliaries for fishing activity, was analyzed.

2. That the Constitutional Chamber analyzed the practice consisting of the installation and use of fish aggregating devices (FADs or plantados) anchored to the seafloor, used as auxiliaries for the aggregation of species and the consequent carrying out of fishing activities.

3. That in accordance with the provisions of the Fisheries and Aquaculture Law No. 8436, the Costa Rican Institute of Fisheries and Aquaculture is the executing authority responsible for the administration, regulation, and control of fishing activity in the country’s jurisdictional marine waters.

4. That in a session of the Board of Directors, Lic. Daniela Madrigal Solórzano, an official of the Legal Advisory Office of INCOPESCA, presented the scope of the resolution issued by the Constitutional Chamber and recommended the adoption of the necessary measures to guarantee due compliance with what was ordered by the Constitutional Court.

5. That in compliance with what was ordered by the Constitutional Chamber in the aforementioned resolution, it falls to this Institute to adopt the necessary regulatory measures within the scope of its competencies to guarantee compliance with what was ordered by said Court.

6. That said actions shall be carried out in coordination with the National Coast Guard Service and the Maritime Port Division of the Ministry of Public Works and Transport, regarding the control and surveillance of activities carried out in the marine environment.

7. That having heard the presentation, after deliberation, the Board of Directors of the Costa Rican Institute of Fisheries and Aquaculture, Therefore;

AGREES

1. In compliance with what was ordered by the Constitutional Chamber through resolution No. 2025039367, the use of fish aggregating devices (FADs or plantados) as auxiliaries for carrying out fishing activities over them in Costa Rican jurisdictional waters is prohibited.

2. To prohibit the installation of fish aggregating devices (FADs or plantados) in the marine environment.

3. To prohibit the promotion or advertising of fishing activities that are carried out or intended to be carried out over fish aggregating devices (FADs or plantados).

4. Not to authorize sport, tourism, or commercial fishing tournaments in which fishing activities are intended to be carried out over fish aggregating devices (FADs or plantados).

5. To instruct the corresponding institutional departments to, in coordination with the National Coast Guard Service and the Maritime Port Division of the MOPT, adopt the necessary actions for the oversight and control of the provisions of this agreement.

6. Firm agreement.
