EL PRESIDENTE DE LA REPÚBLICA

Y EL MINISTRO DE RECURSOS NATURALES, ENERGÍA
Y MINAS,

 

    En el ejercicio de las
facultades que les confiere el artículo 140, inciso 3 y 18 de la Constitución Política
y de conformidad con el artículo 12 de la Ley N° 7317 del 7 de diciembre de 1992.

 

Considerando:

    1°—Que mediante
Decreto N° 16614-MAG se creó el Refugio Nacional de Vida Silvestre Gandoca-Manzanillo,
el cual tiene como uno de los fines la protección de los recursos renovables del área.

    2°- Que el manejo y
administración de esta área protegida corresponde a la Dirección de Vida Silvestre del
Ministerio de Recursos Naturales, Energía y Minas.

    3°—Que la colonia
anidadora de tortugas marinas, baula (Dermochelys coriácea), tortuga verde (Chelonia
mydas), tortuga Carey (Eretmochelys imbricata) y tortuga caguama (Caretta caretta), que
desovan en Playa Gandoca, se considera como una de las más importantes del Caribe Sur.

    4°—Que la cantidad
de turistas que visita el área durante la temporada de anidación de las tortugas baula,
verde, carey caguama, que se da en el período comprendido entre los meses de marzo a
octubre, es de considerable magnitud.

    5°—Que existen
antecedentes científicos que señalan que la presencia humana asociada al uso inadecuado
de luces (linternas y cámaras con flash), así como el incorrecto comportamiento durante
la observación del desove puede alterar de manera significativa el comportamiento
habitual de las tortugas; ya que puede interrumpirse el proceso de desove de las tortugas
y así mismo durante la época de nacimiento de las crías estas pueden desorientarse
durante su regreso al mar.

    6°—Es necesario
regular la afluencia masiva de turistas a este Refugio durante el periodo de desove de las
tortugas baula, verde, carey, caguama, con el fin de proteger dicho proceso y conservar el
recurso para futuras generaciones.

    7° -Que una de las
principales causas de mortalidad de tortugas adultas, se debe a su entrampamiento en redes
colocadas en el paso hacia las playas de anidación o sitios de alimentación. Por
tanto,

Decretan:

    Artículo l° —Para efecto de
controlar la afluencia masiva de personas a la zona de Playa Gandoca dentro del Refugio
Nacional de Vida Silvestre Gandoca-Manzaníllo, se declara de acceso restringido a dicha
área durante la época de desove de la tortuga baula, verde, carey, caguama que comprende
un período que va desde el primero de marzo hasta el 31 de octubre de cada año.

    Artículo 2°—Se declara como área destinada a la observación del desove
de tortuga las que estén debidamente señaladas y marcadas para ese efecto.

    Artículo 3°—Se autorizará observar el desove de las tortugas a cualquier
persona o grupo de personas que se hagan acompañar por un guía que porte el carné
extendido por el Ministerio de Recursos Naturales Energía y Minas, o por el I. C. T.,
dicho grupo no puede exceder la cantidad de diez personas.

    Artículo 4°—No se permite el uso de linternas dentro del área de desove
salvo la que utilizará el guía respectivo. La Dirección General de Vida Silvestre, a
través de la Administración del Refugio Nacional de Vida Silvestre Gandoca Manzanillo
podrá autorizar cuando lo considere conveniente el uso de cámaras fotográficas mediante
un permiso por escrito; por lo que queda terminantemente prohibido el uso de dichas
cámaras cuando no se cuente con el permiso respectivo.

    Artículo 5°—Las personas que funjan como guías deberán comprometerse a
respetar todas las reglas que se dicten para proteger a la tortuga en el proceso de
desove.

    Artículo 6°—Todo guía que participe en las giras para observar tortugas
en la playa, deberá contar con un carné extendido por el Ministerio de Recursos
Naturales,Energía y Minas, previo visto bueno del Administrador del Refugio Nacional de
Vida Silvestre Gandoca-Manzanillo, o carné extendido por el Instituto Costarricense de
Turismo.

    Artículo 7°—La cantidad máxima de personas que se permitirá estar
simultáneamente en la playa, para observar el desove de las tortugas, será de cincuenta.

    Artículo 8°—Para el ingreso a la playa se contará con un punto
debidamente identificado, el cual estará situado en el camino que une a la comunidad de
Gandoca con la playa.

    Artículo 9°—No se permitirá la presencia de personas o grupos de personas
sin guía, en la playa durante la noche, entre las dieciocho horas y las cinco de la
mañana, del día primero del mes de marzo hasta el treinta y uno de octubre de cada año.

    Artículo 10.—El grupo de turistas dará por finalizado el recorrido una vez
que haya observado el desove de una tortuga, y que el guía los acompañe al sitio de
salida.

    Artículo 11 .—No se permite acampar ni hacer fogatas en la playa. La
vegetación es muy frágil y de momento se encuentra en restauración.

Artículo 12.—NOTA
DE SINALEVI: En la publicación de
este decreto, no aparece este artículo. No obstante el sistema exige una numeración
consecutiva, por lo que se ha creado el mismo, pero sin texto.

    Artículo 13.—No
se permitirá ningún tipo de actividad recreativa en la zona de las dunas de la playa.

    Artículo 14.—Los
funcionarios del Ministerio de Recursos Naturales, Energía Minas, están facultados para
desalojar a cualquier visitante que viole o no acate las disposiciones contenidas en este
Decreto.

    Artículo 15.---Se prohibe la venta y consumo de bebidas alcohólicas en la playa
o lugares aledaños.

    Artículo
16.—Deróguese el artículo 6, del Decreto Ejecutivo N° 16614-MAG, de 1° de julio
de 1985, publicado en "La Gaceta N° 206 de 29 de octubre de 1985.

    Artículo 17.—Rige a partir de su publicación.

    Dado en la Presidencia

THE PRESIDENT OF THE REPUBLIC

AND THE MINISTER OF NATURAL RESOURCES, ENERGY,
AND MINES,

 

    In exercise of the
powers conferred upon them by Article 140, subsections 3 and 18 of the Political Constitution
and in accordance with Article 12 of Law No. 7317 of December 7, 1992.

 

Whereas:

    1.—That by
Decree No. 16614-MAG, the Gandoca-Manzanillo National Wildlife Refuge (Refugio Nacional de Vida Silvestre Gandoca-Manzanillo) was created, one of the purposes of which is the protection of the area's renewable resources.

    2.—That the management and
administration of this protected area corresponds to the Wildlife Directorate (Dirección de Vida Silvestre) of the
Ministry of Natural Resources, Energy, and Mines.

    3.—That the nesting colony
of sea turtles—leatherback (Dermochelys coriacea), green turtle (Chelonia
mydas), hawksbill turtle (Eretmochelys imbricata), and loggerhead turtle (Caretta caretta)—that
nest on Gandoca Beach, is considered one of the most important in the Southern Caribbean.

    4.—That the number
of tourists visiting the area during the nesting season of the leatherback, green, hawksbill, and loggerhead turtles, which occurs in the period between the months of March and
October, is of considerable magnitude.

    5.—That scientific
evidence exists indicating that human presence associated with the improper use
of lights (flashlights and cameras with flash), as well as incorrect behavior during
the observation of nesting, can significantly alter the habitual
behavior of the turtles; as the nesting process of the turtles can be interrupted,
and likewise, during the hatching season, the hatchlings can become disoriented
during their return to the sea.

    6.—It is necessary
to regulate the massive influx of tourists to this Refuge during the nesting period of the
leatherback, green, hawksbill, and loggerhead turtles, in order to protect said process and conserve the
resource for future generations.

    7.—That one of the main
causes of mortality of adult turtles is due to their entrapment in nets
placed in the passage to nesting beaches or feeding sites. Therefore,

They Decree:

    Article 1.—For the purpose of
controlling the massive influx of people to the Gandoca Beach area within the
Gandoca-Manzanillo National Wildlife Refuge, said
area is declared of restricted access during the nesting season of the leatherback, green, hawksbill, and loggerhead turtle, which comprises
a period from March 1st to October 31st of each year.

   Article 2.—The areas duly designated and marked for that purpose are declared as the area intended for the observation of turtle
nesting.

   Article 3.—Any person
or group of persons accompanied by a guide carrying a permit (carné) issued
by the Ministry of Natural Resources, Energy, and Mines, or by the I.C.T., shall be authorized to observe the nesting of the turtles;
said group may not exceed the number of ten persons.

   Article 4.—The use of flashlights is not permitted within the nesting area
except for the one to be used by the respective guide. The General Directorate of Wildlife (Dirección General de Vida Silvestre), through
the Administration of the Gandoca-Manzanillo National Wildlife Refuge,
may authorize, when it deems it appropriate, the use of photographic cameras by means of
a written permit; therefore, the use of said
cameras is strictly prohibited when the respective permit is not held.

   Article 5.—Persons acting as guides must commit to
respecting all the rules dictated to protect the turtle during the nesting
process.

   Article 6.—Every guide who participates in the tours to observe turtles
on the beach must carry a permit (carné) issued by the Ministry of Natural
Resources, Energy, and Mines, with the prior approval of the Administrator of the Gandoca-Manzanillo National
Wildlife Refuge, or a permit (carné) issued by the Costa Rican Tourism
Institute (Instituto Costarricense de Turismo).

   Article 7.—The maximum number of persons permitted to be
simultaneously on the beach to observe the nesting of the turtles shall be fifty.

   Article 8.—For entry to the beach, there shall be a duly
identified point, which shall be located on the path connecting the community of
Gandoca to the beach.

   Article 9.—The presence of persons or groups of persons
without a guide shall not be permitted on the beach during the night, between eighteen hundred hours and five in the
morning, from the first day of March to the thirty-first of October of each year.

   Article 10.—The tourist group shall consider the tour concluded once
it has observed the nesting of a turtle and the guide has accompanied them to the exit
point.

   Article 11.—Camping or lighting campfires on the beach is not permitted. The
vegetation is very fragile and is currently undergoing restoration.

Article 12.—SINALEVI NOTE: In the publication of
this decree, this article does not appear. However, the system requires consecutive
numbering, therefore it has been created, but without text.

   Article 13.—No
type of recreational activity shall be permitted in the beach dune area.

    Article 14.—Officials
of the Ministry of Natural Resources, Energy, and Mines are empowered to
evacuate any visitor who violates or fails to comply with the provisions contained in this
Decree.

   Article 15.—The sale and consumption of alcoholic beverages on the beach
or nearby locations is prohibited.

   Article
16.—Article 6 of Executive Decree No. 16614-MAG, of July 1,
1985, published in La Gaceta No. 206 of October 29, 1985, is hereby repealed.

   Article 17.—It shall become effective upon its publication.

    Issued at the Presidency
of the Republic.—San José, at eight o'clock on the twenty-first day of March, nineteen hundred
and ninety-four.
