                     EL PRESIDENTE DE LA REPUBLICA

        Y LOS MINISTROS DE LA PRESIDENCIA, DE JUSTICIA Y GRACIA

                             Y DE TURISMO,

	En uso de las facultades que les confieren el artículo 140, incisos

3) y 18) de la Constitución Política, artículo 6º, inciso e) de la Ley

General de la Administración Pública, número 6227 del 2 de mayo de 1978,

Nº 6758 del 4 de junio de 1982, Ley de Desarrollo y Ejecución del

Proyecto Turístico Golfo Papagayo y ley Nº 6043 Ley de la Zona Marítima

Terrestre, artículo 74 y su reglamento.

                             Considerando:

	UNICO.- Que en la ley Nº 6043, el área que comprende el Proyecto

Turístico Golfo Papagayo en Bahía Culebra, Guanacaste, se definió en su

artículo 74 y en el 93 del reglamento de dicha ley como un caso especial,

con el fin de que el Estado por intermedio del Instituto Costarricense de

Turismo (ICT), pudiese desarrollar un proyecto turístico regulado

posteriormente por la ley Nº 6758, sin embargo, el artículo 63 del

Reglamento de la Ley Zona Marítimo Terrestre y el artículo 44 del

Reglamento de la Ley de Catastro Nacional, indican unos procedimientos a

seguir, los cuales por impedimento material del Estado, no se pueden

cumplir en forma inmediata, como es el de marcar en sitio la zona

pública, para cumplir compromisos adquiridos.  Además, se cuenta con la

anuencia del Instituto Geográfico Nacional (IGN) por ser un proyecto

público y los terrenos del Estado.  Por tanto;

                               DECRETAN:

	Artículo 1º.- Se autoriza al Catastro Nacional a inscribir los

planos de agrimensura de la zona restringida a favor del ICT, sin el

amojonamiento respectivo y sin el visado del IGN, para efectos de

inscribir en el Registro Nacional las concesiones que otorga el ICT

legalmente facultado en el Proyecto Turístico Golfo Papagayo.

	Artículo 2º.- Una vez otorgada la concesión o la subconcesión, según

corresponda, por parte del Instituto Costarricense de Turismo, el

concesionario, antes de iniciar los trabajos de construcción, está

obligado a amojonar la zona pública en sitio, por su cuenta, bajo la

supervisión del ICT y del IGN y a la inscripción de los planos de

agrimensura en el Catastro Nacional con el visto bueno del IGN.

                     THE PRESIDENT OF THE REPUBLIC

        AND THE MINISTERS OF THE PRESIDENCY, OF JUSTICE AND GRACE

                             AND OF TOURISM,

	Exercising the powers conferred upon them by Article 140, subsections

3) and 18) of the Political Constitution, Article 6, subsection e) of the General Law

of Public Administration, Law No. 6227 of May 2, 1978,

Law No. 6758 of June 4, 1982, the Law for the Development and Execution of the

Papagayo Gulf Tourism Project, and Law No. 6043, the Maritime Zone

Law, Article 74 and its Regulation.

                             Considering:

	SOLE.- That in Law No. 6043, the area comprising the Papagayo

Gulf Tourism Project in Bahía Culebra, Guanacaste, was defined in its

Article 74 and in Article 93 of the regulation of said law as a special case,

so that the State, through the Costa Rican Tourism Institute

(ICT), could develop a tourism project subsequently

regulated by Law No. 6758; however, Article 63 of the

Regulation of the Maritime Zone Law and Article 44 of the

Regulation of the National Cadastre Law indicate procedures to

follow, which, due to material impediment of the State, cannot be

fulfilled immediately, such as demarcating the public zone

on site, in order to meet acquired commitments. Furthermore, the

consent of the National Geographic Institute (IGN) is available because it is a public

project on State lands. Therefore;

                               DECREE:

	Article 1.- The National Cadastre is authorized to register the

survey plans of the restricted zone in favor of the ICT, without the

respective demarcation (amojonamiento) and without the approval (visado) of the IGN, for the purposes of

registering in the National Registry the concessions granted by the ICT,

legally empowered within the Papagayo Gulf Tourism Project.

 Article file

	Article 2.- Once the concession or sub-concession, as

appropriate, has been granted by the Costa Rican Tourism Institute, the

concessionaire, before starting construction work, is

obligated to demarcate the public zone on site (amojonar), at their own expense, under the

supervision of the ICT and the IGN, and to register the survey

plans in the National Cadastre with the approval of the IGN.
