Español (source)Artículo 1°—Establécese la Reserva Forestal Los Santos que comprende el territorio ubicado dentro de la siguiente demarcación (mapas topográficos 1:50000 IGN: Tapantí 3445 III, Vueltas 3444 IV, Savegre 3444 III).
Artículo 7°—Las fincas particulares y las reservas nacionales establecidas dentro de los límites de la reserva quedan automáticamente sometidas al Régimen Forestal. Las labores que se fueran a realizar en estas fincas, deben contar con la autorización escrita de la Dirección General Forestal.
Artículo 8°—Las fincas no inscritas en el Registro Público ni amparadas por la posesión decenal vuelven al patrimonio del Estado previos los trámites legales.
English (translation)Article 1—The Los Santos Forest Reserve is established, comprising the territory within the following demarcation (IGN 1:50,000 topographic maps: Tapantí 3445 III, Vueltas 3444 IV, Savegre 3444 III).
Article 7—Private properties and national reserves established within the limits of the reserve are automatically subject to the Forestry Regime. Any activities to be carried out on these properties must have written authorization from the Forestry Directorate.
Article 8—Properties not registered in the Public Registry nor protected by ten-year adverse possession shall revert to the State’s heritage, following legal procedures.

En
el uso de las facultades que le confieren los artículos I°, 2° inciso b),
4°, 19 y 27 de la Ley Forestal N° 4465 del 25 de noviembre de 1969, y
Considerando:
I°-Que
es deber del Estado orientar el aprovechamiento de los recursos forestales
en forma técnica que permita su rendimiento continuo y asegurar que los
terrenos de vocación forestal permanezcan siempre con su cobertura de bosques.
2°-Que es imperativo de la ley garantizar la existencia de agua para suplir las necesidades actuales
y futuras.
3°-Que
el establecimiento de reservas forestales debidamente administradas es el
mejor método para conseguir los objetivos mencionados.
Por
tanto,
DECRETAN
:
Artículo
1°-Establécese la Reserva Forestal Los Santos que comprende el territorio
ubicado dentro de la siguiente demarcación (mapas topográficos 1:50000 IGN:
Tapantí 3445 III,
Vueltas 3444 IV, Savegre 3444 III).
Por el Norte parte de la intersección de las coordenadas 189600 y 541000 a una
altitud de 2 300 metros sobre el nivel del mar. Dicho punto se encuentra en la
carretera Empalme-Dota, a 1 200 metros de la intersección con la Carretera
Interamericana. Este es el punto cero.

Artículo 2°-Se declara
inalienable los terrenos nacionales que se encuentran dentro de la anterior
delimitación.

3°-La reserva forestal que se declara en este decreto comprende 62 000 hectáreas.
La demarcación de dicha reserva se encuentra en el plano confeccionado por la
Dirección General Forestal.

Artículo 4°-La Procuraduría General de la República hará inscribir los
terrenos del Estado de esta reserva en el Registro Público, como finca
individualizada del Patrimonio Nacional.

5°-La Dirección General Forestal dará el asesorarhiento necesario en los
trabajos de deslinde, vigilancia y estudios tendientes al aprovechamiento de los
recursos naturales.

Artículo 6°-El aprovechamiento de cualquiera de
los recursos naturales de la reserva sólo será permitido bajo normas técnicas
que la Dirección General Forestal aprobará en su oportunidad y según la
zonificación que a tal efecto se establezca.

Artículo 7°-Las fincas particulares y las reservas nacionales establecidas

Artículo 9°-La Dirección General
Forestal del Ministerio de Agricultura y Ganadería gestionará la compra
directa o la expropiación de los terrenos reducidos a dominio particular, por
estar amparados a la posesión decenal o por estar debidamente inscritos en el
Registro Público y de las mejoras de ocupantes de terrenos sin inscribir
comprendidos dentro de la demarcación de esa Reserva y que sean indispensables
para su integración.

Artículo 10.-Instituciones nacionales e internacionales colaborarán en la
realización de estudios y en el establecimiento de proyectos tendientes a la
mejor utilización de los recursos naturales.

11.-La Administración de la Reserva Forestal Los Santos estará a cargo de la
Dirección General Forestal con la colaboración de un comité integrado por
representantes de las siguientes instituciones:
Municipalidades.
Centros
Agrícolas Cantonales.
Asociaciones
de Desarrollo,
Otras
Agrupaciones.
Empresarios
de la Zona.

12.-La financiación del proyecto se hará con fondos del presupuesto
ordinario y las partidas que con este fin aprueben las municipalidades.

Therefore, DECREE: Article 1°—The Los Santos Forest Reserve (Reserva Forestal Los Santos) is hereby established, comprising the territory located within the following demarcation (1:50000 IGN topographic maps: Tapantí 3445 III, Vueltas 3444 IV, Savegre 3444 III). On the North, it starts from the intersection of coordinates 189600 and 541000 at an altitude of 2,300 meters above sea level. Said point is located on the Empalme-Dota road, 1,200 meters from the intersection with the Inter-American Highway. Article 3°—The forest reserve declared in this decree comprises 62,000 hectares. The demarcation of said reserve is found on the plan prepared by the Dirección General Forestal. Article 4°—The Procuraduría General de la República shall register the State lands of this reserve in the Public Registry (Registro Público), as an individualized property (finca individualizada) of the National Heritage. Article 5°—The Dirección General Forestal shall provide the necessary advice in the work of demarcation, surveillance, and studies aimed at the use of natural resources. Article 6°—The use of any of the natural resources of the reserve shall only be permitted under technical standards that the Dirección General Forestal shall approve in due course and according to the zoning established for that purpose. Article 7°—Private properties (fincas particulares) and national reserves established within the limits of the reserve are automatically subject to the Forestry Regime (Régimen Forestal). Any activities to be carried out on these properties must have the written authorization of the Dirección General Forestal. Article 8°—Properties (fincas) not registered in the Public Registry nor protected by ten-year possession (posesión decenal) revert to the State's heritage following the corresponding legal proceedings. Article 9°—The Dirección General Forestal of the Ministry of Agriculture and Livestock shall manage the direct purchase or expropriation of lands reduced to private domain—because they are protected by ten-year possession or because they are duly registered in the Public Registry—and of the improvements of occupants of unregistered lands included within the demarcation of this Reserve that are indispensable for its integration. Article 10.—National and international institutions shall collaborate in carrying out studies and in the establishment of projects aimed at the better utilization of natural resources. Article 11.—The Administration of the Los Santos Forest Reserve shall be the responsibility of the Dirección General Forestal with the collaboration of a committee composed of representatives from the following institutions: Municipalities. Cantonal Agricultural Centers (Centros Agrícolas Cantonales). Development Associations (Asociaciones de Desarrollo), Other Groups. Business Owners of the Zone. Article 12.—The financing of the project shall be made with funds from the ordinary budget and the appropriations that the municipalities approve for this purpose. Article 13.—It shall become effective upon its publication. Given at the Presidential House.—San José, on the twenty-eighth day of the month of October, nineteen hundred seventy-five.
