EL PRESIDENTE DE LA REPÚBLICA





Y EL MINISTRO DE AGRICULTURA Y GANADERIA





Con fundamento en lo dispuesto en los artículos 140, incisos 3) y 18), y 146 de la Constitución
Política, la Ley Nº 6227 del 2 de mayo de 1978, Ley General de la Administración Pública, la Ley Nº
7064 del 29 de abril de 1987, Ley de Fomento a la Producción Agropecuaria, que incorpora la Ley
Orgánica del Ministerio de Agricultura y Ganadería, la Ley Nº 7779 del 30 de abril de 1998, Ley de
Uso, Manejo y Conservación de Suelos y la Ley Nº 8149 del 5 de noviembre del 2001, Ley de Creación
del Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria.





Considerando:





1º-Que mediante Ley Nº 7779 del 30 de abril de 1998, se emitió la Ley de Uso, Manejo y Conservación
de Suelos, la cual se encuentra debidamente reglamentada y establece como función del Ministerio de
Agricultura y Ganadería, el llevar un Registro de las personas físicas o jurídicas de carácter
privado dedicadas a realizar proyectos para el mejor uso, manejo y conservación de suelos, así como
acreditar y autorizar a los profesionales respectivos como Certificadores de Uso Conforme del Suelo.





2º-Que la implementación del Registro indicado, permitirá la participación de profesionales de libre
ejercicio y de reconocida capacidad en el campo de la Edafología, en el cumplimiento de los fines
dispuestos por la Ley Nº 7779, en beneficio de la eficiencia y eficacia de las gestiones que deben
ser cumplidas por los interesados y la atención de los objetivos de naturaleza pública, bajo la
supervisión y control de la Administración.





3º-Que mediante Ley Nº 8149 del 5 de noviembre del 2001, se creó el Instituto Nacional de Innovación
y Transferencia en Tecnología Agropecuaria (INTA), como un órgano de desconcentración máxima del
MAG, el cual asumirá en su momento las funciones de la Dirección de Investigaciones Agropecuarias.
Por tanto,





Decretan:





Artículo 1º-Créase el Registro Oficial de Certificadores de Uso Conforme del Suelo, con sede en el
Departamento de Suelos y Evaluación de Tierras de la Dirección de Investigaciones Agropecuarias del
Ministerio de Agricultura y Ganadería (MAG-INTA).

Artículo 2º-Créase el Comité Evaluador de Postulantes a Certificadores de Uso Conforme del Suelo, el
cual estará integrado por:





- Un representante del Departamento de Suelos y Evaluación de Tierras del MAG-INTA.





- Un representante del CONARE.





- Dos representantes del Colegio de Ingenieros Agrónomos de Costa Rica.





- Un representante de la Asociación Costarricense de la Ciencia del Suelo.





Los representantes serán nombrados por la entidad respectiva, durarán en sus funciones por un
período de dos años y podrán ser reelectos.





El Comité se reunirá toda vez que el Colegio de Ingenieros Agrónomos lo requiera, a fin de evaluar
todos los requisitos de los postulantes a Certificadores de Uso Conforme del Suelo. Para la validez
de sus decisiones deberá contarse con la presencia mínima de tres de sus miembros y las mismas se
adoptarán por mayoría simple de votos presentes.

Artículo 3º-Los aspirantes a inscribirse en el Registro Oficial de Certificadores de Uso Conforme
del Suelo, deberán cumplir con los siguientes requisitos:





a) Estar debidamente incorporados al Colegio de Ingenieros Agrónomos de Costa Rica y en ejercicio
vigente de la profesión.





b) Poseer grado mínimo de Bachiller en Ingeniería Agronómica con énfasis en Fitotecnia o Generalista
o grado mínimo de Bachiller en Ciencias Forestales. Además podrán ser aspirantes otros profesionales
miembros del Colegio de Ingenieros Agrónomos con postgrado o especialización en materia de suelos o
conservación de suelos. Todos deberán demostrar experiencia práctica mínima de un año en estudios
para planificación y desarrollo del uso de la tierra.





(Mediante resolución N° 003756 del 12 de junio de 2024, el Tribunal Contencioso Administrativo y
Civil de Hacienda, anuló el último párrafo del inciso b) anterior,  debiendo entenderse de dicho
ordinal, que los profesionales en ciencias forestales debidamente incorporados al Colegio de
Ingenieros Agrónomos, y que hayan aprobado el curso de Certificadores de Uso Conforme del Suelo
impartido por el Colegio Profesional, están facultados para emitir los "certificados de usos de
suelo conforme", descritos en la Ley de Uso, Manejo y Conservación de Suelos N°7779 y su Reglamento
Decreto N°29375, afirmación condicionada a que el ordenamiento jurídico no imponga otro requisito
para los profesionales certificadores. Finalmente, de conformidad con lo dispuesto en el artículo
130 inciso 3) del Código Procesal Contencioso Administrativo, la declaratoria de disconformidad con
el "ordenamiento" jurídico del párrafo "Los miembros del Colegio de Ingenieros Agrónomos con grado
mínimo de Bachiller en ciencias Forestales, podrán fungir como Certificadores de Uso Conforme del
Suelo, en tierras en las que se desarrollarán proyectos forestales" contenida en el inciso b) del
artículo 3 del decreto  Nº 30636-MAG publicado en la Gaceta N°164 del 28 de agosto del 2002, tiene
efectos erga omnes, salvo derechos adquiridos de buena fe y situaciones jurídicas consolidadas.
Posteriormente mediante resolución de la Sala Primera,  N° 1523-2025 del 23 de octubre de 2025, se
declaran parcialmente con lugar los recursos incoados por el Estado y el INTA. En consecuencia, se
casa parcialmente la sentencia no. 2024003756 de las 13 horas 12 minutos del 12 de junio de 2024,
dictada por el Tribunal Contencioso Administrativo y Civil de Hacienda, únicamente, en el tanto se
impuso a su cargo el pago de las costas. En su lugar, cada parte correrá con las propias.)





c) Cursar y aprobar el Curso de Certificadores de Uso Conforme del Suelo, impartido por el Colegio
de Ingenieros Agrónomos y el MAG-INTA.

Artículo 4º-El Colegio de Ingenieros Agrónomos emitirá en cada curso, dos tipos de certificados: a)
Uno de Asistencia al Curso para quienes hayan asistido al menos al 80% del curso y b) Uno de
Aprobación del Curso para quienes hayan satisfecho los requisitos de aprobación del curso.

Artículo 5º-A quienes demuestren su experiencia y preparación académica suficiente ante el Comité
Evaluador, se les podrá eximir de los módulos del curso que fueran pertinentes.

Artículo 6º-El Comité Evaluador emitirá la resolución de aprobación del postulante.

Artículo 7º-Los postulantes que no aprobaren el curso tendrán derecho a realizar un examen
extraordinario, cuya fecha definirá el Comité Evaluador. En caso de reprobar el examen
extraordinario, el postulante interesado en fungir como Certificador de Uso Conforme del Suelo
deberá repetir el curso.

Artículo 8º-El postulante deberá completar el documento de "Solicitud de Inscripción" que para tal
efecto dispondrá el Departamento de Suelos y Evaluación de Tierras del MAG-INTA, aportando toda la
información referida en el artículo 3º. Con dicha información y una vez cumplidos los requisitos
establecidos, se incluirá al postulante en el Registro Oficial de Certificadores de Uso Conforme del
Suelo, acreditándolo como tal mediante la emisión de un carné que ostentará el mismo número de
Colegiado. Este carné será emitido por el Departamento de Suelos y Evaluación de Tierras del MAG-
INTA y deberá ser revalidado durante el mes de enero de cada año.

Artículo 9º-Los gastos administrativos para la inscripción en el Registro de Certificadores de Uso
Conforme del Suelo se fijan inicialmente en la suma de diez mil colones y serán depositados por el
interesado en la Cuenta Estaciones Experimentales del MAG, Programa 4, Actividad 2, Nº 20239-0 del
Banco Nacional de Costa Rica.

Artículo 10.-La relación entre el Colegio de Ingenieros Agrónomos de Costa Rica y los Certificadores
de Uso Conforme del Suelo, así como entre ellos, la Administración del Estado y las empresas
regentadas, se regirá por lo estipulado en la Ley Orgánica del Colegio de Ingenieros Agrónomos Nº
7221 del 6 de abril de 1991 y su Reglamento.

Artículo 11.-Para realizar su labor fiscalizadora sobre los Certificadores de Uso Conforme del
Suelo, el Colegio de Ingenieros Agrónomos de Costa Rica podrá establecer las cuotas
correspondientes, las cuales deberá pagar el interesado debidamente inscrito en el Registro Oficial
de Certificadores.

Artículo 12.-Las tarifas de honorarios por la labor de los Certificadores de Uso Conforme del Suelo,
se regirán de acuerdo con el valor mínimo de la hora profesional para la prestación de servicios
privados en ciencias agropecuarias y forestales.

Artículo 13.-El Departamento de Suelos y Evaluación de Tierras del MAG-INTA, de común acuerdo con el
Colegio de Ingeniero Agrónomos de Costa Rica, revisará periódicamente el contenido del Curso de
Certificadores de Uso Conforme del Suelo, para adecuarlo según lo ameriten las circunstancias.

Artículo 14.-Rige a partir de su publicación.

Transitorio I.-Hasta tanto el Colegio de Ingenieros Agrónomos de Costa Rica y el MAG o su ente
sucesor, no inicien el proceso de capacitación y se instale el Comité Evaluador, podrán inscribirse
como Certificadores de Uso Conforme del Suelo, en el Registro que para tal fin llevará el
Departamento de Suelos y Evaluación de Tierras del MAG-INTA, los miembros del Colegio de Ingenieros
Agrónomos de Costa Rica que acrediten sus títulos y su experiencia práctica, según lo consignado en
el inciso b) del artículo 3º del presente Decreto Ejecutivo. El Colegio de Ingenieros Agrónomos de
Costa Rica, en coordinación con el MAG-INTA, abrirá el período de solicitud de inscripciones para
los interesados en recibir el Curso correspondiente.

Ingenieros Agrónomos de Costa Rica, deberán elaborar el contenido del Curso de Certificadores de Uso
Conforme del Suelo, las normas de evaluación de dicho curso, así como los requisitos mínimos de
presentación de los informes que realicen los Certificadores de Uso Conforme del Suelo (formato de
los informes).

THE PRESIDENT OF THE REPUBLIC





AND THE MINISTER OF AGRICULTURE AND LIVESTOCK





Based on the provisions of articles 140, subsections 3) and 18), and 146 of the Political Constitution, Law No. 6227 of May 2, 1978, General Law of Public Administration, Law No. 7064 of April 29, 1987, Law for the Promotion of Agricultural Production, which incorporates the Organic Law of the Ministry of Agriculture and Livestock, Law No. 7779 of April 30, 1998, Law on the Use, Management and Conservation of Soils, and Law No. 8149 of November 5, 2001, Law Creating the National Institute of Innovation and Transfer in Agricultural Technology.





Considering:





1st-That through Law No. 7779 of April 30, 1998, the Law on the Use, Management and Conservation of Soils was issued, which is duly regulated and establishes as a function of the Ministry of Agriculture and Livestock to maintain a Registry of private natural or legal persons engaged in carrying out projects for the better use, management, and conservation of soils, as well as to accredit and authorize the respective professionals as Certifiers of Land Use Conformity (Certificadores de Uso Conforme del Suelo).





2nd-That the implementation of the indicated Registry will allow for the participation of independent professionals of recognized capacity in the field of Edaphology, in the fulfillment of the purposes established by Law No. 7779, for the benefit of efficiency and effectiveness of the procedures that must be completed by the interested parties and the attention of objectives of a public nature, under the supervision and control of the Administration.





3rd-That through Law No. 8149 of November 5, 2001, the National Institute of Innovation and Transfer in Agricultural Technology (INTA) was created as an organ of maximum deconcentration of the MAG, which will assume in due course the functions of the Directorate of Agricultural Research. Therefore,





Decree:





Article 1-The Official Registry of Certifiers of Land Use Conformity (Registro Oficial de Certificadores de Uso Conforme del Suelo) is hereby created, with headquarters in the Department of Soils and Land Evaluation of the Directorate of Agricultural Research of the Ministry of Agriculture and Livestock (MAG-INTA).

Article 2-The Evaluation Committee for Applicants to Certifiers of Land Use Conformity (Comité Evaluador de Postulantes a Certificadores de Uso Conforme del Suelo) is hereby created, which will be composed of:





- A representative of the Department of Soils and Land Evaluation of MAG-INTA.





- A representative of CONARE.





- Two representatives of the College of Agronomists of Costa Rica (Colegio de Ingenieros Agrónomos de Costa Rica).





- A representative of the Costa Rican Soil Science Association (Asociación Costarricense de la Ciencia del Suelo).





The representatives will be appointed by the respective entity, will serve in their functions for a period of two years, and may be reelected.





The Committee will meet whenever the College of Agronomists requires it, in order to evaluate all the requirements of the applicants for Certifiers of Land Use Conformity. For the validity of its decisions, a minimum attendance of three of its members will be required, and decisions shall be adopted by a simple majority of votes present.

Article 3-Applicants for enrollment in the Official Registry of Certifiers of Land Use Conformity must meet the following requirements:





a) Be duly incorporated into the College of Agronomists of Costa Rica and in active practice of the profession.





b) Possess a minimum degree of Bachelor's in Agronomic Engineering with emphasis in Plant Science or Generalist, or a minimum degree of Bachelor's in Forestry Sciences. Furthermore, other professional members of the College of Agronomists with a postgraduate degree or specialization in soil matters or soil conservation may be applicants. All must demonstrate a minimum of one year of practical experience in studies for the planning and development of land use.





(Through resolution No. 003756 of June 12, 2024, the Administrative and Civil Treasury Court annulled the last paragraph of subsection b) above, it being understood from said normative provision that professionals in forestry sciences duly incorporated into the College of Agronomists, and who have passed the course for Certifiers of Land Use Conformity taught by the Professional College, are authorized to issue the "certificates of land use conformity" described in the Law on the Use, Management and Conservation of Soils No. 7779 and its Regulation, Decree No. 29375, an affirmation conditioned upon the legal system not imposing another requirement for certifying professionals. Finally, in accordance with the provisions of article 130, subsection 3) of the Contentious Administrative Procedure Code, the declaration of non-conformity with the legal "system" of the paragraph "Members of the College of Agronomists with a minimum degree of Bachelor's in Forestry Sciences may serve as Certifiers of Land Use Conformity on lands where forestry projects will be developed" contained in subsection b) of article 3 of Decree No. 30636-MAG published in Gazette No. 164 of August 28, 2002, has erga omnes effects, except for good faith acquired rights and consolidated legal situations. Subsequently, through a resolution of the First Chamber, No. 1523-2025 of October 23, 2025, the appeals filed by the State and INTA were partially granted. Consequently, judgment no. 2024003756 of 13:12 on June 12, 2024, handed down by the Administrative and Civil Treasury Court, is partially overruled, solely insofar as the payment of costs was imposed on them. In its place, each party shall bear its own.)





c) Complete and pass the Course for Certifiers of Land Use Conformity, taught by the College of Agronomists and MAG-INTA.

Article 4-The College of Agronomists will issue, for each course, two types of certificates: a) One of Course Attendance for those who have attended at least 80% of the course, and b) One of Course Completion for those who have satisfied the course's passing requirements.

Article 5-Those who demonstrate their sufficient experience and academic preparation before the Evaluation Committee may be exempted from the pertinent course modules.

Article 6-The Evaluation Committee will issue the resolution of approval for the applicant.

Article 7-Applicants who do not pass the course will have the right to take an extraordinary examination, the date of which shall be defined by the Evaluation Committee. In the event of failing the extraordinary examination, the applicant interested in serving as a Certifier of Land Use Conformity (Certificador de Uso Conforme del Suelo) must repeat the course.

Article 8-The applicant must complete the "Application for Enrollment" document, which the Department of Soils and Land Evaluation of MAG-INTA will provide for that purpose, supplying all the information referred to in Article 3. With said information and once the established requirements are met, the applicant will be included in the Official Registry of Certifiers of Land Use Conformity and accredited as such through the issuance of a card that will bear the same Collegiate number. This card will be issued by the Department of Soils and Land Evaluation of MAG-INTA and must be revalidated during the month of January of each year.

Article 9-The administrative expenses for enrollment in the Registry of Certifiers of Land Use Conformity are initially set at the sum of ten thousand colones and will be deposited by the interested party into the MAG Experimental Stations Account, Program 4, Activity 2, No. 20239-0 of the National Bank of Costa Rica.

Article 10-The relationship between the College of Agronomists of Costa Rica and the Certifiers of Land Use Conformity, as well as between them, the State Administration, and the managed companies, will be governed by the provisions of the Organic Law of the College of Agronomists No. 7221 of April 6, 1991, and its Regulation.

Article 11-To carry out its oversight function over the Certifiers of Land Use Conformity, the College of Agronomists of Costa Rica may establish the corresponding fees, which must be paid by the interested party duly enrolled in the Official Registry of Certifiers.

Article 12-The fee tariffs for the work of the Certifiers of Land Use Conformity will be governed in accordance with the minimum value of the professional hour for the provision of private services in agricultural and forestry sciences.

Article 13-The Department of Soils and Land Evaluation of MAG-INTA, by mutual agreement with the College of Agronomists of Costa Rica, will periodically review the content of the Course for Certifiers of Land Use Conformity to adapt it as circumstances require.

Transitory Provision I-As long as the College of Agronomists of Costa Rica and the MAG or its successor entity have not initiated the training process and the Evaluation Committee has not been installed, members of the College of Agronomists of Costa Rica who accredit their degrees and practical experience, as stated in subsection b) of Article 3 of this Executive Decree, may enroll as Certifiers of Land Use Conformity in the Registry that the Department of Soils and Land Evaluation of MAG-INTA will maintain for that purpose. The College of Agronomists of Costa Rica, in coordination with MAG-INTA, will open the application period for those interested in receiving the corresponding Course.

Transitory Provision II-The Department of Soils and Land Evaluation of MAG-INTA and the College of Agronomists of Costa Rica must develop the content of the Course for Certifiers of Land Use Conformity, the evaluation rules for said course, as well as the minimum requirements for the presentation of the reports prepared by the Certifiers of Land Use Conformity (report format).
