Con fundamento en las facultades que les confiere los artículos 140, incisos 3) y 18) y 146) Constitución Política, y el artículo 18 de la Ley Forestal Nº 7575 del 13 de febrero de 1996 y su reglamento, Ley Orgánica del Ambiente Nº 7554 del 4 de octubre de 1995, Decreto Ejecutivo Nº 25721-MINAE del 17 de octubre de 1996, y sus reformas. Decreto Nº 27998-MINAE Principios Criterios Indicadores para el Manejo Sostenible de Bosque Secundario y Certificación Forestal Decreto Ejecutivo Nº 30763-MINAE Principios Criterios Indicadores para el manejo Sostenible de Bosques Naturales y su Certificación en Costa Rica, Ley Nº 6043 Ley de la Zona Marítimo Terrestre del 2 de marzo de 1977, artículos 4 y 5 de la Ley Orgánica del Instituto Costarricense de Turismo y el Decreto Ejecutivo Nº 31045-MOPT del 6 de marzo del 2003. Considerando: 1º-Que la Ley Forestal Nº 7575 dispone que la función esencial y prioritaria del Estado, es velar por la conservación, protección y administración de los bosques naturales del Estado, de acuerdo con el principio de uso adecuado y sostenible de los recursos naturales renovables. 2º-Que en el patrimonio natural, el Estado podrá realizar o autorizar labores de investigación, capacitación y ecoturismo, una vez aprobadas por el Ministerio del Ambiente y Energía quién definirá cuando corresponda la realización de evaluaciones del impacto ambiental, según lo establezca el reglamento de la Ley. 3º-Que el ecoturismo es una modalidad del turismo sostenible, que a su vez se inserta dentro del marco general de desarrollo sostenible. Este último ha sido definido como un patrón de transformaciones estructural de índole socioeconómica que optimiza los beneficios similares en el futuro. 4º-Que el concepto de ecoturismo se refiere a un segmento dentro del sector turístico, en tanto que los principios de sostenibilidad deben aplicarse a toda forma de actividad. Based on the powers granted by Articles 140, subsections 3) and 18) and 146) of the Political Constitution, and Article 18 of the Ley Forestal No. 7575 of February 13, 1996 and its regulation, the Ley Orgánica del Ambiente No. 7554 of October 4, 1995, Executive Decree No. 25721-MINAE of October 17, 1996, and its amendments, Decree No. 27998-MINAE Principles Criteria Indicators for the Sustainable Management of Secondary Forest and Forest Certification, Executive Decree No. 30763-MINAE Principles Criteria Indicators for the Sustainable Management of Natural Forests and their Certification in Costa Rica, Law No. 6043 Law of the Maritime Terrestrial Zone (Ley de la Zona Marítimo Terrestre) of March 2, 1977, Articles 4 and 5 of the Organic Law of the Instituto Costarricense de Turismo, and Executive Decree No. 31045-MOPT of March 6, 2003. Considering: 1º-That the Ley Forestal No. 7575 provides that the essential and priority function of the State is to ensure the conservation, protection, and administration of the State's natural forests, in accordance with the principle of adequate and sustainable use of renewable natural resources. 2º-That within the natural heritage, the State may carry out or authorize research, training, and ecotourism activities, once approved by the Ministry of Environment and Energy (Ministerio del Ambiente y Energía), which shall define, when appropriate, the conducting of environmental impact assessments (evaluaciones del impacto ambiental), as established by the regulation of the Law. 3º-That ecotourism is a modality of sustainable tourism, which in turn is inserted within the general framework of sustainable development. The latter has been defined as a pattern of structural transformations of a socioeconomic nature that optimizes similar benefits in the future. 4º-That the concept of ecotourism refers to a segment within the tourism sector, while the principles of sustainability must be applied to all forms of activity.
