EL PRESIDENTE DE LA REPÚBLICA,





EL MINISTRO DEL AMBIENTE Y ENERGÍA





 





En el ejercicio de las facultades conferidas por los artículos, 50, 89, 140 incisos 3 y 18 y 146 de
la Constitución Política, y 3 de la Convención Relativa a los Humedales de Importancia Internacional
Especialmente como hábitat de las aves acuáticas (Convención RAMSAR) ratificada por ley de la
República Nº 7224 de 9 de abril de 1991; 6, 11 y 27 de la Ley General de la Administración Pública
Nº 6227 de 2 de mayo de 1978 y con fundamento en lo dispuesto en los artículos 2º incisos ch), e),
i) de la Ley Orgánica del Ministerio del Ambiente y Energía Nº 7152 de 21 de junio de 1990; 2, 7
inciso h) de la Ley de Conservación de la Vida Silvestre y sus reformas Nº 7317 del 30 de octubre de
1992; 32, 36, 37,39, 40, 41, 42, 43, 44, 45, 46, 47, 50, 51, 52, 53, 54 y 55 de la Ley Orgánica del
Ambiente Nº 7554 del 4 de octubre de 1995; Ley Forestal Nº 7575 de 5 de febrero de 1996 y sus
reformas.





 





Considerando:





 





1º-Que es obligación del Estado velar por la conservación de los recursos naturales del país, la
administración de la vida silvestre y la recomendación de medidas que aseguren la perpetuidad de las
especies y sus ecosistemas, en la figura del Ministerio del Ambiente y Energía. 





2º-Que el artículo 32 de la Ley Orgánica del Ambiente Nº 7554 establece que los Humedales son una de
las categorías de manejo de Área Silvestre Protegida, instituida para Costa Rica y faculta al Poder
Ejecutivo a declararlos por la vía del decreto ejecutivo.





3º-Que mediante resolución Nº 895-02-TAA del 18 de noviembre de 2002 y a consecuencia de denuncia
interpuesta ante el Tribunal Ambiental Administrativo, se procedió al nombramiento de Peritos para
la presentación de un Informe Técnico sobre la delimitación exacta y amojonamiento del área del
Humedal Laguna Pochotal.





4º-Que el Departamento de Cartografía del Instituto Geográfico Nacional realizó un levantamiento
cartográfico con fecha 17 de diciembre del 2002, mediante el cual se identificaron los cauces
naturales y artificiales existentes en el sector denominado Humedal Laguna Pochotal, el cual fue
realizado con base en el recuento histórico de fotografías aéreas y el apoyo técnico de dos
especialistas en la materia.





5º-Que la sentencia 1123-2206 del Tribunal de Casación Penal de las 9 horas 55 minutos del 20 de
octubre del 2006 estableció que Toda esta relación de normas, consideradas a partir de una
hermenéutica integradora y sistemática, permite comprender que el legislador definió las
características y condiciones especiales que deberán tomarse en cuenta para que un área determinada
califique y sea declarada (y delimitada) como un humedal, para lo cual incluso podrá y será
conveniente contar con auxilio técnico y profesional adecuado. También estableció que esa
declaratoria y delimitación deberá realizarse por medio de decreto ejecutivo, el cual presupone que
cuando se trate de un inmueble privado, se haya cumplido con el trámite de expropiación o con una
indemnización previa ( en casos de simple afectación".





6º-Que por razones de seguridad jurídica es necesario que se oficialice la delimitación de la Laguna
Pochotal, de manera que los operadores jurídicos, tanto administrativos como judiciales, sepan con
certeza a qué atenerse cuando tengan que determinar sus linderos. Por tanto,





 





DECRETAN:





 





Oficialización del levantamiento Cartográfico que identifica





los Cauces Naturales y Artificiales existentes





en el sector Humedal Laguna Pochotal





 





Articulo 1º-Se oficializa el levantamiento cartográfico realizado por el Departamento de Cartografía
del Instituto Geográfico Nacional con fecha 17 de diciembre del 2002, mediante el cual identificaron
los cauces naturales y artificiales existentes en el sector denominado Humedal Laguna Pochotal. La
citada laguna está incluida en la hoja cartográfica Herradura, escala I: 50.000, editada por el
Instituto Geográfico Nacional.

Artículo 2º-Para todos los efectos legales la delimitación de la Laguna Pochotal es la establecida
en el levantamiento cartográfico indicado en el artículo 1 del presente decreto ejecutivo.

Artículo 3º-De conformidad con el artículo 33 de la Ley Forestal la Laguna tendrá una zona de
protección de cincuenta metros.

Artículo 4º-Rige a partir de su publicación en el Diario Oficial La Gaceta.

THE MINISTER OF ENVIRONMENT AND ENERGY





 


In the exercise of the powers conferred by articles 50, 89, 140 subsections 3 and 18 and 146 of
the Political Constitution, and 3 of the Convention on Wetlands of International Importance
especially as Waterfowl Habitat (RAMSAR Convention) ratified by Law of the
Republic Nº 7224 of April 9, 1991; 6, 11 and 27 of the General Law of Public Administration
Nº 6227 of May 2, 1978 and based on the provisions of articles 2 subsections ch), e),
i) of the Organic Law of the Ministry of Environment and Energy Nº 7152 of June 21, 1990; 2, 7
subsection h) of the Wildlife Conservation Law and its amendments Nº 7317 of October 30,
1992; 32, 36, 37,39, 40, 41, 42, 43, 44, 45, 46, 47, 50, 51, 52, 53, 54 and 55 of the Organic Law of
the Environment Nº 7554 of October 4, 1995; Ley Forestal Nº 7575 of February 5, 1996 and its
amendments.





 


Considering:





 


1º-That it is the State's obligation to ensure the conservation of the country's natural resources, the
administration of wildlife and the recommendation of measures that ensure the perpetuation of
species and their ecosystems, through the figure of the Ministry of Environment and Energy. 

2º-That article 32 of the Organic Law of the Environment Nº 7554 establishes that Wetlands are one of
the management categories of Protected Wilderness Area, instituted for Costa Rica and empowers the Executive
Branch to declare them via executive decree.

3º-That by resolution Nº 895-02-TAA of November 18, 2002 and as a result of a complaint
filed before the Administrative Environmental Tribunal, Experts were appointed for
the presentation of a Technical Report on the exact delimitation and boundary marking of the area of the
Humedal Laguna Pochotal.

4º-That the Cartography Department of the IGN conducted a cartographic
survey dated December 17, 2002, through which the natural
and artificial watercourses (cauces) existing in the sector called Humedal Laguna Pochotal were identified, which was
carried out based on the historical recount of aerial photographs and the technical support of two
specialists in the field.

5º-That sentence 1123-2206 of the Criminal Cassation Court of 9:55 a.m. on October 20,
2006 established that "All this body of norms, considered from an
integrative and systematic hermeneutics, allows us to understand that the legislator defined the
special characteristics and conditions that must be taken into account for a specific area to
qualify and be declared (and delimited) as a wetland, for which it may even and will be
advisable to have adequate technical and professional assistance." It also established that "this
declaration and delimitation must be carried out by means of an executive decree, which presupposes that,
in the case of a private property, the expropriation procedure or prior
compensation has been completed (in cases of mere encumbrance)."

6º-That for reasons of legal certainty it is necessary to officialize the delimitation of the Laguna
Pochotal, so that legal operators, both administrative and judicial, will know with
certainty what to expect when they must determine its boundaries. Therefore,





 


DECREE:





 


Officialization of the Cartographic Survey that identifies





the Natural and Artificial Watercourses existing





in the Humedal Laguna Pochotal sector





 


Article 1º-The cartographic survey carried out by the Cartography Department
of the IGN on December 17, 2002, through which they identified
the natural and artificial watercourses existing in the sector called Humedal Laguna Pochotal, is officialized. The
aforementioned lake is included in the Herradura cartographic sheet, scale 1:50,000, published by the
IGN.

Article 2º-For all legal purposes, the delimitation of the Laguna Pochotal is that established
in the cartographic survey indicated in article 1 of this executive decree.

Article 3º-In accordance with article 33 of the Ley Forestal, the Laguna shall have a
protection zone of fifty meters.

Article 4º-It is effective upon its publication in the Official Gazette La Gaceta.
