LA PRESIDENTA DE LA
REPÚBLICA

Y EL MINISTRO DE
JUSTICIA Y PAZ

Con fundamento en lo dispuesto en los artículos
140, inciso 18) y 146 de la Constitución Política, en el artículo 32 de la Ley
de Asociaciones y en los artículos 27 y siguientes de su Reglamento.

Considerando:

I.-Que el artículo 32 de la Ley de Asociaciones Nº
218 del ocho de agosto de mil novecientos treinta y nueve y sus reformas,
confiere al Poder Ejecutivo la potestad de declarar de Utilidad Pública a las
Asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades
sean particularmente útiles para los intereses del Estado, y que por ello
contribuyan a solventar una necesidad social.

II.-Que la Asociación
Específica Administradora del Acueducto Integrado de las Comunidades de
Gutiérrez y Bron, cédula de Persona Jurídica número 3-002-198499, se inscribió
en el Registro de Asociaciones del Registro Público desde el día dieciséis de
diciembre del dos mil tres, bajo el tomo Nº 435, asiento 14363.

III.-Que los fines que
persigue la Asociación, según su acta constitutiva son los que se transcriben: ".Artículo
tercero "los fines de la Asociación son los siguientes: a) La
construcción, operación y reconstrucción de un sistema de acueducto para las
comunidades de Gutiérrez y Bron. b) Administrar, operar y conservar en buenas
condiciones el acueducto, de acuerdo con las disposiciones y reglamentos que al
respecto emita el Instituto Costarricense de Acueductos y Alcantarillados, en
adelante AyA. c) Obtener la participación efectiva de la comunidad, en la
construcción y mantenimiento del acueducto. d) Realizar y en su caso con otros
organismos en los programas y campañas de índole educativas relacionadas con el
uso racional y la sostenibilidad del sistema de acueducto. e) Ayudar a explicar
y divulgar en la comunidad las disposiciones y reglamentos de AyA. f) Cooperar
en los planes, proyectos y obras que emprenda AyA en la comunidad. g)
Participar en la vigilancia y protección de las fuentes de abastecimiento del
acueducto, evitar las contaminaciones de las mismas y ayudar a la protección de
las cuencas hidrográficas de la región".

IV.-Que tales fines
solventan una necesidad social de primer orden, por lo cual merecen el apoyo
del Estado Costarricense. Por tanto,

Decretan:

Artículo 1º-Declárese de Utilidad Pública para los
intereses del Estado la Asociación Específica Administradora del Acueducto
Integrado de las Comunidades de Gutiérrez y Bron, cédula de persona jurídica
número 3-002-198499.

Artículo 2º-Es deber de la
Asociación rendir anualmente un informe ante el Ministerio de Justicia y Paz,
de conformidad con lo indicado en el artículo 32 del Reglamento a la Ley de
Asociaciones.

Artículo 3º-Una vez
publicado este Decreto los interesados deberán protocolizar y presentar el
respectivo testimonio ante el Registro de Asociaciones del Registro Nacional,
para su respectiva inscripción.

Artículo 4º-Rige a partir
de su publicación.

Dado en la Presidencia de la República.-San José, a
las catorce horas, treinta minutos del ocho de junio del dos mil once.

THE PRESIDENT OF THE REPUBLIC

AND THE MINISTER OF JUSTICE AND PEACE

Based on the provisions set forth in Articles 140, subsection 18) and 146 of the Political Constitution, in Article 32 of the Ley de Asociaciones and in Articles 27 and following of its Reglamento.

Considering:

I.—That Article 32 of Law of Associations No. 218 of August eight, nineteen thirty-nine, and its amendments, grants the Executive Branch the power to declare of Public Utility simple, federated, or confederated Associations whose development and activities are particularly useful for the interests of the State, and that therefore contribute to addressing a social need.

II.—That the Specific Administrative Association of the Integrated Aqueduct of the Communities of Gutiérrez and Bron, legal entity identification number 3-002-198499, was registered in the Associations Registry of the Public Registry on December sixteen, two thousand three, under volume No. 435, entry 14363.

III.—That the purposes pursued by the Association, according to its articles of incorporation (acta constitutiva), are transcribed as follows: ".Article three 'the purposes of the Association are the following: a) The construction, operation, and reconstruction of an aqueduct system for the communities of Gutiérrez and Bron. b) To administer, operate, and conserve in good condition the aqueduct, in accordance with the provisions and regulations issued in this regard by the Instituto Costarricense de Acueductos y Alcantarillados, hereinafter AyA. c) To obtain the effective participation of the community in the construction and maintenance of the aqueduct. d) To carry out, and as the case may be with other organizations, programs and campaigns of an educational nature related to the rational use and sustainability of the aqueduct system. e) To help explain and disseminate in the community the provisions and regulations of AyA. f) To cooperate in the plans, projects, and works undertaken by AyA in the community. g) To participate in the surveillance and protection of the aqueduct's supply sources, prevent their contamination, and help protect the hydrographic basins of the region'."

IV.—That such purposes address a social need of the highest order, for which they deserve the support of the Costa Rican State. Therefore,

They Decree:

Article 1.—The Specific Administrative Association of the Integrated Aqueduct of the Communities of Gutiérrez and Bron, legal entity identification number 3-002-198499, is hereby declared of Public Utility for the interests of the State.

Article 2.—It is the duty of the Association to submit an annual report to the Ministry of Justice and Peace, in accordance with the provisions of Article 32 of the Reglamento a la Ley de Asociaciones.

Article 3.—Once this Decree is published, the interested parties must formalize in a public deed (protocolizar) and submit the respective certified copy (testimonio) to the Associations Registry of the National Registry, for its corresponding registration.

Article 4.—It enters into force as of its publication.
