Playa Corozalito y Playa Islita practicadas y declara de Aptitud Turística los sectores de la Zona
Marítimo Terrestre del frente costero del Cantón de Nandayure

COMUNICADO DE ACUERDO

N° SJD-284-2011.-Tomado en la sesión ordinaria de
Junta Directiva N° 5697, artículo 5, inciso IV, celebrada el día 21 de junio
del 2011, que textualmente dice:

SE ACUERDA:

A)
Acoger el criterio técnico contenido en
el oficio N° MPD-P-232-2011 suscrito por el Macroproceso de Planeamiento y
Desarrollo, relativo a la solicitud planteada ante el ICT por la Municipalidad
de Nandayure, mediante Acuerdo de Concejo de sesión ordinaria N° 22, celebrada
el 29 de setiembre del 2010, para modificar la aptitud no turística de las
declaratorias de los sectores de Playa Corozalito y Playa Islita, practicadas
en años anteriores para el cantón de Nandayure.

B)
Declarar de aptitud turística los
sectores de zona marítima terrestre localizadas en el frente costero del cantón
de Nandayure, colindante con el Océano Pacífico, entre las coordenadas de
proyección CRTM05:

1089217 N - 345955 E

1075834 N - 366375 E

C)
Declarar de aptitud turística los
sectores de zona marítima terrestre presentes en la Isla Berrugate, ubicada en
el Golfo de Nicoya.

D)
Declarar de aptitud no turística las
porciones de zona marítima terrestre aledañas a los manglares del Golfo de
Nicoya, localizadas dentro de las jurisdicción del cantón de Nandayure, entre
las coordenadas de proyección CRTM05:

1106738 N - 371810 E

Excluir de este acuerdo, todos aquellos
sectores costeros que el Área de Conservación Guanacaste ha clasificado
certificado como terrenos de Patrimonio Natural del Estado, mediante la
Metodología establecida por el MINAET en la totalidad del cantón de Nandayure.

F)
Excluir de este acuerdo, los sectores
que se encuentren afectados por lo establecido en los artículos 6 y 73 de la
Ley de la Zona Marítimo Terrestre.

G) Derogar toda aquella declaratoria que se
haya practicado en años anteriores para el cantón de Nandayure, según registros
de las siguientes Gacetas:

  Gaceta N° 93 del 16 de mayo de 1984

  Gaceta N° 231 del 12 de junio de 1989

  Gaceta N° 186 del 30 de setiembre de
1995

  Gaceta N° 159 del 23 de agosto de 1995

Instruir al Macroproceso Planeamiento y
Desarrollo comunique a los interesados la presente resolución.

I)
Instruir al Macroproceso
Administrativo para que se realicen las gestiones para publicar en el Diario
Oficial La Gaceta la oficialización de este acuerdo.

                        Rectifies the non-tourism suitability of the declarations of the sectors of
Playa Corozalito and Playa Islita made and declares the sectors of the Maritime
Terrestrial Zone of the coastal front of the Canton of Nandayure as Tourism-Suitable

    COSTA RICAN TOURISM INSTITUTE

AGREEMENT COMMUNIQUÉ

No. SJD-284-2011.- Taken at the regular session of
the Board of Directors No. 5697, article 5, subsection IV, held on June 21,
2011, which textually states:

IT IS AGREED:

A)
To accept the technical opinion contained in
official letter No. MPD-P-232-2011 signed by the Macroproceso de Planeamiento y
Desarrollo, regarding the request filed with the ICT by the Municipality
of Nandayure, through Council Agreement of regular session No. 22, held
on September 29, 2010, to modify the non-tourism suitability of the
declarations of the sectors of Playa Corozalito and Playa Islita, made
in previous years for the canton of Nandayure.

B)
To declare as tourism-suitable the
sectors of the maritime terrestrial zone located on the coastal front of the canton
of Nandayure, adjacent to the Pacific Ocean, between the CRTM05 projection
coordinates:

C)
To declare as tourism-suitable the
sectors of the maritime terrestrial zone present on Isla Berrugate, located in
the Gulf of Nicoya.

D)
To declare as non-tourism-suitable the
portions of the maritime terrestrial zone adjacent to the mangroves of the Gulf
of Nicoya, located within the jurisdiction of the canton of Nandayure, between
the CRTM05 projection coordinates:

To exclude from this agreement all
those coastal sectors that the Guanacaste Conservation Area has classified and
certified as State Natural Heritage lands, through the
methodology established by MINAET in the entirety of the canton of Nandayure.

F)
To exclude from this agreement the sectors
that are affected by the provisions of articles 6 and 73 of the
Maritime Terrestrial Zone Law.

G) To repeal any declaration made
in previous years for the canton of Nandayure, according to records
in the following Gazettes:

  Gazette No. 93 of May 16, 1984

  Gazette No. 231 of June 12, 1989

  Gazette No. 186 of September 30,
1995

  Gazette No. 159 of August 23, 1995

  Gazette No. 25 of April 2, 2000

H)
To instruct the Macroproceso Planeamiento y
Desarrollo to notify the interested parties of this resolution.

I)
To instruct the Macroproceso
Administrativo to take the necessary steps to publish the officialization of this
agreement in the Official Gazette La Gaceta.
