Y EL MINISTRO DE HACIENDA

Con fundamento en las atribuciones que les confieren los artículos 140
incisos 3) y 18) y 146 de
la Constitución Política; los artículos 25 inciso
1), 27 inciso 1) y 28 inciso 2) acápite b) de
la Ley Nº 6227, Ley General de
la Administración
 Pública de 2 de mayo de 1978 y sus reformas;
la Ley Nº 8131, Ley de
la Administración
 Financiera de
la República y Presupuestos Públicos de 18 de
setiembre de 2001 y sus reformas; su Reglamento, el Decreto Ejecutivo No.
32988-H-MP-PLAN de 31 de enero de 2006 y sus reformas;
la Ley Nº 7788, Ley de
Biodiversidad de 30 de abril de 1998 y sus reformas; el Decreto Ejecutivo Nº
32452-H de 29 de junio de 2005 y sus reformas y el Decreto Ejecutivo Nº 35821-H
de 4 de marzo de 2010 y su reformas.

Considerando:

1º-Que mediante la Ley No.
7788, publicada en La
 Gaceta Nº 101 de 27 de mayo de 1998 y sus reformas; se
creó la
 Comisión Nacional para
la Gestión de
la Biodiversidad
(CONAGEBIO), como un órgano desconcentrado del Ministerio del Ambiente y
Energía con personería jurídica instrumental, y funciones referentes a la
conservación, el uso ecológicamente sostenible y la restauración de la
biodiversidad.

2º-Que mediante oficios OT-129-2011 de 20 de mayo
de 2011, la
 Comisión Nacional para
la Gestión de
la Biodiversidad,
solicita ampliar el gasto máximo presupuestario asignado para el año 2011, por
un monto de ¢31.701.005,67 (treinta y un millones setecientos un mil cinco
colones con sesenta y siete céntimos), con el objetivo de dar cobertura al pago
de salarios de la
 Oficina Técnica en los meses de setiembre a diciembre.

3º-Que con recursos provenientes del superávit
específico, según lo dispone el artículo 20 de
la Ley de Biodiversidad, se
financiarán los gastos operativos de la institución, que permitan cumplir con
las acciones indicadas en el considerando anterior.

4º-Que mediante el Decreto Ejecutivo Nº 32452-H,
publicado en La Gaceta
 Nº 130 de 6 de julio de 2005 y sus reformas, se emite el
"Lineamiento para la aplicación del Artículo 6 de
la Ley No. 8131 de
la Administración
 Financiera de
la República y Presupuestos Públicos y la regulación
de la clase de ingresos del Sector Público denominada Financiamiento".

5º-Que en relación con el superávit específico, el
numeral 9° del referido Decreto Ejecutivo Nº 32452-H, posibilita la utilización
de éste, para el pago de gastos definidos en los fines establecidos en las
disposiciones especiales o legales aplicables a tales recursos.

6º-Que mediante el Decreto Ejecutivo Nº 35821-H,
publicado en La Gaceta
 Nº 55 de 19 de marzo de 2010 y sus reformas, se emitieron las
Directrices Generales de Política Presupuestaria para las Entidades Públicas,
Ministerios y demás Órganos según corresponda, cubiertas por el Ámbito de
la Autoridad Presupuestaria
para el Año 2011, estableciéndose en el artículo 1° del citado decreto, el
gasto presupuestario máximo del año 2011, para las instituciones cubiertas por
el ámbito de la
 Autoridad Presupuestaria.

7º-Que con el oficio DM-412-2011 de 18 de mayo de
2011, la Ministra
a. í. de Ambiente, Energía y Telecomunicaciones, avala la solicitud planteada
por la
 Comisión Nacional para
la Gestión de
la Biodiversidad
(CONAGEBIO).

8º-Que por lo anterior, resulta necesario ampliar
el gasto presupuestario máximo fijado para
la Comisión Nacional
para la Gestión
de la Biodiversidad
(CONAGEBIO) para el año 2011, incrementándolo en la suma de ¢31.701.005,67
(treinta y un millones setecientos un mil cinco colones con sesenta y siete
céntimos). Por tanto,

Decretan:

Artículo 1º-Amplíese para
la Comisión Nacional para
la Gestión de
la Biodiversidad
(CONAGEBIO), el gasto presupuestario máximo para el 2011, establecido en el
Decreto Ejecutivo Nº 35821-H, publicado en
La Gaceta Nº 55 de 19
de marzo de 2010 y sus reformas, en la suma de ¢31.701.005,67 (treinta y un
millones setecientos un mil cinco colones con sesenta y siete céntimos), para
ese período.

Artículo 2°-Es responsabilidad de la administración
activa de la
 Comisión Nacional para
la Gestión de
la Biodiversidad
(CONAGEBIO), el cumplimiento de lo dispuesto en el artículo 6 de
la Ley Nº 8131, Ley de
la Administración
 Financiera de
la República y Presupuestos Públicos, publicada en
La Gaceta Nº 198 de
16 de octubre de 2001 y sus reformas, así como en el Decreto Ejecutivo Nº 32452-H,
publicado en La Gaceta Nº 130 de 6 de julio de 2005 y sus reformas.

Artículo 3°-Rige a partir de su publicación.

Based on the powers conferred by articles 140, subsections 3) and 18), and 146 of
the Political Constitution; articles 25, subsection
1), 27, subsection 1), and 28, subsection 2), paragraph b) of
Law Nº 6227, General Law of Public
 Administration, of May 2, 1978, and its amendments;
Law Nº 8131, Law of Financial
 Administration of
the Republic and Public Budgets, of September 18, 2001, and its amendments; its Regulation, Executive Decree No.
32988-H-MP-PLAN of January 31, 2006, and its amendments;
Law Nº 7788, Biodiversity
 Law of April 30, 1998, and its amendments; Executive Decree Nº
32452-H of June 29, 2005, and its amendments; and Executive Decree Nº 35821-H
of March 4, 2010, and its amendments.

Considering:

1º-Whereas by Law No.
7788, published in La
 Gaceta Nº 101 of May 27, 1998, and its amendments, the
 National Commission for Biodiversity Management
(CONAGEBIO) was created as a deconcentrated body of the Ministry of Environment and
Energy with instrumental legal personality and functions related to the
conservation, ecologically sustainable use, and restoration of
biodiversity.

2º-Whereas through official communications OT-129-2011 of May 20,
2011, the National Commission for Biodiversity Management
requests to expand the maximum budgetary expenditure assigned for the year 2011 by
an amount of ¢31,701,005.67 (thirty-one million seven hundred one thousand five
colones with sixty-seven céntimos), in order to cover the payment
of salaries of the Technical Office for the months of September to December.

3º-Whereas with resources from the specific surplus,
as provided in Article 20 of the Biodiversity Law, the
operating expenses of the institution will be financed, enabling compliance with
the actions indicated in the preceding considering clause.

4º-Whereas through Executive Decree Nº 32452-H,
published in La Gaceta
 Nº 130 of July 6, 2005, and its amendments, the
"Guideline for the application of Article 6 of Law No. 8131, Law of Financial
 Administration of
the Republic and Public Budgets, and the regulation
of the class of Public Sector revenues called Financing" was issued.

5º-Whereas regarding the specific surplus, numeral
9° of the aforementioned Executive Decree Nº 32452-H enables its use
for the payment of expenses defined in the purposes established in the
special or legal provisions applicable to such resources.

6º-Whereas through Executive Decree Nº 35821-H,
published in La Gaceta
 Nº 55 of March 19, 2010, and its amendments, the General
Budgetary Policy Guidelines for 2011 were issued for Public Entities,
Ministries, and other Organs, as applicable, covered by the Scope of
the Budgetary Authority,
establishing in article 1° of the cited decree the
maximum budgetary expenditure for the year 2011 for the institutions covered by
the scope of the Budgetary Authority.

7º-Whereas through official communication DM-412-2011 of May 18,
2011, the Acting Minister of Environment, Energy, and Telecommunications endorses the request raised
by the National Commission for Biodiversity Management
(CONAGEBIO).

8º-Whereas due to the foregoing, it is necessary to expand
the maximum budgetary expenditure set for the National Commission
for Biodiversity Management
(CONAGEBIO) for the year 2011, increasing it by the sum of ¢31,701,005.67
(thirty-one million seven hundred one thousand five colones with sixty-seven
céntimos). Therefore,

They decree:

Article 1º-The maximum budgetary expenditure for 2011 established in
Executive Decree Nº 35821-H, published in
La Gaceta Nº 55 of March
19, 2010, and its amendments, is expanded for the National Commission for Biodiversity Management
(CONAGEBIO) in the sum of ¢31,701,005.67 (thirty-one million seven hundred one thousand five colones with sixty-seven
céntimos) for that period.

Article 2°-It is the responsibility of the active administration
of the National Commission for Biodiversity Management
(CONAGEBIO) to comply with the provisions of Article 6 of
Law Nº 8131, Law of Financial
 Administration of
the Republic and Public Budgets, published in
La Gaceta Nº 198 of
October 16, 2001, and its amendments, as well as Executive Decree Nº 32452-H,
published in La Gaceta Nº 130 of July 6, 2005, and its amendments.

Article 3°-It shall be effective upon its publication.

on the eleventh day of the month of July of the year two thousand eleven.
