En ejercicio de las facultades que les
confieren los artículos 140, incisos 3) y 18) y 146 de la Constitución
Política, el Convenio sobre Diversidad Biológica y Anexos ratificado por Ley Nº
7416 del 30 de junio de 1994, el artículo 2 inciso a) de la Ley Orgánica del
Ambiente Nº 7554 del 04 de octubre de 1995, la Ley Forestal Nº 7575 del 13 de
febrero de 1996 y el artículo 22 de la Ley de Biodiversidad, Nº 7788 del 30
abril de 1998.

Considerando:

1º-Que en el Convenio sobre Diversidad
Biológica y Anexos, ratificado mediante Ley Nº 7416 del 30 de junio en 1994,
Costa Rica adquirió el compromiso de establecer un sistema de áreas protegidas,
tomar medidas especiales para conservar la diversidad biológica, administrar
los recursos biológicos importantes para garantizar su conservación, y promover
la protección de ecosistemas y hábitat naturales, entre otros.

2º-Que
el artículo 2 inciso a) de la Ley Orgánica del Ambiente Nº 7554 del 04 de
octubre 1995, estableció que el ambiente es patrimonio común de todos los
habitantes de la Nación, donde el Estado y los particulares deben participar en
su conservación y utilización sostenibles, ya que son de utilidad pública e interés
social.

3º-Que
el artículo 22 de la Ley de Biodiversidad Nº 7788 crea el Sistema Nacional de
Áreas de Conservación (SINAC), con personalidad jurídica instrumental, como un
sistema de gestión y coordinación institucional, desconcentrado y participativo,
que integra las competencias en materia forestal, vida silvestre y áreas
protegidas, con el fin de dictar políticas, planificar y ejecutar procesos
dirigidos a lograr la sostenibilidad en el manejo de los recursos naturales de
Costa Rica.

4º-Que
el SINAC, como unidad especializada en el campo de los recursos naturales, debe
establecer con entidades públicas y privadas, los medios y mecanismos que
permitan identificar las mejores prácticas y técnicas para el manejo de los
recursos naturales; e involucrar y participar a los diferentes actores sociales
en su protección, conservación y uso.

5º-Que
conservar los recursos forestales del país, tanto en terrenos del Patrimonio
Natural del Estado como en áreas forestales privadas, así como desarrollar y
ejecutar programas de investigación, educación y divulgación que contribuyan al
desarrollo sostenible de los recursos forestales, en coordinación con los
organismos competentes, es una de las principales competencias de la
Administración Forestal del Estado, otorgadas en el artículo 6 de la Ley
Forestal Nº 7575 del 13 de febrero de 1996.

6º-Que
la Estación Experimental Forestal Horizontes se encuentra ubicada en el
distrito de Nacascolo, cantón de Liberia en la provincia de Guanacaste, Costa
Rica, en las coordenadas (CL-TM 05) 312.351 oeste, 1.192.173 norte, Carretera
Interamericana, 323.730 oeste, y 1182664 norte, entrada principal de la
Estación, 330809 oeste, 1.181.554, Río Tempisque. La misma, está constituida
por fincas cuyos usos intensivos en el pasado fueron la ganadería y la
agricultura de arroz y algodón, entre otros, y presenta actualmente una mezcla
de áreas de pastizal de jaragua y áreas de regeneración de cobertura boscosa,
que va desde pastizales arbustivos hasta el bosque de galería.

7º-Que
la Fundación de Parques Nacionales, cédula jurídica número tres-cero cero
seis-cero cuatro cinco mil novecientos doce-doce, es una organización sin fines
de lucro constituida en escritura otorgada en el Tomo Nº 319, Asiento 9866 de
las 8:00 horas del 02 de mayo de 1979 por la Notaría del Estado de la
Procuraduría General de la República, con el propósito de promover el
establecimiento, protección y desarrollo de las áreas silvestres protegidas, la
cual ha prestado colaboración en lo relacionado a la implementación de las
acciones del SINAC, y ha mantenido una alianza en el desarrollo del Área de
Conservación Guanacaste como proyecto en conservación desde la creación de
dicha área, que por sus características biológicas y diversidad de ecosistemas
ha sido declarado por la Organización de Naciones Unidas para la Educación,
Ciencia y Cultura (UNESCO), como Sitio de Patrimonio Natural de la Humanidad.

8º-Que
las 7.317 hectáreas
que integran la Estación Experimental Forestal Horizontes, se encuentran
registralmente inscritas a nombre de la Fundación Parques Nacionales y son
administradas y manejadas por el Área de Conservación Guanacaste (ACG) y han
sido dedicadas a la restauración , investigación, educación, ecoturismo y
silvicultura, con los siguientes fines:

I. Realizar y
promover la investigación silvicultural sobre las especies arbóreas más
valiosas del bosque seco, así como otras de uso múltiple para propiciar su
cultivo y utilización, siendo además un sitio demostrativo del establecimiento
de diferentes tipos de plantaciones.

II. Facilitar y
promover la transmisión de los conocimientos generados en los diferentes
procesos de investigación, procurando con esto fortalecer el desarrollo del
cultivo de especies arbóreas y leñosas para el beneficio de la sociedad en
general, especialmente en la zona del Pacífico Seco.

III. Facilitar en la
región la posibilidad de almacenamiento del material genético (en diferentes
formas de propagación) necesario para desarrollar los programas de plantación
de árboles y plantas leñosas, así como propiciar su mejoramiento por medio de
selección y reproducción de los individuos de la mejor calidad.

IV. Plantear técnicas
para el establecimiento y monitoreo de ensayos que favorezcan la restauración
de terrenos altamente degradados en distintos ambientes del Área de
Conservación Guanacaste, incorporando el estudio de la composición florística,
estructura y dinámica poblacional de los actuales bosques en recuperación.

V.  Desarrollar proyectos de investigación y
monitoreo de diferentes especies del Bosque Seco.

VI. Desarrollar actividades de educación biológica
y ambiental

VII. Desarrollar la
actividad eco turística, en armonía con los objetivos de investigación forestal
que ha venido trabajando el programa.

9.-Que el ACG, desarrolla desde 1989 en la Estación
Experimental Forestal Horizontes, diferentes proyectos de investigación,
fomento, reproducción, conservación y manejo de las especies nativas de alto
valor, incluyendo la totalidad de especies amenazadas y en peligro de
extinción, del Bosque Seco Tropical de la región; siendo actualmente una fuente
de material genético de gran valor científico y cultural. Por tanto,

Decretan:

"DECLARAR
DE INTERÉS PÚBLICO LAS ACCIONES

DESARROLLADAS
EN LA ESTACIÓN EXPERIMENTAL

FORESTAL
HORIZONTES"

Artículo 1º-Declárese de interés público las
acciones que se desarrollan en la Estación Experimental Forestal Horizontes, en
administración del Área de Conservación Guanacaste; para promover la
restauración del Bosque Seco Tropical, así como fomentar la restauración,
investigación, educación, ecoturismo y promoción de su biodiversidad asociada.

Artículo
2º-El Estado costarricense y demás instituciones podrán brindar apoyo a las
acciones que se desarrollen en la Estación Experimental Forestal Horizontes.

Artículo
3º-Rige a partir de su publicación en el Diario Oficial La Gaceta.

THE PRESIDENT OF THE REPUBLIC

AND THE MINISTER OF ENVIRONMENT, ENERGY AND TELECOMMUNICATIONS

In exercise of the powers conferred by Articles 140, subsections 3) and 18), and 146 of the Political Constitution, the Convention on Biological Diversity and Annexes ratified by Law No. 7416 of June 30, 1994, Article 2, subsection a) of the Organic Law of the Environment No. 7554 of October 4, 1995, the Forest Law (Ley Forestal) No. 7575 of February 13, 1996, and Article 22 of the Biodiversity Law No. 7788 of April 30, 1998.

Considering:

1º-That in the Convention on Biological Diversity and Annexes, ratified by Law No. 7416 of June 30, 1994, Costa Rica undertook the commitment to establish a system of protected areas, take special measures to conserve biological diversity, manage important biological resources to guarantee their conservation, and promote the protection of ecosystems and natural habitats, among others.

2º-That Article 2, subsection a) of the Organic Law of the Environment No. 7554 of October 4, 1995, established that the environment is the common heritage of all the inhabitants of the Nation, where the State and private parties must participate in its conservation and sustainable use, as they are of public utility and social interest.

3º-That Article 22 of the Biodiversity Law No. 7788 creates the National System of Conservation Areas (SINAC), with instrumental legal personality, as a decentralized and participatory institutional management and coordination system, which integrates competencies in forestry, wildlife, and protected areas, for the purpose of issuing policies, planning, and executing processes aimed at achieving sustainability in the management of Costa Rica's natural resources.

4º-That SINAC, as a specialized unit in the field of natural resources, must establish, with public and private entities, the means and mechanisms that allow for the identification of best practices and techniques for the management of natural resources; and involve and engage the different social actors in their protection, conservation, and use.

5º-That conserving the country's forest resources, both on lands of the State's Natural Heritage and in private forest areas, as well as developing and executing research, education, and outreach programs that contribute to the sustainable development of forest resources, in coordination with the competent agencies, is one of the primary competencies of the State Forestry Administration, granted in Article 6 of the Forest Law (Ley Forestal) No. 7575 of February 13, 1996.

6º-That the Estación Experimental Forestal Horizontes is located in the district of Nacascolo, canton of Liberia in the province of Guanacaste, Costa Rica, at coordinates (CL-TM 05) 312,351 West, 1,192,173 North, Inter-American Highway, 323,730 West, and 1,182,664 North, main entrance of the Station, 330,809 West, 1,181,554, Río Tempisque. The same is composed of farms whose intensive uses in the past were cattle ranching and rice and cotton agriculture, among others, and currently presents a mixture of jaragua pastureland areas and forest cover (cobertura boscosa) regeneration areas, ranging from shrubby pasturelands to gallery forest.

7º-That the Fundación de Parques Nacionales, legal identification number three-zero zero six-zero four five thousand nine hundred twelve-twelve, is a non-profit organization established by deed granted in Volume No. 319, Entry 9866 at 8:00 a.m. on May 2, 1979, by the Notary of the State of the Procuraduría General de la República, with the purpose of promoting the establishment, protection, and development of protected wilderness areas, which has provided collaboration regarding the implementation of SINAC's actions, and has maintained an alliance in the development of the Área de Conservación Guanacaste as a conservation project since the creation of said area, which, due to its biological characteristics and diversity of ecosystems, has been declared by the United Nations Educational, Scientific and Cultural Organization (UNESCO) as a World Natural Heritage Site.

8º-That the 7,317 hectares that make up the Estación Experimental Forestal Horizontes are registered in the name of the Fundación Parques Nacionales and are administered and managed by the Área de Conservación Guanacaste (ACG) and have been dedicated to restoration, research, education, ecotourism, and silviculture, with the following purposes:

I. To conduct and promote silvicultural research on the most valuable tree species of the dry forest, as well as other multipurpose species to foster their cultivation and use, also serving as a demonstration site for the establishment of different types of plantations.

II. To facilitate and promote the transmission of the knowledge generated in the different research processes, thereby seeking to strengthen the development of the cultivation of tree and woody species for the benefit of society in general, especially in the Dry Pacific zone.

III. To facilitate in the region the possibility of storing genetic material (in different forms of propagation) necessary to develop tree and woody plant planting programs, as well as to foster their improvement through the selection and reproduction of the highest-quality individuals.

IV. To propose techniques for the establishment and monitoring of trials that favor the restoration of highly degraded lands in different environments of the Área de Conservación Guanacaste, incorporating the study of the floristic composition, structure, and population dynamics of the current recovering forests.

V. To develop research and monitoring projects for different species of the Dry Forest.

VI. To develop biological and environmental education activities.

VII. To develop ecotourism activities, in harmony with the forest research objectives that the program has been pursuing.

9.-That the ACG has been developing, since 1989 at the Estación Experimental Forestal Horizontes, different projects of research, promotion, reproduction, conservation, and management of high-value native species, including all threatened and endangered species of the region's Tropical Dry Forest; currently being a source of genetic material of great scientific and cultural value. Therefore,

Decree:

"DECLARE OF PUBLIC INTEREST THE ACTIONS CARRIED OUT AT THE ESTACIÓN EXPERIMENTAL FORESTAL HORIZONTES"

Article 1.-Declare of public interest the actions carried out at the Estación Experimental Forestal Horizontes, under the administration of the Área de Conservación Guanacaste; to promote the restoration of the Tropical Dry Forest, as well as to foster the restoration, research, education, ecotourism, and promotion of its associated biodiversity.

Article 2.-The Costa Rican State and other institutions may provide support to the actions carried out at the Estación Experimental Forestal Horizontes.

Article 3.-It shall take effect upon its publication in the Official Gazette La Gaceta.
