R-SINAC-40-2011.-El Consejo Nacional de Áreas de
Conservación, de conformidad al Acuerdo Nº 12 de
la Sesión Ordinaria
Nº 01-2011 del 24 de enero del 2011, y en cumplimiento del artículo 12 inciso
d) del Reglamento a la Ley
de Biodiversidad Nº 7788, Decreto Ejecutivo Nº 34433-MINAE, aprueba y emite el
presente:

"PROCEDIMIENTO PARA
EL DECOMISO

DE LANA (MUSGOS)"

I.-Propósito del Procedimiento: Orientar a los
funcionarios del SINAC / MINAET, en el procedimiento a seguir en los operativos
y funciones de control cuando se encuentre que hay lana (musgos) no autorizada
para ser transportada o comercializada.

II.-Alcance: Este
procedimiento será de aplicación para todos los funcionarios del SINAC, en el
desempeño de sus funciones, dentro y fuera de Áreas Silvestres Protegidas.

III.-Normativa
Legal y Técnica:

Ley 7317 de
Conservación de Vida Silvestre.

Decreto Ejecutivo
32633-MINAE-Reglamento a la Ley de Conservación de Vida Silvestre.

Ley 8689-
Modificación a la Ley de Conservación de Vida Silvestre.

IV.-Lineamientos y Directrices

 

Debe proceder a
decomisarse:

.   Toda lana (musgos) que se encuentre en sacos
en los lugares de comercialización o durante el transporte a estos lugares.

.   Toda lana (musgos) que se encuentre esquivada
y no puedan probar procedencia.

.   Toda lana que se encuentre en bolsa plástica
sin identificación.

.   Será decomisada en el acto y se procederá a
interponer la denuncia correspondiente ante las autoridades judiciales y/o
administrativas.

PROTOCOLO DE ACTUACIÓN:

En el lugar de los hechos:

.   Identifíquese como funcionario.

.   Solicite los permisos (resolución
original-factura).

.   Revise que el producto lana este empacado
correctamente (bolsa plástica tamaño 24x40 pulgadas o más pequeña, de cualquier
color y con calcomanía adherida).

.   Si se detecta incumplimiento proceder con el
decomiso e interposición de las denuncias (presentar el producto lana (musgos)
ante la Fiscalía Juzgado o el Juzgado Contravencional junto con la denuncia y
las actas correspondientes - Acta decomiso e interposición de denuncia.

LA LANA DE POTRERO ES LEGAL CUANDO:

1) Solamente está autorizado el aprovechamiento y
la comercialización del producto lana proveniente de potrero cuya
característica principal es que es verde (café cuando está seca).

2) Lanas de color blancas, rojizas, amarillas o
las lanas que cuelgan o están adheridas a los árboles, arbustos, rocas u otras
superficies (barba de viejo, lana ceda, musgos, entre otras) NO ESTÁN
AUTORIZADAS PARA EL TRANSPORTE NI LA COMERCIALIZACIÓN.

3) Se transporta ÚNICAMENTE en sacos entre la
finca donde se extrae y hasta el lugar de acopio (para secado), mediante el uso
de una guía de transporte original.

4) Se transporta ÚNICAMENTE en bolsas plásticas
autorizadas y con la calcomanía adherida entre el lugar de acopio y los lugares
de comercialización. Debe estar respaldada con factura de compra.

5) En el mercado se encuentra empacada en bolsas
plásticas de 24x40 pulgadas o más pequeña, de cualquier color, pero debe tener
la calcomanía adherida que lo autoriza como producto legal. Calcomanía con las
siguientes características.

a. Lana autorizada para comercializar.

b. Tenga los logos del SINAC y un Área de
Conservación (ACA-HN, ACCVC, ACT, ACLA-C, ACLA-P, ACG, ACOPAC, ACTo, ACOSA o
ACA-T)

c. Numerada consecutivo.

6) El comerciante tiene una factura de compra que
respalda el producto, con mínimo la siguiente información:

a. Fecha.

b. Cantidad de bolsas de lana compradas (indicando
numeración).

c. Nombre, firma y número de cédula del vendedor.

d. Número de resolución de permiso.

7) NO es permitido el USO DE COPIAS de
resoluciones ni facturas para demostrar la legalidad del producto lana.
SOLAMENTE EL PERMISIONARIO PODRÁ Y DEBERÁ CONSERVAR EL DOCUMENTO ORIGINAL DE
RESOLUCIÓN ADMINISTRATIVA OTORGADA POR EL SINAC / MINAET para demostrar
legalidad y/o la Licencia de Lana.

V.-Responsables: Gerencia de Manejo de Recursos
Naturales (Procedimiento para el decomiso de lana/musgos).

VI.-Glosario:

1) Lana de potrero (musgo de potrero): musgo verde
rastrero, no colgante, que crece en el suelo del potrero, fuera del bosque.
Puede compartir el espacio con pasturas y moras. Es la única lana autorizada
por el SINAC para comercio, usos tradicionales y otros usos.

Interposición
de denuncia

Para efectos prácticos, la denuncia constará de las siguientes partes:

1) un encabezado que contenga los datos del
denunciante, el denunciado, posible delito

2) una relación de hechos en la cual se
contestarán las siguientes preguntas básicas: 
Dónde ocurrió?, quién lo hizo y cómo sucedió?, qué sucedió a raíz de ello

3) Cuáles leyes se incumplieron?

4) Prueba. 
Esta puede ser documental, testimonial y pericial.

5) Medidas cautelares.  En ocasiones se hace necesaria la aplicación
de una medida cautelar para evitar que el daño causado por el denunciado se
agrave o continúe. Para la aplicación de una medida cautelar por parte de un
funcionario del SINAC / MINAET, la misma debe cumplir con 5 requisitos: 

a.  Debe ser una medida realizable. 

b.  Debe dirigirse a una persona física
(identificarla con nombre completo y número de cédula)

c.  Se le debe notificar personalmente, haciéndolo
constar en los dos documentos tanto el original que se le entrega a la persona
como en la copia que guardamos para prueba

d.  Se le debe otorgar un plazo prudencial para
que cumpla con la medida.

e.  Se le debe indicar en el acta una leyenda que
diga:  "Se le advierte que de incumplir
con las medidas cautelares aquí dictadas, podrá estar incurriendo en el delito
de Desobediencia  a
la Autoridad" 

6) Lugar para recibir notificaciones para lo que
debe señalarse el lugar, oficina y fax.

7) Firma del funcionario o de los o las
funcionarias que suscriben la denuncia.

2 | a). En el recorrido entre la finca de donde se extrae y hasta el lugar de acopio, EN ESTE
TRAYECTO EL TRANSPORTE SE HACE EN SACOS. El administrado debe mostrar a la autoridad la guía de
transporte original (formulario 3) que para tal efecto le entregó la Administración. En la guía debe
verificarse que venga completo el cuadro con la información correspondiente a ese viaje, o sea,
fecha, cantidad de sacos que transporta, nombre del transportista, cédula y firma. Esta información
debe estar llena durante el recorrido en carretera. Para efectos de control puede solicitarse al
conductor presentar su cédula de identidad y verificar la vigencia de la guía de transporte y que se
esté haciendo el recorrido por un lugar autorizado en el mismo documento. DECOMISO: Debe procederse
con el decomiso de la lana que no se demuestre su legalidad, usando para ello un Acta de decomiso

NO ES PERMITIDO EL TRASPORTE DE LANA EN SACOS. El producto lana debe encontrarse únicamente,
empacado en bolsas plásticas de cualquier color que mida 24x40 pulgadas o más pequeña y la cual debe
tener adherida la calcomanía oficial (Formulario 4) que tiene los sellos oficiales del SINAC, y
alguna Área de Conservación, con la leyenda: "Lana autorizada para comercializar" "Paquete
autorizado (con la numeración consecutiva)" "Resolución XXX" Cada transportista debe portar la
factura de compra (Formulario 5) que respalda la legalidad de ese producto. En la factura de compra,
debe constar la fecha, resolución que autorizó la extracción, la cantidad de bolsas compradas y los
números de las bolsas con calcomanía, nombre y firma de quien vendió el producto. En caso de que sea
el permisionario puede presentar la resolución original. Para efectos de control, solicitar al
conductor la factura que debe coincidir con la cantidad y numeración de las bolsas con lana que
transporta. En caso del permisionario puede presentar el original de la resolución. Revisar que las
bolsas tengan adherida la calcomanía. DECOMISO: Debe procederse con el decomiso de la lana que no se
demuestre su legalidad, usando para ello un Acta de decomiso (formulario 1) e interposición de

                        Procedure for the Seizure of Wool (Mosses)

SISTEMA NACIONAL DE

R-SINAC-40-2011.- The National Council of Conservation Areas, in accordance with Agreement No. 12 of Ordinary Session No. 01-2011 of January 24, 2011, and in compliance with Article 12, subsection d) of the Regulation to the Biodiversity Law No. 7788, Executive Decree No. 34433-MINAE, approves and issues the following:

"PROCEDURE FOR
THE SEIZURE

OF WOOL (MOSSES)"

I.- Purpose of the Procedure: To guide officials of SINAC / MINAET in the procedure to follow during operations and control functions when wool (mosses) is found that is not authorized to be transported or marketed.

II.- Scope: This procedure shall apply to all officials of SINAC, in the performance of their duties, inside and outside Protected Wilderness Areas.

III.- Legal
and Technical Regulations:

Wildlife Conservation Law 7317.

Executive Decree 32633-MINAE-Regulation to the Wildlife Conservation Law.

Law 8689- Amendment to the Wildlife Conservation Law.

IV.- Guidelines and Directives

 

The following must be seized:

.   Any wool (mosses) found in sacks at marketing locations or during transport to these locations.

.   Any wool (mosses) found hidden and for which provenance cannot be proven.

.   Any wool found in plastic bags without identification.

.   It shall be seized on the spot, and the corresponding complaint shall be filed before the judicial and/or administrative authorities.

ACTION PROTOCOL:

At the scene of the incident:

.   Identify yourself as an official.

.   Request the permits (original resolution-invoice).

.   Verify that the wool product is correctly packaged (plastic bag size 24x40 inches or smaller, of any color, and with a sticker affixed).

.   If non-compliance is detected, proceed with the seizure (decomiso) and filing of complaints (present the wool product (mosses) before the Prosecutor's Office, the Court, or the Contraventional Court together with the complaint and the corresponding reports - Seizure Report and Filing of Complaint.

PASTURE WOOL IS LEGAL WHEN:

1) Only the harvest (aprovechamiento) and marketing of the wool product from pastures is authorized, the main characteristic of which is that it is green (brown when dry).

2) White, reddish, yellow wools or wools that hang or are attached to trees, shrubs, rocks, or other surfaces (old man's beard, silk wool, mosses, among others) ARE NOT AUTHORIZED FOR TRANSPORT OR MARKETING.

3) It is transported ONLY in sacks between the farm where it is extracted and the collection center (acopio) (for drying), by using an original transport guide.

4) It is transported ONLY in authorized plastic bags with the sticker affixed between the collection center and the marketing locations. It must be supported by a purchase invoice.

5) In the market, it is found packaged in plastic bags measuring 24x40 inches or smaller, of any color, but must have the sticker affixed that authorizes it as a legal product. Sticker with the following characteristics.

a. Wool authorized for marketing.

b. Has the logos of SINAC and a Conservation Area (ACA-HN, ACCVC, ACT, ACLA-C, ACLA-P, ACG, ACOPAC, ACTo, ACOSA or ACA-T)

c. Consecutive numbered.

6) The merchant has a purchase invoice that supports the product, with at least the following information:

a. Date.

b. Quantity of wool bags purchased (indicating numbering).

c. Name, signature, and identification number of the seller.

d. Permit resolution number.

7) The USE OF COPIES of resolutions or invoices to demonstrate the legality of the wool product is NOT permitted. ONLY THE PERMIT HOLDER MAY AND MUST KEEP THE ORIGINAL DOCUMENT OF THE ADMINISTRATIVE RESOLUTION GRANTED BY SINAC / MINAET to demonstrate legality and/or the Wool License.

VI.- Glossary:

1) Pasture wool (pasture moss): green creeping moss, not hanging, that grows on the ground of the pasture, outside the forest. It can share space with pastures and blackberries. It is the only wool authorized by SINAC for trade, traditional uses, and other uses.

Filing of Complaint (Interposición de denuncia)

For practical purposes, the complaint shall consist of the following parts:

1) a header containing the details of the complainant, the accused, possible offense

2) a statement of facts in which the following basic questions will be answered: Where did it occur?, who did it and how did it happen?, what happened as a result?

3) What laws were violated?

4) Evidence. This may be documentary, testimonial, and expert evidence.

5) Precautionary measures. Sometimes it is necessary to apply a precautionary measure to prevent the damage caused by the accused from worsening or continuing. For the application of a precautionary measure by an official of SINAC / MINAET, it must meet 5 requirements:

a. It must be a feasible measure.

b. It must be directed against a natural person (identify them with full name and identification number)

c. They must be personally notified, making it recorded on both documents, the original given to the person and the copy we keep for evidence.

d. A reasonable deadline must be granted for them to comply with the measure.

e. A legend must be indicated in the report stating: "You are warned that failure to comply with the precautionary measures issued here may result in committing the offense of Disobedience to Authority"

6) Place for receiving notifications, for which the place, office, and fax must be indicated.

7) Signature of the official or officials who file the complaint.
