DECRETA:

MODIFICACIÓN PARCIAL DE
LA LEY N.º 8023, ORDENAMIENTO

Y MANEJO DE LA CUENCA
 ALTA DEL RÍO REVENTAZÓN,

DE 27 DE SETIEMBRE DE 2000

ARTÍCULO 1.- Se reforma el título de
la Ley N.° 8023, Ordenamiento y Manejo de
la Cuenca Alta del Río
Reventazón, de 27 de setiembre de 2000. El texto dirá:

"ORDENAMIENTO Y MANEJO DE LA CUENCA

DEL RÍO REVENTAZÓN"

ARTÍCULO 2.- Se reforma el artículo 1 de
la Ley N.º 8023, Ordenamiento y Manejo de
la Cuenca Alta del Río
Reventazón, de 27 de setiembre de 2000. El texto dirá:

 "Artículo 1.- La presente ley regula la
planificación, la ejecución y el control de las actividades para la gestión
integrada de los recursos hídricos, así como de los demás recursos naturales de
la cuenca del río Reventazón.

El propósito de este plan es manejar la cuenca mediante acciones
correctivas de sus principales problemas y desarrollar proyectos sostenibles
que involucren activamente a la sociedad civil organizada y a las entidades
públicas, de esta forma se permitirá mejorar la calidad de vida de las
comunidades vecinas y salvaguardarla.

La cuenca del río Reventazón, desde su punto más alto hasta la desembocadura
del cauce principal en el mar Caribe, posee un área de 2950 km2; no obstante,
de acuerdo con la base vectorial de cuencas hidrográficas, elaborada por el
Instituto Costarricense de Electricidad (ICE), actualizada al 2006, el área de la
cuenca en cuestión es de 2830 km2. Dentro de la provincia de Cartago abarca los
cantones de Cartago, Oreamuno, El Guarco, Alvarado, Jiménez, Turrialba y Paraíso,
mientras que, de la provincia de Limón, recorre parte de los cantones de Pococí,
Guácimo y Siquirres.

Siguiendo la línea divisoria de la cuenca, tomando como punto de inicio el par
de coordenadas latitud 1086371 - longitud 4966731, en
dirección NNE a la altura de Alto Mata de Caña, sobre las estribaciones de
la Fila Ventolera
hacia Alto Quebradillas, atravesando de seguido los cerros de
La Carpintera. En el
sector de Poroses, al oeste de Tierra Blanca, sigue dirección norte, tomando
rumbo hacia Llano Grande. Aproximadamente en las coordenadas latitud 1102275 -
longitud 511529, vuelve a tomar rumbo este; retoma su orientación hacia el
norte en las coordenadas aproximadas latitud 1103583 - longitud 522239, en
dirección al cráter del volcán Turrialba. Cerca de las coordenadas latitud
1114306 - longitud 528690, la divisoria se dirige en dirección NNW, cruza la
población de Emilia, próxima al centro de Guápiles, continúa por la población
de La Cruz y toma
el rumbo NEE por aproximadamente 21
 km. Cerca de Hacienda Los Corrales, en las coordenadas
latitud 1111082 - longitud 541375, toma dirección NNE hacia la población de
Zancudo, atraviesa transversalmente las Lomas de Sierpe (Azules), toma hacia
los cerros próximos a San Gerardo, cruza
la Reserva Forestal
del IDA y, finalmente, interseca el litoral Caribe.

Retomando el punto de inicio latitud 1086371 - longitud 496673, hacia el SSE
la divisoria sigue una dirección hacia Casa Mata. En
la Vuelta Ventolera cambia
la dirección hacia el sur y retoma la dirección SSE hacia El Empalme. En el
hito Artieda, 2669
 metros sobre el nivel del mar, toma rumbo hacia Paso
Macho y, sobre la carretera Interamericana, continúa hacia poblaciones como
Trinidad y Salsipuedes. Cerca de las coordenadas latitud 1065351 - longitud
517048 se dirige con rumbo SSW y, a la altura del Alto Indio, pequeña cumbre
que forma parte del cerro Vueltas, retoma la dirección hacia el este para
volver a correr a lo largo de la carretera Interamericana hasta sobrepasar
cumbres como los cerros Sakira, Sábila, Zacatales y Asunción. Cerca de
Buenavista retoma la dirección E, corriendo más o menos paralela a la carretera
Interamericana hasta cortarla y tomar el parteaguas que corre sobre la
cordillera de Talamanca. Busca hacia los cerros Cuericí, donde vuelve a retomar
el rumbo norte por más de 25
 km atravesando los cerros Cataratas, Mirador y Silencio.
En el punto cuyas coordenadas aproximadas son latitud 1087964 - longitud 548729
toma rumbo NNW y, cerca de la población de Pacayitas, retoma el rumbo NNE
pasando por Linda Vista (Alto Cincuenta y Dos).

Cruza las poblaciones de San Alejo, Guayacán y Moravia siguiendo aproximadamente
paralela a la carretera hacia Siquirres, intersecando esta aproximadamente en las
coordenadas latitud 1116641 - longitud 551041. En este punto, se dirige en
dirección NNE hacia San Alberto Viejo, atraviesa la línea del ferrocarril al
Atlántico, cerca de finca San Francisco, recorre zonas de llanura y humedales
y, por último, culmina en el litoral Caribe."

ARTÍCULO 3.- Se reforman los incisos a) y e) del artículo 2 de
la Ley N.º 8023, Ordenamiento
y Manejo de la Cuenca Alta
del Río Reventazón, de 27 de setiembre de 2000. El texto dirá:

 "Artículo 2.- Para los efectos de esta
ley, se presentan las siguientes definiciones:

a) Plan: Plan de ordenamiento y
manejo de la cuenca del río Reventazón.

[...]

e) Comcure: Comisión para el
Ordenamiento y Manejo de la
 Cuenca del Río Reventazón. Es la instancia de coordinación
entre todas las entidades públicas y privadas que tengan actividades que
impacten el manejo integrado de la cuenca."

[...]"

ARTÍCULO 4.- Se reforma el artículo 3 de
la Ley N.º 8023, Ordenamiento y Manejo de
la Cuenca Alta del Río
Reventazón, de 27 de setiembre de 2000. El texto dirá:

 "Artículo 3.- Para ejecutar el Plan de
ordenamiento y manejo de la cuenca del río Reventazón, se crean los siguientes
órganos, se definen sus responsabilidades y se establecen las disposiciones que
orientan su conducción:

a) Junta
Directiva de la Comcure.

b) Consejo
de la cuenca.

c) Gerencia
de la cuenca."

ARTÍCULO 5.- Se reforma el artículo 4 de la
 Ley N. º 8023, Ordenamiento y Manejo de
la Cuenca Alta del Río
Reventazón, de 27 de setiembre de 2000, cuyo texto dirá:

 "Artículo 4.- Se crea
la Comisión para el
Ordenamiento y Manejo de la Cuenca
del Río Reventazón, en adelante Comcure, como un órgano de máxima desconcentración
del Ministerio de Ambiente y Energía, la cual tendrá personalidad jurídica
instrumental para la administración de sus recursos materiales, humanos,
presupuestarios y financieros; podrá firmar, establecer y ejecutar
fideicomisos, así como suscribir todo contrato y convenio que requiera para el
cumplimiento de sus funciones."

ARTÍCULO 6.- Se reforma el artículo 5 de
la Ley N.º 8023, Ordenamiento y Manejo de
la Cuenca Alta del Río
Reventazón, de 27 de setiembre de 2000. El texto dirá:

 "Artículo 5.- El objetivo general de
Comcure será definir, ejecutar y controlar el Plan de ordenamiento y manejo de
la cuenca del río Reventazón, con el apoyo de su estructura funcional y en
coordinación con las instituciones públicas, privadas y los órganos colegiados
creados al tenor de la Ley
 General de
la Administración Pública
y leyes conexas."

ARTÍCULO 7.- Se reforman los incisos b), d), g), h), i), j) y se adiciona el inciso m) al
artículo 7 de la Ley
 N.º 8023, Ordenamiento y Manejo de
la Cuenca Alta del Río Reventazón,
de 27 de setiembre de 2000. Los textos dirán:

 "Artículo 7.- Comcure tendrá las
siguientes atribuciones y funciones:

[...]

b) Organizar,
programar, dirigir, revisar y evaluar la ejecución de las actividades que debe
cumplir la Gerencia
de la cuenca.

[...]

d) Recomendar
trabajos e investigaciones a la
 Gerencia de la cuenca, cuando sea necesario.

[...]

g) Elaborar,
aprobar y remitir el presupuesto anual de Comcure, al Ministerio de Hacienda.

h) Suscribir,
administrar y ejecutar los fideicomisos creados al amparo de esta ley.

i) Nombrar
y remover al gerente, según el artículo 21 de la presente ley.

j) Consultar
al Consejo de la cuenca los programas, presupuestos ordinarios y las
actividades que llevará a cabo la
 Gerencia de la cuenca, y convocarlo cuando lo considere
necesario.

[...]

m) Establecer
la prioridad de las actividades y los proyectos que las entidades públicas y
privadas desarrollen en la cuenca con fondos provenientes de los cánones
hídricos. Para estos efectos,
la Junta Directiva de
la Comcure, la cual
recomendará a Fonafifo, Sinac y a
la Dirección de Aguas para su final aprobación."

ARTÍCULO 8.- Se reforme el artículo 8 de
la Ley N.º 8023. El texto dirá:

 "Artículo 8.-
La Junta Directiva de Comcure estará
conformada de la siguiente manera:

a) El
ministro o la ministra de Ambiente y Energía o su representante de nivel
superior.

b) El
ministro o la ministra de Agricultura y Ganadería o su representante de nivel
superior.

c) El
presidente ejecutivo o la presidenta ejecutiva del Instituto Costarricense de
Electricidad o su representante de nivel superior.

d) El
presidente ejecutivo o la presidenta ejecutiva del Instituto Costarricense de
Acueductos y Alcantarillados o su representante de nivel superior.

e) El
presidente o la presidenta de
la Comisión Nacional de Prevención de Riesgos y
Atención de Emergencias o su representante de nivel superior.

f) EI
presidente ejecutivo o la presidenta ejecutiva de
la Junta de Administración
Portuaria y Desarrollo Económico de
la Vertiente Atlántica
o su representante de nivel superior.

g) El
gerente o la gerenta de
la Junta Administrativa de Servicios Eléctricos de
Cartago o su representante de nivel superior.

h) Una
persona representante de
la Federación de Municipalidades de Cartago.

i) Una
persona representante de
la Federación de Municipalidades de Limón, en
representación de los cantones de Siquirres, Guácimo y Pococí.

j) Una
persona representante de las asociaciones de usuarios de la provincia de
Cartago, de ambientalistas, agricultores o industriales, que formen parte del
consejo de cuenca y sean designados por este.

k) Una
persona representante de las asociaciones de usuarios de los cantones de
Siquirres, Guácimo y Pococí, de ambientalistas, agricultores o industriales,
que formen parte del Consejo de cuenca y sean designados por este."

ARTÍCULO 9.- Se reforma el artículo 9 de
la Ley N.º 8023, Ordenamiento y Manejo de
la Cuenca Alta del Río
Reventazón, de 27 de setiembre de 2000. El texto dirá:

 "Artículo 9.- Las personas miembros de
la Junta Directiva de
la Comcure no
devengarán dietas por la asistencia a las sesiones."

ARTÍCULO 10.- Se reforma el artículo 11 de
la Ley N.º 8023, Ordenamiento y Manejo de
la Cuenca Alta del Río
Reventazón, de 27 de setiembre de 2000. El texto dirá:

 "Artículo 11.- Comcure deberá nombrar de
su seno a un presidente o una presidenta y un secretario o una secretaria. Para
sesionar válidamente, deberán estar presentes al menos siete de sus
integrantes; los acuerdos se tomarán por mayoría simple de los presentes, salvo
cuando la ley exija, de manera expresa, una votación diferente. Todos los
miembros permanecerán en sus cargos un período de dos años y podrán ser
reelegidos."

ARTÍCULO 11.- Se reforma el artículo 12 de
la Ley N.º 8023, Ordenamiento y Manejo de
la Cuenca Alta del Río
Reventazón, de 27 de setiembre de 2000. El texto dirá:

 "Artículo 12.- Se autoriza a
las instituciones y organizaciones del Estado costarricense para que aporten
recursos, tales como apoyo logístico, materiales, personal administrativo, pago
de viáticos, gastos administrativos, otros gastos no personales y cualesquiera
otros necesarios para el cumplimiento de esta ley."

ARTÍCULO 12.- Se reforma el título de la sección II y el artículo 14 de
la Ley N.º 8023, Ordenamiento
y Manejo de la Cuenca Alta
del Río Reventazón, de 27 de setiembre de 2000. El texto dirá:

"Sección II

Consejo de cuenca

 "Artículo 14.- Se establece un Consejo de
cuenca cuya función principal será asesorar y apoyar a Comcure en la dirección
y evaluación de los distintos componentes del Plan."

ARTÍCULO 13.- Se reforma el artículo 15 de
la Ley N.º 8023, Ordenamiento y Manejo de
la Cuenca Alta del Río
Reventazón, de 27 de setiembre de 2000. El texto dirá:

 "Artículo 15.- El Consejo de cuenca
estará conformado de la siguiente manera:

a) El
ministro o la ministra de Ambiente y Energía o su representante.

b) EI
ministro o la ministra de Agricultura y Ganadería o su representante de nivel
superior.

c) EI
presidente ejecutivo o la presidenta ejecutiva del Instituto Costarricense de
Electricidad o su representante de nivel superior.

d) EI
presidente ejecutivo o la presidenta ejecutiva del Instituto Costarricense de
Acueductos y Alcantarillados o su representante de nivel superior.

e) EI
presidente ejecutivo o la presidenta de
la Refinadora Costarricense
de Petróleo Sociedad Anónima o su representante.

f) EI
presidente ejecutivo o la presidenta ejecutiva de
la Junta de Administración
Portuaria y Desarrollo Económico de
la Vertiente Atlántica
o su representante de nivel superior.

g) EI
presidente o la presidenta de
la Comisión Nacional de Prevención de Riesgos y
Atención de Emergencias o su representante de nivel superior.

h) EI
rector o la rectora del lnstituto Tecnológico de Costa Rica o su representante
de nivel superior.

i) El
gerente y la gerenta de
la Junta Administrativa de Servicios Eléctricos de
Cartago o su representante de nivel superior.

j) El
alcalde o la alcaldesa de cada una de las municipalidades de los cantones
enumerados en el artículo 1 de la presente ley, o su representante.

k) Una
persona representante del Servicio Nacional Aguas Subterráneas, Riego y
Avenamiento.

l) Una
persona representante del Consejo Regional de Desarrollo (Coredes-Proli).

m) Una
persona representante de la provincia de Cartago y un representante de la
provincia de Limón, de
la Unión Cantonal de Asociaciones de Desarrollo.

n) Una
persona representante de la provincia de Cartago y un representante de la
provincia de Limón, de las asociaciones ambientalistas.

ñ) Una
persona representante de la provincia de Cartago y un representante de la
provincia de Limón, del sector empresarial e industrial.

o) Una
persona representante de la provincia de Cartago y un representante de la
provincia de Limón, de las organizaciones de agricultores.

p) Una
persona representante de la
 Dirección de Urbanismo del Instituto Nacional de Vivienda y
Urbanismo."

ARTÍCULO 14.- Se reforma el inciso c) del artículo 16 de
la Ley N.º 8023, Ordenamiento
y Manejo de la Cuenca Alta
del Río Reventazón, de 27 de setiembre de 2000. El texto dirá:

 "Artículo 16.- Son funciones
del Consejo de cuenca:

[...]

c) Brindar
asesoramiento a la Gerencia
de cuenca sobre la política general de ejecución del Plan y los problemas de la
cuenca, y emitir su opinión.

[...]."

ARTÍCULO 15.- Se reforma el artículo 17 de
la Ley N.º 8023, Ordenamiento y Manejo de
la Cuenca Alta del Río
Reventazón, de 27 de setiembre de 2000. El texto dirá:

 "Artículo 17.- El Consejo de cuenca
designará de su seno a un presidente o una presidenta, quien permanecerá en su
cargo por un período de dos años y podrá ser reelegido. Se reunirá al menos dos
veces al año, convocado por su presidente o presidenta o cuando el presidente o
presidenta de Comcure lo solicite."

ARTÍCULO 16.- Se reforma el título de la sección III y el artículo 18 de
la Ley N.º 8023, Ordenamiento
y Manejo de la Cuenca Alta
del Río Reventazón, de 27 de setiembre de 2000. El texto dirá:

"Sección III

Gerencia de Cuenca

Artículo 18.- Se establece una Gerencia de cuenca bajo la dirección de Comcure. Su
función principal será ejecutar los componentes técnico-operativos de las
diferentes etapas del proyecto."

ARTÍCULO 17.- Se reforma el artículo 19 de
la Ley N.º 8023, Ordenamiento y Manejo de
la Cuenca Alta del Río
Reventazón, de 27 de setiembre de 2000. El texto dirá:

 "Artículo 19.-
La Gerencia de cuenca estará
constituida por el personal técnico aportado o contratado por las instituciones
representadas en Comcure o contratado por
la Gerencia de cuenca. Este
personal conformará grupos de trabajo para realizar las acciones y los estudios
específicos programados."

ARTÍCULO 18.- Se reforma el inciso a) y se adiciona un nuevo inciso i) al artículo 20 de
la Ley N.º 8023, Ordenamiento y Manejo de la Cuenca Alta del Río Reventazón, de
27 de setiembre de 2000. El texto dirá:

 "Artículo 20.- Son funciones de
la Gerencia de cuenca:

a) Revisar
y evaluar los estudios y proyectos específicos que existen sobre la cuenca del
río Reventazón.

[...]

i) Fungir
como secretario del Consejo de Cuenca, firmando las convocatorias y las actas de
forma conjunta con el presidente de este órgano."

ARTÍCULO 19.- Se reforma el artículo 21 y los incisos a), c) y h) de este mismo artículo
de la Ley N.º
8023, Ordenamiento y Manejo de
la Cuenca Alta del Río Reventazón, de 27 de
setiembre de 2000. El texto dirá:

 "Artículo 21.-
La Gerencia de cuenca contará con un gerente o una gerenta, nombrado
por la Junta Directiva
de Comcure, quien tendrá las siguientes obligaciones:

a) Participar
en las reuniones de Comcure.

[...]

c) Coordinar,
con las instituciones vinculadas, los aportes de estas para cumplir el proyecto
de ordenamiento y manejo de la cuenca del río Reventazón.

[...]

h) Presentar,
al Consejo de Cuenca los programas y las actividades que, previa aprobación de
Comcure, realizará la
 Gerencia de cuenca que dirige.

[...]"

ARTÍCULO 20.- Se reforma el artículo 22 de
la Ley N.º 8023, Ordenamiento y Manejo de
la Cuenca Alta del Río
Reventazón, de 27 de setiembre de 2000. El texto dirá:

 "Artículo 22.- El gerente o la gerenta de
cuenca permanecerá en su cargo tres años y podrá ser reelegido."

ARTÍCULO 21.- Se reforma el título de la sección IV y el artículo 23 de
la Ley N.º 8023, Ordenamiento
y Manejo de la Cuenca Alta
del Río Reventazón, de 27 de setiembre de 2000. El texto dirá:

"SECCIÓN IV

Consejos Regionales de Áreas de Conservación

Artículo 23.- En cumplimiento de lo preceptuado por el artículo 30 de
la Ley N.º 7788, Ley de
Biodiversidad, las actividades de Comcure se coordinarán con los consejos
regionales de: Área de Conservación Cordillera Volcánica Central (ACCVC), Área
de Conservación Tortuguero (ACTO), Área de conservación Amistad Caribe
(Aclac)."

ARTÍCULO 22.- Se reforma el artículo 24 de
la Ley N.º 8023, Ordenamiento y Manejo de
la Cuenca Alta del Río
Reventazón, de 27 de setiembre de 2000. El texto dirá:

 "Artículo 24.- Las funciones de los
consejos regionales de áreas de Conservación son las fijadas en
la Ley N.º 7788, Ley
de la Biodiversidad."

ARTÍCULO 23.- Se reforma el párrafo segundo y se adiciona un párrafo tercero al artículo
25 de la Ley N.º
8023, Ordenamiento y Manejo de
la Cuenca Alta del Río Reventazón, de 27 de
setiembre de 2000. El texto dirá:

"CAPÍTULO III

RÉGIMEN DE FINANCIAMIENTO

Artículo 25.-

[...]

Las municipalidades de los cantones de las provincias de Cartago y Limón, comprendidos
en el artículo 1 de esta ley, y los demás organismos de
la Administración Pública
prestarán su colaboración a Comcure para cumplir los fines de esta ley.

La Dirección de Aguas del Minae
recaudará los cánones de recurso hídrico creados al amparo de
la Ley N.º 276, de 27
de agosto de 1942, y con base en la información suministrada por
la Comcure presupuestará los
recursos para su funcionamiento, los cuales no serán inferiores a cinco por
ciento (5%) del monto total recaudado en los cánones de recurso hídrico
existentes. Los recursos presupuestados únicamente se utilizarán para su
funcionamiento y para el financiamiento de las actividades que corresponde
desarrollar a la Comcure.
 La Dirección de Aguas del Minae los transferirá en el plazo
máximo de un mes, contado a partir de la aprobación legislativa del presupuesto
de la República."

ARTÍCULO 24.- Se reforma el artículo 27 de
la Ley N.º 8023, Ordenamiento y Manejo de
la Cuenca Alta del Río
Reventazón, de 27 de setiembre de 2000. El texto dirá:

 "Artículo 27.- Las municipalidades de los
cantones de las provincias de Cartago y Limón, comprendidos en el artículo 1 de
esta ley, podrán destinar un porcentaje de lo establecido en los incisos 1) y
5) del artículo 43 de la Ley
 N.º 7788, Ley de Biodiversidad, de 30 de abril de 1998, a la formulación e implementación
de los programas dispuestos en la presente ley."

ARTÍCULO 25.- Se reforma el artículo 28 de
la Ley N.º 8023, Ordenamiento y Manejo de
la Cuenca Alta del Río
Reventazón, de 27 de setiembre de 2000. El texto dirá:

 "Artículo 28.- Se autoriza a los entes
usuarios y a los que prestan servicios públicos en la provincia de Cartago, y
en los cantones de Siquirres, Guácimo y Pococí, en la provincia de Limón, para
que ingresen en sus tarifas los costos para el manejo de la cuenca del río
Reventazón, según el artículo 37 de
la Ley N.º 7788, Ley de Biodiversidad, de 30 de
abril de 1998."

ARTÍCULO 26.- Se reforma el artículo 29 de
la Ley N.º 8023, Ordenamiento y Manejo de
la Cuenca Alta del Río
Reventazón, de 27 de setiembre de 2000. El texto dirá:

"CAPÍTULO V

SEGUIMIENTO Y CONTROL DE RESULTADOS DEL PLAN

Artículo 29.- Para sistematizar los resultados de la ejecución del Plan,
la Comcure y
la Gerencia de cuenca
definirán una estrategia de implementación y control de resultados, de la cual
se obtendrán informes de avance y, con base en ellos, se definirán las acciones
por seguir en reuniones de control y coordinación entre los entes creados por
esta ley.

Deberán presentarse mensualmente informes de avance, en el ámbito de todo
el personal técnico del proyecto.

Los resultados del proyecto deberán divulgarse en toda la comunidad y
estarán a disposición de cualquier persona."

ARTÍCULO 27.- Se reforma el artículo 30 de
la Ley N.º 8023, Ordenamiento y Manejo de
la Cuenca Alta del Río
Reventazón, de 27 de setiembre de 2000. El texto dirá:

 "Artículo 30.- Se aplicarán
evaluaciones periódicas que permitan incorporar o corregir las diferentes
labores; para ello, se solicitará el apoyo de organismos nacionales
especializados en esta materia o la eventual contratación de especialistas
nacionales y/o internacionales, siempre con la participación del personal del
proyecto. Se coordinará con organismos internacionales y nacionales, tales como
la Red
 Latinoamericana de Cuencas, las fundaciones de recursos naturales
y las cámaras de empresarios."

ARTÍCULO 28.- Se deroga el transitorio único de
la Ley N.º 8023, Ordenamiento y Manejo de

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF COSTA RICA

DECREES:

PARTIAL AMENDMENT OF LAW NO. 8023, PLANNING AND MANAGEMENT OF THE UPPER REVENTAZÓN RIVER WATERSHED, OF SEPTEMBER 27, 2000

ARTICLE 1.- The title of Law No. 8023, Planning and Management of the Upper Reventazón River Watershed, of September 27, 2000, is amended. The text shall read:

"PLANNING AND MANAGEMENT OF THE REVENTAZÓN RIVER WATERSHED"

ARTICLE 2.- Article 1 of Law No. 8023, Planning and Management of the Upper Reventazón River Watershed, of September 27, 2000, is amended. The text shall read:

"Article 1.- This law regulates the planning, execution, and control of activities for the integrated management of water resources, as well as the other natural resources of the Reventazón River watershed.

The purpose of this plan is to manage the watershed through corrective actions addressing its main problems and to develop sustainable projects that actively involve organized civil society and public entities, thereby improving the quality of life of neighboring communities and safeguarding them.

The Reventazón River watershed, from its highest point to the mouth of the main channel in the Caribbean Sea, has an area of 2950 km2; however, according to the vector base of hydrographic watersheds, prepared by the Costa Rican Electricity Institute (ICE) and updated to 2006, the area of the watershed in question is 2830 km2. Within the province of Cartago, it encompasses the cantons of Cartago, Oreamuno, El Guarco, Alvarado, Jiménez, Turrialba, and Paraíso, while, from the province of Limón, it runs through part of the cantons of Pococí, Guácimo, and Siquirres.

Following the watershed divide, taking as the starting point the coordinate pair latitude 1086371 - longitude 4966731, in a NNE direction at the height of Alto Mata de Caña, on the foothills of the Fila Ventolera toward Alto Quebradillas, subsequently crossing the La Carpintera hills. In the Poroses sector, west of Tierra Blanca, it follows a north direction, heading toward Llano Grande. At approximately coordinates latitude 1102275 - longitude 511529, it heads east again; it resumes its northward orientation at approximate coordinates latitude 1103583 - longitude 522239, in the direction of the Turrialba volcano crater. Near coordinates latitude 1114306 - longitude 528690, the divide heads in a NNW direction, crosses the town of Emilia, near the center of Guápiles, continues through the town of La Cruz, and takes a NEE heading for approximately 21 km. Near Hacienda Los Corrales, at coordinates latitude 1111082 - longitude 541375, it takes a NNE direction toward the town of Zancudo, crosses transversally the Lomas de Sierpe (Azules), heads toward the hills near San Gerardo, crosses the IDA Forest Reserve, and finally intersects the Caribbean coastline.

Returning to the starting point latitude 1086371 - longitude 496673, toward the SSE the divide follows a direction toward Casa Mata. At La Vuelta Ventolera it changes direction toward the south and resumes the SSE direction toward El Empalme. At the Artieda milestone, 2669 meters above sea level, it heads toward Paso Macho and, on the Inter-American Highway, continues toward towns such as Trinidad and Salsipuedes. Near coordinates latitude 1065351 - longitude 517048 it heads SSW and, at the height of Alto Indio, a small peak that is part of the Cerro Vueltas, it resumes the eastward direction to run again along the Inter-American Highway until surpassing peaks such as the Sakira, Sábila, Zacatales, and Asunción hills. Near Buenavista it resumes the E direction, running more or less parallel to the Inter-American Highway until cutting it and taking the watershed divide that runs along the Talamanca Mountain Range. It heads toward the Cuericí hills, where it turns north again for more than 25 km, crossing the Cataratas, Mirador, and Silencio hills. At the point whose approximate coordinates are latitude 1087964 - longitude 548729 it takes a NNW heading and, near the town of Pacayitas, resumes the NNE heading, passing through Linda Vista (Alto Cincuenta y Dos).

It crosses the towns of San Alejo, Guayacán, and Moravia, following approximately parallel to the highway to Siquirres, intersecting it at approximately coordinates latitude 1116641 - longitude 551041. At this point, it heads NNE toward San Alberto Viejo, crosses the Atlantic railroad line, near the San Francisco farm, traverses areas of plains and wetlands, and finally ends at the Caribbean coastline."

ARTICLE 3.- Subsections a) and e) of article 2 of Law No. 8023, Planning and Management of the Upper Reventazón River Watershed, of September 27, 2000, are amended. The text shall read:

"Article 2.- For the purposes of this law, the following definitions are provided:

a) Plan: Plan for the planning and management of the Reventazón River watershed.

[...]

e) Comcure: Commission for the Planning and Management of the Reventazón River Watershed. It is the coordination body among all public and private entities that carry out activities impacting the integrated management of the watershed."

ARTICLE 4.- Article 3 of Law No. 8023, Planning and Management of the Upper Reventazón River Watershed, of September 27, 2000, is amended. The text shall read:

"Article 3.- To execute the Plan for the planning and management of the Reventazón River watershed, the following bodies are created, their responsibilities are defined, and the provisions guiding their conduct are established:

a) Board of Directors (Junta Directiva) of Comcure.

b) Watershed Council (Consejo de la cuenca).

c) Watershed Management Office (Gerencia de la cuenca)."

ARTICLE 5.- Article 4 of Law No. 8023, Planning and Management of the Upper Reventazón River Watershed, of September 27, 2000, is amended, and its text shall read:

"Article 4.- The Commission for the Planning and Management of the Reventazón River Watershed, hereinafter Comcure, is created as a body of maximum deconcentration of the Ministry of Environment and Energy, which shall have instrumental legal personality for the administration of its material, human, budgetary, and financial resources; it may sign, establish, and execute trusts, as well as subscribe to any contract and agreement required for the fulfillment of its functions."

ARTICLE 6.- Article 5 of Law No. 8023, Planning and Management of the Upper Reventazón River Watershed, of September 27, 2000, is amended. The text shall read:

"Article 5.- The general objective of Comcure shall be to define, execute, and control the Plan for the planning and management of the Reventazón River watershed, with the support of its functional structure and in coordination with public and private institutions and the collegiate bodies created in accordance with the General Law of the Public Administration and related laws."

ARTICLE 7.- Subsections b), d), g), h), i), j) are amended, and subsection m) is added to article 7 of Law No. 8023, Planning and Management of the Upper Reventazón River Watershed, of September 27, 2000. The texts shall read:

"Article 7.- Comcure shall have the following powers and functions:

[...]

b) Organize, program, direct, review, and evaluate the execution of the activities that the Watershed Management Office must fulfill.

[...]

d) Recommend works and investigations to the Watershed Management Office, when necessary.

[...]

g) Prepare, approve, and submit the annual budget of Comcure to the Ministry of Finance.

h) Subscribe to, administer, and execute the trusts created under this law.

i) Appoint and remove the manager, according to article 21 of this law.

j) Consult the Watershed Council on the programs, ordinary budgets, and activities that the Watershed Management Office will carry out, and convene it when deemed necessary.

[...]

m) Establish the priority of the activities and projects that public and private entities develop in the watershed with funds from water use fees (cánones hídricos). For these purposes, the Board of Directors of Comcure, which shall recommend to Fonafifo, Sinac, and the Water Directorate for their final approval."

ARTICLE 8.- Article 8 of Law No. 8023 is amended. The text shall read:

"Article 8.- The Board of Directors of Comcure shall be constituted as follows:

a) The Minister of Environment and Energy or a senior-level representative.

b) The Minister of Agriculture and Livestock or a senior-level representative.

c) The Executive President of the Costa Rican Electricity Institute or a senior-level representative.

d) The Executive President of the Costa Rican Institute of Aqueducts and Sewers or a senior-level representative.

e) The President of the National Commission for Risk Prevention and Emergency Response or a senior-level representative.

f) The Executive President of the Board of Port Administration and Economic Development of the Atlantic Slope or a senior-level representative.

g) The Manager of the Administrative Board of Electrical Services of Cartago or a senior-level representative.

h) One representative from the Federation of Municipalities of Cartago.

i) One representative from the Federation of Municipalities of Limón, representing the cantons of Siquirres, Guácimo, and Pococí.

j) One representative from the user associations of the province of Cartago, representing environmentalists, farmers, or industrialists, who are part of the watershed council and are designated by it.

k) One representative from the user associations of the cantons of Siquirres, Guácimo, and Pococí, representing environmentalists, farmers, or industrialists, who are part of the Watershed Council and are designated by it."

ARTICLE 9.- Article 9 of Law No. 8023, Planning and Management of the Upper Reventazón River Watershed, of September 27, 2000, is amended. The text shall read:

"Article 9.- The members of the Board of Directors of Comcure shall not receive per diem compensation for attending sessions."

ARTICLE 10.- Article 11 of Law No. 8023, Planning and Management of the Upper Reventazón River Watershed, of September 27, 2000, is amended. The text shall read:

"Article 11.- Comcure must appoint from its membership a president and a secretary. To validly convene, at least seven of its members must be present; agreements shall be adopted by a simple majority of those present, except when the law expressly requires a different vote. All members shall remain in their positions for a period of two years and may be reelected."

ARTICLE 11.- Article 12 of Law No. 8023, Planning and Management of the Upper Reventazón River Watershed, of September 27, 2000, is amended. The text shall read:

"Article 12.- The institutions and organizations of the Costa Rican State are authorized to contribute resources, such as logistical support, materials, administrative personnel, payment of per diems, administrative expenses, other non-personnel expenses, and any others necessary for the fulfillment of this law."

ARTICLE 12.- The title of Section II and article 14 of Law No. 8023, Planning and Management of the Upper Reventazón River Watershed, of September 27, 2000, are amended. The text shall read:

"Section II

Watershed Council

"Article 14.- A Watershed Council is established whose main function shall be to advise and support Comcure in the direction and evaluation of the different components of the Plan."

ARTICLE 13.- Article 15 of Law No. 8023, Planning and Management of the Upper Reventazón River Watershed, of September 27, 2000, is amended. The text shall read:

"Article 15.- The Watershed Council shall be constituted as follows:

a) The Minister of Environment and Energy or a representative.

b) The Minister of Agriculture and Livestock or a senior-level representative.

c) The Executive President of the Costa Rican Electricity Institute or a senior-level representative.

d) The Executive President of the Costa Rican Institute of Aqueducts and Sewers or a senior-level representative.

e) The Executive President of the Costa Rican Oil Refinery, S.A. or a representative.

f) The Executive President of the Board of Port Administration and Economic Development of the Atlantic Slope or a senior-level representative.

g) The President of the National Commission for Risk Prevention and Emergency Response or a senior-level representative.

h) The Rector of the Technological Institute of Costa Rica or a senior-level representative.

i) The Manager of the Administrative Board of Electrical Services of Cartago or a senior-level representative.

j) The Mayor of each of the municipalities of the cantons listed in article 1 of this law, or a representative.

k) One representative from the National Service for Groundwater, Irrigation, and Drainage.

l) One representative from the Regional Development Council (Coredes-Proli).

m) One representative from the province of Cartago and one representative from the province of Limón, from the Cantonal Union of Development Associations.

n) One representative from the province of Cartago and one representative from the province of Limón, from the environmental associations.

ñ) One representative from the province of Cartago and one representative from the province of Limón, from the business and industrial sector.

o) One representative from the province of Cartago and one representative from the province of Limón, from the farmers' organizations.

p) One representative from the Urban Planning Directorate of the National Institute of Housing and Urbanism."

ARTICLE 14.- Subsection c) of article 16 of Law No. 8023, Planning and Management of the Upper Reventazón River Watershed, of September 27, 2000, is amended. The text shall read:

"Article 16.- The functions of the Watershed Council are:

[...]

c) Provide advice to the Watershed Management Office on the general policy for the execution of the Plan and the problems of the watershed, and issue its opinion.

[...]."

ARTICLE 15.- Article 17 of Law No. 8023, Planning and Management of the Upper Reventazón River Watershed, of September 27, 2000, is amended. The text shall read:

"Article 17.- The Watershed Council shall designate from its membership a president, who shall remain in office for a period of two years and may be reelected. It shall meet at least twice a year, convened by its president or when the president of Comcure so requests."

ARTICLE 16.- The title of Section III and article 18 of Law No. 8023, Planning and Management of the Upper Reventazón River Watershed, of September 27, 2000, are amended. The text shall read:

"Section III

Watershed Management Office

Article 18.- A Watershed Management Office is established under the direction of Comcure. Its main function shall be to execute the technical-operational components of the different stages of the project."

ARTICLE 17.- Article 19 of Law No. 8023, Planning and Management of the Upper Reventazón River Watershed, of September 27, 2000, is amended. The text shall read:

"Article 19.- The Watershed Management Office shall be constituted by the technical personnel provided or contracted by the institutions represented on Comcure or contracted by the Watershed Management Office. This personnel shall form work groups to carry out the specific programmed actions and studies."

ARTICLE 18.- Subsection a) is amended and a new subsection i) is added to article 20 of Law No. 8023, Planning and Management of the Upper Reventazón River Watershed, of September 27, 2000. The text shall read:

"Article 20.- The functions of the Watershed Management Office are:

a) Review and evaluate the specific studies and projects that exist on the Reventazón River watershed.

[...]

i) Serve as secretary of the Watershed Council, signing the notices of meeting and the minutes jointly with the president of this body."

ARTICLE 19.- Article 21 and subsections a), c), and h) of this same article of Law No. 8023, Planning and Management of the Upper Reventazón River Watershed, of September 27, 2000, are amended. The text shall read:

"Article 21.- The Watershed Management Office shall have a manager, appointed by the Board of Directors of Comcure, who shall have the following obligations:

a) Participate in the meetings of Comcure.

[...]

c) Coordinate, with the linked institutions, their contributions to fulfill the project for the planning and management of the Reventazón River watershed.

[...]

h) Present, to the Watershed Council, the programs and activities that, with the prior approval of Comcure, the Watershed Management Office they direct will carry out.

[...]"

ARTICLE 20.- Article 22 of Law No. 8023, Planning and Management of the Upper Reventazón River Watershed, of September 27, 2000, is amended. The text shall read:

"Article 22.- The watershed manager shall remain in office for three years and may be reelected."

ARTICLE 21.- The title of Section IV and article 23 of Law No. 8023, Planning and Management of the Upper Reventazón River Watershed, of September 27, 2000, are amended. The text shall read:

"SECTION IV

Regional Conservation Area Councils

Article 23.- In compliance with the provisions of article 30 of Law No. 7788, Biodiversity Law, the activities of Comcure shall be coordinated with the regional councils of: Central Volcanic Mountain Range Conservation Area (ACCVC), Tortuguero Conservation Area (ACTO), Caribbean Friendship Conservation Area (Aclac)."

ARTICLE 22.- Article 24 of Law No. 8023, Planning and Management of the Upper Reventazón River Watershed, of September 27, 2000, is amended. The text shall read:

"Article 24.- The functions of the regional conservation area councils are those set forth in Law No. 7788, Biodiversity Law."

ARTICLE 23.- The second paragraph is amended, and a third paragraph is added to article 25 of Law No. 8023, Planning and Management of the Upper Reventazón River Watershed, of September 27, 2000. The text shall read:

"CHAPTER III

FINANCING REGIME

Article 25.-

[...]

The municipalities of the cantons of the provinces of Cartago and Limón, included in article 1 of this law, and the other bodies of the Public Administration shall provide their collaboration to Comcure to fulfill the purposes of this law.

The Water Directorate of MINAE shall collect the water resource fees created under Law No. 276, of August 27, 1942, and based on the information provided by Comcure, shall budget the resources for its operation, which shall not be less than five percent (5%) of the total amount collected in the existing water resource fees. The budgeted resources shall only be used for its operation and for the financing of the activities that Comcure is responsible for developing. The Water Directorate of MINAE shall transfer them within a maximum period of one month, counted from the legislative approval of the Republic's budget."

ARTICLE 24.- Article 27 of Law No. 8023, Planning and Management of the Upper Reventazón River Watershed, of September 27, 2000, is amended. The text shall read:

"Article 27.- The municipalities of the cantons of the provinces of Cartago and Limón, included in article 1 of this law, may allocate a percentage of what is established in subsections 1) and 5) of article 43 of Law No. 7788, Biodiversity Law, of April 30, 1998, to the formulation and implementation of the programs provided for in this law."

ARTICLE 25.- Article 28 of Law No. 8023, Planning and Management of the Upper Reventazón River Watershed, of September 27, 2000, is amended. The text shall read:

"Article 28.- The user entities and those that provide public services in the province of Cartago, and in the cantons of Siquirres, Guácimo, and Pococí, in the province of Limón, are authorized to include in their tariffs the costs for the management of the Reventazón River watershed, in accordance with article 37 of Law No. 7788, Biodiversity Law, of April 30, 1998."

ARTICLE 26.- Article 29 of Law No. 8023, Planning and Management of the Upper Reventazón River Watershed, of September 27, 2000, is amended. The text shall read:

"CHAPTER V

MONITORING AND CONTROL OF PLAN RESULTS

Article 29.- To systematize the results of the Plan's execution, Comcure and the Watershed Management Office shall define a strategy for implementation and control of results, from which progress reports shall be obtained, and based on them, the actions to follow shall be defined in control and coordination meetings among the entities created by this law.

Progress reports must be submitted monthly, covering all the project's technical personnel.

The project results must be disseminated throughout the entire community and shall be available to any person."

ARTICLE 27.- Article 30 of Law No. 8023, Planning and Management of the Upper Reventazón River Watershed, of September 27, 2000, is amended. The text shall read:

"Article 30.- Periodic evaluations shall be applied to allow for the incorporation or correction of the different tasks; for this purpose, the support of specialized national bodies in this matter or the eventual contracting of national and/or international specialists shall be requested, always with the participation of the project personnel. Coordination shall be made with international and national bodies, such as the Latin American Watershed Network, natural resource foundations, and chambers of business owners."

ARTICLE 28.- The sole transitory provision of Law No. 8023, Planning and Management of the Upper Reventazón River Watershed, of September 27, 2000, is repealed.

ARTICLE 29.- A transitory provision is added to Law No. 8023, Planning and Management of the Upper Reventazón River Watershed, of September 27, 2000. The text shall read:

SOLE TRANSITORY PROVISION.-

The president of the Board of Directors, as well as the watershed manager, in office at the time of the approval of this law, shall continue in the exercise of their functions and powers until completing the term for which they were appointed, and may be reelected.

It shall take effect upon its publication.
