Este Decreto Ejecutivo declara zona protectora los territorios que comprenden las cuencas de los ríos Navarro y Sombrero, ubicados al sur de Lourdes de Agua Caliente de Cartago, con una superficie aproximada de 6,450 hectáreas. La declaratoria se fundamenta en la necesidad de asegurar el aprovisionamiento hídrico para las poblaciones actuales y futuras, especialmente de la provincia de Cartago, y preservar la cobertura boscosa para mantener un ambiente adecuado en el Valle Central. Todos los inmuebles, estatales y privados, dentro del área quedan sometidos al Régimen Forestal, requiriendo autorización de la Dirección General Forestal para cualquier labor. Se prohíbe el derribo de árboles, extracción de productos forestales, caza de animales silvestres y quemas. Los terrenos estatales afectados son inalienables e imprescriptibles. La administración queda a cargo de la Dirección General Forestal en colaboración con las municipalidades de Cartago, Paraíso y El Guarco, las cuales deberán asignar guardabosques permanentes.

Article 2-The properties -state and private- included within the boundaries set forth in the previous article are obligatorily subject to the Forestry Regime. Consequently, any work to be carried out must previously obtain authorization from the Directorate General of Forestry.

En ejercicio de las
facultades que les confiere el artículo 140, incisos 3) y 18) de la
Constitución Política, de conformidad con lo dispuesto por los artículos 1° y
2°, inciso b), 83, 86 y 87 de la Ley Forestal No 4465 de 25 de noviembre de 1969,
y

Considerando:

1°-Que es una función
esencial del Estado procurar el ordenamiento y manejo de las cuencas naturales
en forma técnica de manera que permita su rendimiento continuo y asegure que
los terrenos de vocación forestal mantengan siempre su cobertura boscosa.

2°-Que por razones
hídricas, topográficas, climáticas, edáficas y vegetacionales la zona ubicada
al sur del poblado Lourdes de Agua Caliente de Cartago es una importante cuenca
de captación de los ríos Sombrero y Navarro que garantiza la afluencia de aguas
para suplir necesidades de las poblaciones actua­les y futuras, principalmente
de la provincia de Cartago.

3°-Que es de vital
importancia para la población del Valle Central ínter montano la preservación
de áreas boscosas para mantener un medio ambiente adecuado.

Por tanto,

Decretan:

1°-Decláranse zona protectora los territorios que comprenden las cuencas del
río Navarro y del río Sombrero, superficie que comprende la descrita a

Artículo 4°-Las
reservas nacionales y demás terrenos del Estado afectados por la zona
protectora creada por el presente Decreto, según lo dispone el artículo 25 de
la Ley Forestal, son inalienables y no susceptibles de inscripción en el
Registro Público por trámite alguno y la acción reivindicatoria del Estado
respecto de ellos es imprescriptible.

Artículo 5°-La
administración de esta zona protectora estará a cargo de la Dirección General
Forestal, con la colaboración de las municipalidades de los cantones de
Cartago, Paraíso y El Guarco.

Artículo 6°-Las
municipalidades de dichos cantones destinarán las partidas necesarias en su
presupuesto para destacar dos funcionarlos para cada munici­palidad, en calidad
de guardabosques permanentes en la zona. Para garantizar su protección, la
Dirección General Forestal dará el asesoramiento necesario en los trabajos de
deslinde, vigilancia y estudios tendientes al aprovechamiento racional de los
recursos naturales. Corresponde al Instituto Geográfico Nacional la demarcación
de sus límites en el terreno.

THE PRESIDENT OF THE
REPUBLIC

AND THE MINISTER OF
AGRICULTURE AND LIVESTOCK,

 

In exercise of the
powers conferred upon them by Article 140, subsections 3) and 18) of the
Political Constitution, in accordance with the provisions of Articles 1 and
2, subsection b), 83, 86, and 87 of the Forestry Law (Ley Forestal) No. 4465 of November 25, 1969,
and

Considering:

1°—That it is an essential
function of the State to procure the planning and management of natural basins
in a technical manner that allows for their continuous yield and ensures that
lands with forestry vocation always maintain their forest cover (cobertura boscosa).

2°—That for hydric, topographic,
climatic, edaphic, and vegetational reasons, the zone located south of the town
of Lourdes de Agua Caliente de Cartago is an important catchment basin for the
Sombrero and Navarro rivers, which guarantees the influx of water to supply the
needs of current and future populations, mainly in the province of Cartago.

3°—That the preservation
of forested areas is vitally important for the population of the Intermontane
Central Valley to maintain a suitable environment.

Therefore,

They decree:

Article
1°—The territories comprising the basins of the Navarro River and the Sombrero River are hereby declared a protected zone (zona protectora), the area comprising what is described
below, according to the topographic map of the National Geographic Institute (IGN),

Article 2°—The
properties—state and private—included within the boundaries indicated in the
preceding article are mandatorily subject to the Forestry Regime (Régimen Forestal).
Consequently, all work to be carried out must first have the authorization of
the General Forestry Directorate (Dirección General Forestal).

Article 3°—The following is
prohibited on the properties—state and private—included within the boundaries
indicated in the preceding article:

 

a) Felling trees,
extracting, collecting forest products and debris of any species without the
authorization of the General Forestry Directorate (Dirección General Forestal).

b) The hunting of wild
animals and/or their capture.

c) The practice of burns (quemas).

Article 4°—The national
reserves and other State lands affected by the protected zone (zona protectora) created by this
Decree, as provided in Article 25 of the Forestry Law (Ley Forestal), are inalienable and not
susceptible to registration in the Public Registry through any proceeding, and
the State's action for their recovery is imprescriptible.

Article 5°—The
administration of this protected zone (zona protectora) will be in charge of the General Forestry
Directorate (Dirección General Forestal), with the collaboration of the municipalities of the cantons of
Cartago, Paraíso, and El Guarco.

Article 6°—The
municipalities of said cantons will allocate the necessary items in their
budget to assign two officials from each municipality, as permanent forest
rangers in the zone. To guarantee its protection, the General Forestry
Directorate (Dirección General Forestal) will provide the necessary advice in the demarcation,
surveillance, and studies aimed at the rational use of natural resources. The
National Geographic Institute (IGN) is responsible for the demarcation of its boundaries on the
ground.
