EJERCICIO DE LA
 PRESIDENCIA DE
LA REPÚBLICA

Y
LA MINISTRA DE AMBIENTE,
ENERGÍA Y TELECOMUNICACIONES

En uso de las
facultades que les confieren los artículos 140, incisos 3) y 18), y 146 de la Constitución
Política, y la Ley
de Biodiversidad Nº 7788 del 30 de abril de 1998.

 

CONSIDERANDO:

I.- Que
la Ley de Biodiversidad Nº 7788
del 30 de abril de 1998, creó la Comisión Nacional para
la Gestión de
la Biodiversidad como
un órgano desconcentrado del Ministerio de Ambiente, Energía y
Telecomunicaciones, con personería jurídica instrumental.

II.- Que la citada
Ley le asigna a esa Comisión, funciones referentes a la conservación, el uso
ecológicamente sostenible y la restauración de la biodiversidad, que son de
vital importancia para el desarrollo sostenible del país.

III.- Que el
artículo 15 de la Ley
de Biodiversidad, establece la forma en que se integrará la Comisión, de
acuerdo al nombramiento realizado por los entes y organizaciones que señala la
ley.

IV.- Que el Decreto
Ejecutivo N° 29680-MINAE del 23 de julio del 2001, publicado en La Gaceta N°
150 del 7 de agosto del 2001, regula el funcionamiento de esta Comisión.

POR TANTO:

DECRETAN:

Artículo 1º- Nombrar
como parte de los miembros que integran
la Comisión Nacional
para la Gestión de la
 Biodiversidad, a los siguientes representantes de
la Asociación Mesa
Nacional Indígena:

1. Miembro
propietario:

Oldermar Pérez
Hernández

2. Miembro suplente:

Donald Rojas Maroto

Artículo 2º- Para
los efectos del plazo contemplado en el artículo 15 de la Ley de Biodiversidad,
los nombramientos se realizan por un plazo completo de tres años.

Artículo 3º- Se
deroga:

1. El Decreto
Ejecutivo Nº 35582-MINAET del 01 de octubre del 2009, publicado en La Gaceta
Nº 223 del 17 de noviembre del 2009.

Artículo 4º- Rige a
partir de su publicación.

                        Appoints member of the National Commission for Biodiversity Management

The FIRST
VICE PRESIDENT

IN THE
EXERCISE OF THE
 PRESIDENCY OF
THE REPUBLIC

AND
THE MINISTER OF ENVIRONMENT,
ENERGY AND TELECOMMUNICATIONS

In exercise of the
powers granted to them by articles 140, subsections 3) and 18), and 146 of the Political
Constitution, and Law
on Biodiversity No. 7788 of April 30, 1998.

 

WHEREAS:

I.- That
Law on Biodiversity No. 7788
of April 30, 1998, created the National Commission for
Biodiversity Management as
a deconcentrated body of the Ministry of Environment, Energy and
Telecommunications, with instrumental legal personality.

II.- That the aforementioned
Law assigns to this Commission functions concerning the conservation, ecologically
sustainable use, and restoration of biodiversity, which are of
vital importance for the sustainable development of the country.

III.- That
article 15 of the Law
on Biodiversity establishes the manner in which the Commission shall be composed, according
to the appointments made by the entities and organizations designated by the
law.

IV.- That Executive
Decree No. 29680-MINAE of July 23, 2001, published in La Gaceta No.
150 of August 7, 2001, regulates the operation of this Commission.

THEREFORE:

THEY DECREE:

Article 1- To appoint
as part of the members that compose
the National Commission
for Biodiversity Management, the following representatives of
the Asociación Mesa
Nacional Indígena:

1. Full
member:

Oldermar Pérez
Hernández

2. Alternate member:

Donald Rojas Maroto

Article 2- For
the purposes of the term established in article 15 of the Law on Biodiversity,
the appointments are made for a full three-year term.

Article 3- The following
is repealed:

1. Executive
Decree No. 35582-MINAET of October 01, 2009, published in La Gaceta
No. 223 of November 17, 2009.

Article 4- It takes effect as
of its publication.
