    SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN

R-SINAC-CONAC-19-2012.-El Consejo Nacional de
Áreas de Conservación, de conformidad al Acuerdo Nº 18 de
la Sesión Ordinaria
Nº 05-2012 celebrada el día 28 de mayo de 2012, y en cumplimiento del artículo
12 del Reglamento a la Ley
de Biodiversidad Nº 7788, Decreto Ejecutivo Nº 34433-MINAE, aprueba y emite la
presente:

    OFICIALIZACIÓN
DEL CORREDOR

    BIOLÓGICO
RÍO NARANJO

    Resultando:

1°-Que mediante Decreto Ejecutivo Nº
33106-MINAE, publicado en La
 Gaceta Nº 103 del día 30 de mayo de 2006 se crea el
Programa Nacional de Corredores Biológicos: una Estrategia de Conservación de
la Biodiversidad; el
cual contará con un Plan Estratégico de largo plazo. Se implementará a través
del Sistema Nacional de Áreas de Conservación (SINAC), el cual deberá otorgar
sostenibilidad al Programa, incluyendo las actuaciones de éste en sus planes de
acción y en su estructura funcional, administrativa y financiera.

2°-Que
mediante Decreto Ejecutivo Nº 34433-MINAE, publicado en
La Gaceta Nº 68 del
día 8 de abril del 2008, se establece en el artículo 3 inciso b), la definición
de corredor biológico de manera oficial por primera vez para Costa Rica.

3°-Que
el artículo 22 de la Ley
de Biodiversidad Nº 7788, publicada en
La Gaceta Nº 101 del 27 de mayo de 1998
establece al Sistema Nacional de Áreas de Conservación, como una institución
desconcentrada y participativa, con personería jurídica instrumental, que
integra las competencias en materia forestal, vida silvestre y áreas silvestres
protegidas, protección y conservación del uso de cuencas hidrográficas y
sistemas hídricos, del Ministerio de Ambiente, Energía y Telecomunicaciones
(MINAET), con el fin de dictar políticas, planificar y ejecutar procesos
dirigidos a lograr la sostenibilidad en el manejo de los recursos naturales de
Costa Rica.

4°-Que
mediante Resolución administrativa Nº R-SINAC-CONAC-013-2009 publicada en el
Diario Oficial La Gaceta
 Nº 72 del 15 de abril del 2009, se establecen por primera
vez, los Lineamientos para
la Oficialización de Corredores Biológicos en Costa
Rica.

5°-Que
la Resolución
administrativa Nº R-SINAC-CONAC-028-2011 publicada en el Diario Oficial
La Gaceta Nº 181 del
21 de setiembre del 2011, con base en el Acuerdo Nº 12 de la sesión ordinaria
Nº 05-2011 del 30 de mayo del 2011 del CONAC acordó aprobar modificaciones a la
resolución Nº R-SINAC-CONAC-013-2009.

    Considerando:

Único.-Que de conformidad al artículo 12
inciso del Reglamento a la Ley
de Biodiversidad, Decreto Ejecutivo Nº 34433-MINAE publicado en
La Gaceta Nº 68 del
08 de abril de 2008, el Consejo Nacional de Áreas de Conservación (CONAC),
mediante Acuerdo Nº 18 de la sesión ordinaria Nº 05-2012 celebrada el día 28 de
mayo de 2012 conoció el expediente administrativo del Corredor Biológico Río
Naranjo, demostrándose el cumplimiento de los diferentes requisitos
solicitados, así como del proceso requerido, para la oficialización la emisión
de la presente resolución. Por tanto:

SECRETARIO EJECUTIVO DEL  CONSEJO

    NACIONAL
DE ÁREAS DE CONSERVACIÓN, RESUELVE:

Artículo 1°-Oficialización del Corredor
Biológico Río Naranjo:

1.         Se oficializa el Corredor Biológico Río
Naranjo, aprobado mediante Acuerdo Nº 18 de
la Sesión Ordinaria
Nº 05-2012 del CONAC celebrada el día 28 de mayo de 2012.

2.         El expediente específico para el Corredor
Biológico Río Naranjo puede ser consultado en la oficina del Enlace Regional de
Corredor Biológico del Área de Conservación Pacífico Central, así como en
la Coordinación
del PNCB.

Artículo 2°-Abreviaturas:

a) CBRN: Corredor Biológico Río Naranjo.

b) PNCB: Programa Nacional de Corredores
Biológicos.

c) CRTM 05: Proyección Transversal de
Mercator para Costa Rica.

d) CONAC: Consejo Nacional de Áreas de
Conservación.

e) SINAC: Sistema Nacional de Áreas de
Conservación.

f)  MINAET: Ministerio de Ambiente, Energía
y Telecomunicaciones.

Artículo 3°-Cumplimiento de requisitos:

1. Perfil Técnico del Corredor Biológico Río
Naranjo:

-  Presentado en el formulario oficial de Perfil
Técnico del Corredor Biológico que puede ser descargado en la dirección

-  Para acceder a la versión impresa: en la
oficina del PNCB, ubicada en el edificio del SINAC.

2. Mapa de límites del Corredor Biológico Río
Naranjo:

-  El mapa de límites del corredor biológico fue
presentado a la
 Coordinación del PNCB en archivos digitales de ArcView o
ArcGis y en coordenadas CRTM 05, el se incluirá en el Mapa Nacional de
Corredores Biológicos, el cual puede ser descargado en la dirección
electrónica:

3. Información general sobre el Consejo Local que
gestiona el Corredor Biológico Río Naranjo:

-  El formulario oficial de Información General

                        Formalizes the Río Naranjo Biological Corridor

    NATIONAL SYSTEM OF CONSERVATION AREAS

R-SINAC-CONAC-19-2012.—The National Council of
Conservation Areas, in accordance with Agreement No. 18 of
Ordinary Session
No. 05-2012 held on May 28, 2012, and in compliance with Article
12 of the Regulations to the
Biodiversity Law No. 7788, Executive Decree No. 34433-MINAE, approves and issues the
following:

    OFFICIALIZATION
OF THE

    RÍO NARANJO BIOLOGICAL
CORRIDOR

    Whereas:

1°—That by means of Executive Decree No.
33106-MINAE, published in
La Gaceta No. 103 of May 30, 2006, the
National Program of Biological Corridors: a Strategy for the Conservation of
Biodiversity was created;
which shall have a long-term Strategic Plan. It shall be implemented through
the National System of Conservation Areas (SINAC), which must provide
sustainability to the Program, including its actions in its action plans
and in its functional, administrative, and financial structure.

2°—That
through Executive Decree No. 34433-MINAE, published in
La Gaceta No. 68 of
April 8, 2008, the definition
of biological corridor is officially established for the first time for Costa Rica in Article 3 subsection b).

3°—That
Article 22 of the Biodiversity
Law No. 7788, published in
La Gaceta No. 101 of May 27, 1998,
establishes the National System of Conservation Areas as a deconcentrated
and participatory institution, with instrumental legal personality, which
integrates the competencies in forestry, wildlife, and protected wilderness areas matters,
protection and conservation of the use of watersheds and
hydric systems, of the Ministry of Environment, Energy, and Telecommunications
(MINAET), for the purpose of issuing policies, planning, and executing processes
aimed at achieving sustainability in the management of Costa Rica's natural resources.

4°—That
through Administrative Resolution No. R-SINAC-CONAC-013-2009, published in the
Official Gazette La Gaceta
No. 72 of April 15, 2009, were established for the first
time, the Guidelines for
the Officialization of Biological Corridors in Costa
Rica.

5°—That
Administrative
Resolution No. R-SINAC-CONAC-028-2011, published in the Official Gazette
La Gaceta No. 181 of
September 21, 2011, based on Agreement No. 12 of ordinary session
No. 05-2011 of May 30, 2011, of CONAC agreed to approve modifications to
Resolution No. R-SINAC-CONAC-013-2009.

    Considering:

Sole.—That in accordance with Article 12
subsection of the Regulations to the Biodiversity
Law, Executive Decree No. 34433-MINAE published in
La Gaceta No. 68 of
April 08, 2008, the National Council of Conservation Areas (CONAC),
through Agreement No. 18 of ordinary session No. 05-2012 held on May 28 of
2012, reviewed the administrative file of the Río
Naranjo Biological Corridor, demonstrating compliance with the different requested
requirements, as well as the required process, for the officialization and issuance
of this resolution. Therefore:

    THE
EXECUTIVE SECRETARY OF THE NATIONAL

    COUNCIL
OF CONSERVATION AREAS, RESOLVES:

Article 1—Officialization of the Río Naranjo
Biological Corridor:

1.         The Río Naranjo Biological Corridor is hereby officialized,
approved through Agreement No. 18 of
Ordinary Session
No. 05-2012 of CONAC held on May 28, 2012.

2.         The specific file for the Río
Naranjo Biological Corridor can be consulted at the office of the Regional Biological Corridor Liaison of the Central Pacific Conservation Area, as well as at
the Coordination
of the PNCB.

Article 2—Abbreviations:

a) CBRN: Río Naranjo Biological Corridor.

b) PNCB: National Program of Biological
Corridors.

c) CRTM 05: Transverse Mercator Projection
for Costa Rica.

d) CONAC: National Council of Conservation
Areas.

e) SINAC: National System of Conservation
Areas.

f)  MINAET: Ministry of Environment, Energy
and Telecommunications.

Article 3—Compliance with requirements:

1. Technical Profile of the Río Naranjo
Biological Corridor:

-  Submitted on the official Technical Profile form
of the Biological Corridor, which can be downloaded at the electronic

-  To access the printed version: at the
office of the PNCB, located in the SINAC building.

2. Boundary Map of the Río Naranjo
Biological Corridor:

-  The boundary map of the biological corridor was
submitted to the
Coordination of the PNCB in ArcView or
ArcGis digital files and in CRTM 05 coordinates; it shall be included in the National Map of
Biological Corridors, which can be downloaded at the electronic
address:

3. General information about the Local Council that
manages the Río Naranjo Biological Corridor:

-  The official General Information form
of the Local Council of the Biological Corridor can be downloaded at the electronic

Article 4—It shall become effective upon its publication in
the Official Gazette La Gaceta.
