    Y EL MINISTRO DE HACIENDA 

Con fundamento en las atribuciones que les confieren los artículos 140 incisos 3) y 18) y 146 de la
Constitución  Política; los artículos 25 inciso 1), 27 inciso 1) y 28 inciso 2) acápite b) de la Ley
N° 6227, Ley General de la Administración Pública de 2 de mayo de 1978 y sus reformas; la Ley N°
8131, Ley de la Administración Financiera de la República y Presupuestos Públicos de 18 de setiembre
de 2001 y sus reformas; su Reglamento, el Decreto Ejecutivo N° 32988-H-MP-PLAN de 31 de enero de
2006 y sus reformas; la Ley N° 7593, Ley de la Autoridad Reguladora de los Servicios Públicos de 9
de agosto de 1996 y sus reformas; el Decreto Ejecutivo N° 26635-MINAE de 18 de diciembre de 1997 y
su reforma; el Decreto Ejecutivo N° 32452-H de 29 de junio de 2005 y sus reformas; y el Decreto
Ejecutivo N° 37042-H de 13 de marzo de 2012 y sus reformas. 

    Considerando: 

I.-Que el Transitorio V de la Ley N° 7593, publicada en
La Gaceta N° 169 de 5
de setiembre de 1996 y sus reformas, traslada el Departamento de Aguas del
Servicio Nacional de Electricidad, incluyendo su personal, activos y funciones,
al Ministerio del Ambiente y Energía, disponiendo que el traslado se haría
efectivo dentro del plazo máximo de un año después de entrar en vigencia esa
ley, con el propósito de facilitar los ajustes presupuestarios y de otra
naturaleza que sean pertinentes. 

II.-Que el artículo 1° del Decreto
Ejecutivo N° 26635-MINAE, publicado en La Gaceta N° 22 de 2 de febrero de 1998 y su
reforma, trasladó con base en el Transitorio V de la citada Ley N° 7593, el
Departamento de Aguas al Instituto Meteorológico Nacional del Ministerio del
Ambiente y Energía, definiendo en el artículo 2° que su misión será la de
administrar oportuna y eficientemente los recursos hídricos en todo el
territorio nacional, procurando el desarrollo sostenible mediante su
ordenamiento y manejo racional; brindando un servicio excelente. 

III.-Que mediante el oficio
149-2013-IMN de 5 de abril de 2013, el Director General del Instituto
Meteorológico Nacional, solicita ampliar el gasto presupuestario máximo
autorizado para el año 2013 inicialmente en un monto de ¢2.531.887.217,38 (dos
mil quinientos treinta y un millones ochocientos ochenta y siete mil doscientos
diecisiete colones con treinta y ocho céntimos), suma que en forma posterior es
modificada, precisando que la ampliación solicitada asciende a
¢2.523.067.217,38 (dos mil quinientos veintitrés millones sesenta y siete mil
doscientos diecisiete colones con treinta y ocho céntimos), para la Dirección de
Aguas. 

IV.-Que la ampliación del gasto
presupuestario máximo solicitada, se requiere para cubrir diferentes
necesidades, relacionadas con el fortalecimiento de la capacidad tecnológica y
administrativa para la regulación del aprovechamiento y la administración del
agua, que contribuye con la gestión integral del recurso hídrico a nivel
nacional, para el año 2013. 

V.-Que de la citada cifra, la suma
de ¢1.737.352.305,00 (mil setecientos treinta y siete millones trescientos
cincuenta y dos mil trescientos cinco colones exactos), corresponde a recursos
de superávit libre por lo que de conformidad con lo establecido en el artículo
7° del Decreto Ejecutivo N° 37042-H, publicado en el Alcance Digital N° 35 a La Gaceta N° 59 de 22
de marzo de 2012 y sus reformas, corresponde ampliar ese monto vía Decreto
Ejecutivo. Estos recursos se destinarán a la compra de equipo especializado de
trabajo de campo para conocer la disponibilidad de agua en nuestros ríos y
otros cuerpos de agua, así como a la compra de estaciones meteorológicas que
contribuirían al adecuado desarrollo de las funciones de la Dirección de
Aguas y a la adquisición de vehículos tipo rural. Asimismo, la ampliación
permitirá el desarrollo de los proyectos denominados "Sistema Nacional de
Monitoreo de Agua Subterránea en Tiempo Real" y "Sistema Nacional de Gestión
Integral de la
 Información del Recurso Hídrico", ambos considerados
sustantivos por estar relacionados con una de las funciones primordiales de la Dirección de
Aguas, como lo es la gestión y monitoreo del agua en el país. 

VI.-Que del monto anterior no se
autorizó la suma ¢9.000.000,00 (nueve millones de colones exactos), en gastos
de la subpartida de "maquinaria y equipo de producción" y "equipo y mobiliario
de oficina", para la compra de equipo para la sala de capacitación y
desarrollo, la compra de una máquina trituradora de papel de uso eléctrico,
etiquetador para CD, una máquina encuadernadora manual, una gata hidráulica, un
taladro para labores de urgencia en el Departamento Informático, toda vez que
dichos gastos no se consideran prioritarios para el desarrollo de la actividad
sustantiva de la
 Dirección de Aguas. 

VII.-Que mediante el Decreto
Ejecutivo N° 37042-H citado, se emitieron las Directrices Generales de Política
Presupuestaria para el año 2013, estableciéndose en el artículo 5°, el
porcentaje máximo en que podría incrementarse el gasto presupuestario de las
entidades públicas, ministerios y demás órganos, con respecto al del año precedente.
En correspondencia con dicha disposición, el monto de gasto presupuestario
máximo resultante para la
 Dirección de Aguas, fue establecido en la suma de
¢928.002.400,00 (novecientos veintiocho millones dos mil cuatrocientos colones
exactos), el cual fue comunicado mediante el oficio STAP-1515-2012 del 22 de
agosto de 2012, cifra que no contempla el gasto indicado previamente en este
decreto. 

VIII.-Que mediante el Decreto
Ejecutivo N° 32452- H, publicado en La Gaceta N° 130 de 6 de julio de 2005 y sus
reformas, se emite el "Lineamiento para la aplicación del artículo 6 de la Ley No. 8131 de
la Administración
 Financiera de la República y Presupuestos Públicos y la regulación
de la clase de ingresos del Sector Público denominada Financiamiento". 

IX.-Que el artículo 7° del Decreto
citado en el considerando anterior, dispone que los recursos de financiamiento
que provienen de vigencias anteriores -superávit libre- son parte del
patrimonio de los órganos y las entidades y pueden utilizarlos en períodos
subsiguientes para financiar gastos que se refieran a la actividad ordinaria de
éstas, con los cuales se atienda el interés de la colectividad, el servicio
público y los fines institucionales siempre que no tengan el carácter
permanente o generen una obligación que requiera financiarse a través del
tiempo, como la creación de plazas para cargos fijos, o cualquier otro
compromiso de la misma naturaleza. 

X.-Que por lo anterior, resulta
necesario ampliar el gasto presupuestario máximo fijado a la Dirección de
Aguas para el año 2013, incrementándolo en la suma de ¢1.728.352.305,00 (mil
setecientos veintiocho millones trescientos cincuenta y dos mil trescientos
cinco colones exactos). Por tanto. 

    Decretan: 

Artículo 1°-Amplíese para la Dirección de
Aguas, el gasto presupuestario máximo para el 2013, establecido de conformidad
con el Decreto Ejecutivo N° 37042-H, publicado en el Alcance N° 35 a La Gaceta N° 59 de 22
de marzo de 2012 y sus reformas, en la suma de ¢1.728.352.305,00 (mil
setecientos veintiocho millones trescientos cincuenta y dos mil trescientos
cinco colones exactos), para ese período.

Artículo
2º-Es responsabilidad de la administración activa de la Dirección de
Aguas, el cumplimiento de lo dispuesto en el artículo 6 de la Ley N° 8131, Ley de
la Administración
 Financiera de la República y Presupuestos Públicos, publicada en La Gaceta N° 198 de
16 de octubre de 2001 y sus reformas, así como en el Decreto Ejecutivo N°
32452-H, publicado en La
 Gaceta N° 130 de 6 de julio de 2005 y sus reformas.

Artículo
3º-Rige a partir de su publicación.

                        Increases the budget expenditure set for the Water Directorate for
2013

    THE PRESIDENT OF THE REPUBLIC

    AND THE MINISTER OF FINANCE 

Based on the powers conferred by articles 140 subsections 3) and 18) and 146 of the
Political Constitution; articles 25 subsection 1), 27 subsection 1) and 28 subsection 2) paragraph b) of Law
N° 6227, General Law of Public Administration of 2 May 1978 and its amendments; Law N°
8131, Law of Financial Administration of the Republic and Public Budgets of 18 September
2001 and its amendments; its Regulation, Executive Decree N° 32988-H-MP-PLAN of 31 January
2006 and its amendments; Law N° 7593, Law of the Regulatory Authority for Public Services of 9
August 1996 and its amendments; Executive Decree N° 26635-MINAE of 18 December 1997 and
its amendment; Executive Decree N° 32452-H of 29 June 2005 and its amendments; and Executive
Decree N° 37042-H of 13 March 2012 and its amendments. 

    Considering: 

I.—That Transitory Provision V of Law N° 7593, published in
La Gaceta N° 169 of 5
September 1996 and its amendments, transfers the Department of Water of the
National Electricity Service, including its personnel, assets, and functions,
to the Ministry of Environment and Energy, providing that the transfer would become
effective within a maximum period of one year after the entry into force of that
law, for the purpose of facilitating the pertinent budgetary and other
adjustments.

II.—That article 1 of Executive
Decree N° 26635-MINAE, published in La Gaceta N° 22 of 2 February 1998 and its
amendment, transferred, based on Transitory Provision V of the aforementioned Law N° 7593, the
Department of Water to the National Meteorological Institute of the Ministry of
Environment and Energy, defining in article 2 that its mission shall be to
administer water resources (recursos hídricos) throughout the national
territory in a timely and efficient manner, seeking sustainable development through their
planning and rational management; providing excellent service.

III.—That through official communication
149-2013-IMN of 5 April 2013, the General Director of the National
Meteorological Institute, requests to increase the maximum authorized budget expenditure
for the year 2013 initially in an amount of ¢2,531,887,217.38 (two
thousand five hundred thirty-one million eight hundred eighty-seven thousand two hundred
seventeen colones and thirty-eight céntimos), a sum that is subsequently
modified, specifying that the requested increase amounts to
¢2,523,067,217.38 (two thousand five hundred twenty-three million sixty-seven thousand
two hundred seventeen colones and thirty-eight céntimos), for the Water Directorate.

IV.—That the requested increase in maximum budget
expenditure is required to cover different
needs, related to the strengthening of technological and
administrative capacity for the regulation of water use and administration,
which contributes to the integrated management of water resources (recurso hídrico) at the national
level, for the year 2013.

V.—That of the cited amount, the sum
of ¢1,737,352,305.00 (one thousand seven hundred thirty-seven million three hundred
fifty-two thousand three hundred five exact colones), corresponds to free surplus
resources, and therefore, in accordance with the provisions of article
7 of Executive Decree N° 37042-H, published in Digital Supplement N° 35 to La Gaceta N° 59 of 22
March 2012 and its amendments, that amount is to be increased via Executive
Decree. These resources will be allocated to the purchase of specialized field
work equipment to ascertain water availability in our rivers and
other bodies of water, as well as to the purchase of meteorological stations that
would contribute to the proper execution of the functions of the Water
Directorate and to the acquisition of rural-type vehicles. Likewise, the increase
will allow the development of the projects called "National Real-Time
Groundwater Monitoring System" and "National System for the Integrated
Management of Water Resource Information", both considered
substantive as they are related to one of the primary functions of the Water
Directorate, namely the management and monitoring of water in the country.

VI.—That from the previous amount, the sum of
¢9,000,000.00 (nine million exact colones) was not authorized for expenses
in the sub-item for "production machinery and equipment" and "office equipment and
furniture", for the purchase of equipment for the training and
development room, the purchase of an electric paper shredder,
a CD labeler, a manual binding machine, a hydraulic jack, a
drill for emergency tasks in the IT Department, given
that these expenses are not considered priorities for the development of the
substantive activity of the Water
Directorate.

VII.—That through the cited Executive
Decree N° 37042-H, the General Budgetary Policy
Guidelines for the year 2013 were issued, establishing in article 5, the
maximum percentage by which the budget expenditure of
public entities, ministries, and other bodies could increase, with respect to the preceding year.
In accordance with that provision, the resulting maximum budget expenditure
amount for the Water
Directorate was established in the sum of
¢928,002,400.00 (nine hundred twenty-eight million two thousand four hundred exact
colones), which was communicated through official communication STAP-1515-2012 of 22
August 2012, an amount that does not contemplate the expenditure previously indicated in this
decree.

VIII.—That through Executive
Decree N° 32452-H, published in La Gaceta N° 130 of 6 July 2005 and its
amendments, the "Guideline for the application of article 6 of Law No. 8131 on the
Financial Administration of the Republic and Public Budgets and the regulation
of the class of public sector income called Financing" is issued.

IX.—That article 7 of the Decree
cited in the preceding considering provides that financing resources
originating from prior budget periods -free surplus- are part of the
equity of the bodies and entities and may be used in subsequent
periods to finance expenses related to their ordinary
activity, which serve the collective interest, the public
service, and institutional purposes, provided they do not have a
permanent character or generate an obligation that requires financing over
time, such as the creation of permanent positions or any
other commitment of the same nature.

X.—That in view of the foregoing, it is
necessary to increase the maximum budget expenditure set for the Water
Directorate for the year 2013, increasing it by the sum of ¢1,728,352,305.00 (one
thousand seven hundred twenty-eight million three hundred fifty-two thousand three hundred
five exact colones). Therefore.

    They Decree:

Article 1.—Increase, for the Water
Directorate, the maximum budget expenditure for 2013, established in accordance
with Executive Decree N° 37042-H, published in Supplement N° 35 to La Gaceta N° 59 of 22
March 2012 and its amendments, by the sum of ¢1,728,352,305.00 (one
thousand seven hundred twenty-eight million three hundred fifty-two thousand three hundred
five exact colones), for that period.

Article
2.—The active administration of the Water
Directorate is responsible for compliance with the provisions of article 6 of Law N° 8131, Law of
the Financial
Administration of the Republic and Public Budgets, published in La Gaceta N° 198 of
16 October 2001 and its amendments, as well as Executive Decree N°
32452-H, published in La
Gaceta N° 130 of 6 July 2005 and its amendments.

Article
3.—Effective from its publication.
