EL PRESIDENTE DE LA REPÚBLICA

Y EL MINISTRO DE AMBIENTE Y ENERGÍA

En
ejercicio de las facultades conferidas en el artículo 140, incisos 3), 8), 18)
y 146) de la Constitución Política; los artículos 82 inciso c) y 87 de la Ley
de Conservación de la Vida Silvestre Nº  7317
de 7 de diciembre de 1992; los artículos 32, 34, 35, 36 y 37 de la Ley Orgánica
del Ambiente Nº 7554 del 13 de noviembre de 1995; los artículos 58 y 60 de la
Ley de Biodiversidad Nº 7788 del 27 de mayo de 1998; el artículo 6 inciso a) de
la Ley Forestal Nº 7575; los artículos 171 y 172 del Reglamento a la Ley de
Conservación de la Vida Silvestre, Decreto Ejecutivo Nº 32633-MINAE publicado
en La Gaceta Nº 180 del 20 de setiembre del 2005; los artículos 70
inciso e), 71 y 72 del Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo
Nº 34433-MINAE del 11 de marzo del 2008 y los artículos 6, 11 y 27 de la Ley
General de la Administración Pública Nº 6227 del 2 de mayo de 1978.

Considerando:

I.-Que es interés del
Estado costarricense fortalecer las estructuras administrativas en el campo de
los recursos naturales, a fin de contar con políticas definidas que garanticen
el uso racional de dichos recursos.

II.-Que la Ley de
Conservación de la Vida Silvestre Nº 7317 en su artículo 82 dice que son
refugios nacionales de fauna y vida silvestre, los que el Poder Ejecutivo
declare o haya declarado como tales, para la protección e investigación de la
flora y la fauna silvestres, en especial de las especies que se encuentren en
vías de extinción. Para efecto de clasificarlos, existen tres clases de
refugios nacionales de vida silvestre: Refugios de propiedad estatal, Refugios
de propiedad mixta y Refugios de propiedad privada.

III.-Que la sociedad
denominada ASOCIACIÓN DE COOPERATIVAS EUROPEAS LONGO MAI, cédula jurídica
número tres-cero cero dos-cero cuarenta y cinco mil seiscientos sesenta y tres,
a través de su Apoderado Generalísimo sin límite de suma el señor Roland
Spendligwimmer Beimrohr, mayor de edad, casado una vez, ciudadano austriaco,
con número de cédula de residencia uno cero cuatro cero cero cero cero uno cero
uno dos uno, vecino de Finca Sonador, Longo Mai de Buenos Aires de Puntarenas,
cuya personería está vigente, solicitó en el año 2011 al Área de Conservación
La Amistad Pacífico, Oficina Subregional de Buenos Aires el sometimiento
voluntario al Régimen de Refugios Privados de Vida Silvestre, parte de cinco
inmuebles de su propiedad.

IV.-Que mediante
memorial del 21 de febrero del 2014 presentado a la Asesoría Legal de la
Secretaría Ejecutiva del Sistema Nacional de Áreas de Conservación, el señor
Jiri Spendligwimmer Spendligwimmer, mayor, costarricense, casado una vez,
antropólogo, vecino de San Isidro de El General, cédula de identidad número
800870154, en su calidad de gerente con facultades de Apoderado Generalísimo
sin límite de suma de ACE LONGO MAI, SOCIEDAD DE RESPONSABILIDAD LIMITADA,
cédula jurídica número 3-102-661273, cuya personería está vigente, manifestó
que los inmuebles anteriormente a nombre de ASOCIACIÓN DE COOPERATIVAS EUROPEAS
LONGO MAI se encuentran actualmente inscritos en el Registro Nacional a nombre
de su representada y acepta someter las mismas al régimen de Refugio Nacional
de Vida Silvestre, categoría privado, por lo que solicita continuar con el
trámite respectivo a la declaratoria.

V.-Que los inmuebles a nombre de ACE LONGO MAI, SOCIEDAD DE
RESPONSABILIDAD LIMITADA, se encuentran inscritas en el Registro de la
Propiedad Inmueble, bajo los folios reales que se describen a continuación;
todos del Partido de Puntarenas, Cantón 3 Buenos Aires, Distrito 2 Volcán,
según el siguiente detalle:

VI.-Que la medida total de los cinco inmuebles inscritos a
nombre de ACE LONGO MAI, SOCIEDAD DE RESPONSABILIDAD LIMITADA es de setecientos
noventa y dos hectáreas ocho mil trescientos trece metros con treinta y tres
decímetros cuadrados (792 ha. 8313.33 dm²).

VII.-Que la
ASOCIACION DE COOPERATIVAS EUROPEAS LONGO MAI entonces propietaria de los
inmuebles a nombre de ACE LONGO MAI, SOCIEDAD DE RESPONSABILIDAD LIMITADA, a
través del representante de la Sociedad aceptó expresamente, someter
voluntariamente al régimen de Refugio Nacional de Vida Silvestre, categoría
privada, en total un área de 452 hectáreas de los inmuebles descritos en el
considerando 5 del presente decreto ejecutivo, por un período de diez años,
según lo establece el artículo 171 inciso f) del Reglamento a la Ley de
Conservación de Vida Silvestre.

VIII.-Que los
inmuebles sometidos al régimen de Refugio Nacional de Vida Silvestre, por
voluntad de su propietario, serán dedicados exclusivamente a la conservación en
adelante, por lo que desde el punto de vista ambiental representan una
importante área de recuperación de los hábitat naturales y para la regeneración
de zonas degradadas que servirán para el desarrollo de la flora y fauna
presentes en la zona.

IX.-Que las áreas a someter
al régimen de Refugio Nacional de Vida Silvestre, se componen de bosques
primarios y bosques intervenidos que han estado en recuperación desde el año
1979. Los inmuebles se ubican dentro del bosque tropical muy húmedo -
transición a pre montano, y bosque pluvial pre montano, según el mapa ecológico
de Costa Rica y el Sistema de Clasificación de zonas de vida del mundo de L.R.
Holdridge.

Ambas zonas de vida se caracterizan por
presentar un exceso de precipitación de 4000 a 6000 mm como promedio anual y se
encuentran entre los 600 a 1000 metros sobre el nivel del mar.

X.-Que dentro del
área objeto de sometimiento al régimen de Refugio Nacional de Vida Silvestre,
existen un gran número de recursos faunísticos (insectos, mamíferos, anfibios,
aves y reptiles) así como recursos florísticos que merecen ser conservados
racional y sosteniblemente, para garantizar su permanencia dentro de los
ecosistemas en que actualmente se encuentran.

XI.-Que con la
protección oficial de los ecosistemas descritos en el considerando anterior, se
logrará la conservación de especies de vida silvestre propias de dichos
hábitats, los cuales tienen gran importancia biológica y socioeconómica, ya que
algunas se encuentran en peligro de extinción, debido al estado actual de los recursos
naturales en la zona.

XII.-Que de
conformidad con el artículo 70 inciso e.2) del Reglamento a la Ley de
Biodiversidad, Decreto Ejecutivo Nº 34433-MINAE, el principal efecto ambiental
que genera la declaratoria de un inmueble bajo este régimen jurídico lo es, que
para los efectos de la conservación de los recursos naturales la administración
del mismo corresponderá al propietario de los inmuebles, la cual será
supervisada por el Sistema Nacional de Áreas de Conservación a través del Área
de Conservación La Amistad Pacífico, Oficina Subregional de Buenos Aires.

XIII.-Que analizada
la documentación que consta en el expediente administrativo se determinó que
cumplió con lo establecido en el artículo 171 del Decreto Ejecutivo Nº 32633-
MINAE denominado Reglamento a la Ley de Conservación de la Vida Silvestre.

XIV.-Que por medio de
la resolución número ACLA-P-D-299-2012 de las ocho horas del día catorce de
junio del año dos mil doce, el Director del Área de Conservación La Amistad
Pacífico, Licenciado Ronald Chan Fonseca, aceptó la solicitud de sometimiento
voluntario al régimen de Refugio Nacional de Vida Silvestre que realizó la
ASOCIACIÓN DE COOPERATIVAS EUROPEAS LONGO MAI entonces titular de los inmuebles
indicados en el considerando número 5, titularidad que cambio durante la
tramitación del presente decreto ejecutivo según consta en el expediente de
marras.

XV.-Que mediante
acuerdo Nº 3 de la sesión ordinaria Nº 05-2012 del Consejo Regional del Áreas
de Conservación La Amistad Pacífico (CORACLAP) del 15 de junio del 2012, aprobó
la iniciativa de declaratoria del Refugio Nacional de Vida Silvestre Longo Mai,
categoría privada, de conformidad al artículo 30 inciso 7) de la Ley de
Biodiversidad Nº 7788.

XVI.-Que mediante Acuerdo Nº 11 de la Sesión Ordinaria Nº 02-2013 del 25
de febrero del 2013 el Consejo Nacional de Áreas de Conservación (CONAC) aprobó
la creación del Refugio Nacional de Vida Silvestre Longo Mai, categoría
privada, de conformidad al artículo 25 inciso 6) de la Ley de Biodiversidad Nº 7788.
Por tanto,

Decretan:

"CRÉASE EL REFUGIO
NACIONAL DE VIDA SILVESTRE LONGO MAI, CATEGORÍA PRIVADA"

Artículo 1º-Créase el Refugio Nacional de Vida Silvestre Longo Mai,
categoría privada, el cual está formado por una superficie total de
cuatrocientos cincuenta y dos hectáreas (452 ha) de los inmuebles inscritos en
el Registro Público de la propiedad inmueble que se describen a continuación:

Artículo 3º-ACE LONGO MAI SOCIEDAD DE RESPONSABILIDAD
LIMITADA se compromete a no desarrollar ninguna actividad que ponga en riesgo
la existencia de la flora y fauna sin el respectivo permiso del Sistema
Nacional de Áreas de Conservación (SINAC) del Ministerio del Ambiente y
Energía. Asimismo, brindarán toda la colaboración necesaria a los funcionarios
del SINAC, para las labores de control y verificación de las políticas
ambientales mediante el Área de Conservación La Amistad Pacífico, así como a
los investigadores, estudiantes y otros que esporádicamente visiten dicha área
en las funciones propias de sus respectivos cargos, estudio e investigaciones.
Asimismo se comprometen a cumplir con las disposiciones que al efecto señalan
la Ley de Conservación de la Vida Silvestre, la Ley Forestal, sus respectivos
reglamentos, así como las demás disposiciones vigentes en la materia.

Artículo
4º-Las 452 hectáreas de los inmuebles indicados en el artículo primero del
presente decreto ejecutivo, estarán sometidos a la categoría de Refugio
Nacional de Vida Silvestre, categoría privado, por un período de diez años
prorrogables por períodos iguales en forma automática, en caso de que la
propietaria no manifieste su deseo de desafectar las fincas, en el término de
tres meses antes del vencimiento del plazo.

Lo
anterior, mediante escrito presentado ante el Área de Conservación La Amistad
Pacífico, de conformidad al artículo 171 del Decreto Ejecutivo Nº 32633- MINAE
denominado Reglamento a la Ley de Conservación de la Vida Silvestre, para
iniciar los trámites correspondientes a la desafectación de la misma y en todo
caso deberán respetarse las limitaciones legales indicadas en la Ley Forestal y
en la demás legislación ambiental con respecto al cambio de uso del suelo y a
la protección de los ríos.

Artículo 5º-La administración, vigilancia y mantenimiento de este
Refugio y el cumplimiento de las disposiciones técnicas que al efecto emita el
Área de Conservación La Amistad Pacífico, serán responsabilidad de ACE LONGO
MAI, SOCIEDAD DE RESPONSABILIDAD LIMITADA en su carácter de propietaria de los
inmuebles afectados.

6º-ACE LONGO MAI, SOCIEDAD DE RESPONSABILIDAD LIMITADA deberá presentar ante el
Área de Conservación La Amistad Pacífico, al menos un informe anual sobre los
diferentes aspectos relacionados con los inmuebles y el estado de los recursos
naturales dentro del mismo.

7º-ACE LONGO MAI, SOCIEDAD DE RESPONSABILIDAD LIMITADA, gozará de los
beneficios e incentivos establecidos en la Ley de Conservación de la Vida
Silvestre, para lo cual el Área de Conservación La Amistad Pacífico emitirá los
documentos necesarios para tales efectos.

THE PRESIDENT OF THE REPUBLIC

AND THE MINISTER OF ENVIRONMENT AND ENERGY

In
exercise of the powers conferred by Article 140, subsections 3), 8), 18)
and 146) of the Political Constitution; Articles 82 subsection c) and 87 of the
Wildlife Conservation Law No. 7317
of December 7, 1992; Articles 32, 34, 35, 36 and 37 of the Organic Environmental Law
No. 7554 of November 13, 1995; Articles 58 and 60 of the
Biodiversity Law No. 7788 of May 27, 1998; Article 6 subsection a) of
the Forest Law (Ley Forestal) No. 7575; Articles 171 and 172 of the Regulations to the
Wildlife Conservation Law, Executive Decree No. 32633-MINAE published
in La Gaceta No. 180 of September 20, 2005; Articles 70
subsection e), 71 and 72 of the Regulations to the Biodiversity Law, Executive Decree
No. 34433-MINAE of March 11, 2008 and Articles 6, 11 and 27 of the General
Law of Public Administration No. 6227 of May 2, 1978.

Considering:

I.-That it is in the interest of the
Costa Rican State to strengthen administrative structures in the field of
natural resources, in order to have defined policies that guarantee
the rational use of said resources.

II.-That the
Wildlife Conservation Law No. 7317 in its article 82 states that
national fauna and wildlife refuges are those that the Executive Branch
declares or has declared as such, for the protection and research of
wild flora and fauna, especially species that are
endangered. For the purpose of classification, there are three classes of
national wildlife refuges: State-owned Refuges, Refuges
of mixed ownership and Privately-owned Refuges.

III.-That the
entity called ASOCIACIÓN DE COOPERATIVAS EUROPEAS LONGO MAI, legal identification
number three-zero zero two-zero forty-five thousand six hundred sixty-three,
through its General Attorney-in-fact without limit of amount Mr. Roland
Spendligwimmer Beimrohr, of legal age, married once, Austrian citizen,
with residence ID number one zero four zero zero zero zero one zero
one two one, resident of Finca Sonador, Longo Mai of Buenos Aires de Puntarenas,
whose legal representation is valid, requested in 2011 from the Área de Conservación
La Amistad Pacífico, Buenos Aires Subregional Office the voluntary
submission to the Regime of Private Wildlife Refuges, for part of five
properties owned by it.

IV.-That by
brief dated February 21, 2014, submitted to the Legal Advisory Office of the
Executive Secretariat of the National System of Conservation Areas, Mr.
Jiri Spendligwimmer Spendligwimmer, of legal age, Costa Rican, married once,
anthropologist, resident of San Isidro de El General, identity card number
800870154, in his capacity as manager with powers of General Attorney-in-fact
without limit of amount of ACE LONGO MAI, SOCIEDAD DE RESPONSABILIDAD LIMITADA,
legal identification number 3-102-661273, whose legal representation is valid, stated
that the properties formerly in the name of ASOCIACIÓN DE COOPERATIVAS EUROPEAS
LONGO MAI are currently registered in the National Registry in the name of
his represented entity and accepts submitting the same to the regime of National
Wildlife Refuge, private category, and therefore requests to continue with the
respective process for the declaration.

V.-That the properties in the name of ACE LONGO MAI, SOCIEDAD DE
RESPONSABILIDAD LIMITADA, are registered in the Real Property Registry, under the real folios described below;
all from the Partido of Puntarenas, Canton 3 Buenos Aires, District 2 Volcán,
according to the following detail:

VI.-That the total measurement of the five properties registered in the
name of ACE LONGO MAI, SOCIEDAD DE RESPONSABILIDAD LIMITADA is seven hundred
ninety-two hectares, eight thousand three hundred thirteen square meters and thirty-three
square decimeters (792 ha. 8313.33 dm²).

VII.-That the
ASOCIACION DE COOPERATIVAS EUROPEAS LONGO MAI, then owner of the
properties now in the name of ACE LONGO MAI, SOCIEDAD DE RESPONSABILIDAD LIMITADA,
through the representative of the Company expressly accepted to voluntarily
submit to the regime of National Wildlife Refuge, private
category, a total area of 452 hectares of the properties described in
considering 5 of this executive decree, for a period of ten years,
as established in article 171 subsection f) of the Regulations to the
Wildlife Conservation Law.

VIII.-That the
properties submitted to the regime of National Wildlife Refuge, by the
will of their owner, will be dedicated exclusively to conservation from now on,
therefore, from an environmental point of view, they represent an
important area for the recovery of natural habitats and for the regeneration
of degraded zones that will serve for the development of the flora and fauna
present in the area.

IX.-That the areas to be submitted
to the regime of National Wildlife Refuge consist of primary
forests and intervened forests that have been in recovery since the year
1979. The properties are located within the tropical very humid forest -
transition to premontane, and premontane rain forest, according to the ecological map
of Costa Rica and the World Life Zone Classification System of L.R.
Holdridge.

Both life zones are characterized by
having an excess precipitation of 4000 to 6000 mm annual average and are
found between 600 to 1000 meters above sea level.

X.-That within the
area subject to submission to the regime of National Wildlife Refuge,
a large number of faunal resources (insects, mammals, amphibians,
birds and reptiles) as well as floral resources exist which deserve to be conserved
rationally and sustainably, to guarantee their permanence within the
ecosystems in which they are currently found.

XI.-That with the
official protection of the ecosystems described in the previous considering,
the conservation of wildlife species native to said
habitats will be achieved, which are of great biological and socioeconomic importance, since
some are endangered, due to the current state of natural
resources in the area.

XII.-That in
accordance with article 70 subsection e.2) of the Regulations to the
Biodiversity Law, Executive Decree No. 34433-MINAE, the primary environmental effect
generated by the declaration of a property under this legal regime is that,
for the purposes of natural resource conservation, the administration
thereof will correspond to the owner of the properties, which will be
supervised by the National System of Conservation Areas through the Área
de Conservación La Amistad Pacífico, Buenos Aires Subregional Office.

XIII.-That upon analyzing
the documentation contained in the administrative file, it was determined that
it complied with the provisions of article 171 of Executive Decree No. 32633-
MINAE called Regulations to the Wildlife Conservation Law.

XIV.-That through
resolution number ACLA-P-D-299-2012 of eight o'clock on the day of June
fourteenth, two thousand twelve, the Director of the Área de Conservación La Amistad
Pacífico, Licenciado Ronald Chan Fonseca, accepted the request for voluntary
submission to the regime of National Wildlife Refuge made by
ASOCIACIÓN DE COOPERATIVAS EUROPEAS LONGO MAI, then owner of the properties
indicated in considering number 5, ownership which changed during the
processing of this executive decree as recorded in the
relevant file.

XV.-That by
agreement No. 3 of the ordinary session No. 05-2012 of the Regional Council of the
Áreas de Conservación La Amistad Pacífico (CORACLAP) of June 15, 2012, approved
the initiative for the declaration of the Longo Mai National Wildlife Refuge,
private category, in accordance with article 30 subsection 7) of the
Biodiversity Law No. 7788.

XVI.-That by Agreement No. 11 of the Ordinary Session No. 02-2013 of February
25, 2013, the National Council of Conservation Areas (CONAC) approved
the creation of the Longo Mai National Wildlife Refuge, private
category, in accordance with article 25 subsection 6) of the Biodiversity Law No. 7788.
Therefore,

They Decree:

"CREATION OF THE
NATIONAL WILDLIFE REFUGE LONGO MAI, PRIVATE CATEGORY"

Article 1.-Creates the Longo Mai National Wildlife Refuge,
private category, which is formed by a total area of
four hundred fifty-two hectares (452 ha) of the properties registered in
the Public Registry of Real Property described below:

Article 3.-ACE LONGO MAI SOCIEDAD DE RESPONSABILIDAD
LIMITADA undertakes not to develop any activity that jeopardizes
the existence of flora and fauna without the respective permit from the National
System of Conservation Areas (SINAC) of the Ministry of Environment and
Energy. Likewise, they will provide all necessary collaboration to officials
of SINAC, for the control and verification work of environmental
policies through the Área de Conservación La Amistad Pacífico, as well as to
researchers, students and others who sporadically visit said area
in the performance of their respective positions, studies and research.
They also undertake to comply with the provisions set forth in this regard by
the Wildlife Conservation Law, the Forest Law (Ley Forestal), their respective
regulations, as well as other provisions in force on the matter.

4.-The 452 hectares of the properties indicated in article one of this
executive decree will be subject to the category of National
Wildlife Refuge, private category, for a period of ten years
renewable for equal periods automatically, in the event that the
owner does not express a desire to release the properties, within the term of
three months prior to the expiration of the period.

The
foregoing, by means of a written request submitted to the Área de Conservación La Amistad
Pacífico, in accordance with article 171 of Executive Decree No. 32633- MINAE
called Regulations to the Wildlife Conservation Law, to
initiate the corresponding procedures for its release and in any
case, the legal limitations indicated in the Forest Law (Ley Forestal) and
other environmental legislation regarding land-use change (cambio de uso del suelo) and
the protection of rivers must be respected.

Article 5.-The administration, surveillance and maintenance of this
Refuge and compliance with the technical provisions issued for this purpose by
the Área de Conservación La Amistad Pacífico, will be the responsibility of ACE LONGO
MAI, SOCIEDAD DE RESPONSABILIDAD LIMITADA in its capacity as owner of the
affected properties.

6.-ACE LONGO MAI, SOCIEDAD DE RESPONSABILIDAD LIMITADA must submit to the
Área de Conservación La Amistad Pacífico, at least one annual report on the
different aspects related to the properties and the state of the natural
resources within it.

7.-ACE LONGO MAI, SOCIEDAD DE RESPONSABILIDAD LIMITADA, shall enjoy the
benefits and incentives established in the Wildlife Conservation
Law, for which purpose the Área de Conservación La Amistad Pacífico will issue the
necessary documents for such purposes.

8.-Takes effect upon its publication in the Official Gazette La Gaceta.
