EL PRESIDENTE DE LA REPÚBLICA

Y LA MINISTRA DE JUSTICIA Y PAZ

Con fundamento en los incisos 3) y 18) del artículo 140 y 146 de la
Constitución Política de Costa Rica, en el artículo 28 inciso b) de la Ley General
de la Administración Pública, Ley N° 6227 de 2 de mayo de 1978, Ley de Creación
del Registro Nacional, Ley N° 5695 de 28 de mayo de 1975, ( reformada por leyes
N° 8766 de 1 de setiembre de 2009, N° 8823 de 5 de mayo de 2010, N° 8710 de 3
de febrero de 2009, N° 7764 de 17 de abril de 1998, N° 6934 de 28 de noviembre
de 1983 y por Ley N° 5950 de 27 de octubre de 1976). Asimismo, artículos 13,
14, 15, 20, 21 de la Ley de Catastro Nacional N° 6545 de 25 de marzo de 1981,
artículos 7 y 26 de Reglamento a la Ley de Catastro Nacional, Decreto Ejecutivo
N° 34331 de 29 de noviembre de 2007 (reformado por Decreto Ejecutivo N° 34763
de 16 de setiembre de 2008), Ley N° 8154 de 27 de noviembre de 2001, "Convenio
de Préstamo N° 1284/0C-CR, Programa de Regularización Catastro y Registro",
Decreto Ejecutivo N° 30106-J, de 6 de diciembre de 2001, "Declara Zona
Catastral la Totalidad de los Cantones del Territorio Nacional" y Decreto
Ejecutivo N° 35509-J de 30 de setiembre de 2009, "Reglamento de Organización
del Registro Inmobiliario".

Considerando:

I.-Que mediante Ley N° 8710, publicada en La Gaceta N° 48 del 10
de marzo de 2009 se reforma el artículo 2 de la Ley N° 5695, Ley de Creación
del Registro Nacional, y sus reformas, indicando que el Catastro Nacional pasa
a formar parte del Registro Inmobiliario.

II.-Que el Decreto Ejecutivo N° 35509-J de 30 de setiembre de 2009,
Reglamento de Organización del Registro Inmobiliario publicado en el Diario
Oficial La Gaceta N° 198 del 13 de octubre de 2009, establece que el Registro
Inmobiliario está conformado por la Subdirección Catastral y la Subdirección
Registral.

III.-Que el Registro Inmobiliario del Registro Nacional, con fundamento
en la Ley de Catastro Nacional N° 6545 de 25 de marzo de 1981, en su artículo
13 tiene como potestad exclusiva, la ejecución y mantenimiento del Catastro,
función que puede delegar parcialmente en otras instituciones estatales.

IV.-Que la Asamblea Legislativa, el 27 de noviembre de 2001, aprobó la
Ley N° 8154, "Convenio de Préstamo N° 1284/0CCR, Programa de Regularización del
Catastro y Registro", suscrito entre el Gobierno de la República y el Banco
Interamericano de Desarrollo (BID), para la ejecución del Programa de
Regularización del Catastro y Registro Nacional, que por disposición de la misma
ley, está a cargo de una Unidad Ejecutora adscrita al Ministerio de Hacienda
como órgano desconcentrado.

V.-Que el Programa de Regularización del Catastro y Registro Nacional,
tuvo como tarea el levantamiento catastral con el objetivo de formar el catastro
nacional y compatibilizar la información catastral y registral de los
inmuebles, en aplicación de lo que dispone la Ley de Catastro N° 6545 de 25 de
marzo de 1981, función que culminó el 07 de mayo de 2014.

VI.-Que de conformidad con lo que establece el artículo 1° Decreto
Ejecutivo N° 30106-J donde se "Declara Zona Catastral la Totalidad de los
Cantones del Territorio Nacional" publicado en La Gaceta N° 19 de
28 de enero de 2002 y el artículo 7 del Reglamento a la Ley del Catastro
Nacional, Decreto Ejecutivo N° 34331, el cual rige desde el 27 de setiembre de
2008, la totalidad de los cantones del territorio nacional fueron declarados
zona catastral.

VII.-Que el Reglamento a la Ley de Catastro Nacional, Decreto Ejecutivo
N° 34331 el cual rige desde el 27 de setiembre de 2008, establece los
requerimientos técnicos para el levantamiento de planos de agrimensura.

VIII.-Que por haber concluido los trabajos de levantamiento catastral
del cantón 05 Osa, distrito 04 Bahía Ballena, Provincia de Puntarenas, y de conformidad
con lo que establece el artículo 19 de la Ley de Catastro Nacional y 10 de su
reglamento, fueron invitados los titulares de inmuebles de dicho distrito a una
exposición pública para conocer los resultados del levantamiento y manifestar
su conformidad o disconformidad, exposición que se llevó a cabo del 19 al 26 de
agosto del 2017

IX.-Que la invitación a la exposición pública de los resultados del
levantamiento catastral del cantón 05 Osa, distrito 04 Bahía Ballena, Provincia
de Puntarenas, fue publicada en el Diario Oficial La Gaceta N° 152, del
11 de agosto del 2017, página 36 y en el diario de Circulación Nacional La
Extra de 19 de agosto de 2017, página 19.

X.-Que en resolución de las ocho horas treinta minutos del diez de
octubre del año dos mil diecinueve, el Registro Inmobiliario del Registro
Nacional declaró firmes los datos catastrales resultantes del levantamiento
catastral efectuado en el cantón 05 Osa, distrito 04 Bahía Ballena, Provincia
de Puntarenas.

XI.-Que ya transcurrieron los términos de los plazos establecidos en el
artículo 20 de la Ley del Catastro Nacional y fueron resueltos, por la
Dirección del Registro Inmobiliario del Registro Nacional, los reclamos
presentados por los propietarios. Por tanto,

Decretan:

SE DECLARA ZONA CATASTRADA EL DISTRITO 04

BAHÍA BALLENA, CANTÓN 05 OSA,

PROVINCIA DE PUNTARENAS

Artículo 1°-De conformidad con el artículo 20 de la Ley de Catastro
Nacional N° 6545 de 25 de marzo de 1981, se declara zona catastrada el cantón
05 Osa, distrito 04 Bahía Ballena, Provincia de Puntarenas.

especificaciones técnicas, que se emitieron en el Decreto Ejecutivo N° 36830-JP

THE PRESIDENT OF THE REPUBLIC

AND THE MINISTER OF JUSTICE AND PEACE

Based on subsections 3) and 18) of article 140 and 146 of the
Political Constitution of Costa Rica, article 28 subsection b) of the General Law
of Public Administration, Law No. 6227 of May 2, 1978, Law for the Creation
of the National Registry, Law No. 5695 of May 28, 1975, (amended by laws
No. 8766 of September 1, 2009, No. 8823 of May 5, 2010, No. 8710 of February 3,
2009, No. 7764 of April 17, 1998, No. 6934 of November 28,
1983, and by Law No. 5950 of October 27, 1976). Also, articles 13,
14, 15, 20, 21 of the National Cadastre Law No. 6545 of March 25, 1981,
articles 7 and 26 of the Regulation to the National Cadastre Law, Executive Decree
No. 34331 of November 29, 2007 (amended by Executive Decree No. 34763
of September 16, 2008), Law No. 8154 of November 27, 2001, "Loan
Agreement No. 1284/0C-CR, Cadastre and Registry Regularization Program",
Executive Decree No. 30106-J, of December 6, 2001, "Declares a Cadastral
Zone the Entirety of the Cantons of the National Territory," and Executive
Decree No. 35509-J of September 30, 2009, "Regulation for the Organization
of the Real Property Registry."

Considering:

I.-That through Law No. 8710, published in La Gaceta No. 48 of March
10, 2009, article 2 of Law No. 5695, the Law for the Creation of the
National Registry, and its amendments, is reformed, indicating that the National Cadastre becomes
part of the Real Property Registry.

II.-That Executive Decree No. 35509-J of September 30, 2009,
Regulation for the Organization of the Real Property Registry published in the
Official Gazette La Gaceta No. 198 of October 13, 2009, establishes that the Real Property
Registry is composed of the Cadastral Subdirectorate and the Registry
Subdirectorate.

III.-That the Real Property Registry of the National Registry, based
on the National Cadastre Law No. 6545 of March 25, 1981, in its article
13, has the exclusive authority for the execution and maintenance of the Cadastre,
a function that it may partially delegate to other state institutions.

IV.-That the Legislative Assembly, on November 27, 2001, approved
Law No. 8154, "Loan Agreement No. 1284/0CCR, Cadastre and Registry Regularization
Program," signed between the Government of the Republic and the Inter-American
Development Bank (IDB), for the execution of the
Cadastre and National Registry Regularization Program, which, by provision of the same
law, is in charge of an Executing Unit attached to the Ministry of Finance
as a deconcentrated body.

V.-That the Cadastre and National Registry Regularization Program
was tasked with the cadastral survey (levantamiento catastral) with the objective of forming the national
cadastre and making the cadastral and registry information of real
estate compatible, in application of the provisions of the Cadastre Law No. 6545 of March
25, 1981, a function that concluded on May 7, 2014.

VI.-That in accordance with the provisions of article 1 of Executive
Decree No. 30106-J, which "Declares a Cadastral Zone the Entirety of the
Cantons of the National Territory," published in La Gaceta No. 19 of
January 28, 2002, and article 7 of the Regulation to the National Cadastre Law,
Executive Decree No. 34331, which has been in effect since September 27,
2008, the entirety of the cantons of the national territory were declared a
cadastral zone.

VII.-That the Regulation to the National Cadastre Law, Executive Decree
No. 34331, which has been in effect since September 27, 2008, establishes the
technical requirements for the survey of land survey plans (planos de agrimensura).

VIII.-That because the cadastral survey work
for canton 05 Osa, district 04 Bahía Ballena, Province of Puntarenas, has concluded, and in accordance
with the provisions of article 19 of the National Cadastre Law and article 10 of its
regulation, the owners of real estate in that district were invited to a
public exhibition to learn about the survey results and express
their agreement or disagreement, an exhibition that took place from August 19 to 26,
2017.

IX.-That the invitation to the public exhibition of the cadastral survey results
for canton 05 Osa, district 04 Bahía Ballena, Province
of Puntarenas, was published in the Official Gazette La Gaceta No. 152, of
August 11, 2017, page 36, and in the nationally circulated newspaper La
Extra of August 19, 2017, page 19.

X.-That in a resolution issued at eight thirty in the morning of October
ten, two thousand nineteen, the Real Property Registry of the National
Registry declared the cadastral data resulting from the cadastral
survey carried out in canton 05 Osa, district 04 Bahía Ballena, Province
of Puntarenas, to be final (firmes).

XI.-That the terms of the periods established in
article 20 of the National Cadastre Law have already elapsed, and the claims
filed by the owners were resolved by the
Directorate of the Real Property Registry of the National Registry. Therefore,

They Decree:

DISTRICT 04 BAHÍA BALLENA, CANTON 05 OSA,

PROVINCE OF PUNTARENAS, IS DECLARED A CADASTERED ZONE

Article 1°—In accordance with article 20 of the National Cadastre Law
No. 6545 of March 25, 1981, canton
05 Osa, district 04 Bahía Ballena, Province of Puntarenas, is declared a cadastered zone.

Article 2°—The same legal effects and
technical specifications issued in Executive Decree No. 36830-JP
of September 12, 2011, published in the official newspaper La Gaceta No.
208 of Monday, October 31, 2011, articles 2 through 6, govern this declaration.
